Abstract

Pyramid schemes are strictly prohibited by Law No. 7 of 2014 on Commerce in Article 9, but the practice of this business scheme continues to grow. People are often fooled by lucrative offers. The offer is often packed in the form of fraud and undue influence. The weakness of the Civil Code as a legal umbrella guarding the process of investing agreement is alleged to be the factor of not offering the bidder to do this pyramid scheme marketing strategy. Only Article 1321 Civil Code can be used as a legal backlash against undue influence, while the legal aspects arising from business investment pyramid schemes are so complex. This study focuses on the study of the undetermined forms undertaken by offerors on offeree in pyramid scheme business investment practices, as well as reviewing legal aspects arising from abuse of circumstances, and reviewing the legal responsibilities of offerors in practice business investment pyramid scheme. Using the juridical-empirical approach method and the research specification is analytical descriptive, then analyzed by qualitative juridical, the research results show that, in practice pyramid scheme various forms of undue influence on offeree, partly because of economic condition, psychological condition, and livinglaw values, such as communal values ​​and mutual cooperation, and trust factors. Initially simple from abuse of circumstances when the bidding process, but raises multi-faceted law, covering aspects of civil law, aspects of criminal law, and economic laws. From multi aspects of the law that arise then lead to convergence of legal responsibility for the offeror. Keywords: Undue Influence, Pyramid Scheme.

Abstract

In Indonesia, various legislations have been enacted to protect women. In fact, the Convention on the Elimination of All Forms of Discrimination Against Women has been ratified through Act No. 7 Year 1984. But numbers of discrimination, domination, and violence against women is increasing. This is motivated finding of preliminary data at the penitentiary that women cases that affect women perpetrators of criminal acts predominantly sourced from domestic violence. This study uses normative juridical methods empirically supported, through a multidisciplinary approach is the approach of the legal aspects of civil and criminal law and procedural law. The data obtained and analyzed by juridical qualitatively. The results showed that, the model of conventional litigation, directs the entire process of the law to be passed by left entirely to legal counsel. Model of this litigation has not provided the knowledge, understanding and awareness of the law against female perpetrators (victims marginalized). Results of this study recommend a model of independent litigation. This model is expected to accommodate the litigation needs of female perpetrators of criminal acts, so that they can advocate for themselves in the face of the proceedings. In addition, the model is expected to have an independent advocate can be a new alternative in the judicial process, and can be used as a reason for consideration for renewal effort does justice process.Keywords: Empowerment; Women; Self Advocacy; RenewalDi Indonesia, berbagai peraturan perundang-undangan telah diberlakukan untuk melindungi kaum perempuan. Bahkan, telah meratifikasi Convention on The Elimination of  All Forms of Discrimination Against Women melalui Undang-Undang No. 7 Tahun 1984. Namun faktanya diskriminasi, dominasi, dan kekerasan terhadap perempuan semakin meningkat. Hal ini dilatarbelakangi ditemukannya data awal bahwa di lembaga pemasyarakatan perempuan kasus-kasus yang menimpa perempuan pelaku tindak pidana dominan bersumber dari KDRT. Penelitian ini menggunakan metode yuridis normatif dengan didukung metode yuridis empiris, melalui pendekatan multidisiplin yaitu pendekatan dari aspek hukum perdata dan hukum pidana serta hukum acara. Data yang diperoleh kemudian dianalisis secara yuridis kualitatif. Hasil penelitian menunjukan bahwa, model litigasi konvensional, mengarahkan pada seluruh proses hukum yang akan dilalui diserahkan seluruhnya kepada penasihat hukum. Model litigasi ini belum memberikan pengetahuan, pemahaman dan kesadaran hukum terhadap perempuan pelaku tindak pidana (korban termarginalkan). Hasil penelitian ini merekomendasikan perlunya model litigasi mandiri. Model ini diharapkan mampu mengakomodasi kebutuhan berlitigasi dari perempuan pelaku tindak pidana, sehingga dapat mengadvokasi dirinya sendiri pada saat menghadapi proses beracara. Selain itu, diharapkan model advokasi mandiri ini dapat dijadikan alternatif baru di dalam proses peradilan, dan dapat dijadikan alasan pertimbangan untuk dilakukannya upaya pembaharuan proses peradilan.Kata Kunci :   Pemberdayaan; Perempuan; Advokasi Mandiri; Pembaharuan

