Abstract

The handling of mass clashes due to land conflicts carried out by the North Sumatra Regional Police Mobile Brigade Unit will not be effective without the support of the community. One effective step to anticipate mass riots arising from land problems as high-level Kamtibmas disturbance is to implement the polemical synergy of the Kamandahan Patrol conducted by the North Sumatra Police Mobile Brigade first applying the mapping of land conflict-prone areas as conflicts arising from natural resource conflicts that have the potential to cause mass riots. This research uses normative legal research, descriptive analysis. The handling of mass clashes due to land conflicts carried out by the North Sumatra Regional Police Mobile Brigade Unit will not be effective without the support of the community. The obstacle of the North Sumatra Regional Police Mobile Brigade in overcoming mass clashes due to land conflicts is the limited number of personnel in quantity and quality that has not been running optimally so that it has an impact on community assessments in handling mass riots due to horizontal conflicts arising from land issues including Knowledge, Skill, Attitude . Efforts made by the North Sumatra Regional Police Mobile Brigade were to apply the Kamandahan Patrol managerial method in anticipating mass clashes caused by land conflicts which included planning, organizing, implementing, monitoring and controlling were considered to be less than optimal.

Abstract

The mere violations committed by minors deserve special and serious attention from the government. In this case, it is necessary to have a process of special investigation of the perpetrators of minors and the responsibility of the perpetrators to adjust to Law No.23 of 2002 concerning Child Protection Jo Law No. 35 of 2014 in the jurisdiction of the Traffic Police Traffic Unit of Langkat. The research method in this paper used a normative research method which is descriptive in nature withe a legal, conceptual and case approach and secendary data sources. The result of this writing show that in the process of investigating children in the form of arrest, detention and impriosonment can be done as a last resort because there are differences in the criminal accountability process with adult offenders. The effort made by the police is to receive reports from victims and implement restorative justice by pursuing a system of disruption

Abstract

The rise of narcotics circulation in recent years, has caused many losses not only economic losses but the loss of a generation of people who have lost common sense to become victims of life, even though in a very productive age. Based on this condition, the legal policy taken by the government by making maximum legal sanctions for drug dealers and drug dealers with a maximum sentence of life or death sentence. This writing aims to examine the position and function of scientific testimony on the death penalty for narcotics offenders and the perspective of North Sumatra BNN and North Sumatra Regional Police on scientific testimony on the death penalty for narcotics offenders. The results of this study indicate that the use of scientific testimony in criminal cases will scientifically reveal narcotics criminal cases, so that it can be seen what articles can be applied in narcotics crime cases, that the position and function of scientific testimony against capital punishment for narcotic offenders is as a tool or means to supplement other evidence whether a suspect is indeed eligible for a death sentence or not and also whether or not a recommendation from the results of scientific testimony can change the law enforcement authorities not to impose the death penalty for narcotics offenders depending, whether the investigator or the investigator is willing to use information from the letter of the results.

Abstract

Nowadays public service by the state apparatus has become a strategic issue because the level of quality of public service performance will determine the image of the state apparatus itself. The large number of complaints from the public as recipients of services to government agencies, illustrates how poor service quality has been in the past. Like public complaints that are often received due to slow service times and unclear service procedures and costs in resolving cases of traffic violations. On-line traffic violations are intended to overcome various problems related to the implementation of speeding tickets for traffic violations. The research method used in this thesis is analytical descriptive with normative legal research. Data collection techniques in this study use library research techniques as an instrument of document studies. In addition, interviews with informants are also carried out. Data analysis uses analysis qualitatively. The implementation of the synergy of online ticketing public services for the handling of traffic violations starting from the police to the court session stage has implemented the settlement of traffic violations through the sophistication of a computerized system that is connected to the entire BRI ATM network so that the public does not have to go to the prosecutor's office or the court. to solve the problem and without having to attend a court hearing by conducting an electronic payment system or e-commerce.

Abstract

Traffic accidents are events that are not intended to be expected and are expected to be used in the way of law and forms of legal action and human rights. Based on the results of the study, it was found that in the determination of the provisions and the portion of the traffic accident accidents which resulted in the loss of others most of the traffic accidents caused the loss of someone involving someone as the culprit, the judge was decided through restorative justice through the university. Abstract

Cooperative is a business entity established by and consisting of individuals. The purpose of establishing a Cooperative is as a joint effort based on the principles of kinship and democracy, which in turn requires a strong legal basis relating to the deed of establishment of a Cooperative using an authentic deed. Considering the need for a Notary in the growth and development of Cooperatives as a legal entity, especially in the process of its establishment and amendments to its articles of association, then based on the State Decree of Cooperatives and Small and Medium Enterprises Number: 98/KEP/M.UKM/IX/2004, Notaries are given the authority to make Cooperative deed. Notary authority is very important, namely as a public official authorized to make authentic deeds and other authorities as referred to in Law Number 30 of 2004 concerning Notary Positions. The involvement of a notary is not only to assist the process of making cooperative deeds, but also to care about the prospects for the development of cooperatives that are clients and are willing to provide legal guidance and consultation related to the making of cooperative deeds. The goal is that the cooperative movement and the cooperative community understand more and are not unfamiliar with matters related to the rule of law

