Abstract

The basic concept of the insurance is because people need protection against any incident that occurs in the community such as illness and natural disasters. The article 14 In Law No. 2 of 1992 on  Insurance, that social insurance is a type of insurance to the implemented by the government for public welfare.  The current population is Moslem Indonesia reached 80%, therefore, the Indonesian Muslim community needs the systema syariah  social insurance.   The system of syariah social insurance where there are 2 (two) products, where there are participants and savings accounts tabarru’ and as managers by the BUMN (state corporation) in law No. 2 of 1992 on Insurance.DOI: 10.15408/ajis.v15i1.2854

Abstract

The Regional Representative Council has 3 powers as regulated in Articles 22D, 23E and 23F of the 1945 Constitution of the Republic of Indonesia, namely the powers of Legislation, Consideration and Supervision. The authority of the Regional Representative Council is expanded and added in Law No. 2 of 2018 concerning the People's Consultative Assembly, the People's Representative Council, the Regional Representative Council, and the Regional People's Representative Council, namely in Article 249 paragraph (1) letter j related to the Monitoring and evaluation of the Draft Regional Regulations and Regional Regulations. Normative juridical research method with a statutory approach. The purpose of this research is to find out and analyze constitutionally and legal problems that arise regarding the new authority of the Regional Representative Council. Based on the 1945 Constitution of the Republic of Indonesia, the new authority of the Regional Representatives Council is in the opposite direction because it is not included in the meaning of the 3 powers of the Regional Representatives Council which is referred to as the 1945 Constitution of the Republic of Indonesia. Legal problems that arise over the authority of the House of Representatives The area is an indication of rivalry between institutions, namely the Ministry of Home Affairs, the Governor, the Supreme Court and the Regional Representatives Council itself, this can be seen juridically, namely in the 1945 Constitution of the Republic of Indonesia, Law No. 23 of 2014 concerning Regional Government, Constitutional Court Decision No.137/PUU -XIII/2015 and No. 56/PUU-XIV/2016.Keywords: Constitutional, The Regional Representative Council, Authority, Monitoring and Evaluation of Draft Regional Regulations and Regional Regulations

Abstract

The aim of this study was to figure out how the Village Information System in Serang Regency was implemented and developed. There are 326 villages in Serang Regency, all of which have access to the Village Information System. The issue is that village data is slow to update, resulting in recipients of village funds not being on target or having to double-check their information. This study used the legal empirical method with normative data analysis. The data used are primary data (Interviews and Observations) and secondary data (Legislation, Books, Journals, and relevant materials sourced from the Internet) which are then processed and narrated using words with scientific logic. According to the findings of this study, villages in Serang Regency still do not take advantage of existing information systems. The Regional Government of Serang Regency must issue regional legal regulations to define the implementation and development of the Village Information System. Furthermore, each village must prepare human resources so that the Village Information System can be implemented quantitatively and managed effectively

Abstract

The law, as an important part of the society, regulates all legal aspects, which in it includes the aspect of taxation law. It must be oriented to justice in the society, therefore, the values must represent the interests of the society.  Hotels are facilities which provide services in the form of lodging/resting area, including the other services which are related, with some charge. This also includes motels, guesthouses, tourism huts, tourism guesthouses, tourism boarding houses, inns, etc., also boarding houses with more than ten rooms. Tangerang Regency is one of the areas which has a high potential in the hospitality sector to increase the Regional Original Revenue (Pendapatan Asli Daerah/PAD). Based on Tangerang Regency’s Regional Regulations No. 10 year 2010 regarding Regional Tax, the regional government of Tangerang Regency withdraws the tax of that region, in which in it includes hotel tax. The hotel tax provisions in Tangerang regency are based on that regulation, where tax are withdrawn from the hotels for the services they provide.

