Abstract

Penelitian ini mengkaji masalah tindak tutur komisif pada CALEG DPRD tahun 2019 di wilayah Surakarta. Penelitian ini bertujuan untuk: (1) mendeskripsikan bentuk tindak tutur komisif pada baliho CALEG DPRD tahun 2019 di wilayah Surakarta, (2) mendeskripsikan maksud yang terkandung dalam tindak tutur komisif pada baliho CALEG DPRD tahun 2019 di wilayah Surakarta. Tindak tutur merupakan aspek penting dalam studi pragmatik dan sosiopragmatik. Tindak tutur bermuatan menindakkan sesuatu dan atau tidak menindakkan sesuatu salah satunya sangat bergantung pada bentuk dan strategi tindak tutur. Tindak tutur komisif merupakan tindak tutur yang digunakan untuk meyakinkan tuturan penutur kepada mitra tutur. Jenis penelitian ini adalah deskriptif kualitatif. Objek penelitian ini adalah dasar kajian pada penelitian ini. Teknik pengumpulan data dalam penelitian ini adalah teknik simak dan catat. Keabsahan data penelitian ini adalah triangulasi teori. Teknik analisis data penelitian ini adalah metode analisis isi.

Abstract

ABSTRACT Purpose of the study: This research aimed to analyze the judicial rationing behind Decision No. 262/Pid.B/2018/Pn.Skt. According to Article 170 of the Indonesian Criminal Code in the legal event of a mass violence crime that occurred in Surakarta City.  Methodology: This was normative legal research that used the case approach. It emphasized the legal consideration of judges in deciding and giving a verdict upon a case. Results: This research analyzed Decision No. 262/Pid.B/2018/Pn.Skt. Judges considered that the actions committed by the group of perpetrators originated from the aggressive nature of humans due to their animal power that can cause law-violating actions. This aggressive human nature in a group caused a sense of affection and bond creates similarities in desires, goals, and ideas. It resulted in a sense of solidarity in the group according to the ashobiyah terminology. Applications of this study: to provide knowledge on: (1) the judicial analysis based on the factors that influence the occurrence of mass violence; and (2) the judicial consideration in deciding upon a case of mass violence in Surakarta City based on the judicial rationing in Decision No. 262/Pid.B/2018/PN.Skt. Novelty/Originality of this study: This paper provided new information on the action of mass violence on Decision No. 262/Pid.B/2018/PN.Skt correlated with Ibnu Khaldun’s ashobiyah terminology. Keywords: judicial reasoning, mass violence, aggressivity, ashobiyah    ABSTRAK  Tujuan: Penelitian ini bertujuan untuk menganalisis pertimbangan yuridis di balik Putusan Nomor 262/Pid.B/2018/Pn.Skt. Menurut Pasal 170 KUHP dalam peristiwa hukum tersebut, tindak pidana kekerasan massal terjadi di Kota Surakarta.  Metodologi: Penelitian ini merupakan penelitian hukum normatif yang menggunakan pendekatan kasus. Ditekankan pada pertimbangan hukum hakim dalam memutus dan memberikan putusan atas suatu perkara.  Hasil: Penelitian ini menganalisis Keputusan No. 262/Pid.B/2018/Pn.Skt. Hakim menilai bahwa perbuatan yang dilakukan oleh kelompok pelaku tersebut berawal dari sifat agresif manusia karena animal power yang dapat menimbulkan perbuatan melanggar hukum. Sifat agresif manusia dalam suatu kelompok menimbulkan rasa kasih sayang dan ikatan yang menimbulkan kesamaan keinginan, tujuan, dan gagasan. Hal itu mengakibatkan rasa solidaritas dalam kelompok menurut terminologi ashobiyah.  Aplikasi penelitian ini: memberikan pengetahuan tentang (1)analisis yuridis berdasarkan faktor-faktor yang mempengaruhi terjadinya kekerasan massal, (2)pertimbangan yuridis dalam memutus perkara kekerasan massal di Kota Surakarta berdasarkan yuridis rationing dalam Putusan No. 262/Pid.B/2018/PN.Skt.  Kebaruan/Orisinalitas: Tulisan ini memberikan informasi baru tentang aksi kekerasan massal pada Putusan No. 262/Pid.B/2018/PN.Skt yang berkorelasi dengan terminologi ashobiyah Ibnu Khaldun.  Kata kunci: penalaran yudisial, kekerasan massal, agresivitas, ashobiyah

