Abstract

Rekrutmen politik merupakan salah satu fungsi strategis yang diberikan kepada partai politik. Tujuan rekrutmen politik untuk menyeleksi atau memilih kandidat yang akan ditawarkan ke masyarakat pada saat pemilihan umum sebagai calon anggota legislatif, calon presiden dan calon wakil presiden, calon kepala daerah dan calon wakil kepala daerah. Menurut Pasal 29 UU No. 2 Tahun 2011 mengatur bahwa rekrutmen dilaksanakan melalui seleksi kaderisasi secara demokratis sesuai dengan AD/ART partai dengan mempertimbangkan paling sedikit 30% keterwakilan perempuan belum sepenuhnya sesuai harapan, sehingga rekrutmen selama ini dilakukan melalui pendekatan-pendekatan pragmatis belaka. Untuk memudahkan pelaksanaan rekrutmen politik tersebut diperlukan prinsip-prinsip yang akan menjadi landasan ideal bagi partai politik untuk menyusun metode atau mekanisme rekrutmen politik dalam AD/ART partai politik mereka. Fungsi AD/ART dijadikan sebagai landasan yuridis bagi partai politik sebagaimana yang diamanatkan undang-undang. Adapun prinsip-prinsip tersebut antara lain; prinsip ketokohan, prinsip kemanfaatan/kepentingan bersama, prinsip ideologis, prinsip perimbangan suara, prinsip demokrasi, prinsip keterbukaan, prinsip keadilan dan prinsip kesetaraan.

Abstract

Sesuai amanat konstitusional bahwa penyelenggaraan demokrasi dilaksanakan secara langsung dan juga tidak langsung. Pada demokrasi langsung dijalankan melalui pemilu. Sedangkan demokrasi tidak langsung dilaksanakan oleh lembaga perwakilan atau lembaga legislative. Keanggotaan lembaga legislative ini dipilih oleh rakyat pada pemilu legislative. Selain memilih anggota legislative, pemilu juga memilih presiden dan wakil presiden serta memilih kepala daerah dan wakil kepala daerah. Satu-satunya peserta pada pemilu ini adalah partai politik untuk itu partai politik memiliki fungsi yang strategis menyiapkan dan menyediakan calon-calon pejabat yang akan dipilih dalam pemilu tersebut. Di sisi lain terdapat ketentuan ambang batas pencalonan yang dikenal dengan parliamentary threshold dan presidensial threshold. Pada parliamentary threshold menjadi syarat bagi partai politik untuk ikut pemilu sedangkan presidensial threshold menjadi syarat bagi partai politik untuk mencalonkan presiden dan wakil presiden. Ketentuan ambang batas ini memberikan dampak pada pemerintahan, salah satunya adalah masuknya unsur partai politik dalam kabinet presidensil dan mempengaruhi kinerja lembaga legislative sebagai pengawas pemerintah karena sebagian besar anggota legislative merupakan pendukung koalisi pencalonan presiden dan wakil presiden (pemerintah)

Abstract

Representative democracy in Indonesia is a democracy mandated in the Constitution and Pancasila. The manifestation of democracy through a general election conducted every five years with the aim to elect members of the parliament at the central and regional levels. Members of the parliament are candidates promoted by political parties. In the history of partying in Indonesia it is seen that the party system is built based on multiparty. Party system with multiparty in the old order era has managed to build a political party ideology so as to emerge political parties that berideologi. In the new order era ideologipartai-political parties in the "key" with one ideology that is Pancasila. And in the reform era the multiparty system places political parties with diverse views and interests. The number of political parties that are much strived to provide support for the implementation of presidential government. The support is realized through the formation of coalitions between parties.Keywords : Representative democracy, Political party, Multiparty, and party ideology

Abstract

Implementation of democracy in Indonesia is done directly and not indirectly do langsung.Pelaksanaan democracy through democratic election mechanism umum.Sedangkan implementation indirectly through representative institutions rakyat.Dengan Parliament thus undertaking the public trust, especially those of people who had voted at the time Pemilu.Tak can difungkiri that in performing duties as a board member does not cover the possibility of violations including violations of etika.Untuk the enforcement of the code of conduct for board members to have a reciprocal relationship to strengthening the representative institutions. The better the performance of the members of the board with sticking to a code of conduct that has been agreed will have an impact on the support of the community for the better. Abstract

Otonomi desa merupakan perkembangan konsep otonomi daerah. Titik berat otonomi ada di desa, sehingga desa diharapkan dapat mengembangkan potensi desa dan masyarakat menjadi sejahtera. Desa sebagai daerah otonom dipimpin oleh kepala desa. Di samping kepala desa ada Badan Permusyawaratan Desa (BPD) yang berfungsi membuat peraturan desa. Untuk mengakomodir fungsi ini maka dalam UU No. 12 Tahun 2011 Peraturan Desa dimasukan dalam hirarki aturan hukum. Namun demikian masih banyak desa yang belum memiliki peraturan desa. Secara konstitusional keberadaan peraturan desa merupakan perwujudan dari perlindungan hak konstitusional masyarakat desa. Hak konstitusional merupakan hal dasar yang dimiliki oleh desa sejak lama dan turun temurun. Hak dasar tersebut meliputi hak atas asal usul masyarakat masyarakat, hak atas sumber daya alam; tanah adat (ulayat), hasil perkebunan, hasil perikanan, sungai (air)/laut, kekayaan intelektual, rumah adat, kesenian adat, pakaian adat, obat-obatan dan makanan adat. Sehubungan ini keberadaan peraturan desa mempunyai urgensi atau kepentingan konstitusional. Secara umum urgensi konstitusional peraturan desa antara lain menjadi payung hukum untuk penegakan hukum dan menjamin kepastian hukum di tengah perkembangan global. Selain itu urgensi peraturan desa adalah sebagai peraturan pelaksana yang sesuai dengan kekhasan masyarakat desa sehingga aturan tersebut dapat dilaksanakan sesuai dengan aspirasi masyarakat

