Abstract

Klasterisasi yang muncul karena adanya jalur zonasi, afirmasi, dan perpindahan orang tua/wali memiliki implikasi terhadap tercederainya hak atas pendidikan khususnya dalam memilih fasilitas pendidikan secara bebas dan leluasa, hal itu dihambat oleh adanya persentasi zonasi yang diterapkan melalui Peraturan Menteri Pendidikan dan Kebudayaan Nomor 1 Tahun 2021. Problematika hak atas pendidikan itu muncul karena lebih mengutamakan aspek ‘jarak’ di bandingkan ‘kognitif’, bahkan peluang ekonomi yang tidak mampu jauh lebih sedikit dibandingkan zonasi. Metode penelitian yang digunakan yaitu yuridis normatif dengan pendekatan perundang-undangan. Tujuan Penelitian ini yaitu untuk mengkaji adanya problematika ekualitas hak atas pendidikan sejak diterapkannya sistem zonasi. Hasil penelitian menunjukkan bahwa penerapan kebijakan   itu berimplikasi terhadap tidak terpenuhinya hak atas pendidikan sebagaimana yang diatur oleh Pasal 28C ayat (1) dan Pasal 31 ayat (2) UUD NRI Tahun 1945, bahwa dalam proses penerimaan siswa baru harus mempertimbangkan ‘nilai’ sebagai kuota terbanyak terhadap daya tampung sekolah, kemudian diikuti oleh jalur afirmasi, dan jalur perpindahan orangtua/wali untuk menciptakan ekualitas hak atas pendidikan yang proporsional dan berkeadilan.

Abstract

The method for the formation of laws and regulations that has become the public spotlight recently is the Omnibus Law method which of course cannot only be applied in the formation of laws alone. It can also be applied in the formation of regional regulations. However, this is not yet an issue that is discussed nationally. The purpose of this study is to answer legal problems related to the application of the omnibus law in the formation of regional regulations so that there is a common viewpoint and become input for stakeholders. The research method used is normative juridical. The results show that the formation of local legislation using the omnibus law method can minimize disharmony of local legislation both vertically and horizontally with PUU.

Abstract

This article discusses the authority to carry out autonomous management of religious administrative policies that are denied by the central government of Indonesia where the regional government has no right to give recognition of a religion or belief embraced by the local community. The government only recognizes six administratively registered religions based on the population records. Those are Islam, Catholicism, Christianity, Buddhism, Hinduism, and Confucianism. The method used in this paper is normative juridical legal researhc. Whereas in the anthropological tradition of the local communities’ spiritual beliefs, Indonesia has 187 local beliefs with its unofficial number of trustees of 20 million people. Therefore, the religious beliefs embraced by the residents are ignored in public services and bureaucratic practices. Hence, the logical consequences that have implications for the adherents of local religious beliefs are the exclusion of basic rights as citizens, inequality before the law and government, discrimination in public services, restrictions on freedom of worship and tradition, being the recipients of racism, and forms of intolerance in society. This article will focus on conducting empirical-theoretical analysis of decentralization, religious administration policies, and relation to pluralist democratic discourse.

Abstract

The lack of quantity of halal auditors has implications for the less than optimal implementation of halal product guarantee in Indonesia, so it is necessary to compare with Brunei Darussalam in standardizing halal auditors. The research method used in this research is normative juridical. The results of the study indicate that halal auditors still need to optimize the quantity of halal auditors so that they are more optimal in halal and there will be an increase in halal product guarantee in Indonesia. Comparative with Brunei Darussalam, apart from an adequate quantity of halal auditors, there is also a code of ethics for trainee auditors (halal auditors), Indonesia needs to optimize the number of halal auditors and also have a code of ethics for halal auditors. So the results are more optimal and in accordance with Law of the Republic of Indonesia Number 33 Year 2014 on Halal Product Guarantee.

