Abstract

Labor unions are workers association organizations that will fight for workers' rights when dealing with entrepreneurs. However, based on previous research, labor unions in Banyumas District experienced "death suspended". Its presence has not been felt by the members, it is supported by a survey conducted by the authors that of the 113 members of the All Indonesian Labor Union Federation (Serikat Pekerja Seluruh Indonesia) of Banyumas Regency, 90% have no Collective Labor Agreement (Perjanjian Kerja Bersama). The existence of these conditions often raises problems in the field of employment, especially labor unions. Underpinning the situation analysis is an urgent need to provide education and training of PKB for unions with partners of the All-Indonesia Labors Union Federation (SPSI) in Banyumas Regency under the supervision of Ministry of Manpower Republic Indonesia (Dinas Tenaga Kerja, Koperasi dan Unit Kredit Mikro Republik Indonesia) through community service activities, as devotion is a strategic means of transferring science and technology. Approach method of this writing is sociological juridical with the type of primary and secondary data and methods of presentation of data in the form of descriptive narrative. The purpose of this paper is to publish the results of community service in the form of education and training of PKB making in SPSI Banyumas Regency in order to be able to make PKB correct so that will guarantee the sustainability and protection for workers and support the creation of harmonious working relationship between workers and employers in Banyumas Regency. Keywords: Labor Unions; Collective Labor Agreement (PKB); work relationship.

Abstract

Labor is the main capital Pancasila community development  because the purpose of manpower development is the people's welfare, therefore the rights of workers must be guaranteed.  The Government of Republic of Indonesia has a commitment to be responsible in the implementation of Social Security. It was realized its implementation by the government based on Law No. 24 of 2011 through the Social Security Agency ( BPJS ) which is a statutory body established to administer social security program. BPJS consists of Workers Social Agency and Healthcare and Social Security Agency.  Social insurance programs provided by the Government aimed at protecting the rights of Indonesian workers , but on the other hand there are employers who do not carry out its obligations.  Of course this provides a problem for workers whose position has not been balanced with employers. The government is not only responsible for the management of social security but also protection relating to administrative sanctions that may be granted to employers who neglect their obligations so that with the imposition of administrative sanctions is expected to lead to harmonious industrial relations.Keywords : administrative sanctions , employers , social security

Abstract

Kebebasan berserikat sebagai hak dasar tidak bisa dilepaskan dari pendekatan realitas kehidupan sosial dan politik dengan berbagai aspeknya seperti aspek ekonomi, pendidikan, agama dan sebagainya. Alasannya karena aspek-aspek tersebutlah yang sangat berperan membuat manusia kehilangan banyak kesempatan memperoleh kebebasan dirinya, sehingga diperlukan suatu kepastian jaminan dari pemerintah sebagai penyelenggara negara untuk melindungi pekerja/buruh dalam berorganisasi untuk berjuang mendapatkan kelayakan hidup seperti yang dijanjikan oleh pemerintah. Jaminan ini sangatlah penting mengingat kaum pekerja/buruh adalah kaum marjinal yang cenderung tidak memiliki bargaining position power dalam bernegosiasi menghadapi pihak pengusaha. Penelitian ini merupakan penelitian hukum yuridis normatif yaitu dengan metode pendekatan mengkaji bahan-bahan pustaka sehingga data yang digunakan adalah data sekunder. Tujuan dari penelitian ini adalah melakukan kajian analitik terhadap peraturan perundang-undangan dan peraturan pelaksananya yang mengatur mengenai jaminan pemerintah negara Republik Indonesia terhadap penyelenggaraan serikat pekerja sehingga diperoleh suatu kesimpulan mengenai penegakan hukum dalam penyelenggaraan serikat pekerja. Abstract

The handover of the authority of the central government to the local government as a form of decentralization in the unitary state in the field of spatial planning, especially green open space in the form of burial land in the Banyumas Regency area, can be said to have not been effective in utilization and management like other forms of green open space. This is because it is not in accordance with the application of spatial planning as a form of green open space because there are discrepancies in its application to regional regulations that are not in line with higher regulations. This research uses a statutory and conceptual approach method with normative juridical research specifications. Using secondary data sources are then analyzed using deductive methods. Based on the results of the study, it can be concluded that there are deviations in legal norms in the content material for the management of burial land in Article 5 paragraph (3) of Banyumas Regency Regional Regulation Number 2 of 2014 concerning Burial Place Management which is contrary to Chapter II of the Provision of Green Open Space in Urban Areas in Green Open Spaces certain functions in Cemeteries listed in the Regulation of the Minister of Public Works Number 5 of 2008 concerning Guidelines for Provision and  Utilization of Green Open Space in Urban Areas.Keywords: Decentralization, Green Open Space, Burial Land

Abstract

The implementation of work employment and wages is not in line between labor and Islamic law. This study aimed to review and analyze labor employment and wage arrangements from perspectives on labor law and Islamic law. This research used a normative juridical method with a contextual approach, rules and regulations, the Quran, and hadith. The results showed that Islamic and labor laws have the same goal: that workers can live decent lives. In labor law, work relations are born from work agreements, and wages are the right of workers after obligations are carried out. However, in Islamic law, work relations are based on justice without exploitation, are efficient, and do not violate other sharia principles, and wages are included in the study of Ijarah. The concept of employment is based on time, type of work, and targets obtained. F or work relations and wages to fulfill human dignity, it is necessary to contain labor regulations that pay attention to the principles of relations and wages in Islamic law.

Abstract

The sale and purchase deed is proof that the sale and purchase process has been carried out regarding land rights or ownership rights to apartment units made by land deed officer. In making sale and purchase deed is must be attended by the parties carrying out the legal action concerned or their authorized person and land deed officer. The problem raised in this research is the validity of the sale and purchase deed whose signing was not in the presence the land deed officer. The research aims to analyze the validity of deeds of sale not executed in the presence of a land deed officer and the responsibility of the land deed officer towards the aggrieved party in making such deeds. Deeds of sale that are not executed in the presence of a land deed officer are considered illegitimate because they fail to satisfy both the formal criteria. The responsibility of the land deed officer towards the aggrieved party regarding the making of deeds of sale takes the form of civil liability, responsible to compensate for the damages caused by their fault and materially compensate for the losses suffered

Abstract

This research aims to recommend the implementation of the digital measurement model on Village Devices and Land Data Collectors (PULDATAN) so that the collection of land data, both physical and juridical, serves as a means to support the validity of village land data. This aims to support the National Program for Complete Systematic Land Registration as mandated by Article 19 of Law Number 5 of 1960 on the Basic Agrarian Law. The location of this research is conducted in Panembangan Village, Cilongok District, Banyumas Regency. The research on the model of implementing digital measurement in village administration was conducted through the following stages: 1. Updating the Juridical Data of Village Land; 2. Updating the Physical Data of Village Land; 3. Computerization and Digitalization of Village Land Administration. The method used in this research is the empirical juridical method. This research aims to review the application of digital measurement as a form of implementing land administration law in villages to support the validity of land data in the villages. This research produces a digital measurement model in villages to prevent agrarian disputes/conflicts. The validity of village land data is the initial gateway to land administration order.