Abstract

This study aims to describe and analyze the effectiveness of the family planning program in controlling the birth rate in Prabumulih City, as well as the factors that influence it. The research method uses descriptive qualitative, with data collection techniques using: interviews, observation and documentation.The results of this study showed that (1) the Vasectomy program was quite effective in controlling the birth rate in Prabumulih City. This can be seen from efforts to increase awareness and community participation through maturing the age of marriage, birth control, fostering family resilience, and increasing family welfare to create a small, happy, and prosperous family. (2) Supporting factors: organizational characteristics are strengthened through communication strategies, counseling of family planning programs for the community is carried out in a planned manner, with a schedule that has been prepared, while the inhibiting factors are: environmental characteristics in the form of community perceptions, this can be seen from community acceptance of the vasectomy family planning program varies, where some accept and some reject.

Abstract

Political recruitment is a process of selecting and selecting a person or several members of the community to occupy and exercise certain political roles as cadres of political parties, legislators, as president and vice president and as regional head. In the Indonesian state system, this political recruitment is left to political parties. The rise of political parties as a result of freedom of association and assembly on the one hand is a reflection of democracy but on the other hand the large number of political parties will give rise to increasingly tight competition between political parties. The increasing competition makes political actors easily trapped in political pragmatism. Political pragmatism as a short-term orientation of political actors to win political competition is power. Power as the ultimate goal of the political competition. Political pragmatism has had a significant impact on the formation of pragmatic recruitment patterns. The pattern of pragmatic recruitment has spawned many problems, especially issues related to the quality of recruitment results. One of them is that many of the political elites are facing legal problems such as corruption and so on. Under these conditions emerged initiatives to present a systematic and structured pattern of political recruitment. One of the indications is that political recruitment is based on the ideology of political parties. The ideology of a political party is broadly divided into recruitment based on Islamic ideology (religion) and other ideologies such as nationalism. the closer the party ideology to the party recruitment pattern will result in quality recruitment and visionary cadres. on the contrary, the further distance the party ideology with the party recruitment pattern will result in a pragmatic recruitment. The results of recruitment have a close relationship with the quality of products produced, especially product legislation. Kata Kunci : pola rekrutmen, partai politik, sistem ketatanegaraan

Abstract

Within the framework of representative democracy, a general election is held every five years. These election include the election of legislative members, the election of president and vice president and the election of regional heads and regional deputy heads. The only participant in the election is a political party. Political parties have a strategic function which is to prepare candidates for the people’s representative, presidential candidates and vice presidential candidates as well as regional head and deputy regional head candidates. The vote acquisition of political in the Pileg, Pilpres and Pilkada determine the position of political parties in government. Party government begins nomination by political parties. Legislative members in addition to being representative of political parties who sit in factions according to the number of votes. Likewise after the presidential election, the presidential election and vice presidential pairs that are carried by a coalition of political parties indicate the existence of a seat of minister for the bearer political parties. Furthermore, after the elections, the pair of Pilkada, who were carried by a coalition of political parties indicated the existence of seat in regional government.

Abstract

Sistem jual beli online atau elektronik, akhir-akhir ini banyak diminati masyarakat regional dengan menggunakan jaringan internet. Antara pembeli dan penjual bertemu dalam bentuk aplikasi penjualan. Berbada dengan cara jual beli konvensional, antara pembeli dan penjual bertemu langsung untuk melakukan transaksi. Jual beli online melalui aplikasi Shopee merupakan wujud dari perjanjian konsinyasi. Melalui aplikasi Shopee para penjual melakukan jual beli secara online dengan cara pemesanan dan antar ke tempat pembeli melalui jasa kurir. Dalam pelaksanaan di lapangan kadang terdapat permasalahan misalnya barang yang dipesan tidak sesuai atau mengalami kerusakan. Melalui mekanisme perjanjian konsinyasi upaya penyelesaian perselisihan yang timbul akibat jual beli online terhadap pelanggan yang dirugikan melalui forum pertemuan / pusat resolusi yang disediakan oleh Shopee secara online, dimana Shopee bertindak sebagai pihak ketiga. Terdapat  dua bentuk cara penyelesaian yaitu mengembalikan barang atau mendapatkan uang kembali asalkan ada video unboxing yang jelas. Ketika sudah di putuskan kesepakatan, kesepakatan dapat diambil dengan kesediaan penjual untuk memberikan kompensasi / ganti rugi yang berupa pengembalian barang dan pengembalian uang dan biaya pengiriman nya gratis apabila melalui aplikasi Shopee (gratis ongkir).
