Abstract

International instruments such as the Universal Declaration on Human Rights, the Internasional Covenants on Civil and Political Rights and Social and Cultural Rights, and the Convention for the Elimination of Discrimination Agaist Women (CEDAW) have led to what has been called a juridical revolution. Under these international instruments, the idea of all these rights including woman rights has been constitutionalized in almost all countries and practically all countries are now committed internationally to respect and ensure the woman rights of their citizens. In this paper international instruments relating the woman rights and their domestic enforceability are covered. Using juridical-normative approach, we discuss the domestic enforceability of international woman rights in Indonesia. The result showed that although women are guaranteed equality under Indonesian Constitution, considerable gaps exist between de jure and de facto equality for women. When there is a conflict within a monist approach, Indonesia tends to follow a doctrine of national law primate. In a case of instruments conflict between woman rights at national/local instruments and international one, then international instument is put aside.

Abstract

Uncertainty of the status of the building rights after the termination of the contract for the place of business has an impact on third parties (tenants) who do not get certainty to who pays the lease obligations. Each party, both from the Tegal City Regional Government and the Investor claim as the right party. Even since the settlement of the peace agreement for the implementation of the Reinjection Decision Number 413/PK/Pdt/2008 (from the Investor's lawsuit against the Tegal City Government) after the termination of the contract for the place. The tenant gets uncertainty again when the Investor's lawsuit against the tenant after receiving the morning market compensation from the Tegal City Government, increasingly becomes unclear the status of the HGB for the stall occupied.This study uses a normative juridical approach to analyze court decisions andtermination of agreements and legal protection. The research specification is descriptiveanalytic and the analysis is based on secondary data. Termination of the contract for the place of business does not necessarily mean that the status of the HGB has also been transferred. This must bedone with the release of rights as regulated in Article 35 of Government Regulation Number 40 of 1996, Land Use Rights, Building Use Rights, and Land Use Rights, namely paragraph 1 (c) , in the case of the author who raised the status of the HGB above the HPL of Block B and C of the Tegal City Morning Market after the termination of the contract for the place of business is still on behalf of the Investor as the rights holder. Legal protection for third parties/tenants is the first repressive form of protection which is reflected in the objection ruling Decision Objection. Number 7/Pdt.G.S/2018/PN. The Tegal District Court's claim from an investor that was declared unacceptable refers to the implementation of a peace agreement between the Tegal City Government and the Investor.

Abstract

In Cilacap, migrant workers are the second largest contributors of foreign exchange after oil and gas sector. It's just the contribution of migrant workers is not consistent with the protection provided by the government, seen by the increasing cases of abuse, sexual violence and trafficking. This research located in Cilacap District using normative-sociological approach to analyze the problems of migrant workers in the normative and empirical levels. The results showed that the normative provisions at the national level have not been able to reach the whole problematics of service and protection of migrant workers in the District. The normative problems include the overlapping of the regulation, duplication of regulation, and provision multiple interpretations that complicate its application. Legislation in general is also not reaching abuses of administration officials. While the results of an empirical study illustrate that the complaints of violence against migrant workers conducted largely by parents and migrant workers are mostly from poor families. Key words: migrant workers, protection, local regulation

Abstract

Gender activists have two opposite point of view towards the decision from Constitutional Court of Justice (MK). The one who does not agree with the decision argue that the decision can rise many obstacles for women who want to be members of parliament. The women argue that women - compared to men - have more burdens either in private and public life, therefore they have more difficulties to become members of parliament. On the other hand, some gender activists mention that this decision gives a good opportunity for women to show that they are elected into the parliament because of their qualified capabilities with no preference from gender point of view. Besides, in the general election under MK containing a fair competition for both women and men, reflects that people sovereignty is more accommodated, although a substantive gender equality is marginalized. Abstract

