Abstract

Fokus utama dari tulisan ini, adalah;  mengapa dalam kitab-kitab fiqh masalah hukum wasiat dipisahkan dari kompleksitas pembagian harta penginggalan? Dan bagaimanakah implementasi wasiat dalam sistem pembagian harta peninggalan yang akomodatif sebagai upaya pembaharuan dan pengembangan hukum di Indonesia? Penelitian ini dianalisis secara kualitatif artinya suatu cara penelitian yang menghasilkan data diskriptif analitis yang dinyatakan dalam bentuk tulisan yang nyata yang diteliti dan dipelajari sebagai sesuatu yang utuh. Dari hasil penelitian tersebut dapatlah diketahui bahwa: Pertama, pemisahan ini hukum wasiat dari kompleksitas harta peninggalan, lebih disebabkan oleh  dasar Hukum Wasiat berbeda dengan Waris, bahkan diantara para ulama terjadi ikhtilaf dan untuk kemudahan dalam memahami jenis-jenis harta peninggalan, sehingga model teknis pembahasan tentang wasiat atau waris, atau pusaka dan lainnya dibahas secara tematis, serta adanya perbedaan dalam interpretasi teks. Kedua, wasiat merupakan bagian tak terpisahkan dalam sistem pembagian harta peninggalan, maka implementasinya adalah merupakan jalan keluar untuk melengkapi, mengisi celah-celah peristiwa hukum dalam pelaksanaan pembagian harta peninggalan, sebab dalam sistem kewarisan Islam adakalanya ahli waris tidak dapat menikmati bagian harta warisan. Kata kunci : wasiat, pembagian warisan, Hukum Islam di Indonesia

Abstract

Fokus utama dari studi ini adalah untuk menjawab mengapa, dalam  buku-buku  fiqh, wasiyat  dipisahkan  dari  kompleksitas pembagian warisan, dan bagaimana pelaksanaan wasiyat dalam distribusi sistem warisan mengakomodasi kebutuhan untuk memperbarui dan mengembangkan hukum Islam di Indonesia. Penelitian ini adalah murni deskriptif dalam arti bahwa ia examineds data deskriptif analitis. Penelitian ini menyimpulkan bahwa: pertama, pemisahan bukti dari kompleksitas warisan hukum disebabkan oleh dasar yang berbeda dari hukum waris serta perbedaan penafsiran teks di antara para pendeta. Dengan demikian, pembahasan model teknis tentang kehendak dan warisan atau warisan dan lainnya tematis dibahas terjadi untuk memudahkan dalam memahami jenis warisan. Kedua, bukti merupakan bagian integral dalam distribusi sistem warisan. Pelaksanaan itu, oleh karena itu, membuka jalan untuk mengisi kekosongan dalam pelaksanaan membagi warisan karena dalam ahli waris sistem pewarisan Islam kadang-kadang tidak dapat menikmati warisan. Kata kunci: Wasiyat, Pembagian Warisan, Hukum Islam diIndonesia

Abstract

Abstrak Peneliti tertarik untuk menganalisa bentuk dan model waris dan wasiat pada masyarakat muslim Jawa yang berprinsip keadilan. Urgensi dari hasil temuan dalam penelitian ini adalah; adanya tawaran reinterpretasi terhadap perluasan sasaran hukum waris dan wasiat Islam, dan memberikan gambaran tentang model pembagian waris dan wasiat Islam yang berprinsip keadilan yang bermuatan lokal. Penelitian ini dilaksanakan di wilayah Sleman, Yogyakarta. Sumber datanya adalah seluruh Kaur Kesra Desa di wilayah penelitian dan teknik sampel yang digunakan adalah Purposive random sampling. Analisis dengan cara non-statistik yaitu secara kualitatif dengan menggunakan metode “reflektive thinking” dengan pola deduksi-induksi dan tata pikir devergen yaitu tata pikir kreatif inovatif. Penelitian ini menemukan bahwa dalam masyarakat manapun agama yang dianut cenderung berpengaruh dalam berbagi aspek kehidupannya sehingga wajar jika hukum Islam sulit dinafikan eksistensinya dikalangan masyarakat Jawa. Oleh karena itu, bagi suku Jawa berjalannya pluralisme hukum antara hukum Islam dan adat sulit dihindari, bahkan pluralisme ini sudah merupakan hal yang diyakini secara umum. Masyarakat yang saat ini menganut agama Islam sudah terbiasa diatur dengan norma hukum adat, sehingga hukum waris Islam dan adat terkadang tidak terhindarkan. Dalam sistem pembagian harta peninggalan, masyarakat muslim Jawa tidak seluruhnya menggunakan sistem pembagian waris dan wasiat Islam, tetapi lebih cenderung dengan sistem adat Jawa, walaupun ada sebagian sistem Islam yang dipergunakan. Abstract This study aims to explain the concept and the method of estate and testament division amongst Javanese Muslim that is based on the principle of justice. This study is hopped to offer reinterpretation of Isamic law of inheritance and give an overview of the distribution of inheritance and tastement in Selaman, Yogyakarta. The data were collected through observation and interview all the head of welfare affairs in all areas of research. It also used purposive randaom sampling. Analysis is conducted by nonstatistical qualitatively using “reflective thinking”with the pattern of induction and deduction-governance for innovative creative thinking. This study found that in any society the religious affiliation tends to affect the share aspetcs of their life so the influence of Islamic law in inevitable the people of Java. Therefore, for egal pluralism Javanese passage between Islamic law and custom are difficult to avoid, even pluralism is accepted. People that are now converted to Islam have become accustomed to e governed by customary law norms, so that Islamic law and customs are sometimes unavoidable. In the system of the distribution of inheritance, the customary system of Java applies although some Islamic system is also used.