Abstract

AbstrakRelasi utama dalam tektual dan kontekstual Pancasila selalu berkorelasi dengan hakikat kehidupan berbangsa dan kehidupan bernegara. Pluralitas, multikulturalias dalam aktualisasi Pancasila dalam sila-sila yang termaktub dalam batang tubuh Pancasila menjadi hakikat anatomi dari paradigma kehidupan bangsa Indonesia. reflekesi dan realitas Pancasila harus mendorong perubahan fundamental kebangsaan, kerusakan dan kehancuran akibat dari Tindakan-tindakan sistemik yang dilakukan oleh kelompok yang tidak bertanggungjawab terhadap eksistensi Pancasila. Pemahaman terhadap akomodasi Pancasila dalam kehidupan berbangsa dan bernegara menjadi jalan tengah untuk menciptakan tatanan bernegara bangsa Indonesia, dimana rumusan Pancasila sebagai rumusan sumber hukum dan jalan tengan akomodasi bagi kehidupan bangsa Indonesia tergambar dalam dialektika Pancasila dengan rumusan-rumusan universalitas dengan doktrin utama nusantara.Kata Kunci: Paradigma, Tektualitas, Kontektualitas, Pancasila AbstractThe main relationship in the textual and contextual context of Pancasila is always correlated with the nature of national life and state life. Abstract

AbstrakPenelitian ini bertujuan untuk mengetahui Perlindungan Hukum Pidana terhadap Korban Malpraktek Medik. Data yang digunakan dalam penelitian ini adalah data primer dan sekunder. Sedangkan jenis penelitian ini adalah penelitian hukum normative, maka metode yang digunakan adalah melalui pendekatan perundang-undangan. Hasil penelitian menunjukan bahwa Perlindungan Hukum Pidana terhadap Korban Malpraktek Medik, bahwa Hukum pidana merupakan hukum publik yang melindungi masyarakat dari kejahatan yang semakin berkembang dari konvensional menjadi profesional yang didalam aksi kejahatannya melibatkan keahlian atau profesi seperti kasus malpraktek medik. Malpraktek adalah tindakan tenaga profesional yang bertentangan dengan SOP, kode etik, dan undang-undang yang berlaku, baik disengaja maupun akibat kelalaian yang mengakibatkan kerugian atau kematian pada orang lain. Masyarakat atau seseorang yang merupakan korban malpraktek tentu akan menuntut ganti kerugian yang dialaminya baik materil maupun imateril melalui gugatan perdata, tuntutan pidana maupun secara administrasi. Sebagai salah satu ciri negara hukum adalah adanya perlindungan hukum terhadap hak azasi manusia. Berkaitan dengan korban malpraktek bahwa hukum pidana memeberikan perlindungan hukum melalui perangkat hukum, seperti penegak hukum memberikan pelayanan dan pengamanan terhadap korban dan atau keluarga korban, kemudian peraturan perundang-undangan yang berlaku, mengatur dan memberikan hak untuk meminta pertanggungjawaban terhadap pelaku Malpraktek. Seperti diatur di dalam Kitab Undang –undang Hukum Pidana, Kitab Undang-undang Hukum Perdata, Undang-undang No. 36 tahun 2009 tentang kesehatan, Undang-undang no. 29 tahun 2004 tentang Praktek kedokteran. Ada dua model perlindungan Hukum, yaitu : pertama, model hak-hak prosedural (the procedural right model), Secara singkat model ini menekankan agar korban berperan aktif dalam proses peradilan pidana, seperti membantu jaksa penuntut umum, dilibatkan dalam setiap tingkat pemeriksaan perkara, didengar pendapatnya apabila terpidana dilepas bersyarat, dan lain sebagainya. Dan Kedua, model pelayanan (the services model) yang menekankan pada pemberian ganti rugi dalam bentuk kompensasi, restitusi, dan upaya pengambilan kondisi korban yang mengalami trauma, rasa takut, dan terekan akibat kejahatan.Kata Kunci: Perlindungan Hukum Pidana, Korban Malpraktek Medik.