AbstractLegal protection for the auction buyer/auction winner means that there is legal certainty of the auction winner's rights to the goods he bought through the auction, obtaining the goods and material rights to the goods he purchased or in other words the auction winner can control the auction object which he has legally and materially. And if there is a lawsuit, the winner of the auction should not participate as a defendant. This study discusses how the legal protection for the auction winner of the execution of mortgage over the control of the auction object and the obstacles experienced in the legal protection for the auction winner of the execution of the mortgage over the mastery of the auction object. The method used in this research is the normative juridical method, carried out through a literature study which examines mainly secondary data. The law has guaranteed legal certainty for auction buyers which is clearly stated in Vendu Reglement, HIR, and PMK Number 106/PMK.06/2013 concerning Amendments to PMK Number 93/PMK.06/2010 and PMK Number 93/PMK.06 /2010 Concerning Auction Implementation Guidelines. The Vendu Reglement is a regulation that regulates the basic principles of auction which has been in effect since April 1, 1908. In general, the Vendu Reglement only regulates the implementation of auctions, the auctioneer or currently referred to as the auction official, the parts and contents of the auction minutes. Article 42 of the Vendu Regulation states that the winner of the auction has the right to obtain a quote from the minutes of the auction as a deed of sale and purchase of the object of the auction. The excerpt of the minutes of the auction which will later be used as a deed of sale and purchase for the benefit of changing the name of the auction object if the object being auctioned is an immovable object. Keywords: Execution, Mortgage, Legal Protection, Auction Winner. AbstrakPerlindungan hukum terhadap pembeli lelang/pemenang lelang berarti adanya kepastian hukum hak pemenang lelang atas barang yang dibelinya melalui lelang, memperoleh barang dan hak kebendaan atas barang yang dibelinya atau dengan kata lain pemenang lelang dapat menguasai obyek lelang yang telah dimilikinya secara yuridis maupun secara materiil. Dan apabila terjadi gugatan, seharusnya pemenang lelang tidak turut serta sebagai tergugat. Penelitian ini membahas bagaimana perlindungan hukum bagi pemenang lelang eksekusi hak tanggungan atas penguasaan obyek lelang dan hambatan-hambatan yang dialami dalam perlindungan hukum bagi pemenang lelang eksekusi hak tanggungan atas penguasaan obyek lelang. Metode yang digunakan dalam penelitian ini yaitu Metode yuridis normatif dilakukan melalui studi pustaka yang menelaah terutama data sekunder. Undang-undang telah menjamin kepastian hukum bagi pembeli lelang yang secara jelas dinyatakan dalam Vendu Reglement, HIR, serta PMK Nomor 106/PMK.06/2013 Tentang Perubahan Atas PMK Nomor 93/PMK.06/2010 dan PMK Nomor 93/PMK.06/2010 Tentang Petunjuk Pelaksanaan Lelang. Vendu Reglement merupakan peraturan yang mengatur prinsip-prinsip pokok tentang lelang yang telah berlaku sejak 1 April 1908. Secara umum Vendu Reglement hanya mengatur tentang penyelenggaraan lelang, juru lelang atau saat ini disebut sebagai pejabat lelang, bagian-bagian serta isi dari risalah lelang. Dalam Pasal 42 Vendu Reglement, menyatakan bahwa pemenang lelang berhak memperoleh kutipan risalah lelang sebagai akta jual beli obyek lelang. Kutipan risalah lelang mana nantinya akan dipergunakan sebagai akta jual beli untuk kepentingan balik nama obyek lelang apabila yang dilelang adalah benda tidak bergerak.Kata kunci: Eksekusi, Hak Tanggungan, Perlindungan Hukum, Pemenang Lelang

Abstract

Inheritance occurs because of the death of a family member. Currently, heirs can be limited with a Letter of Inheritance that can be made in the Kelurahan. This study aims to analyze the responsibility of the Lurah in making a Letter of Inheritance based on the inheritance system according to Islamic law in Indonesia. In addition, it is also aimed at analyzing the legal status of the Letter of Inheritance made by the Lurah as evidence. The research method used is normative juridical research. The results of the research, the Lurah and Camat are only administratively responsible in the process of recording the Letter of Inheritance, and are not responsible materially regarding the substance of the composition of Inheritaries. Other findings show that the Letter of Inheritance which was signed by the Petitioner legalized by the Head of the Village and the Camat, is an underhand letter.Keywords: Lurah, Letter of Inheritance, Islamic Law

