Abstract

ABSTRAKPerkawinan bukanlah peristiwa kemasyarakatan biasa, melainkan peristiwa yang menimbulkan akibat-akibat yang diatur oleh hukum. Dalam masyarakat terjadi berbagai bentuk perkawinan yang sangat beragam salah satunya ialah perkawinan periparan yang banyak terjadi di salah satu daerah di Kabupaten Garut dalam dua bentuk. Pertama, pernikahan antar ipar dimana pasangan suami isteri yang menikah diikuti dengan adik mereka masing-masing melangsung peknikahan juga. Bentuk kedua, yaitu suami menikah dengan saudara pasangan. Penelitian ini bertujuan untuk mengkaji bagaimana keabsahan perkawinan periparan tersebut ditinjau berdasarkan perspektif hukum islam dan hukum adat dihubungkan dengan UUP, serta mengakaji juga bagaimanakah akibat hukum dari perkawinan periparan tersebut. Penelitian ini menggunakan metode yuridis normatif. Berdasarkan penelitian dapat diketahui bahwa perkawinan periparan dalam bentuk yang pertama sah baik menurut hukum islam dan hukum adat, sedangkan perkawinan periparan dalam bentuk kedua sah pula menurut hukum adat, tetapi menurut hukum islam sah sepanjang dilakukan tidak dalam satu waktu yang bersamaan. Kata kunci: Hukum Adat, Hukum Islam, Perkawinan Periparan. ABSTRACT Marriage is not an ordinary social event, but an event that has consequences that are regulated by law. In society, there are various forms of marriage that are very diverse, one of which is periparan marriage, which occurs in one area in Garut Regency in two forms. First, the marriage between in-laws where a married couple is followed by their respective siblings to get married as well. The second form, namely the husband married to the spouse's brother. This study aims to examine how the legitimacy of the partner marriage is reviewed from the perspective of Islamic and customary law, and also to examine how the legal consequences of the partner marriage are. This study uses a normative juridical research method. Based on the research, it can be seen that the partner marriage in the first form is valid both according to Islamic law and customary law, while the partner marriage in the second form is also valid according to customary law, but according to Islamic law as long as it is not carried out at the same time.Keywords: Customary Law, Islamic Law, Marriage In Relation

Abstract

Abstract: This research aims to examine and analyze the responsibilities of petrol stations as well as legal protection that can be obtained by consumers designed by petrol stations based on statutory views and Islamic law. This study uses the Normative Juridical method with references to Law Number 8 of 1999 concerning Consumer Protection and Law Number 2 of 1981 concerning Legal Metrology regarding measuring instruments. These results conclude that: First, engineering pump removal by business actors carried out by SPBU managers has an impact on the revocation of the PASTI PAS predicate by Pertamina which has harmed consumers, so that it is the responsibility of business actors who provide compensation in accordance with Article 19 of the Consumer Protection Law because it has increased to default. Furthermore, in Islamic law, the stipulation of compensation is carried out because no loss or damage to the victim has occurred. Second, legal protection for consumers, namely in the form of preventive and repressive. Preventive measures are carried out by providing guidance by the government and Pertamina, while repressiveness is carried out by law enforcement and / consumer dispute resolution both through courts and outside the court. Likewise, the Islamic view of pump engineering is not in line with the principles and principles of Islamic law because there is an element of gharar in it.

Abstract

Komisi Pengawas Persaingan Usaha adalah suatu lembaga khusus yang dibentuk berdasarkan Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktik Monopoli dan Persaingan Usaha Tidak Sehat untuk menegakkan hukum persaingan usaha. Tidak berkedudukan sebagai 'lembaga penegak hukum' yang sesungguhnya menyebabkan KPPU tidak memiliki daya paksa dalam hal pemanggilan para pihak maupun dalam pelaksanaan eksekusi. Selain itu, banyaknya putusan KPPU yang dibatalkan dalam proses upaya huku (yang disebut sebagai keberatan) yang diajukan pihak pelanggar pada akhirnya menyebabkan tidak terciptanya kepastian hukum bagi para pihak. Not functioning as a 'law enforcement agency' has led to KPPU to have no power to either forcibly summon the parties or execute its decisions. Moreover, a lot of KPPU's decisions are cancelled due to further legal action filed by the offender and thus undermining the legal centainty for the parties. The purpose of this article is to seek and analyze the enforcement of KPPU's decision in disputes regarding monopolistic practices and unfair competition as regulated in Law Number 5 of 1999. Abstract

