Abstract

Dunia sedang berjuang untuk mengatasi masalah yang ada saat ini yaitu COVID-19. Diketahui bahwa COVID-19 menular dari manusia ke manusia karena itulah penyebarannya sangat cepat dan harus segera dikendalikan. Indonesia pun tak luput dari penyebaran COVID-19 ini. Perseberannya semakin cepat dan mengakibatkan banyak korban berjatuhan. Pemerintah juga banyak mengeluarkan kebijakan terkait pengananan COVID-19 seperti menetapkan masa tanggap darurat nasional. Salah satu upaya lain pemerintah untuk menghentikan penyebaran COVID-19 di Indonesia adalah dengan mengeluarkan kebijakan pembebasan bersyarat Narapidana untuk mencegah penyebaran COVID-19 di lingkungan Lapas. Dalam tulisan ini akan dibahas mengenai dasar hukum yang digunakan pemerintah untuk mengeluarkan kebijakan pembebasan narapidana demi mencegah COVID-19 menyebar di Lapas. Sudah patut atau tidak kebijakan ini dikeluarkan mengingat bahwa tidak serta merta pembebasan bersyarat bisa diberikan kepada Narapidana. Dalam tulisan ini menggunakan metode penelitian normatif-empiris melalui kebijakan yang dikeluarkan pemerintah. Dari kebijakan pemerintah yakni Menkumham yang mengeluarkan Peraturan Menteri Hukum dan HAM RI nomor 10 tahun 2020 perlu adanya analisa untuk menilai apakah langkah yang diambil pemerintah sejalan dengan upaya pencegahan penyebaran COVID-19 dan apa tolak ukur pemerintah dalam mengeluarkan kebijakan ini.

Abstract

The idea of village head dispute resolution through the Special Judicial Institution began with anxiety over Law 6 of 2014 concerning Villages, Government Regulation number 6 of 2014 concerning Implementation of Village Laws, and Minister of Home Affairs Regulation No. 112 of 2014 concerning Guidelines for Election of Village Heads, which has not yet regulated the village head election supervisory institutions and dispute resolution institutions for village head elections. The institutions that are required to complete based on these rules are Regents with a period of 30 days. Regents are political positions which also have many political interests. The existence of this decision had an impact on one of the candidates for the village head. The current practices for resolving disputes over village head elections through the District Court and the State Administrative Court. The purpose of this study to create a concept for regional special judiciary institutions in resolving regional election disputes in Indonesia. This research using a normative juridical approach with a statute approach, history approach and conceptual approach. The results of the study show that by establishing a special independent judicial institution based on local wisdom by prioritizing the principle of kinship and consensus building. The main task of the institution is to assist the regional head in providing alternative legal services, to serve and protect the rights of the parties in seeking truth and justice, and to settle according to a predetermined time, to try to examine and decide on cases of village head election disputes.

Abstract

In the year of 2013, Lumajang Regency carries out 159 village chief election (Pilkades). There are 4 disputes of Pilkades, and all about voice counting result of Pilkades. Local Regulation No. 24 year 2006 and Local Regulation No. 6 year 2012 do not state any matter of dispute in village headman election and mechanism of solution, but Local Government Regulation determines Watchdog Committee in the level of sub-district and Team of Village Governance Issues Completion in the level of District. Watchdog committee conducts supervision by preventive and repressive act. Supervision is done through preventive act in the form of communications and socialization to the village officer, Village Consultative Council (BPD), and Pilkades Committee about the importance of honest, fair and democratic Pilkades. Meanwhile, supervision is conducted through repressive act by facilitating the parties if dispute happened. As the result, committee executes the monitoring well, proven from 159 Pilkades, there was only 4 disputes, three among others can be resolved in non litigation process. Existence of Watchdog Committee is supported by the availability of budget coming from help of region budget (APBD) that is packed into village budget (APBDes), Rp.2.000.000 for every Pilkades.

