Abstract

The implementation of auctions through Instagram social media often does not provide legal certainty for the parties participating in the auction because many in its implementation are not in accordance with the regulation of the Minister of Finance Number 213/PMK.06/2020 concerning auction implemention guidelines. So that in its implementation can cause disadvantage for the parties carrying out the auction. The research used descriptive analytical juridical normative method. Primary data and secondary data were obtained from library research and field research. The result of the research shows that the legal status of the Instagram account @usedbapeofficial was not an official auction house because it did not meet the requirements as an auction house, which should be in the form of limited liability company and obtaining permission form the Minister. Legal certainty for the owner of the goods has been carried out by @usedbapeofficial in the form of the payment proceeds being transferred to only one account, namely Kenneth Lee’s account as the account owner but does not provide legal certainty regarding when the owner of the goods will receive payment for the goods he auctions, legal certainty for the auction winner has been provides in the form of information that is listed in accordance with the format filled in by the owner of the goods. Legal protection for the owner of the goods is given in the form of holding funds in the @usedbapeofficial account until the goods are received by the buyer, while for the auction winner the legal protection is in the form of preventive and repressive legal protection. The conclusion of this research is the legal status of Instagram account @usedbapeofficial is not an official auction house. Legal certainty for the owner of the goods and the auction winner has not been fulfilled because most of the implementation of the auction on the Instagram account @usedbapeofficial do not comply with the provisions in the regulations of the Minister of Finance Number 213/PMK.06/2020 concerning auction implementation guidelines. Legal protection for the owner of the goods provided by @usedbapeofficial in the form of money auction sales is accommodated in one account, while legal protection for the auction winner has not been fully fulfilled because in its implementation legal protection is not provided by @usedbapeofficial in full to the injured party. It is recommended to @usedbapeofficial to improve the auction procedure into a buying and selling account with an auction mechanism and register its business as a Limited Liability Company, it is suggested to the government to update the regulations governing auction activities through social media, especially Instagram.

Abstract

AbstractDisputes are inevitable. Disputes can occur in almost all aspects of life . In Karo communities, disputes are generally associated with the object of inheritance . Land as one of the objects of inheritance is considered to have  more value in Karo communities . Therefor  disputes that occur are usually associated with land ownership . Due to the disputes that happens is still in the realm Karo local law, then  Karo customary law and existing national laws should be taken into account.IntisariSengketa merupakan hal yang tidak terelakkan dalam kehidupan bermasyarakat. Sengketa dapat terjadi dalam hampir seluruh aspek kehidupan. Pada masyarakat adat Karo sengketa yang terjadi pada umumnya berkaitan dengan objek waris. Tanah sebagai salah satu objek waris dianggap memiliki nilai “lebih” dalam masayarakat adat Karo. Untuk itu sengketa waris adat yang terjadi biasanya berkaitan dengan kepemilikan tanah. Dikarenakan sengketa waris yang terjadi masih dalam ranah masyarakat adat, maka dalam penyelesaiannya juga tetap memperhatikan hukum adat dan hukum nasional yang ada.

Abstract

Tujuan penelitian ini untuk mengetahui dan menganalisis tentang penyelenggaraan pengadaan tanah untuk pembangunan Irigasi Batang Bayang; proses penetapan ganti kerugian yang dilakukan panitia hingga menimbulkan gugatan dalam Putusan Nomor 32/Pdt.G/2020/PN Psb; dan analisis yang digunakan dalam penilaian ganti kerugian pengadaan tanah pembangunan irigasi Batang Bayang pada Putusan Nomor 32/Pdt.G/2020/PN Psb. Penelitian ini merupakan penelitian yuridis normatif bersifat preskriptif. Teknik pengumpulan data dilakukan dengan studi pustaka dan studi lapangan. Hasil penelitian disimpulkan bahwa penyelenggaraan pengadaan tanah untuk pembangunan Irigasi Batang Bayang telah sesuai dengan peraturan perundang-undangan. Proses penetapan ganti kerugian yang dilakukan panitia hingga menimbulkan gugatan dalam Putusan Nomor 32/Pdt.G/2020/PN Psb Dilakukan dengan proses penghitungan atau penilaian dalam mengadakan pembebasan tanah ganti kerugian yang mempunyai kewenangan dalam hal ini Tim Appraisal.Analisis yang digunakan dalam penilaian ganti kerugian pengadaan tanah pembangunan irigasi Batang Bayang pada Putusan Nomor 32/Pdt.G/2020/PN Psb dengan menentukan nilai tanah terhadap tanah yang akan diberikan ganti kerugian untuk pembangunan proyek dinilai belum merepresentasikan keadilan.