Abstract

The settlement of bad debts through the transfer of receivables (CESSIE) is regulated in Article 613 of the Civil Code. However, in practice, there are problems regarding the mechanism for implementing the transfer of receivables (CESSIE) in the case of the Pekanbaru District Court decision Number 129/Pdt.G/2016/PN.PBR is then on appeal with the decision of the Pekanbaru High Court Number 59/Pdt.G/2017/PT.PBR. This study aims to analyze the mechanism for the transfer of receivables (CESSIE), which is considered valid by applicable legal provisions, and to examine and analyze the role of the Notary in the transfer of receivables (CESSIE). This study uses a normative juridical method, with the research specifications used prescriptively. The writing uses secondary data consisting of primary, secondary, and tertiary legal materials. Methods Data collection using literature study with the method presented in the form of descriptive narrative text. Analysis The data were analyzed in a qualitative normative manner. The research results obtained are 4 (four) stages of the mechanism that are considered valid in settling bad loans through the transfer of receivables (cessie) by PT. Bank Tabungan Negara. First, the credit was declared bad by the Bank, in this case, PT. Bank. Tabungan Negara Second, by implementing the restructuring of credit belonging to debtors who are unable to carry out their performance as they should. Third, PT. Bank Tabungan Negara is required to subpoena 3 (three) times to the Debtor due to default by the Debtor. Fourth, through the transfer of receivables (CESSIE), which is bound by Mortgage Rights and contained in authentic deeds, PT. Bank Tabungan Negara can sell the object of collateral owned without the assistance of the Court. The four stages refer to the provisions of Article 1243 of the Civil Code, Law Number 10 of 1998, concerning Banking and its implementing regulations, namely Bank Indonesia Regulation Number 14/15/PBI/2012 concerning asset quality assessment of commercial banks which is now the Financial Services Authority Regulation Number 40 / POJK.03/2019, and the Mortgage Law. If this fourth stage is not carried out, the mechanism for the transfer of receivables (CESSIE), which the Mortgage Rights do not bind, is still valid but is not related to the transfer of the object of collateral. The Notary's role in transferring receivables (CESSIE) in the case of Decision Number 129/Pdt.G/2016/PN. PBR is not following the provisions of the Law on Notary Positions. What is violated is that the Notary does not provide legal counseling as referred to in Article 15 paragraph (2) letter (e) of the Notary Position Act. The Notary is authorized to provide legal counseling regarding the deed. In the case of a transfer of sale and purchase of receivables (CESSIE), the role of the notary shifts as the Pejabat Pembuat Akta Tanah (PPAT) to transfer the mortgage guarantee from the old creditor (Cedent) to the new creditor (Cessionaris), the Deed of Transfer of Mortgage Rights (APHT) is then registered to the Office of the National Land Agency (BPN), thereby switching Mortgage Rights from the old creditor (Cedent) to the new creditor (Cessionaris). Without the transfer of Mortgage registration, the new creditor (cessionary) only becomes a congruent creditor, not a separatist creditor, and does not have preferential rights in paying off debtors' debts.Keywords: Role of Notary, Bad Credit, Cessie

Abstract

Penelitian ini dilakukan terhadap perkara dan Putusan Pengadilan Nomor 30/Pdt.G/2018/PN. Pwt, dengan judul Tanggung Jawab Atas Terjadinya Wanprestasi. Permasalahan yang diajukan dalam penelitian ini adalah : 1. Bagaimana pertimbangan hukum hakim atas terjadinya wanprestasi dalam Putusan Pengadilan Negeri Purwokerto Nomor : 30/Pdt.G.S/2018/PN. Pwt? dan 2. Bagaimana bentuk tanggung jawab atas terjadinya wanprestasi dalam Putusan Pengadilan Negeri Purwokerto Nomor : 30/Pdt.G.S/2018/PN. Pwt ?. Adapun tujuan penelitiannya adalah : melakukan analisis mengetahui pertimbangan hukum hakim atas terjadinya wanprestasi dalam Putusan Pengadilan Negeri Purwokerto Nomor : 30/Pdt.G.S/2018/PN. Pwt dan bentuk tanggung jawab atas terjadinya wanprestasi dalam Putusan Pengadilan Negeri Purwokerto Nomor : 30/Pdt.G.S/2018/PN. Pwt.  Metode penelitian yang digunakan adalah metode yuridis normatif, dengan spesifikasi penelitian diskriptif analitis dan analisis secara kualitatif. Berdasarkan hasil analisis diperoleh hasil bahwa: pertama, 1. Pertimbangan Hakim yang menyatakan debitur telah melakukan wanprestasi dan wajib menyerahkan objek hak tanggungan kepada kreditur, secara umum telah benar dan sesuai dengan ketentuan peraturan perundang-undangan yang berlaku, yaitu KUH Perdata dan UUHT. Akan tetapi dalam menyebutkan dasar hukum atas wanprestasinya debitur tidak tepat, karena menyebut Pasal 1234 KUH Perdata. Seharusnya yang digunakan adalah Pasal 1238 sampai dengan Pasal 1246 KUH Perdata. Dan kedua, 2.Tanggung jawab debitur atas utangnya terdiri dari dua hal, yaitu menyediakan seluruh kekayaannya sebagai jaminan sebagaimana diatur dalam Pasal 1131 KUH Perdata dan menyerahkan objek hak tanggungan pada saat eksekusi hak tanggungan berdasarkan Pasal 11 ayat (2) huruf j tentang janji-janji hak tanggungan.Kata Kunci : Hak Tanggungan; Tanggung jawab; Wanprestasi