ABSTRAKTerkadang suatu akta perdamaian yang telah disepakati oleh para pihak yang sedang bersengketa, tidak dilaksanakan oleh salah satu pihak atau bahkan oleh kedua belah pihak. Salah satunya Putusan Akta Perdamaian Nomor 35/Pdt.G/2007/PN.Sal. Dalam kasus ini hakim yang menangani perkara tersebut menyatakan bahwa gugatan yang diajukan oleh penggugat tidak dapat diterima (niet ontvankelijk verklaard). Penelitian ini mengkaji mengenai tepatkah tindakan hakim Pengadilan Negeri Salatiga yang memproses gugatan wanprestasi atas Akta Perdamaian Nomor 35/Pdt.G/2007/PN.Sal. Metode penelitian yang digunakan yuridis normatif, mengkaji peraturan hukum dan data sekunder. Hasil penelitian majelis hakim Pengadilan Negeri Salatiga pada perkara Putusan Nomor 22/Pdt.G/2016/PN.Slt sebetulnya telah menerapkan asas ius curia novit. Di mana setiap hakim tahu akan hukum, sehingga harus mengadili setiap perkara yang diajukan kepadanya. Majelis hakim juga telah tepat menyatakan gugatan tidak dapat diterima, dikarenakan pengugat belum melaksanakan kewajibannya yang ada di dalam akta perdamaian. Namun dalam pertimbangan hukumnya, majelis hakim kurang memperhatikan ketentuan Pasal 130 ayat (2) HIR dan Perma Nomor 1 Tahun 2016. Sebetulnya dalam kasus gugatan wanprestasi akta perdamaian cukup hanya mengajukan permohonan pelaksanaan putusan (eksekusi) ke Pengadilan Negeri Salatiga.Kata kunci: akta perdamaian; ius curia novit; gugatan tidak dapat diterima. ABSTRACTOccasionally, deed of settlement that has been agreed by the disputed parties is not enforced by one party or even by both parties. Among those cases is the Decision on Deed of Settlement Number 35/Pdt.G/2007/PN.Sal. The panel of judges in this case stated that the lawsuit filed by the plaintiff cannot be granted (niet ontvankelijk verklaard). This study examines action of panel of judges from the Salatiga District Court who handled the lawsuit regarding breach of Deed of Settlement Number 35/Pdt.G/2007/PN.Sal. This research uses normative juridical method, by reviewing law regulations and secondary data. The results of the research concludes the panel of judges from Salatiga District Court on case number 22/Pdt.G/2016/PN.Slt have applied ius curia novit principle which means every judge shall know law, accordingly he/she has to try every case brought to him/her. The panel of judges have also stipulated correctly that the lawsuit cannot be granted because the plaintiff has not enforced the obligations as stated in the deed of settlement. However, in the decision’s deliberation, the panel of judges did not pay attention to the provision of Article 130 paragraph (2) HIR and Perma Number 1 of 2016. In a lawsuit for breach of deed of settlement the plaintiff is adequate to only le a petition for the enforcement of the decision to the Salatiga District Court.Keywords: deed of settlement; ius curia novit; lawsuit not granted.

