Abstract

Land has a very important role for human life because land is a place to carry out life activities, because of its large role it can also cause legal problems, such as the existence of Land Use Rights Number 1 on behalf of the Regional Government of Nanggroe Aceh Darussalam Province which was granted in 1989 by The Ministry of Basic Chemical Industry based on the Grant Charter No. 566/DJ.KD/VIII/1983 dated August 3, 1983. It is located in Simpang Kelaping village, Kala Pegasing, Kung, Pegasing District, Central Aceh Regency, better known as Belang Bebangka, with an area of ​​122 Ha. The land is partly from State land and partly from customary-owned land, initially the land will be built by the Takengon Paper Project by the central government in this case the Ministry of Basic Industry/Mining. 1 since it was handed over by the Ministry of Basic Industry in 1989 until now, what has happened is that people who claim to be Penghulu Gading, namely groups of heirs and those who claim to have rights to the land on the land, manage directly, and even some have transferred their rights by selling buy. The problems that have occurred in this area have been going on for years until now there has not been a meeting point between the Aceh Provincial Government, Central Aceh District Government and the community. In this regard, the guarantee of legal capacity is very necessary.

Abstract

Land Deed Making Officials (henceforth referred to as PPAT) is the public official who is authorized to make authentic deeds concerning certain legal action regarding land or property rights over flat units. PPAT is demanded to work carefully, thoroughly and responsibly because the PPAT deed is used as evidence for the transfer of land rights. When PPAT is negligent in making the deed then it may result in loss for others. As in the Supreme Court verdict No.156K/Pdt/2020, where PPAT has been negligent in making the deed and resulted loss experienced by the buyer due to the loss payment and the land he had purchased. Even though the buyer has made sale and purchase clearly before the PPAT, that PPAT deed should be able to provide legal certainty. Therefore, this research is trying to analyze and answer the problems on to what extend is the legal accountability of PPAT when the sale and purchase deed of inherited land that made before him is cancelled by the Supreme Court, to what extend is the legal protection for buyer against the negligence committed by PPAT in making the sale and purchase deed of inherited land that has not been divided and whether judge’s decision in the Supreme Court verdict No.156K/Pdt/2020 has accommodated protection for the buyer.

Abstract

In article 7 paragraph (1) letter t of the Sibolga Mayor Regulation Number 16 of 2018 concerning the Utilization of Coastal Areas and Coastal Borders in Sibolga City, it is stated that the coastal area and coastal border can be used for one of the other existing buildings and/or existing buildings. have permission. The problems include the legality and control of the use of coastal areas where buildings are built, the application of the Sibolga Mayor Regulation number 16 of 2018, and the application for registration of rights in coastal areas at the Sibolga Land Office. This type of research is an empirical juridical research with descriptive analysis. The results of the research The community building on the coastal border and above sea level does not have legality and official permission from the Sibolga City Government. There are no detailed and specific rules in these articles to be used as guidelines for the use of coastal areas related to border boundaries, procedures for obtaining permits from the Sibolga City government. The application for registration of rights in the coastal area of ​​ Kelurahan Pasar Belakang, Sibolga Kota District has not been processed because the Law has not provided more concrete arrangements, especially regarding the granting of types of settlement rights on the coastal border and on water marine.

Abstract

penyelesaian sengketa tanah oleh Keuchik di Gampong Keude Mane, hambatan Keuchik dalam menyelesaikan sengketa tanah di Gampong Keude Mane, dan Eksistensi peran Keuchik dalam penyelesaian sengketa tanah di Gampong Keude Mane. Jenis penelitian yang digunakan adalah penelitian yuridis normatif dan bersifat deskriptif analitis. Sumber data berasal dari data primer dan data sekunder yang didapat melalui teknik pengumpulan data studi lapangan dan studi kepustakaan. Data yang terkumpul selanjutnya di analis secara kualitatif. Hasil penelitian disimpulkan bahwa mekanisme penyelesaian sengketa tanah oleh Keuchik Gampong Keude Mane adalah dengan menganalisis persoalan, kemudian mempertemukan para pihak, apabila tercapai kesepakatan maka sengketa tersebut dinyatakan selesai, tetapi jika tidak ada kesepakatan maka dapat di ajukan untuk banding ke tingkat mukim. Apabila tidak juga selesai maka para pihak bisa membawa persengketaan ke jalur pengadilan yakni Pengadilan Negeri setempat. Upaya yang dilakukan Keuchik dalam penyelesaian sengketa sesuai pola adat Aceh seperti Penyelesaian Sengketa Bentuk Sayam, Suloh, Peusijuek, dan Peumat Jaroe. Keuchik berwenang sebagai hakim ketua majelis sidang adat gampong dan tuha peut, imeum meunasah serta kaum cerdik pandai lainnya sebagai hakim anggota, keberadaan keuchik dalam peradilan adat gampong adalah suatu keharusan. Saran penelitian bahwa sebaiknya putusan penyelesaian sengketa tanah yang diputus oleh Keuchik tersebut dituliskan dalam bentuk akta perdamaian.