Abstract

Abstrak Artikel ini menganalisis berkaitan dengan paradigma relasi hukum profetik dalam dimensi Pancasila sebagai nilai asli bangsa Indonesia yang ditransfromasikan dalam kehidupan berbangsa dan kehidupan bernegara. Pada hakikatnya dimensi kehidupan berbangsa dan bernegara selalu memiliki realitas konkrit masyarakat dalam suatu negara, keyakinan dalam pembangunan hukum harus didasarkan kepada nilai-nilai asli suatu bangsa, sehingga arah pembagunan hukum akan menjadi jelas dan terukur dalam pembangunannya. Refleksi pembangunan hukum di Indonesia yang berbasiskan kepada Pancasila, tidak terlepas dalam paradigama relasi hukum profetik dalam setiap kebijakan hukum yang dibuat, sehingga pemahaman terhadap hukum dimanifestasikan dalam kehidupan berbangsa dan kehidupan bernegara. Oleh karena itu Pancasila sebagai sumber dari segala sumber hukum itu sendiri tidak dapat melepaskan dari nilai asli nusantara yang di rumuskan dalam kehidupan berbangsa dan kehidupan bernegara. Dalam penelitian ini focus menganalisis secara mendalam berkaitan dengan pendekatan paradigma relasi profetik dalam pembangunan hukum, dimana Pancasila sebagai sumber pembangunan hukum. Kata Kunci: Hukum, Profetik dan Pancasila Abstract This article analyzes the paradigm of the relationship of the prophetic law in the Pancasila dimension as the original values of the Indonesian nation transformed into the life of the nation and the country. In fact, the dimensions of national and national life always have the concrete reality of society in a country, the belief in the development of law must be based on the original values of a nation, so that the direction of the growth of law will be clear and measurable in its construction. The reflection of the development of the law in Indonesia based on Pancasila, is not independent in the paradigm of the prophetic relationship of law in every law policy made, so that the understanding of law is manifested in the life of the nation and the country. Therefore, Pancasila as the source of all the sources of the law itself can not relinquish from the original values of nusantara which is formulated in the life of the nation and the country. In this study the focus is to analyze in depth related approaches to the paradigm of prophetic relations in the construction of law, where Pancasila as the source of the development of law. Abstract

Abstrak Penelitian ini di latar belakangi mengenai penjualan obat keras tanpa resep di Apotek yang dilakukan oleh apoteker. Apoteker dianggap negatif oleh media di Indonesia, dikarenakan terdapat praktek yang tidak sesuai. Adapun tujuan penelitian ini untuk mengetahui penjualan obat keras tanpa resep dokter di Kabupaten Lebak. Selanjutnya, untuk mengetahui tanggung jawab hukum administrasi bagi apotek yang menjual obat keras tanpa resep dokter, dan bagaimana pengawasan yang dilakukan oleh BPOM terhadap obat keras yang memiliki izin edar. Jenis penelitian ini menggunakan penelitian yuridis normatif empiris, dengan pendekatan Undang-Undang, Sosiologis. Data untuk analisanya menggunakan analisa secara kualitatif. Hasil Penelitian ini yaitu penjualan obat keras tanpa resep dokter merupakan pelanggaran hukum. Apotek dalam setiap menjual obat keras harus berdasarkan ketentuan yang ada, dan bertanggung jawab untuk melaporkan setiap penjualan obat keras kepada Pemerintah, dalam hal ini Dinas Kesehatan. Adapun sanksi yang diberikan kepada pelaku usaha kefarmasian terhadap penjualan obat keras tanpa resep dokter yaitu sanksi administratif dimulai peringatan tertulis, penghentian sementara kegiatan hingga pencabutan SIA. Upaya pengawasan yang dilakukan oleh Pemerintah yaitu dengan membentuk BPOM sebagai pengawasan obat keras yang ilegal. Adanya BPOM pengawasan pemerintah lebih terjamin, dan masyarakat lebih aman dan nyaman dalam menggunakan obat-obatan yang mereka butuhkan. Kata Kunci: Tanggung Jawab, Hukum, Apotek Abstract This research is motivated by the issue of over-the-counter sales of prescription drugs in pharmacies conducted by pharmacists. Pharmacists are perceived negatively by the media in Indonesia due to inappropriate practices. The objectives of this research are to determine the sales of prescription drugs without a doctor's prescription in Lebak Regency. Furthermore, to understand the administrative legal responsibilities for pharmacies selling prescription drugs without a doctor's prescription, and how the supervision is carried out by the National Agency of Drug and Food Control (BPOM) for prescription drugs with circulation permits. This research employs a normative empirical juridical approach with legal and sociological perspectives. Qualitative analysis is used for data analysis. The results of this research indicate that the sale of prescription drugs without a doctor's prescription is a legal violation. Pharmacies must adhere to existing regulations when selling prescription drugs and are responsible for reporting each sale to the government, specifically the Health Department. Sanctions imposed on pharmaceutical business operators for selling prescription drugs without a doctor's prescription include administrative penalties ranging from written warnings to temporary cessation of activities to revocation of the pharmacy license. Government oversight is carried out through the establishment of BPOM to monitor illegal prescription drug sales. The existence of BPOM ensures more effective government supervision, providing greater safety and comfort for the public in using the medications they need. Keyword: Rensponsibility, Law, Pharmacy