Abstract

Perbuatan hibah sering menimbulkan permasalahan yang berujung pada sengketa antara penerima hibah dan ahli waris pemberi hibah seperti dalam Putusan Perkara No. 2681/K/PDT/2015. Perdebatannya adalah mengenai kekuatan surat penyerahaan tanah objek hibah tahun 1901 yang hanya berupa Surat Penyerahan Tanah atau surat di bawah tangan. Adapun tujuan penelitian ini untuk menganalisis kekuatan pembuktian surat hibah tanah di bawah tangan menurut hukum perdata dan analisa pertimbangan dan putusan hakim berkaitan dengan Surat hibah dibawah tangan dalam Putusan tersebut. Penelitian ini menggunakan metode penelitian hukum normatif bersifat deskriptif analitis. Hasil penelitian menyatakan bahwa kekuatan hukum pembuktian hibah tanah dalam bentuk surat di bawah tangan berlaku terhadap orang yang untuk siapa hibah itu diberikan, sedangkan terhadap pihak lain, kekuatan pembuktiannya bergantung pada penilaian Hakim berdasarkan pembuktian bebas; Pertimbangan dan putusan hakim berkaitan dengan Surat hibah dibawah tangan tersebut telah memperoleh keyakinan hakim berdasarkan kekuatan pembuktian nya secara formil dan materil, sehingga putusan hakim telah merepresentasikan kepastian hukum karena tetap berlaku dan mengikat para tergugat dan penggugat serta tidak dapat ditarik atau dicabut kembali.

Abstract

The obligation to provide plasma plantations is also one of the requirements for obtaining land rights in the form of Cultivation Rights (HGU) by the Company, as stipulated in the Regulation of the Minister of Agrarian Affairs and Spatial Planning/Head of the National Land Agency of the Republic of Indonesia No. 7 of 2017 concerning Regulations and Procedures for Determining Cultivation Rights, which in Article 40 letter (k) and Article 41 states: "One of the obligations of HGU Holders is to Facilitate the development of local community gardens of at least 20% (twenty percent) of the land area The HGU application for the surrounding community is in the form of a partnership (plasma) in accordance with the business activity permit from the competent technical agency, and the application for partnership (plasma) land rights is submitted simultaneously with the company's HGU application." To achieve one of the goals of the Republic of Indonesia as stated in paragraph IV of the preamble to the 1945 Constitution of the Republic of Indonesia, namely to advance general welfare, the abundance of palm oil production must be utilized as much as possible for national development strategies, this is carried out from various functions related to economics, ecology and socio-culture. Regulations related to the obligation to facilitate the development of plasma plantations have been amended through Law no. 11 of 2020 concerning Job Creation as amended by Government Regulation in Lieu of Law No. 2 of 2022 which was promulgated through Law no. 6 of 2023 has been adjusted and regulated in more detail in its derivative regulations, namely Government Regulation no. 26 of 2021 concerning the Implementation of the Agricultural Sector and Minister of Agriculture Regulation No. 18 of 2021 concerning Facilitation of the Development of Gardens in Surrounding Communities.

Abstract

Decision number 413/Pdt.G/2024/PN Mdn discusses the legal process for filing a lawsuit based on Article 271Rv. This case involved several parties, with the plaintiff filing to withdraw the lawsuit before the defendant gave an answer. The court stated that the action was in accordance with applicable legal provisions. The process of withdrawing the lawsuit in this case occurred before the lawsuit was read, at which point the judge stated that the withdrawal was not contrary to the law. The judge decided to grant the revocation and ordered the removal of the lawsuit from the register. In the context of Indonesian law, Article 271Rv is the main reference in handling the revocation of the lawsuit. This article allows the plaintiff to withdraw his lawsuit on condition that the withdrawal is carried out before there is a response from the defendant

Abstract

This research explores the role of Land Banks in handling and developing abandoned land in Indonesia. Through a qualitative approach using interviews and secondary data analysis, this research identified several key findings related to inventory, procurement, distribution and utilization of abandoned land. The research results show that although the Land Bank has made great efforts to manage abandoned land more efficiently and effectively, there are still a number of challenges that need to be overcome, such as a lack of accurate data, resistance from land owners, and lack of access to resources and technology. To overcome these challenges, the research recommends improving inter-agency coordination, participatory approaches in land acquisition, development of comprehensive mentoring programs, ongoing education and training for communities, as well as policy support that supports access to microcredit and marketing facilities. By implementing these recommendations, it is hoped that the Land Bank can function more effectively in supporting sustainable development and improving the welfare of society in Indonesia..