Abstract

Tindak lanjut atas putusan Mahkamah Konstitusi oleh bukan addressat utama yaitu pembentuk undang-undang justru menimbulkan masalah baru dan produknya tersebut dapat dibatalkan oleh Mahkamah Agung dikarenakan amar putusan Mahkamah Konstitusi tidak ditindaklanjuti dalam bentuk undang-undang. Putusan Mahkamah Konstitusi yang bersifat final dan mengikat, dalam pengujian undang-undang terdapat norma yang telah diuji di Mahkamah Konstitusi tetapi belum mendapat tindak lanjut dari addressat utama sehingga perlu dikaji bentuk ideal atas Putusan Mahkamah Konstitusi dalam pengujian undang-undang. Penelitian ini dilakukan dengan menggunakan metode yuridis normatif melalui pendekatan studi komparatif beberapa negara. Tujuan penelitian ini yaitu untuk menemukan bentuk ideal terhadap tindak lanjut Putusan Mahkamah Konstitusi dalam pengujian undang-undang. Hasil penelitian menunjukkan bahwa Mahkamah Konstitusi perlu memiliki kewenangan melalui amandemen konstitusi, memberikan limitasi waktu bagi legislator untuk merevisi undang-undang agar sesuai dengan putusan Mahkamah Konstitusi terhadap pengujian undang-undang sebagaimana praktik di Negara Slovenia, Ceko, Rumania, Amerika Serikat, Perancis, Ukraina.

Abstract

Gejolak yang muncul akibat Peraturan Menteri Komunikasi dan Informatika Nomor 21 Tahun 2017 tentang Perubahan Kedua atas Peraturan Menteri Komunikasi dan Informatika Nomor 12 tahun 2016 tentang Registrasi Pelanggan Jasa Telekomunikasi. Masyarakat yang resah karena harus melakukan registrasi data pribadi menggunakan Kartu Tanda Penduduk dan Kartu Keluarga dalam waktu yang ditentukan jika tidak kartu prabayarnya akan diblokir. Belum adanya sanksi bagi penyalahguna data pribadi pengguna kartu prabayar yang harus dilindungi negara sebagai penjamin hak asasi manusia. Metode yang digunakan dalam penelitian ini yaitu yuridis normatif dengan melakukan studi kepustakaan. Analisis yang digunakan yaitu analisis kualitatif. Hasil penelitian menunjukkan bahwa kaitan registrasi kartu prabayar dengan hak asasi manusia terutama dalam perlindungan data pribadi termaktub dalam Pasal 28 E, 28 F, dan 28 G Undang-Undang Dasar Negara Republik Indonesia serta beberapa aturan dibawahnya. Akibat hukum registrasi kartu bertentangan dengan peraturan diatasnya yang terkait dengan HAM. Sehingga, peraturan menteri itu, dapat terjadi dua peluang akibat hukum yaitu judicial review dan/atau constitutional review di Mahkamah Agung dan/atau Mahkamah Konstitusi yang dapat berujung pada pembatalan peraturan maupun revisi undang-undang terkait.

Abstract

The polemic of polygamy that is still being contested in Indonesia needs to be studied from the perspective of hermeneutics of Islamic law, its constitutionality, such as how Pancasila guarantees the practice of polygamy, and also in laws and regulations whose substance also regulates polygamy. The research method used in this study is a normative juridical method with a doctrinal approach. The purpose of this study is to determine the constitutionality of polygamy when examined from the hermeneutic perspective of Islamic law in Indonesia. The results showed that the First Principle of Pancasila, Article 29 paragraph (1) of the 1945 Constitution of the Republic of Indonesia, the Marriage Law and its implementing regulations, as well as the various views of the schools allow the practice of polygamy in Indonesia.

Abstract

Problems with the interim dismissal of members of the regional people's representative council who are related to the authority of the governor. The research method used is normative juridical with library research. The results of the study show that within 7 (seven) days of receiving the proposal to dismiss a member of the Regency/Municipal DPRD, it is obligatory to submit the proposal to the Governor. If within 7 (seven) days the regent does not submit a proposal to dismiss a member of the Regency/Municipal DPRD, the leadership of the Regency/Municipal DPRD will immediately submit the proposal to the Governor and within 14 (fourteen) days, the Governor must formalize the dismissal of the member of the Regency/Municipal DPRD