Abstract

Indonesia, as a nation governed by law, as stipulated in the 1945 Constitution, makes law the fundamental regulatory framework for all aspects of life, including employment relationships. In its implementation, protecting trade secrets is crucial due to the increasing risk of leaking information of significant economic value. The legal instruments used are:Non-Disclosure Agreement (NDA), although until now there are no specific provisions in the law. This study aims to analyze whether the NDA is valid and legally binding in employment relations, referring to Article 1320 of the Civil Code. This study also examines the impact of violations of the agreement on breach of contract lawsuits, using a case study that occurred at PT Foom Lab Global. The method in this study uses a juridical-normative approach and focuses on the provisions of the law and analyzes the case that occurred. The legal materials include primary legal materials in the form of the Civil Code, Law 30/2000 concerning Trade Secrets, and court decisions, then secondary legal materials in the form of scientific readings. The study proves that the NDA is legally valid and binding if it is in line with the provisions of a valid agreement. In the case of PT Foom Lab Global against Sulfa Sopiani, the Defendant was proven to have committed a breach of contract in the form of violations of resignation procedures, violations of the non-competence clause, and potential violations of information confidentiality. The Defendant was sentenced to pay compensation of 800 million. This ruling states that NDAs can be legally enforced as long as they are drafted correctly and in a balanced manner. The study concludes that NDAs are an effective legal tool for protecting trade secrets, but their implementation must adhere to the principles of fairness and balance in employment relationships to avoid harming workers' rights.

Abstract

This study aims to analyze the level of public legal compliance in the process of obtaining a Driver's License (SIM) at the Sragen Police Resort, Central Java. The findings indicate that the level of compliance is still relatively low, reflected in 12,456 cases of drivers without a driver's license in 2025, or approximately 28% of the total results of raids. This condition is influenced by procedures that are considered complicated, the practice of extortion ranging from Rp50,000-Rp200,000, and a lack of service transparency, which indirectly contribute to the occurrence of traffic accidents. This study uses a descriptive qualitative approach with a legal sociology perspective through a case study at the Sragen Police Resort Satpas from February to March 2026. Primary data were obtained through interviews, questionnaires distributed using purposive and total sampling techniques, and field observations for five days. Secondary data are sourced from laws and regulations and related documents. Data analysis was carried out using triangulation techniques using the theoretical framework of Soerjono Soekanto, Lawrence Friedman's legal rationality, Max Weber's legitimacy, and Everett M. Rogers' diffusion of innovation. In contrast to previous research which tends to be normative or have a general focus, this research emphasizes an empirical approach that is specific to the Sragen region and integrates the SERVQUAL concept to identify gaps between law in books and law in action.The research findings indicate that legal substance, law enforcement officers, and the public are still influenced by the practice of extortion, but this can be improved through service innovations such as the Sidora-Polisi Menyapa program, which can reduce service time by up to 60 minutes. This study recommends the need for reform through service digitization, strengthening officer integrity oversight, and increasing public outreach to achieve transparent and accountable public services and reduce traffic accidents.

Abstract

Legal language serves as a medium of communication within the legal sphere, utilized by practitioners and legal experts in contexts such as regulations, agreements, official correspondence, and court rulings. For the general public, legal language enables a clear and precise understanding of legal messages and norms—thereby clarifying rights, obligations, and applicable rules—which supports the maintenance of order and legal certainty. This study aims to analyze the text of captions associated with the dissemination of pornographic content on social media—as found in a specific court ruling—through the lens of forensic linguistics. The research employs a normative-juridical approach and qualitative descriptive analysis, utilizing Court Ruling Number 166/Pid.B/2018/PN.Dpk. The data consists of the caption text from the pornographic content posts cited in the ruling, which are analyzed from a forensic linguistic perspective. Data analysis was conducted using an interactive analysis model comprising data reduction, data presentation, and conclusion drawing. The analysis is grounded in criminal law elements and linguistic theory within the framework of forensic linguistics. The study's findings indicate that: (1) the caption text accompanying the pornographic content on social media is shown to satisfy the elements of a criminal offense as stipulated in Law Number 44 of 2008 concerning Pornography; and (2) analysis of the caption text from a forensic linguistic perspective allows for the identification of implicit meanings, thereby substantiating the legal violation—specifically, the fulfillment of criminal elements regarding the dissemination of pornographic content on social media.