Abstract

Hukum waris adalah hukum yang mengatur peralihan harta kekayaan yang ditinggalkan seseorang yang meninggal serta akibat-akibatnya bagi ahli waris. Saat ini pengaturan hukum waris di Indonesia masih bersifat pluralisme karena belum adanya pengaturan khusus yang bersifat nasional. Dalam putusan Pengadilan Negeri Jakarta Pusat Nomor 440/Pdt.G/2013, terdapat perjanjian hibah dengan objek harta waris yang belum dibagi waris dalam suatu keluarga Timur Asing bukan Tionghoa yang dituangkan di dalam Akta Hibah Nomor 141. Majelis hakim menyatakan perjanjian hibah batal demi hukum karena harta waris yang belum dibagi waris tidak dapat dihibahkan dan menetapkan ahli warisnya mengacu pada KUHPerdata. Tujuan penelitian ini untuk mengetahui lebih lanjut mengenai keabsahan hibah dan kedudukan hak mewaris para pihak dihubungkan dengan KUHPerdata. Metode penelitian yang digunakan adalah metode pendekatan yuridis normatif dengan spesifikasi penelitian berupa deskriptif analitis melalui data sekunder yang diperoleh dari studi kepustakaan. Hasil penelitian menunjukkan pertama, perjanjian hibah yang dituangkan di dalam Akta Hibah Nomor 141 tidak sah secara hukum karena perjanjian tersebut tidak memenuhi salah satu syarat sahnya perjanjian di dalam Pasal 1320 KUHPerdata, yaitu sebab yang halal (syarat objektif) karena telah mengakibatkan hilangnya hak ahli waris lainnya atas harta waris, sehingga perjanjian hibah tersebut menjadi batal demi hukum sebagaimana diatur di dalam Pasal 1335 KUHPerdata. Kedua, para pihak selaku ahli waris tergolong sebagai ahli waris yang sah menurut hukum waris Hindu dalam kelompok sapinda yaitu kelompok keturunan berdasarkan pertalian darah menurut garis ke bawah dan ke atas, baik menurut garis ibu maupun garis bapak (purusa), namun berdasarkan hukum waris Hindu, ahli waris laki-laki mempunyai kedudukan yang lebih tinggi dibanding ahli waris perempuan dalam haknya sebagai ahli waris. Berdasarkan ketentuan Pasal 131 ayat (2) sub b IS jo. Stb 1924-556, hukum waris yang berlaku bagi orang Timur Asing bukan Tionghoa ialah hukum waris agama dan hukum adatnya masing-masing.

Abstract

Waqf is one of the institutions of Islamic social institutions that contain socio-economic values that are expected to help to realize social welfare that benefits can be enjoyed together. However, there are many problems related to waqf land, one of which is the change in the designation of waqf land-based on adat meetings. The purpose of this thesis is to examine the legal position of waqf land that has changed its designation and implementation of waqf in Central Aceh District based on Islamic Law and Customary Law in terms of the Law. The research in this thesis uses the normative juridical approach The specification of the research conducted is analytical descriptive. Based on the results of this study, the legal status of waqf land that has been represented cannot be used if it is not in accordance with the waqf pledge, but there are exceptions to the waqf land that can be changed its designation and must follow the procedure for changes stipulated by Law Number 41 of 2004 Execution of existing land parcels in Central Aceh Regency, Islamic Law has been implemented correctly, but the state administration has not been implemented to the maximum.

Abstract

Ulayat land disputes are land disputes over ulayat rights that occur in the Minangkabau customary law community. The provisions of Article 12 paragraph (1) of the West Sumatra Regional Regulation Number 6 of 2008 concerning Communal Land and Its Utilization states that Communal Land Disputes in Nagari are resolved by the Nagari Adat Density (KAN) according to the provisions as long as the applicable custom, 'bajanjang naiak Batanggo turun' and endeavored by way of peace through deliberation and consensus in the form of a peace decision. KAN plays a role in resolving ulayat land disputes that occur in every nagari in West Sumatra. Still, based on the adat salingka of the nagari, every ulayat land dispute that occurs is adjusted to the respective customary law. Based on this, each nagari has differences in resolving ulayat land disputes, especially those that arise in Nagari Tungka, District 50, City of West Sumatra. The research was carried out using normative juridical methods with qualitative juridical analysis methods, which combined primary data obtained at the Tungka KAN Institute and field studies through interviews with ninik mamak Nagari Tungka. Stages of resolving ulayat land disputes in Nagari Tungka based on the salingka nagari custom peace, then by Article 12 paragraph (1) West Sumatra Regional Regulation No. 6 of 2008 concerning ulayat land, further dispute resolution is carried out by the KAN institution.