Abstract

Tujuan penelitian ini untuk mengetahui dan menganalisis tentang penyelenggaraan pengadaan tanah untuk pembangunan Irigasi Batang Bayang; proses penetapan ganti kerugian yang dilakukan panitia hingga menimbulkan gugatan dalam Putusan Nomor 32/Pdt.G/2020/PN Psb; dan analisis yang digunakan dalam penilaian ganti kerugian pengadaan tanah pembangunan irigasi Batang Bayang pada Putusan Nomor 32/Pdt.G/2020/PN Psb. Penelitian ini merupakan penelitian yuridis normatif bersifat preskriptif. Teknik pengumpulan data dilakukan dengan studi pustaka dan studi lapangan. Hasil penelitian disimpulkan bahwa penyelenggaraan pengadaan tanah untuk pembangunan Irigasi Batang Bayang telah sesuai dengan peraturan perundang-undangan. Proses penetapan ganti kerugian yang dilakukan panitia hingga menimbulkan gugatan dalam Putusan Nomor 32/Pdt.G/2020/PN Psb Dilakukan dengan proses penghitungan atau penilaian dalam mengadakan pembebasan tanah ganti kerugian yang mempunyai kewenangan dalam hal ini Tim Appraisal.Analisis yang digunakan dalam penilaian ganti kerugian pengadaan tanah pembangunan irigasi Batang Bayang pada Putusan Nomor 32/Pdt.G/2020/PN Psb dengan menentukan nilai tanah terhadap tanah yang akan diberikan ganti kerugian untuk pembangunan proyek dinilai belum merepresentasikan keadilan.

Abstract

Perbuatan hibah sering menimbulkan permasalahan yang berujung pada sengketa antara penerima hibah dan ahli waris pemberi hibah seperti dalam Putusan Perkara No. 2681/K/PDT/2015. Perdebatannya adalah mengenai kekuatan surat penyerahaan tanah objek hibah tahun 1901 yang hanya berupa Surat Penyerahan Tanah atau surat di bawah tangan. Adapun tujuan penelitian ini untuk menganalisis kekuatan pembuktian surat hibah tanah di bawah tangan menurut hukum perdata dan analisa pertimbangan dan putusan hakim berkaitan dengan Surat hibah dibawah tangan dalam Putusan tersebut. Penelitian ini menggunakan metode penelitian hukum normatif bersifat deskriptif analitis. Hasil penelitian menyatakan bahwa kekuatan hukum pembuktian hibah tanah dalam bentuk surat di bawah tangan berlaku terhadap orang yang untuk siapa hibah itu diberikan, sedangkan terhadap pihak lain, kekuatan pembuktiannya bergantung pada penilaian Hakim berdasarkan pembuktian bebas; Pertimbangan dan putusan hakim berkaitan dengan Surat hibah dibawah tangan tersebut telah memperoleh keyakinan hakim berdasarkan kekuatan pembuktian nya secara formil dan materil, sehingga putusan hakim telah merepresentasikan kepastian hukum karena tetap berlaku dan mengikat para tergugat dan penggugat serta tidak dapat ditarik atau dicabut kembali.

Abstract

This research explores the role of Land Banks in handling and developing abandoned land in Indonesia. Through a qualitative approach using interviews and secondary data analysis, this research identified several key findings related to inventory, procurement, distribution and utilization of abandoned land. The research results show that although the Land Bank has made great efforts to manage abandoned land more efficiently and effectively, there are still a number of challenges that need to be overcome, such as a lack of accurate data, resistance from land owners, and lack of access to resources and technology. To overcome these challenges, the research recommends improving inter-agency coordination, participatory approaches in land acquisition, development of comprehensive mentoring programs, ongoing education and training for communities, as well as policy support that supports access to microcredit and marketing facilities. By implementing these recommendations, it is hoped that the Land Bank can function more effectively in supporting sustainable development and improving the welfare of society in Indonesia..
