Abstract

The development of ownership of land rights in Indonesia develops in line with the developments of the State of Indonesia itself. In this case includes four periods that each period has a specificity related to the political history of the nation. The period is the period of the Kingdom period, the period of the nation's occupation period foreigners namely the Netherlands and Japan, the period of Independence, and the period after the release of Law No. 5/1960 (Basic Agrarian Law). With the enactment of UUPA (National Agrarian Law), the ownership of land rights in Indonesia only differentiates ownership of land rights for Indonesian citizens and for foreign nationals by recognizing the rights of individual land that is Property rights, Building Use Rights, Usage Rights, use rights and the right to lease and title to communal land that is ulayat right (inherited from customary law).

Abstract

The regulation of land procurement for development in the public interest has established since the Dutch colonial administration. Its laws and regulationsundergo many changes based on the government political laws in the land sector. Law Number2 of 2012 on land procurement for development in the public interest has accommodated various public interests among others included several principles of public interest objectives to minimize any conflicts which caused by the decision to take citizens' rights ofland for public use. Other thingswhichregulated are the Implementation of Land Procurement by Land Agency (BPN), Determination of Compensation is not based on the Tax Object Sales Value (NJOP), but more emphasis on the agreement of the parties, namely the government or the agency which require land with the right to the land.

Abstract

The enactment of Law No. 7 of 1994 on Ratification of Agreement Establishing of The World Trade Organization (Agreement of Establishing the World Trade Organization) brings the consequence that all provisions stipulated in the WTO must be complied with and implemented by Indonesia. In the WTO, GATT and TRIPS intellectual property rights protection is an important factor, and one of them is about Trade Secret. Setting these trade secrets contained in Law No. 30 year 2000 on Trade Secrets. This trade secret involves any information that must be kept from general population and have high economic value. In the practice of law, trade secret case occured in the case of Cohen vs. Lindenbaum about bribery to obtain information.

Abstract

The regulation of land ownership had already existed and stipulated in the UUPA. Article 42 of UUPA regulate the land ownership stipulation for foreigners, i.e. foreigners can only have use rights and leasehold. Government Regulation No. 41 of 1996 stipulates that the use rights for foreigners may occur on State Land, Properties Land and land management rights. The regulation of land rights for foreigners in Indonesia stipulated in Government Regulation No.41 of 1996 on Live Home or Residential Ownership by Foreigners domiciled in Indonesia. Law No. 1 of 2011 on Housing and Settlement Zone, which in Article 52 stipulated that foreigners could inhabit or occupy the home by rights of leases or rights of use. Government Regulation No. 41 of 1996 intended to provide the possibility of legal certainty for foreigners to have a house or dwelling which is located in Indonesia, however, the implementation has not been able to provide a clear legal for foreign citizen in related with property investment in Indonesia, as well as the emergence of smuggling law of land by foreigners which cannot be handled due to the lack of oversight and follow-up sanctions.

Abstract

Agricultural Land is a land that is intended or suitable for farming land to produce agricultural or livestock. The history of regulations on the limitation of ownership of agricultural land rights includes 2 periods, namely the limitation of ownership of land rightsduring the colonial period and the period after independence. The political and legal factors of the government greatly influence the operation of law in society, including in the implementation of land reform, especially the ownership of agricultural land rights,including restrictions on ownership of agricultural land rights. The politics of law applied in a government affects the implementation and enforcement of laws and regulations, changes in government that have occurred in Indonesia from the days of President Soekarno, President Soeharto, and Susilo Bambang Yudhoyono to President Joko Widodo affect the implementation of restrictions on ownership of agricultural land rights. The politics of land law are related to limiting ownership of rights to agriculture. It is hoped that the government will take sides by regulating the focus of ownership of agricultural land rights for the benefit of all Indonesian people, especially for farmers to own agricultural land. Ownership and control of agricultural land are not owned and controlled by certain groups or individuals.

Abstract

Pendaftaran tanah sangat diperlukan bagi pemilik hak atas tanah untuk meberikan kepastian hukum dan perlindungan hokum. Sistem Publikasi Pendaftaran tanah di Indonesia berdasarkan PP No 10 tahun 1961 juncto PP No 24 tahun 1997 mengarah pada Sistem Publikasi pendaftaran tanah Negative bertendens Positif. Lembaga Rechtsverwerking yang tercantum dalam pasal 32 ayat (2) 1997 dimaksudkan untuk menguatkan sistem negative. Daluarsa 5 (lima) tahun untuk mengajukan gugatan dalam lembaga rechtsverwerking tidak mutlak. Itikad baik dalam memperoleh hak milik atas tanah menjadi prinsip pertimbangan Hakim dalam membatalkan sertifikat hak atas tanah.