Abstract

Perkembangan teknologi informasi saat ini telah menggeser efektivitas model pembelajaran konvensional menuju model pembelajaran baru berdasarkan penggunaan media teknologi. Penelitian ini bertujuan untuk menentukan tingkat partisipasi mahasiswa pada perkuliahan MKWU Islam Ulil Albab di Universitas Islam Indonesia (UII) dalam proses pembelajaran di kelas selama pandemi Covid-19 melalui model pembelajaran campuran berbasis flipped dan blended learning. Penelitian ini menggunakan Classroom Action Research (CAR), dengan subyek 82 mahasiswa yang sekaligus mengikuti program studi mandiri, mahasiswa dari program studi. Penelitian ini dilakukan selama kurang lebih empat bulan dalam perkuliahan aktif pada semester ganjil tahun ajaran 2020-2021, dengan total 14 pertemuan. Hasil penelitian menunjukkan bahwa model pembelajaran campuran berdasarkan flipped dan blended learning memiliki peningkatan partisipasi siswa dalam setiap pertemuan dan hasil CPMK tercapai dengan baik.

Abstract

Entrepreneurs of NU, engaged in the al-Kautsar religious gathering, can be deemed as having good education and structural position either as a member or an organizer. They declare that NU institutionally gives a big contribution to their business. Their companies are generally home-industries in which they themselves pay the capital. Though the profit is less than IDR 5,000,000, they are aware of developing their industries. Their participation in the Islamic organization, NU, does not mean that they do not choose the conventional banking system, not the shariah one. Their choice is based upon a consideration which banking system is more beneficial for them. To put simply, it can be said that they will be enthusiastic and interested in utilizing the services of shariah-banking system if they could get more benefits. However, they prefer interest system than profit-sharing system. They consider both systems as being at the same position and regard interest as religiously acceptable. Therefore, they believe that conventional banking system is allowed in Islam. Though having preference to conventional banking system, they still possibly utilize shariah-banking system as long as it can give more facilities and benefits and confess that shariah-banking system is in line with their religious doctrines.Keywords: pasar mengambang, pengusaha NU, bank syariah

Abstract

From Good Governance perspective, Indonesia has given positive contribution toward gender issues. Legally, Indonesia has fulfilled all conditions as state with good governance, but unfortunately, at the field showed that such ordinances issued were ineffective. PSI-UII’s research report has found the correlation between violence against women and religious understanding. In the field finding will give inputs to all people who concern with the issue. Several Muslim scholars already had given us some solution with interpretation toward al-Quran and Hadits, which support gender justice and equality. Government and all organization involved, have to support law and its instrument can be applied well.Keywords: governance, gender, religious interpretation.

Abstract

Social justice in the Islamic economy is based on spiritual commitment and the concept of universal brotherhood among human beings which requires that all resources be sacred trust God, used to realize Maqashid Shari’ah, it is the fulfillment of human life. This paper describes the theory of social justice that focus on Islamic financial. The foundation of Islamic justice can be seen from al-Qur’an Surah al-Hadid: 25 affirming that justice has been emphasized by the Qur’an as the primary mission of the Prophets sent by God Almighty, including economic justice and the elimination of the income gap. Social justice in Islam is the implication of the fundamental principle underlying all the teachings of Islam, namely monotheism. At the level of practice, Islam prohibits usury, Islam seeks to build a society based on honesty and fairness. Justice in this context has two dimensions, namely the financiers are entitled to a reward, but should be commensurate with the risk and effort required, and the reward is determined by the profit. Implementation of Islamic justice theory in Islamic finance can be seen from mudharabah and Musharaka or commonly known as a profit and loss sharing.

Abstract

This study focuses on the contract implementation to lease an accommodation according to Islamic law. This study aims to explain the practices in accommodation leasing in Nglanjaran, Sardonoharjo Village, Ngaglik District, Sleman Regency, Yogyakarta and to examine the accommodation leasing practices based on Islamic law. This research used a field research method, with a descriptive analytical approach. The data were collected through observation and interviews. This research shows that the agreement made between the tenant and the accommodation owner was done orally and in writing. This was done in accordance with Islamic law as it fulfills the essential principles and requirements of ijarah. The prices and the period of lease has been determined based on various facilities provided such as physical and non-physical facilities. Meanwhile, disputes that may occur in leasing practices are settled through a negotiation for consensus. To avoid agreement violation, the requirements or any issue related to the lease agreement shall be clearly written to avoid any ambiguity and misunderstanding in the future. In addition, it is suggested that the village apparatus be involved in the arrangement of the lease practice, by way of making general regulations for accommodation leasing in Nglanjaran for community comfort.
