Abstract

This study aims to understand the map of conflict and the evolving dynamics of Lapindo mudflow case settlement. The study was conducted in two villages, namely Siring and Renokenongo, Porong subdistrict, Sidoarjo, EastJava, using a qualitative approach. Data was collected throughin-depth interviews, observation, documentation and focus group discussion. The results showed that the conflict can be divided into vertical and horizontal conflicts. In the vertical conflict, communities faced government and Lapindo Brantas. While horizontal conflicts, it showed a layer conflicts, consisting of the conflict between family members, neighbors, RT/RW, villagers, and between Lapindo mudflow victims vs nonvictims residents. Simplification of Lapindo conflict management based on there placement of material aspects, have potentially to create a new problems in the future.

Abstract

The intensive care unit or ICU (Intensive Care Unit) and the Emergency Department are units that provide relatively nursing services that require a high level of skill due to the patient's condition requiring quick and precise treatment. Objective: To determine the relationship between nurse workload and the caring behavior of nurses in the Emergency Room (IGD) and Intensive Care Unit (ICU) of PKU Muhammadiyah Gamping Hospital. Method: This research uses quantitative research with a correlation method with a cross-sectional time approach. The sampling technique uses total sampling. The sample in this study was 43 respondents, namely nurses who served in the Emergency Room (IGD) and Intensive Care Unit (ICU) of PKU Muhammadiyah Gamping Hospital. Results: The results of research using the Spearman-Rank test showed that there was a significant relationship between nurse workload and caring behavior of nurses in the Emergency Room (IGD) and Intensive Care Unit (ICU) of PKU Muhammadiyah Gamping Hospital (p-value 0.022 < 0.05). The closeness of the relationship with the significance value τ = -0.349 (sufficient correlation). Conclusions and Suggestions: From the results of this study, it was found that there was a relationship between nurses' workload and the caring behavior of nurses in the Emergency Room (IGD) and Intensive Care Unit (ICU) of PKU Muhammadiyah Gamping Hospital. Respondents should be able to use their rest time well so that it does not result in excessive fatigue.

Abstract

Head and Neck Squamous Cell Carcinoma (HNSCC) ranks among the seven most prevalent malignancies globally, associated with significant morbidity and mortality rates. The key risk factors for this malignancy include chronic alcohol consumption, tobacco use, immunosuppression, and infections with oncogenic viruses such as high-risk Human Papillomavirus (HPV) and Epstein-Barr Virus (EBV). This study was a retrospective analysis of HNSCC patients seen at an oncology clinic over a five-year period from January 2015 to December 2020, focusing on the environmental and genetic factors contributing to the disease. A cohort of 1,640 patients was analyzed, assessing their risk factors and diagnostic outcomes. Results indicated that smoking and alcohol consumption were the most significant independent risk factors, displaying a synergistic effect in disease progression. Other variables explored were exposure to air pollution, HPV and EBV infections, age, dietary deficiencies in vegetables, and genetic predispositions. While some factors were statistically significant, others showed weaker associations. This study highlights the importance of preventive strategies focusing on modifiable risk factors, such as lifestyle changes and viral vaccination, to reduce the incidence of HNSCC.

Abstract

Religious teachings are essential to note in seeing the phenomenon of massive Islamic social movements that occur around the world and awareness of a humanitarian movement based on dogmatic values and moral foundations. Previous studies have not explored the aspect of religious teachings on Islamic social movements in the context of armed conflict, so this research must be carried out. Previous studies have focused more on antitheses to misinterpretations of Islamic teachings and less on accommodating philanthropic perspectives in war analysis and macro implications in the digital age. This study covers the interpretation of Islamic teachings that encourage philanthropy, Islamic social movements, and morality-based solidarity in response to the Israeli-Palestinian conflict. The desk research method is used to collect data through the Quran, Hadith, social media, and library research. The stages of analysis include the interpretation of the postulates that encourage philanthropy, the perspective of social movements, and fundamental moral theories to provide a holistic picture of the phenomenon of Islamic philanthropy in the digital era. The findings of this study include the conclusions of Islamic religious teachings that invite Muslims to do philanthropy, the internalization of religious teachings as a driver of Islamic social movements, and moral encouragement that influences an actor’s action in doing philanthropy. The resulting recommendations involve the collaboration of state institutions with all levels of society to ensure security and increase legitimacy in conducting fundraising and providing assistance to victims of armed conflict in Palestine.

Abstract

This research explains various efforts to prevent and overcome sexual violence in higher education. This research uses normative research methods with a legislative and historical approach and analyzes the problems raised by legal protection theory and legal theory as a social engineering tool. The Chancellor of UIN Sunan Ampel formed a Task Force for the Prevention and Control of Sexual Violence. The Task Force Team is tasked with outreach to work units within the UIN Sunan Ampel environment. The outreach is carried out by holding lectures via Zoom meetings or face-to-face and by making short educational videos about efforts to prevent and handle sexual violence. In addition, it also provides a hotline channel to report acts of sexual violence, providing a space to receive direct reports from victims and assistants them. This effort aligns with the promulgation of Law Number 12 of 2022 concerning Crimes of Sexual Violence. From a progressive legal perspective, legislation is expected to encourage social change in society, especially the environment, in terms of preventing and dealing with sexual violence in higher education environments to create safe university institutions free from sexual violence.

