Abstract

Penerapan sistem otonomi yang diamanatkan UUD NRI 1945 berimplikasi pada terbaginya kekuasaan pemerintah pusat pada pemerintah daerah, hal tersebut didasarkan pada asas desentralisasi, dekonsentrasi dan tugas pembantuan. berdasarkan hal tersebut pemerintah daerah berhak membentuk perda untuk mengatur daerahnya, disinilah muncul salah satu peran pemerintah pusat dalam melakukan pengawasan dan pembinaan terhadap pemerintah daerah dengan melakukan pengawasan terhadap perda dengan cara melakukan pengujian perda (excecutive review). Pengujian perda tersebut bermuara pada mekanisme pembatalan perda yang dianggap bertentangan dengan ketertiban umum dan hukum yang lebih tinggi. Namun disini terdapat inkonsisten yang dilakukan oleh pemerintah dalam menggunakan instrumen hukum untuk membatalkan perda. Sudah tegaskan pada UU No. 32 Tahun 2004 Tentang Pemerintahan Daerah bahwa pembatalan perda dilakukan oleh Presiden dengan menggunakan Perpres, sedangkan pada Permendagri No. 53 Tahun 2007 Tentang Pengawasan Peraturan Daerah Dan Peraturan Kepala Daerah menyatakan bahwa pembatalan perda APBD, Pajak, Retribusi dan RTRW dilakukan berjenjang oleh Mendagri untuk perda pemprov dengan menggunakan Permendagri dan oleh Gubernur untuk perda Kabupaten/Kota dengan menggunakan Pergub. Tetapi dalam prakteknya pembatalan perda secara keseluruhan dilakukan oleh Mendagri dengan menggunakan Kepmendagri. Disinilah terjadi ketidakkonsistenan dari segi kewenangan dan penggunaan instrumen hukum oleh pemerintah dalam melakukan pembatalan perda. Hal tersebut tentu memiliki implikasi hukum terhadap perda-perda yang telah dibatalkan pemerintah melalui Kepmendagri. Kata Kunci : executive review, pembatalan perda, dan instrumen hukum.

Abstract

The function of judicial power is to enforce law and justice in the framework of protecting society through justice system based on law in a democratic state of law. One of the important principles of state of law is the existing guarantee of judicial power implementation which is independent, free from the influence of other power to implement justice for law and justice enforcement. Accountability of judge’s performance and Supreme Court institution which is a control form for justice institution becomes an idea concerning the dilema of judicial power independence concept. The supervision of judge’s behaviour by Judicial Commission can hopefully cover the weakness intern supervision by Supreme Court. The judge supervision which can be realised by Judicial Commission includes judicial technic supervision, performance assessment, and judge’s behaviour supervision. This research concerned to the reinforcement of judicial supervision function by judicial commission and Supreme Court as a form of shared responsibility system. The research method used in this research is normative law research method with statute approach, conceptual approach and case approach. Sources of legal materials used are legislation and cases. The results of this study are: the supervision on the judge’s behavior by the Judicial Commission can hopefully cover the weakness of internal supervision by the Supreme Court. It becomes so appropriate that the suprevision on judge is also performed by the Judicial Commission, not only by the Supreme Court. The supervision on judge that can be performed by the Judicial Commission includes the suprevision of judicial technique, performance assessment, and supervision on the judge’s behavior.

Abstract

Article 19 of the Law on Legal Aid provides the authority to local governments to deliver legal assistance to the poor by allocating budgets in the Regional Revenue and Expenditure Budgets, all of which are subsequently regulated by Regional Regulations. However, some areas have not yet implemented the mandate of Article 19 of this Legal Aid Law, because there is still doubt that the fulfillment of legal aid for the poor is part of the absolute government affairs relating to the justice sector. This includes establishing a Judicial Institution, appointing Judges and Prosecutors, establishing human rights and immigration policies, granting pardons, amnesty, abolition, legislation, Substitutionary Rules of Law, Government Regulations, and other national regulations. Unlike Jember Regency, which has legalized the Regional Regulation of Jember Number 6 Year 2016 regarding Legal Aid for the Poor, this Regulation of Jember Regency cannot be implemented since there is no Regent Regulation that regulates the implementation of the Regional Regulation. This article discusses how to regulate the authority of local government in fulfilling legal aid for the poor, and how to fulfill legal aid for the poor in Jember. This article concludes with a suggestion for the Local Government of Jember to immediately approve the Regent's Regulation as the implementing regulation of Jember District Regulation No. 6 of 2016 on Legal Aid for the Poor, and to provide opportunities for community participation in supervising the fulfillment of legal aid in Jember. Abstract

