Abstract

Problems with indigenous people in Boalemo district, Gorontalo Province often occur, especially the issues about the imposement of costumary sanctions. Imposing costumary sanctions without clear relugations will absolutely cause legal consequences in the future. Eventhough constitutional rights for indigenous people is already granted by the government as stated In article 18B paragraph (2), and Article 28 I paragraph (3) of The 1945 Constitution Of Republic Indonesia. This regulation is a mandate from the state and given to the regions. This regulation is oftenly referred when discussing the existence and rights of indigenous peoples and become a crutial issues when it comes to the implementation of the protection of the constitutional rights for indigenous peoples in Boalemo district Gorontalo Province. Therefore, This research aims to analyze the Legal standing for indigenous people and constitutional rights for costumary sanctions in Boalemo district Gorontalo Province. This normative research utilized secondary data as resourch and used statute approach and case approach. The results of the study discover that the costumary law and the imposement of costumary sanctions are still mantained and implemented in Indonesia. Government should more concern about constitutional rights compliance for indigenous people. However, the imposement of customary sanctions are not regulated in a regional regulation. So the constitutional rights which should become the spirit for regional autonomy to provide justice in a judiciary are only resolved by way of deliberation, This can not give the satisfaction for some parties.

Abstract

Desa Botutonuo adalah salah satu desa di Kecamatan Kabila Bone Kabupaten Bone Bolango yang memiliki berbagai macam potensi terutama potensi wisata bahari. Namun demikian, jika dinilai dari segi pemanfaatan teknologi informasi, maka potensi ini masih perlu dikelola lebih baik lagi dengan cara memanfaatkan teknologi informasi untuk melakukan publikasi ataupun promosi pariwisata yang ada. Kegiatan pengabdian ini bertujuan untuk memudahkan masyarakat dan pemerintah dalam mengelola dan mempromosikan potensi Desa Botutonuo terutama dalam sektor pariwisata. Selain itu, kegiatan ini juga bertujuan untuk memudahkan aparat desa dalam mengelola administrasi kependudukan melalui implementasi sistem informasi desa. Metode yang digunakan dalam kegiatan ini adalah pendampingan bagi aparat desa maupun masyarakat. Kegiatan pengabdian berlangsung dengan sukses dan mendapatkan apresiasi yang sangat baik dari pemerintah desa dan masyarakat.

Abstract

AbstrakPerkembangan kontemporer perlindungan HAM telah jauh berkembang hal ini dapat di lihat banyak kawasan regional yang telah mengatur prinsip-prinsip HAM dalam piagam pendirian contohnya Piagam ASEAN dan African Union Constitutive Act. ASEAN dan  Africa Union (AU), di anggap sebagai representatif perlindungan HAM di kawasan regional akan tetapi berbeda dengan AU, ASEAN  masih jauh tertinggal secara konsep hal ini di buktikan masih kuatnya prinsip kedaulatan negara dan prinsip non-intervensi di kawasan ASEAN. Adapun yang menjadi rumusan masalah yaitu adanya diskursus terkait penerapan prinsip non intervensi, kedaulatan negara dan intervensi kemanusian yang menjadi inti permasalahan penegakan HAM di ASEAN. Penelitian ini menggunakan Metode Penelitian Hukum Normatif, menggunakan pendekatan konsep dan pendekatan perbandingan. Untuk dapat mengatasi permasalah pelanggaran HAM di ASEAN maka: (1) ASEAN perlu melakukan pertemuan antar negara guna memperoleh penyelesain permasalahan HAM di dasarkan atas kemufakatan; (2) ASEAN perlu melakukan peninjauan kembali terhadap penerapan prinsip kedaulatan negara dan non intervensi dengan melihat perkembangan hukum internasional kontemporer (3) ASEAN perlu berkomitmen penuh terhadap AICHR guna mendukung ekosistem perlindungan dan penegakan HAM di ASEAN.