Abstract

Village elections (Pilkades) is a direct election procedure and mirrors implementation of democratic life in Indonesia. Article 37 and 38 of the regency Regional Regulation No. 7 of 2006 states that if the Pilkades process turns dispute, the dispute does not stop the next stage. The regency government normatively based on Article 37 guarantees the completion stage of the elections until the inauguration phase and form a team of supervisors who communicate with those who feel aggrieved to get agreement dispute resolution. Until this research is done, there is only one case submitted to the District Court, but then the plaintiffs draw their lawsuit. Dispute settlement pattern research was conducted through interviews and providing information to the bureaucrats and the judiciary in the area of dispute. The involvement of these parties is important that the results of this activity followed up by an independent institution in Pilkades dispute resolution with consideration of existing regional regulations. Abstract

In the use of hills in Jember District related land rights, which most hills in Jember District is private property rights and its utilization cannot be contrary with national interests. In the article 6 UUPA : " All rights over land have a social function". Then on the basis of the law of the government Jember could not only dwell alone without a policy on the protection of the hills. With private ownership over the hills cannot be a reason to ignore the sustainability and environmental protection. The process of development and the protection of environment must be in harmony. Not mutual clashing that culminated in the destruction of the environment. The harmony between the use and maintenance of the environment related to the hills should always maintained in order to safeguard environment quality of life as well as the use of hills must be adjusted with the case and th nature of the right to useful both for peace and prosperity that does and useful for the society, state and public interests. Aware of the condition that happens, author regretted government attitude of Jember against Local Regulation of Jember Number 1 Year 2015 About Regional Exterior Plan Jember District 2015 - 2035 inconsistent with implementation to the use hills. With done by people to hills exploitation economic interests, the impact on the environment. if the view is subjective, it is obvious for the perpetrators of such as hills owner, miners, investors, view it give positive impact for open jobs and improve economic mobility in the region. But for people around the hills, will feel mostly negatives impact, as the weather hotter, drought, erosion, flood, high wind, and micro climate change. The hand of the government through all its policies must put the protection and preservation of environment as the main priority. Economic growth must be consistent with the protection of environment. The current generation must be bequeathed to the next generation of good natural. So the utilization of hills can be done by making hills as a green tourism park, place jogging track, place students research with planted with various plants and conservation of flora and fauna and the existence of a over zoning for the protection hills to as one of the efforts the management of environmental sustainability, with create a community care hills and action as the government policy control of Jember related to the protection hills, proposing an objection against the decision officials responsible for development that is not considered in accordance with the spatial plan, working together with the Government in the spatial plan and oversee the implementation of spatial plan.

Abstract

Penelitian ini hendak membahas atau menganalisa tentang pasal-pasal yang ada di dalam syarat- syarat Umum perjanjian Pinjmanan dan  kredit.  Pasal-pasal tersebut apakah mencerminkan adanya azas Kebebasan Berkontrak dalam membuat perjanjian kredit atau pinjaman uang. Hasil penelitian diperoleh  bahwa pasal-pasal dalam naskah tentang syarat-syarat umum yang wajib dipenuhi, ditemukan adanya pasal yang masih menampakkan belum adanya pemenuhan terhadap azas kebebasan berkontrak maupun azas lainnya yang ikut berpengaruh di dalamnya, yakni azas konsensualisme. Hal ini nampak dalam syarat umum Perjanjian peminjaman dan kredit pada Pasal 2 angka 3 yang mengatakan bahwa ketentuan suku bunga kredit dapat ditinjau dan ditetapkan kembali secara sepihak oleh Bank. Terhadap perubahan suku bunga kredit tersebut pihak Bank cukup memberitahukan secara tertulis dan pemberitahuan dimaksud mengikat pengambil Kredit. Ketentuan pasal tersebut menunjukkan adanya kekurang seimbangan kedudukan antara pihak bank dan pihak debitur. Disamping itu terdapat satu azas lagi yakni azas konsensualisme, yang nampaknya kurang diperhatikan oleh pihak Bank selaku pihak Kreditur. Fenomena demikian ini tentunya dapat menghambat pertumbuhan ekonomi sebagaimana diharapkan oleh negara, untuk tumbuh sebagaimana diharapkan, sesuai dengan misi dari dikeluarkan Uandang-undang Perbankan No. 10 tahun 1998