The issue of citizenship is one part of the study of state studies or commonly referred to as State Administration Law. One element of state existence is citizenship (algemene staatslehre). In the context of citizenship, the issue of citizenship is critical because, in general, the state consists of three elements, namely the territory, people who are identical with citizens, and sovereign government as a constitutive element and the recognition of other countries as declarative elements. Every citizen must have citizenship because it is an essential thing. After all, citizenship has a close relationship between the citizen and the country in which the citizen lives. These matters relate to citizens related to identity, rights, obligations, participation or participation, and shared social ownership. In addition, with citizenship, citizens automatically have legal protection wherever they are. Having two citizenships is no longer a taboo for citizens and is likely to continue to develop in the future. The fact is that there are citizens aged 18 years or over who have dual citizenship, even though the ownership of dual citizenship should be limited. One of the rights of every citizen is the right to be elected and elected. However, there are still citizens who have dual citizenship. Because of dual citizenship, approaching the General Election confuses citizens of those who have dual citizenship but still wants to fulfill their rights in electing potential national leaders and also the right to lead Indonesia. Abstract

This paper aims to examine problems regarding the possible abuse by refugees inconsistent with Indonesia’s laws and regulations. In the context, the government can make efforts to deal with refugees who enter Indonesia illegally and the government can formulate new laws and regulations that can discuss problems caused by refugee actions in more detail, clearly and in detail, starting from the arrest process to the sanctions process that is obtained. Because until now Indonesia has not had this policy. Those refugees' status then serves the purpose to get a decent living in a recipient country such as Australia. Misuse of visas is widely used by refugees because Indonesia implements a visa-free system of visits to 169 countries in the world. Visa-Free Visit Policy based on President Regulation Number 125 of 2016 concerning Visa-Free Visit. In this regard, the country needs to anticipate the increasing number of visa misuse for refugees entry to Indonesian territory by sending them to immigration detention centers as a form of sanctions imposed before returning to their country and making deportation the last step in resolving the visa misuse problem committed by refugees. Abstract

Public participation is intended the idea of forming laws and regulations does not always have to come from the power holders only, but can emerge from the society. This paper aims to determine the impact of the Constitutional Court’s decision Number 91/PUU-XVIII/2020 on the formation of laws in Indonesia, especially in accommodating public participation which is limited to two main issues. First, how is the form of expanding the meaning of public participation in the Constitutional Court’s decision Number 91/PUU-XVIII/2020. Second, what is the impact of expanding the meaning of public participation in the formation of laws. This doctrinal legal research uses secondary data. The results of the study show that the form of expanding the meaning of public participation in the Constitutional Court’s decision Number 91/PUU-XVIII/2020 is carried out in a meaningful way, by providing guarantees of participation for affected communities and the impact of expanding the meaning of public participation in the formation of laws, namely changing the paradigm of law formation, improvement of regulations and strengthening of public participation as a basis for formal testing.

Abstract

This paper aims to discuss Indonesia's current legal framework of citizenship following its more pervasive demand to adopt dual citizenship. It argues that several issues regarding citizenship law in Indonesia have been relatively problematic, mainly related to the change of citizenship status contentiously experienced by Arcandra Tahar, Gloria Natapraja, and Djoko Tjandra to the increasing demand for dual citizenship. On the other hand, in this context, Indonesia's diasporas have voiced this interest in legal reform, resulting in more flexible opportunities and supporting transboundary businesses, as they have encountered some challenges due to restricted citizenship regulations. Using legal research, this study showed that citizenship had become a strategic issue with far-reaching implications. While Indonesia adopts a limited scale of dual citizenship and the vigour for dual citizenship has increased, the flexibility over dual citizenship requires further study of national security and citizens' loyalty to Indonesia. This paper suggested in adopting India’s OCI model for Indonesia’s citizenship policies as ample opportunities for this country’s citizens with foreign status to continue enjoying and accessing their rights in Indonesia, except in the political field. This measure subsequently would be a step forward to adapt citizenship regulations to globalisation while still paying attention to the nationalism concern.

Abstract

This article describes the relationship between the authority local governments and participation in the management of the potential of the region. The authors argue that local government has a broad authority within its jurisdiction to manage local potentials. One of the tasks borne by government is by following the country, namely hold some of the state as organization power, one of them is given to the public and private in publishing licensing. On one side, the role of the community is very important in the management of the potential of the region as a form of concern of the community development of area, then with the participation of the community hope to increase the income of the around and for the local government assets. On the other hand, residents as a their nets a an ongoing activity. Later in this article explain also forms of public participation in the management of the potential of the region. This article use the study literature regarding the authority local governments and the study legislation about the authority local governments that applies. The results of the study concluded that extent authority local governments one of which is the licensing on the management regional potential, on the other side, required public participation in the management of potential an area.
