Abstract

The failure of the supervision system and sanctioning mechanisms to address the negligence of judges has created an urgent need to reform the justice system. Disparities in the independence and accountability of judges create accountability gaps in the justice system. This study uses a juridical-normative approach to analyze positive legal norms, legal principles, and the systematics of laws and regulations related to the accountability of judges for negligence in deciding criminal cases. This study reconceptualizes culpa lata into two categories: negligence that leads to KKN, using the Theory of Rational Choice, Theory of Opportunity, and the Theory of White Collar Crime based on motives and manipulation attempts. Non-KKN Negligence, in the first phase, examines the individual level based on Social Control Theory. The second phase analyzes the failure of the supervisory system to function at the institutional level using the Theory of Sociological Institutionalism and the Theory of Rational Choice Institutionalism. The findings suggest that criminalizing culpa lata is a last resort. Therefore, the authors propose an integrated concept consisting of three components: the evaluation of AI-based judgments synergized with the merit system as a tool for detecting negligence, the special court as the final judicial forum, and the criminalization of culpa lata as a sanction mechanism. This concept aims to balance judicial independence with accountability through effective and organized mechanisms in order to restore public trust and realize the role of the Supreme Court in Indonesia.

Abstract

Perkembangan teknologi digital telah memunculkan berbagai bentuk kejahatan berbasis siber, salah satunya adalah romance scam, yaitu penipuan yang memanfaatkan relasi emosional korban untuk memperoleh keuntungan finansial. Kejahatan ini berkembang seiring meningkatnya penggunaan media sosial dan aplikasi kencan daring yang membuka peluang interaksi tanpa batas geografis. Penelitian ini bertujuan untuk menganalisis motif perilaku pelaku, mengidentifikasi faktor-faktor kriminogen yang mendorong terjadinya kejahatan romance scam, serta merumuskan solusi pencegahan dan penanggulangannya berdasarkan perspektif kriminologi. Penelitian ini merupakan penelitian hukum yuridis normatif dengan pendekatan konseptual. Sumber data diperoleh melalui studi kepustakaan terhadap buku, jurnal ilmiah nasional dan internasional, serta hasil penelitian terdahulu yang relevan. Teknik pengumpulan data dilakukan melalui studi dokumen dengan pencatatan sistematis, kemudian dianalisis secara kualitatif melalui tahapan identifikasi literatur, klasifikasi motif dan faktor kriminogen, analisis keterkaitan antarvariabel, serta sintesis untuk merumuskan solusi yang aplikatif. Hasil penelitian menunjukkan bahwa motif pelaku dipengaruhi oleh dorongan ekonomi, tekanan sosial, dan rasionalisasi tindakan, sedangkan faktor kriminogen terbentuk melalui proses pembelajaran sosial, lemahnya kontrol sosial, serta peluang kejahatan di ruang digital. Penelitian ini menegaskan bahwa romance scam merupakan kejahatan yang berkembang sistematis di era digital dan memerlukan strategi preventif berbasis literasi digital, penguatan regulasi, serta peningkatan kesadaran masyarakat.

Abstract

This article will examine circumstantial evidence in money laundering crimes and the expansion of circumstantial evidence in money laundering crimes from the original crime of corruption. The research method applies descriptive analytical research specifications and uses a normative legal research approach. The research data collection technique was obtained from literature and document studies. The data obtained was then analyzed qualitatively from a legal perspective, emphasizing legal analysis with formal thinking concepts and presented in the form of arguments. The results of the study show that circumstantial evidence in money laundering crimes can be obtained from evidence as referred to in Article 188 (2), namely witness testimony, letters, defendant testimony, and electronic evidence as referred to in Article 73 letter b of Law No. 8 of 2010 concerning the Prevention and Eradication of Money Laundering Crimes. The expansion of circumstantial evidence needs to be pursued by expanding the evidence that serves as preliminary evidence of suspicious financial transactions with electronic evidence in the form of derived evidence, which will be useful in determining legal steps in the form of investigations or in proving cases in court, and needs to be reinforced with statements from financial transaction analysis experts.

Abstract

The determination of suspects as part of a forced effort in Law Number 20 of 2025 demands stricter restrictions on the scope of investigators' assessments, especially after the expansion of the type of evidence and the absence of judicial control before the determination is made. This study aims to analyze the limits of police investigators' discretion in determining suspects, the implications of expanding evidence, and the adequacy of pretrial as a protection mechanism based on the principle of due process of law. The research uses normative legal methods that are descriptive-analytical and prescriptive, with legislative and conceptual approaches. Legal materials are collected through literature studies and document studies, then analyzed qualitatively. The results of the study show that the requirement of a minimum of two pieces of evidence is not enough to be assessed based on the number, but must include the validity of the acquisition, authenticity, reliability, relevance, suitability between evidence, and the relationship of evidence with the crime and the person determined. The discretion of the investigator is not a free authority, but is limited by legality, purpose of investigation, procedure, presumption of innocence, proportionality, reasonable, and effective supervision. Pretrial remains important as judicial control after the determination of the suspect, but the examination needs to include the validity and relevance of the evidence without entering into a misdemeanor. Abstract

Trading in influence is increasingly under public scrutiny, as legal cases emerge that are detrimental to the public, businesses, and the state. Trading in influence is often used by officials and/or their subordinates or colleagues to influence the policies or actions of fellow officials for their own benefit and/or the benefit of others. This trading in influence is also fraught with business collusion and bribery, involving the abuse of real or supposed influence. Provisions are needed that can cover not only civil servants or state administrators but also business actors, who are difficult to prosecute under the Corruption Law (UU TPK). This is because the scope of this offense is broader, encompassing unlawful acts, unfair business competition, and other legal aspects. Although this act is clearly detrimental, the perpetrators often escape the reach of the law due to laws and regulations that do not explicitly regulate and provide sanctions. Although Indonesia has ratified the UN Convention Against Corruption, Vienna, 2003, through Law No. 7 of 2006, Indonesian laws and regulations do not specifically regulate Trading in Influence. This study aims to examine the harmonization of Indonesian laws and regulations in relation to the UNCAC, with the specific goal of determining legal liability for trading in influence through a criminal law approach

Abstract

Artikel ini menganalisis tindak pidana peretasan kartu kredit sebagai salah satu bentuk kejahatan siber yang marak terjadi, dengan menyoroti modus pencurian identitas data kartu kredit, efektivitas penegakan hukum oleh Kepolisian Negara Republik Indonesia (Polri), serta strategi penanggulangannya. Melalui pendekatan yuridis normatif dan deskriptif-analitis, kajian ini menemukan bahwa pencurian identitas data kartu kredit umumnya dilakukan melalui carding dan phishing, termasuk penggunaan situs web palsu, praktik skimming, serta perolehan data secara melawan hukum melalui media elektronik yang merugikan pemilik kartu. Polri memiliki kewenangan dalam penyidikan, penangkapan, dan pemidanaan pelaku sesuai ketentuan hukum yang berlaku. Namun, efektivitas penegakan hukum masih bergantung pada kelancaran proses tersebut. Oleh karena itu, penguatan regulasi seperti Undang-Undang Informasi dan Transaksi Elektronik (UU ITE), peningkatan kolaborasi antara aparat penegak hukum, perbankan, dan perusahaan teknologi, serta kerja sama lintas sektor dan internasional diperlukan untuk meningkatkan pencegahan, deteksi, dan penindakan tindak pidana ini.