Abstract

Prepare leaders with integrity processed fostering of the family. Various methods are used to determine the state 's future leaders, both through the regeneration of the cadre, the appointment or election. Election is a means to process and determine who will lead and hold the mandate of the people they lead. Election is a process, but the nature of the leader determines to be seen from the quality of his personality. Communities are often faced with the dilemma of how good a leader ? Values of the Islamic leadership in the family will answer what and how a leader with high integrity. Therefore, the family is the smallest unit of a miniature community. Integration leader is a leader who has a commitment to his family. Pemilu merupakan sarana untuk mengolah dan menentukan siapa yang akan memimpin dan memegang amanah rakyat yang dipimpinnya. Pemilu merupakan proses, namun hakikat menentukan pemimpin harus dilihat dari  kualitas kepribadiannya. Masyarakat sering dihadapkan pada dilema sosok pemimpin bagaimanakah yang baik? Nilai-Nilai kepemimpinan Islam dalam berkeluarga akan menjawab apa dan bagaimana pemimpin yang memiliki integritas tinggi. Sebab, keluarga merupakan miniatur unit terkecil dari suatu komunitas. Pemimpin yang berintegrasi adalah pemimpin yang memiliki komitmen  terhadap keluarganya. Abstract

This study examines the application of the principle of decency in the insurance system. The research is descriptive-analytical, which describes the legal insurance system as an object regarding realizing consumer protection for the welfare of the people. The normative juridical approach using the theory of the welfare state, justice, and development law is used as a reference to examine the legal insurance system. The study results show that the application of the principle of propriety has only reached the level of legal substance, which is still chaos, while the other two elements, namely the legal structure and legal culture, are still far from the nature of the legal objectives. Therefore, the concept of the principle of propriety of Indonesian personality is proposed to actualize the legal values that live in society. Furthermore, insurance activities based on the principles of economic democracy are believed to foster public trust as social capital for the development of the insurance system.

Abstract

Due to the unlawful practice of pyramid scheme business, there has been noticeable damage on communal value and living law within the affected communities. This condition becomes the source of dispute and affects the loss of trust, harmony and the damage of social and communal order. The segregated litigation process, which is the most common solution; could not solve the complex nature of the dispute. Therefore, there should be a new comprehensive alternative to restore both financial loss and the damage within the affected communities. The research aims to study the use of communal and socio-cultural value in the settlement of Pyramid scheme dispute, which is not only vulnerable as the modus of the scam but also as the solution for the victims. The method used is juridical empiric with juridical normative approach. The research shows the analysis of legal framework to solve the conflict within the community caused by pyramid scheme progressively. The research indicates that penal mediation could be the solution of the problem. The research outcomes could contribute to the alternative to settle the dispute, also to restore the social order and to restore the loss accordingly.