Abstract

One problem that gets the most attention is the issue of fulfilling workers' rights. The emergence of disputes between workers and employers or employers is due to the existence of rights between workers and employers that are not carried out by each party. Abstract

The corona pandemic as a delay in credit payments, the determination of the non-natural disaster Covid-19 as a national disaster through Presidential Decree 12/2020 does not automatically become the basis for parties in commercial agreements to declare themselves in a state of force majeure. In-depth study of case by case analysis by paying attention to the clauses in an agreement becomes the benchmark for determining the state of force majeure. As a result of parties who did not fulfill their achievements in the credit agreement during the Covid-19 period. The suspension of liability occurs when a force majeure event is temporary. When the condition of the obstacle has recovered, for example the export ban is lifted again, then the obligation of the seller returns to recover to hand over the exported goods. Agreement resulting from the corona 19 pandemic in the perspective of presidential decree no. 12 of 2020 concerning the determination of non-natural disasters (Wonosari State Court Decision Study Number 3 / Pdt.G.S / 2020) in agreements usually also regulates the consequences of a force majeure event, for example whether to postpone an agreement or can be used as a condition for canceling an agreement

Abstract

Perseroan Terbatas merupakan suatu badan hukum yang saat ini banyak diminati oleh masyarakat. Hal ini karena tanggung jawab yang harus dibebankan kepada perseroan tersebut hanya sebatas modal yang ada pada perseroan. Pengalihan saham perseroan terbatas kepada pihak ketiga melalui beberapa tahap yang harus dilalui salah satunya ialah dilakukannya dengan akta Pemindahan Hak. Undang-undang Nomor 1 Tahun 1974 tentang Perkawinan menyatakan bahwa perkawinan ialah ikatan lahir dan bathin antara seorang pria dan seorang wanita dengan membentuk keluarga yang bahagia. Menjalani kehidupan rumah tangga tidak terlepas dari adanya perolehan harta yang menjadi harta bersama. Hasil pembahasan bahwa jual-beli atas saham perseroan terbatas diatur dalam Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas juga berkaitan dengan Anggaran dasar dari Perseroan Terbatas. Terhadap pengalihan saham dari Perseroan Terbatas yang merupakan harta bersama dari pasangan suami isteri jika dialihkan maka harus mendapat persetujuan dari pasangan. Namun ketika hal tersebut tidak dilakukan akan terjadi konflik hukum,  sebagaimana  Pasal 31 Undang-undang Nomor 1 Tahun 1974 tentang perkawinan mengatur bahwa hak dan kedudukan isteri adalah seimbang dengan hak dan kedudukan suami dalam kehidupan rumah tangga dan pergaulan hidup bersama dalam masyarakat sehingga harta yang diperoleh selama perkawinan merupakan harta bersama selama tidak dibuatkan perjanjian perkawinan yang mengaturnya. Berdasarkan atas fakta-fakta hukum yang ada dan juga berdasarkan atas ketentuan pasal 1338 KUH Perdata dan pasal 1320 KUH Perdata. Dan analisis mengenai putusan Mahkamah Agung RI No. 3104 K/Pdt/2016 menolak dan menghukum pemohon karena perjanjian Agremeent yang dimaksud dalam gugatan merupakan perjanjian awal dan bukan perjanjian pelaksanaan

Abstract

Mengantisipasi dan memberantas tindakan pelaku yang demikian, maka selain sanksi tindak pidana di bidang perpajakan, sebagaimana diatur dalam UU No.28 Tahun 2007, juga diatur penegasan sanksi tersebut dalam UU PPTPPU dan menempatkan tindak pidana perpajakan dengan memasukkannya ke dalam kelompok kejahatan (predicate crime) 4 dalam Pasal 2 ayat (1) UU PPTPPU. Hal ini dimaksud bahwa apabilahasil dari tindak pidana di bidang perpajakan tersebut kemudian oleh pelaku melakukan tindak pidana pencucian uang, maka dapat dijerat berdasarkan UU PPTPPU. Kualifikasi tindak pidana perpajakan meliputi penggelapan pajak melalui pemalsuan dibidang perpajakan terjadi baik dilakukan oleh orang pribadi maupun orang-orang yang bekerja di badan hukum atas kerjasama antara wajib pajak dan petugas pajak dengan tujuan untuk memperkaya diri. Kebijakan criminal pencucian uang dalam penanggulangan tindak pidana perpajakan terdapat korelasi yang erat antara kejahatan asal, misalnya tindak pidana di bidang perpajakan sebagai predicate crime maka tindak pidana pencucian uang adalah sebagai derivative atau turunannya. Hambatan dan kendala dalam rangka penanggulangan tindak pidana perpajakan melalui rezim anti money laundering yakni kelemahan pada sistem pembuktian yang dianut dalam sistem hukum pidana Indonesia
