Abstract

"He who commands the skies commands all." General Giulio Douhet's renowned 1921 quote resonates even a century later. On January 25, 2022, Indonesia and Singapore settled longstanding bilateral issues, including aviation needs and safety. A crucial aspect was the realignment of their flight information regions (FIRs). This paper delves into the FIR concept, emphasizing the delicate balance between air safety and territorial sovereignty. The FIR agreement safeguards Indonesia's sovereignty while fostering collaboration with Singapore in airspace management. However, it has sparked debates on specific aspects, especially the limited delegation of airspace to Singapore. The intricacies of delegating airspace management have fueled discussions. Additionally, concerns have emerged about the FIR's impact on maritime security operations, given that reporting to the Singapore FIR allows monitoring of maritime security vessels.

Abstract

Journal Nurani Hukum: Journal of Legal Studies, also known as Nurani Hukum, is a peer-reviewed journal focused on legal studies. The journal aims to publish high-quality research across various areas of legal scholarship, including but not limited to law and history, legal philosophy, sociology of law, socio-legal studies, international law, environmental law, criminal law, private law, Islamic law, agrarian law, administrative law, criminal procedural law, commercial law, constitutional law, human rights law, civil procedural law, and adat law. Published by the Faculty of Law, Universitas Sultan Ageng Tirtayasa in collaboration with the Asosiasi Pengelola Jurnal Hukum Indonesia (APJHI), the journal is released biannually in June and December. Each issue is made available on the website and further distributed in hardcopy format.The current edition, Volume VI Issue 1, June 2023, covers a wide range of legal and scientific fields, including civil, criminal, constitutional, and international law. The publication of this journal is a result of the collective efforts of many individuals. Abstract

Indonesia's 1983 bilateral agreement with Malaysia, ratified by Law Number 1 of 1983, addresses Malaysia's recognition of Indonesia's Archipelagic State regime in exchange for Indonesia's acknowledgment of Malaysia's traditional rights in territorial seas and archipelagic waters between East and West Malaysia. While this agreement establishes Indonesia's sovereignty, it has significant drawbacks, particularly for Indonesia's traditional fishermen. The provisions allow Malaysian fishermen to exploit Indonesia’s Natuna Sea, often exceeding agreed boundaries and using modern fishing methods, undermining Indonesia's legal and ecological interests. This research employs normative juridical methods to critically evaluate the agreement's implications on Indonesia’s maritime sovereignty and traditional fishing rights. The study concludes that despite the agreement's validity, its implementation faces challenges, including non-compliance with national laws. The research highlights the urgency of revisiting and renegotiating the agreement to protect Indonesia's maritime resources, uphold its legal regime, and secure equitable outcomes for local fishermen.

Abstract

This study addresses the critical need for increased understanding of halal product certification among Micro and Small Enterprises (MSEs) in Pasanggrahan Village, Indonesia. Halal compliance, encompassing raw materials, production processes, and storage, is essential but difficult for consumers to verify without certification. The Indonesian government, through Law No. 33 of 2014, aims to ensure halal product availability, safety, and value for businesses. This research focuses on empowering local communities by combining halal education and legal counseling to enhance MSEs' understanding of halal certification. The findings highlight the importance of joint supervision and collaboration with village officials to ensure compliance and support local enterprises. This study contributes to improving halal certification awareness and strengthens the legal framework for halal product assurance in Indonesia.

Abstract

Armed conflicts have severe humanitarian consequences, especially for civilians. Among the most vulnerable are children, who require specific protection under international law. This study examines two critical questions: how the 1949 Geneva Conventions regulate the protection of children in armed conflicts, and whether the protection of children during the Russia-Ukraine conflict aligns with these legal frameworks. Using legal protection theory and humanitarian principles, this normative juridical study analyzes literature and secondary data. The findings reveal that the Geneva Conventions, along with Additional Protocols I and II, explicitly protect children in armed conflicts. However, the study also highlights a breach of these protections in the Russia-Ukraine conflict, where recruitment of minors as soldiers violates international law. This research underscores the urgency of ensuring compliance with international humanitarian law to safeguard children in war.