Abstract

This study focuses on the study of media development against misinformation and contains the best elements. This situation has been exploited by the actors / activities that conduct business pyramid scheme invetation. The social growth media plays an important role in the development of the pyramid in which the givers / promoters in attracting the public interest, carried out in a pattern that is shared with the public figures using the ambassador's brand, the notes boost offerees to join other aspects such as legality and prospects social media investment, social media, culture, culture, culture, culture, culture, socialization, promotion, promotion, promotion, promotion, promotion. This study focuses on the study of violations of law against the principle of utmost good faith in the fraudulent practices of pyramid schemes used by the offeror when conducting recruitment. This fraudulent practice in its development uses social media as a misleading means of conveying information. To appeal to a widely used pattern of inviting offeree by accentuating the public figure being brand ambassador, thus boosting offeree trust to join. The objective of the study was to criticize mediamorphosis in eradicating fraudulent pyramid schemes in business investment. This research uses empirical juridical method with normative juridical approach. Observation activities support the search for legal literature. The results show that, (1) misleading information is a violation of the principle of utmost good faiht used when the promoter offers and recruits the offeree into the fraudulent practices of the pyramid scheme business; (2) social media into commodities and promotional support instruments for offerors in the fraudulent practices of pyramid scheme business investments; offeree joins a prominent pyramid promotion scheme without considering the legality and prospects of the investment.

Abstract

Mekarsari Village is one of ten tourist villages in Bandung Regency, which has the potential to be developed into an eco-tourism village. However, this potential has not been maximized because village government governance to support the development of village potential is still inadequate. One of the crucial things in village governance is the legal umbrella in the form of village regulations that are aspirational and responsive to accommodate the interests of the community. Against the urgency of forming village regulations, it is necessary to conduct training activities on the preparation of village regulations that involve community participation. The activity aims to increase the capacity of village officials, village consultative bodies (BPD), and the community to draft village regulations. Based on the observations, the following problems can be identified; (1) The draft village regulations have not been stipulated in the Mekarsari Village Government Work Plan (RKP); (2) the capacity of relevant individuals in mastering the systematic preparation of the village regulations has not been maximized. The method used is Participatory Action Research (PAR) through three stages of activities, namely planning, implementation, and evaluation activities. The whole activity ran smoothly, and the target audience enthusiastically participated in the activity, increasing the target's ability to make and draft village regulations.

Abstract

The high maternal mortality rate (MMR) is one of the indicators to determine the health status of women. In addition, MMR is one of the main targets that have been determined by WHO as an indicator of a country's health. The fulfillment of the right to women's reproductive health can be realized in the Indonesian legal state system, through legal marriage (Article 28B paragraph (1) of the 1945 Constitution). Efforts are being made to fulfill it, namely by improving maternal health, providing health service facilities as needed, low reproductive health, especially for women, will have an impact on the babies they are born. The research was done using normative juridic method. Based on the findings gathered from secondary research result and supported by primary result, it shows that reproductive health is a basic right of every person, so guaranteeing the availability of health facilities and infrastructure is a medium to guarantee and protect so that people can enjoy these basic rights. The form of this research is descriptive analytical and analyzed using normative juridical methods. Reproductive health aims to ensure the fulfillment of the reproductive rights of everyone, including women, through quality, safe, and accountable health services, as well as ensuring maternal health in reproductive age so that they are able to give birth to healthy and quality generations and reduce maternal mortality.

Abstract

The trade war between the United States and China, driven by protectionist policies, has significantly disrupted global trade flows. For Indonesia, the conflict impacts exports, imports, and investment, while raising three critical: protecting domestic industries, maintaining neutral trade relations, and adhering to the principles of the World Trade Organization (WTO). Indonesia must formulate a balanced legal and trade strategy that upholds both national interests and international obligations. This study analyzes Indonesia’s legal-political response to China’s trade war retaliation against the United States, emphasizing the application of protectionist principles within the WTO framework. Employing normative legal research with statutory and conceptual approaches, the study draws on WTO agreements, national trade laws, and relevant case studies. The research findings indicate that Indonesia is able to maintain economic stability and promote peaceful relations with both conflicting countries through trade cooperation, while remaining compliant with the principles of the World Trade Organization (WTO). The "free and active" foreign policy is implemented as a form of “strategic hedging” or “pragmatic engagement” in Indonesia’s international trade policy. This concept serves to mitigate the risks associated with global trade war retaliation. Such a trade policy is in line with Indonesia’s foreign policy as mandated by the Constitution.