Abstract

Tanah merupakan satu hal terpenting yang perlu dimiliki oleh masyarakat Indonesia (manusia) untukmemenuhi salah satu kebutuhan dan keberlangsungan hidupnya, baik itu statusnya sebagai hak milik, hakpakai, hak sewa, dan hak-hak lainnya yang telah diatur oleh peraturan perundang-undangan. RumusanMasalahnya adalah: Apa latar belakang pelarangan pemberian hak milik atas tanah kepada warga negaraIndonesia suku Tionghoa di Daerah Istimewa Yogyakarta?; Mengapa pelarangan pemberianhak milik atastanah kepada warga negara Indonesia suku Tionghoa masih tetap diberlakukan di Daerah IstimewaYogyakarta? Penelitian ini menggunakan pendekatan yuridis normatif (normative legal research) dandidukung menggunakan penelitian yuridis empiris (emperical legal research). Kesimpulannya adalah:Kondisi ini di latar belakang sejarah masa lampau, zaman dulu menjadi pilihan kebijakan kratonYogyakarta yang dikeluarkan melalu Instruksi Wagub DIY 1975 untuk melindungi tanah orang asliYogyakarta di DIY. Awalnya, dulu orang-orang WNI Keturunan Tionghoa mempunyai kekuatan ekonomiyang lebih bagus dibandingkan orang asli DIY. Sehingga Instruksi Wagub DIY 1975 hadir untukmelindungi hak-hak masyarakat DIY. Alasannya karena semata-mata menghormati kearifan lokal yanghidup dan mengakar di DIY. Selain itu, Adanya Putusan Pengadilan Negeri Yogyakarta Nomor132/Pdt.G/2017/PN.YK, Putusan Pengadilan Tinggi Yogyakarta No.51/PDT/2018/PT.YYK, dan PutusanMA No. 565K/PDT/2019 menjadi alasan semakin memantapkan keyakinan Pemda DIY untukmempertahankan keberlakuan Instruksi Wagub 1975, sehingga Gubernur Daerah Istimewa Yogyakartamenyurati Menteri Agraria dan Tata Ruang RI, dan Kepala Kantor Wilayah Badan Pertanahan NasionatDaerah Istimewa Yogyakarta dengan surat Nomor 593/02194 tertanggal 3 Agustus 2020, PerihalPelaksaanaan Putusan Mahkamah Agung Republik Indonesia Nomor 565 K/PDT/2019. Seiring berjalannyawaktu, ada kemungkinan juga Instruksi ini akan direvisi.

Abstract

Kenyataan di lapangan menunjukkan masih adanya peralihan hak atas tanah yang dilakukan olehseorang wali tanpa ada penetapan dari pengadilan negeri setempat terlebih dahulu. Permasalahan dalampenelitian ini adalah: (1) Bagaimana peralihan hak atas tanah oleh anak di bawah umur yang dilakukantanpa ada penetapan perwalian dari Pengadilan Negeri? (2) Apa akibat hukum jika peralihan hak atas tanahanak di bawah umur dilakukan tanpa ada penetapan perwalian dari Pengadilan Negeri?Pendekatan yang dipergunakan dalam penelitian ini adalah yuridis normatif (normativelegal research) danbersifat deskriptif analitis. Jenis dan sumber data yang dipergunakan dalam penelitian ini adalah datasekunder yang merupakan data utama dan data primer yang merupakan data pendukung. Teknikpengumpulan data menggunakan Studi Kepustakaan. Analisis data yang digunakan adalah secara kualitatifdalam bentuk deduktif.Hasil Penelitian,peralihan hak atas tanah oleh anak di bawah umur harus memenuhi syarat, yaitu Syaratmateriil dan syarat formil.Peralihan hak atas tanah oleh anak di bawah umur yang dilakukan tanpa adapenetapan perwalian dari Pengadilan Negeri adalah cacat hukum dan batal demi hukum. Pihak keluargaanak yang masih di bawah umur dapat mengajukan tuntutan pembatalan peralihan hak atas tanah sematamata atas dasar kebelumdewasaan anak yang masih di bawah umur.Saran yang bisa diberikan yaitu perlu dibuat peraturan yang secara tegas mewajibkan seorang wali untukmengajukan permohonan penetapan perwalian jika ingin mengalihkan hak atas tanah milik anak di bawahumur dan perlu penegakan sanksi disiplin oleh Pemerintah kepada PPAT yang tidak mengindahkan syaratpenyertaan penetapan perwalian dari pengadilan karena ketidakcermatan dalam membuat akta jual beliyang dapat merugikan kepentingan hukum anak di bawah umur.

Abstract

Land as a source of human life, has economic value, apart from being a means of fulfilling housing as well as a source of life. Legal certainty for owners of land rights has been regulated for sure, but land can be lost or destroyed through natural factors and government regulations. The provisions for destroyed land have been regulated in PP 18 of 2021 and Ministerial Regulation of ATR/BPN NO 17/2021. The determination of destroyed land needs to be more careful, especially concerning the procurement of land rights for the public interest, if it conflicts with the rights of the community as a source of livelihood.