Abstract

Most of the Criminal Laws implemented in Indonesia come from the provisions contained in the Penal Code inherited from the Netherlands with some amendments. Although its coverage, several criminal laws are regulated outside the Penal Code. It was often heard that there are efforts to revise the Penal Code through the Criminal Code Bill, however, Indonesia has not yet succeeded in passing the Criminal Code Bill. One input in the reform of the Criminal Code Bill is its adaptation to the development of the community, its adjustment with the norms of community that is derived from religious teachings. In the Criminal Code Bill aside from being a codification of all rules related to crime, it is also expected to further strengthen the existence of Islamic criminal law through the values ??of justice, equality, and utility. These values ??are the essence of Islamic Criminal Law through understanding the concept of "qat'iy and dhanny". Even though the guidelines and references used are a positive legal system, the essence contained is in accord with the values ??of Islamic Criminal Law. Abstrak: Sebagian besar Hukum Pidana yang berlaku di Indonesia berasal dari ketentuan yang ada di dalam KUHP yang merupakan hukum pidana warisan Belanda dengan beberapa perubahan ketentuannya, meskipun begitu ada beberapa ketentuan pidana yang berlaku di Indonesia yang diatur diluar KUHP. Sering terdengar bagi kita bahwa terdapat upaya untuk merevisi KUHP melalui RUU KUHP, Akan tetapi Indonesia sampai saat ini belum berhasil mengesahkan RUU KUHP tersebut. Salah satu masukan dalam penyempurnaan RUU KUHP tersebut adalah dengan menyesuaikannya terhadap perkembangan kondisi masyarakat serta memasukkan norma-norma yang berkembang dan berlaku dimasyarakat, dimana sebagian besar norma-norma tersebut berasal dari nilai ajaran agama. Dalam RUU KUHP disamping sebagai kodifikasi seluruh aturan terkait dengan pidana juga diharapkan semakin memperkuat eksistensi hukum pidana Islam melalui nilai-nilai keadilan, kesetaraan, persamaan serta kemaslahatan. Nilai-nilai tersebut merupakan esensi dari Hukum Pidana Islam melalui pemahaman konsep “qat’iy dan dhanny”. Sehingga meskipun pedoman/acuan yang dipakai dalam system hukum nasional di Indonesia merupakan hukum positif perundang-undangan, akan tetapi didalamnya terdapat esensi nilai-nilai Hukum Pidana Islam.

Abstract

This article examines the application of the Miranda rule concept in Criminal Procedure Law in Indonesia which is viewed from the perspective of maqa>s}id ash-syari>'ah. The research method used in this research is normative law which is described in an explorative-qualitative manner. The results of the study explain that the existence of The Miranda Rule concept in the Criminal Procedure Code in Indonesia is not entirely included. It is limited only to Article 52 of the Criminal Code which gives freedom to suspects or defendants in giving information. The right to remain silent is not justified in the Criminal Procedure Code as in Mirnada Right. This is because in some cases there was coercion by the authorities which then led to an inaccurate decision by the court. So maqa>s}id ash-syari>'ah views the concept of the miranda rule of benefit to be applied in criminal law in Indonesia, especially the Criminal Procedure Code as a form of safeguarding human dignity and human rights. Mistakes or harm should be minimized or even eliminated when dealing with human life or human dignity. So the author concludes that it is necessary for lawmakers or in this case the legislature and the government to carry out legal reforms to the existence of the rights of suspects or defendants in procedural law in accordance with the objectives or benefits of a law.

Abstract

The capital is a city designed and used as the center of government of a country as well as a symbol of that country's identity. The move of the country's capital from Jakarta to East Kalimantan (the archipelago's capital) has several reasons, one of which is that Jakarta is no longer suitable for use as the country's capital. The archipelago's capital city is in the form of a particular regional government with an authority body appointed directly by the president after consultation with the DPR. Still, there is no maximum limit on the number of times a person can serve as Head and Deputy Head of the Authority Body. Apart from that, in the archipelago's capital city, there is no DPRD like in other regions, so this is a problem within the scope of Indonesian state administration. This research is included in the category of normative legal research with several approaches, namely the statutory approach and conceptual approaches, as well as using primary and secondary legal materials. The results of this research show that in the context of regional autonomy, the IKN regional government remains under the central government's jurisdiction. The central government still has a role in supervising IKN regional government activities, safeguarding national interests, and providing necessary support. Implementing the National Capital Special Regional Government (IKN) for the archipelago to realize good governance requires active community involvement in decision-making. In the absence of general elections for DPRD members in IKN Nusantara, aspects of representation and legitimacy can be questioned. In addition, an unlimited term of office for the head of the IKN Authority and his deputies could hurt the implementation of good governance. A better mechanism for regular leadership changes is needed to achieve good governance so there is a healthy rotation of power and opportunities for new and qualified leaders to lead. It can create better oversight and transparency in decision-making and minimize the risk of abuse of power.

Abstract

Patronage in Indonesian elections often occurs, especially among political elites and legislative candidates. It may be due to the need for candidates to gain votes and support from the public, and the practice of patronage is considered effective in achieving this goal. The study aims to identify voter patronage practices and measure the impact of patronage practices on the credibility of democracy in Indonesia. This research is qualitative, and data is obtained through document analysis and related literature. Election patronage practices can take many forms, ranging from money or goods to voters, unrealistic political promises, to employing positions or powers to influence voter decisions. The study found that patronage practices can significantly impact the credibility of democracies, thus disrupting democratic processes and affecting the quality of elections in Indonesia. The approach can undermine democratic principles that are supposed to be based on free and fair participation and competitive competition based on political ideas and visions. When elections were influenced by material benefits rather than political views, the public felt that elections no longer represented their aspirations and interests, resulting in dubious legitimacy over the elected government. Therefore, efforts are needed to combat patronage practices in general elections in Indonesia. This can be done through implementing strict regulations related to campaign funding and political practices, education and political literacy for the public, strict law enforcement for patronage practices, and improving the general election system to make it more transparent and accountable