Abstract

Penelitian ini bertujuan untuk menganalisis peran Unit Pelayanan Teknis Daerah Perlindungan Perempuan dan Anak dalam menangani KDRT di Kabupaten Banyumas serta faktor-faktor apa saja yang cenderung memengaruhi peran UPTD PPA dalam menangani KDRT di Kabupaten Banyumas. Penelitian ini merupakan penelitian kualitatif dengan metode pendekatan yuridis empiris dan spesifikasi penelitian deskriptif. Jenis data yang digunakan adalah data primer yang diperoleh dari hasil wawancara dan data sekunder yang diperoleh dari studi kepustakaan. Metode pengolahan data dengan reduksi data, display data dan kategorisasi data. Penyajian data dalam bentuk teks naratif dengan metode analisis data secara kualitatif model analisis isi. Berdasarkan hasil penelitian diperoleh hasil penelitian. Pertama, peran UPTD PPA Kabupaten Banyumas dalam menangani kasus KDRT di Kabupaten Banyumas sudah sesuai dengan Pasal 5 jo. Pasal 6 Peraturan Menteri Perlindungan Perempuan dan Anak No. 4 Tahun 2018 Tentang Pembentukan Unit Pelaksanaan Teknis Daerah PPA. Dibuktikan dengan ditanganinya 46 kasus sepanjang tahun 2021. Adapun peran yang dilakukan oleh UPTD PPA Kabupaten Banyumas adalah Pengaduan masyarakat, Penjangkauan korban, Pengelolaan kasus, Penampungan sementara, Mediasi, dan Pendampingan korban. Kedua, faktor-faktor yang cenderung memengaruhi peran UPTD PPA dalam menangani KDRT Kabupaten Banyumas terdiri dari faktor pendukung seperti tersedianya dana, petugas yang sudah terliterasi tentang gender dengan baik dan sudah berpengetahuan tentang KDRT serta sebagian masyarakat sudah terliterasi tentang KDRT. Faktor penghambatnya seperti pandangan patriarkis masyarakat terhadap KDRT, kurangnya SDM, dsb.

Abstract

Perjanjian sewa beli adalah perjanjian tidak bernama yang merupakan gabungan antara perjanjian sewa menyewa dan perjanjian jual beli, di mana si pembeli sewa tidak langsung menjadi pemilik, namun hanya mempunyai hak pakai terhadap objek sewa beli. Hak kepemilikannya baru beralih ketika melunasi angsuran terakhir. Dalam perjanjian sewa beli apabila penjual sewa telah menerima uang pelunasan atas objek sewa beli dari pembeli sewa, maka ia berkewajiban untuk menyerahkan objek sewa beli kepada pembeli sewa. Jika objek sewa beli merupakan benda tidak bergerak maka diharuskan adanya penyerahan secara yuridis melalui akta otentik, tidak cukup hanya dengan penyerahan nyata. Apabila pihak penjual sewa tidak mau melakukan penyerahan yuridis meskipun pembeli sewa telah melakukan kewajibannya maka penjual sewa dapat digugat dengan gugatan wanprestasi. Kasus berkaitan dengan latar belakang di atas salah satunya terdapat dalam Putusan Mahkamah Agung Nomor 931 K /Pdt/ 2019. Tujuan penelitian ini adalah untuk mengetahui pertimbangan hukum hakim dalam memutuskan gugatan wanprestasi, dan menganalisis tuntutan ganti kerugian wanprestasi yang dituntut oleh Penggugat. Metode Penelitian yang digunakan adalah metode yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Berdasarkan hasil analisis diperoleh simpulan bahwa perbuatan Tergugat sebagai penjual sewa adalah wanprestasi yaitu tidak memenuhi prestasi secara sempurna dengan tidak mau menandatangani akta jual beli sebagai rangkaian perbuatan secara yuridis atau proses balik nama atas nama Penggugat meskipun Penggugat menempati objek sewa beli tersebut, sehingga dasar pertimbangan hakim dalam memutus perkara wanprestasi sudah benar, sedangkan tuntutan ganti kerugian yang dituntut Penggugat sebagai akibat wanprestasi adalah kabur atau tidak jelas karena tidak memenuhi unsur-unsur ganti kerugian sebagaimana ketentuan Pasal 1243 jo 1246 K.U. H. Perdata. Tuntutan ganti kerugian pihak Penggugat lebih mengarah ke uang paksa.Kata Kunci : Perjanjian Sewa Beli, Penyerahan, Wanprestasi
