Abstract

Societal welfare is the achievement that should be supported by Government which essentialy has the obligation for the societal welfare through the arrangements within the scope of authority under the mandate of the preamble and articles of   the Indonesian Constitution of 1945 and relevant laws. The mandate of ASEAN Charter, which was ratified by House of Representative by Law Number 38 of 2008 concerning Ratification of the Charter of the Association of Southeast Asian Nations, is not an opponent of the Constitution of 1945 in terms of societal welfare, as long  as the legislation is implemented on the right way, which can protect Indonesian. The legislative action must reflect the needs and the factual conditions of Indonesian. Regulation relating to the implementation of the ASEAN Charter should always be accompanied by exemption or exception to the path of liberation from the regional competition law which is a logical consequence of the free market of ASEAN in some fields.

Abstract

Indonesia has experienced the dynamics of the law on the local governments' head elections. Various mechanisms have been implemented to obtain the ideal model for filling executive positions at the local level. Unfortunately, the government efforts have yet to deliver optimal results. The irregularity of the legal dynamics also eventually caused various Government instability to corruption, post-electoral conflicts, and the high number of disputes over the local election results to the Constitutional Court is evidence of the imperfection of the mechanism adopted by the government. Furthermore, the costs that must be allocated to organize an election are quite high, which is different from the local election results. Moreover, the long process with the tendency of forced candidates produced corrupt and incompetent leaders. Sharing partnerships between the head and deputy of the local government became another problem that is quite a concern in implementing local elections in Indonesia. Thus, this paper examines the ideal model of the head of local government elections in Indonesia. This research focuses on the dynamics of the legislation and regulation on the head of local government elections in Indonesia. The research method applied is normative juridical legal research. The data collection technique employed is the study of documents and literature on secondary data in the form of primary, secondary, and tertiary legal materials. As a result, this study concludes that the ideal model for filling the position of the local head in Indonesia is an asymmetrical– compromise.

Abstract

The Democratic Rule of Law adopted by Indonesia manifests Article 1 paragraph (2) and Article 1 paragraph (3) of the 1945 Constitution. This requires the public's role as the holder of supreme sovereignty in national and state life in various fields. Public participation has been practically implemented and guaranteed in statutory regulations. However, public participation is still interpreted as just a formality by stakeholders, so this causes harm to the policies implemented for the public and weakens the legitimacy of the owner of the highest sovereignty, namely the people. Constitutional Court Decision Number 91/PUU-XVIII/2020 is considered a landmark decision in strengthening people's sovereignty by encouraging meaningful participation in forming statutory regulations. This decision also triggers meaningful public participation in various areas of national life and patriotism. Through a doctrinal approach, this study intends to elucidate the relationship between Meaningful Participation and the concept of a Democratic Rule of Law, as well as efforts to implement and protect meaningful public participation in state practice. The research results concludes that meaningful participation is a form of popular sovereignty to realize a substantive democratic rule of law. Public participation is important for formulating, implementing, and evaluating policies formed together with the state. Soon, Formal guidelines are needed to realize Meaningful Participation as a follow-up to Constitutional Court Decision No. 91/PUU-XVIII/2020.Keywords: Democracy, People's Sovereignty, Public Participation, Rule of Law.

Abstract

One of the information provided by the The General Election Commission a curriculum vitae of legislative candidates in the legislative elections. Historical life list information is useful for voters as material for consideration in determining their choice according to their preferences. In this article, we will examine how public information disclosure is implemented, especially the curriculum vitae of legislative candidates in the 2024 Legislative Election and how it will affect the The General Election Commission if it does not implement election information disclosure. The method used in this writing is normative juridical with a statutory and contextual approach. The research results show that in the 2024 Legislative Election the percentage of legislative candidates who open their curriculum vitae is greater than the legislative candidates who do not open their curriculum vitae. This phenomenon is caused by the absence of binding regulations that require legislative candidates to open a curriculum vitae. The General Election Commission gives each legislative candidate the freedom to open or not make a curriculum vitae. This step is a form of The General Election Commission effort to carry out public information disclosure. The General Election Commission will be subject to criminal sanctions if it does not carry out information disclosure in accordance with Public Information Openness Law.