Abstract

Pengelolaan air limbah di Indonesia masih sangat sedikit. Padahal, pengelolaan limbah cair rumah tangga yang benar amat dibutuhkan untuk mencegah risiko pencemaran yang juga berdampak pada kualitas hidup penduduk di tanah air.Penelitian ini bertujuan untuk mengetahui konsistensi Perda Nomor 6 Tahun 2018 Tentang Pengelolaan Air Limbah Domestik dengan UU Nomor 32 Tahun 2009 Tentang Perlindungan Dan Pengelolaan Lingkungan Hidup Pasca di Berlakukannya UU Cipta Kerja dalam pengelolaan limbah domestik di Kabupaten Lumajang. Adapun metode penelitian yang digunakan dalam penelitian ini yaitu dengan menggunakan metode penlitian hukum normatif dengan menggunakan pendekatan Perundang – Undangan (Statute Approach) dan Pendekatan Konsep (Conseptual Approach) adapun hasil dari penelitian menyatakan bahwa pasca diberlakukannya UU Cipta Kerja terhadap UU No 32 Tahun 2009 Tentang Perlindungan dan Pengelolaan Lingkungan Hidup dimana UU Cipta Kerja tersebut telah menghapuskan Perizinan lingkungan dan terdapat peerubahan persetujuan lingkungan sehingga dapat berdampak negatif terhadap Pemerintahan Daerah. Hal tersebut akan menjadi sebuah problematika yang akan dihadapi oleh Pemerintahan Daerah khususnya Pemerintahan Daerah Kabupaten Lumajang. Karena lahirnya UU Cipta Kerja berdampak pada resentralisasi, dimana pihak Pemerintahan Pusat mengambil alih Kewenangan yang dimiliki oleh Pemerintahan Daerah.

Abstract

Indonesia becomes the source of illegal, unreported, unregulated fishing (IUUF) since it is a maritime nation with an estimated 9.9 million tons of fish resources per year. Indonesia forbids IUUF because it violates requirements of the Indonesian Law Number 45 of 2009, the Indonesian Law Number 32 of 2014, and the 1982 United Nations Convention on the Law of the Sea. Sectoral egos amongst domestic institutions, however, are currently impeding the exchange of data and information concerning IUUF, which is hindering the overcoming of IUUF. Thus, the Control Center of Task Force 115, which has the responsibility for organizing interoperability, can be used to build a solution for data and information exchange by creating a platform that can integrate various domestic institutions' facilities into a single data and information center. Then, through the reconstruction of Ministerial Regulation Number 37/PERMEN-KP/2017, the execution of interoperability is described in a regulation. This solution must be implemented to avoid duplication of authority among domestic institutions and the inefficiency of Task Force 115's Control Center's role as the coordinator of the exchange of surveillance data or information about IUUF actors who will or have entered the Indonesian Sea.

Abstract

Penelitian ini bertujuan untuk menganalisis pada Pasal 83 Ayat 3 Undang-Undang No 6 Tahun 2014 tentang Desa terhadap pembangunan infrastruktur, pengembangan teknologi tepat guna, peningkatan ekonomi pedesaan yang akan dilakukan di Desa Sumber Danti, Kecamatan Sukowono, Kabupaten Jember. Adapun beberapa permasalahan yang ada di daerah sekitar yaitu tentang kondisi infrastruktur yang harus diperbaiki, tingkat kemiskinan yang tinggi, rendahnya tingkat pendidikan, dan kurangnya tingkat pengetahuan masyarakat tentang pola hidup sehat. Metode penelitian yang digunakan dalam penelitian ini yaitu kualitatif dan menggunakan pendekatan empiris dengan pemfokusan terhadap implementasi aturan hukum. Teknik analisis data dalam penelitian ini yaitu menggunakan data sekunder dan data primer, sedangkan teknik pengumpulan data yaitu dengan melakukan observasi, wawancara, dan dokemtasi secara langsung. Hasil penelitian menunjukkan bahwasannya Pasal 83 Ayat 3 Undang-Undang No 6 Tahun 2014 sudah terlaksana dengan baik dengan melalui beberapa program untuk meningkatkan kesejahteraan masyarakat seperti peningkatan ekonomi desa dan pembangunan infrastruktur meskipun dari program tersebut masih dalam proses pelaksanaan atau pembangunan. Aspek teknologi yang ada di desa tersebut masih belum terlaksana dengan baik, hal ini terjadi karena minimnya pengetahuan tentang teknologi sehingga masih perlu adanya adaptasi secara perlahan agar dapat memaksimalkan teknologi di desa tersebut. Beberapa upaya dan program yang akan dilakukan dalam meningkatkan kesejahteraan masyarakat dimulai harus dilakukan oleh Kepala Desa di daerah tersebut.
