Abstract

[Registration Of Land As To Minimize The Conflict Over Land] Observing a lot of land conflicts in Indonesia which is constantly increasing, and followed by the rapidly growing populations that caused the demand for land will also increase automatically. While the number of the available land is limited. This condition will surely causes problems on controlling and ownership of the land. This research aims to identify the factors which causes conflict of land, by doing inventory to the lands which is owned by the community (whether it is registeredor not registered). The method which is used in this research is empirical normative legalresearch, by using secondary data and primary data. Secondary data is obtained through literature studies, while primary data is obtained directly from interviewees by using interview guide and questionnaire. Research location is at Deli Serdang, from 23 districts in Deli Serdang, 7 districts are taken and were made in samples from each district are assigned 100 respondents. From this research result, it is known that, the implementation of the land registration in Deli Serdang district has not happened as expected. It can be seen from the number of land which has not been registered, this condition will certainly trigger conflicts or disputes in society, both ownership boundary disputes, control of illegal land, inheritance disputes. Certificate ownership mostly only exist in urban area. The lack of interest by the community to join the land registration is due to various of reasons, which is: the community do not recognized the purpose of land registration, the cost is expensive, the management is convoluted, the community feels that it is not a necessary to do it, arable land. Abstract

Land has a very important role for human life because land is a place to carry out life activities, because of its large role it can also cause legal problems, such as the existence of Land Use Rights Number 1 on behalf of the Regional Government of Nanggroe Aceh Darussalam Province which was granted in 1989 by The Ministry of Basic Chemical Industry based on the Grant Charter No. 566/DJ.KD/VIII/1983 dated August 3, 1983. It is located in Simpang Kelaping village, Kala Pegasing, Kung, Pegasing District, Central Aceh Regency, better known as Belang Bebangka, with an area of ​​122 Ha. The land is partly from State land and partly from customary-owned land, initially the land will be built by the Takengon Paper Project by the central government in this case the Ministry of Basic Industry/Mining. 1 since it was handed over by the Ministry of Basic Industry in 1989 until now, what has happened is that people who claim to be Penghulu Gading, namely groups of heirs and those who claim to have rights to the land on the land, manage directly, and even some have transferred their rights by selling buy. The problems that have occurred in this area have been going on for years until now there has not been a meeting point between the Aceh Provincial Government, Central Aceh District Government and the community. In this regard, the guarantee of legal capacity is very necessary.

Abstract

Lahirnya Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja diakui pemerintah akan mewujudkan pembangunan berkelanjutan dan menyelesaikan masalah dalam sektor pengelolaan pulau-pulau kecil. Undang-Undang Cipta Kerja bertujuan untuk mendorong perluasan dan percepatan investasi, menyederhanakan persyaratan dasar untuk perizinan. Penelitian ini bertujuan untuk mengetahui undang-undang cipta kerja mempengaruhi masuknya investor asing dan tenaga kerja asing di Indonesia, bagaimana ruang lingkup aspek penataan ruang terhadap perubahan yang dilakukan pasca berlakunya undang-undang cipta kerja dan bagaimana pengaruh percepatan investasi dalam pengelolaan pulau-pulau kecil pasca berlakunya undang-undang cipta kerja. Penelitian ini menggunakan pendekatan penelitian yuridis normatif yang bersifat deskriptif. Dengan menggunakan data sekunder dan bahan hukum primer, sekunder dan tersier dan analisa kualitatif. Penelitian ini menunjukan bahwa Undang- Undang No. 11 Tahun 2020 tentang Cipta Kerja bertujuan untuk menyerap tenaga kerja Indonesia yang seluas-luasnya di tengah persaingan yang semakin kompetitif dan tuntutan globalisasi ekonomi, dengan melakukan penyesuaian pada berbagai aspek pengaturan yang berkaitan dengan kemudahan, perlindungan, dan pemberdayaan koperasidan usaha mikro, kecil, dan menengah, peningkatan ekosistem investasi, dan percepatan proyek strategis nasional, termasuk peningkatan perlindungan dan kesejahteraan pekerja guna melakukan percepatan investasi khsusnya dalam bidang pengelolaan pulau-pulau kecil. Dapat disimpulkan bahwa semakin baiknya suatu aturan serta pengawasan dalam undang-undang cipta kerja, maka tidak akan menimbulkan suatu kesenjangan antar pihak yang memanfaatkan pulau-pulau kecil.

Abstract

ABSTRAK Of 1,242 parcels of wakaf land in Medan, 663 of them have been certified and 393 have not, and 186 of them were in the process in the National Land Board and several of them have not been registered which will possibly cause dispute. Wakaf is expected to be able to improve people’s welfare, especially Moslems. Therefore, it is necessary to keep the assets of registered and unregistered wakaf land. The problems of the research were as follows: first, how about the correlation between Nazir and BWI (Indonesian Wakaf Board) of North Sumatera, related to the management of unregistered wakaf land in Medan; secondly, how about the obstacles faced by Nazir and BWI of North Sumatera in managing unregistered wakaf land; and thirdly, how about the role BWI in controlling the management of unregistered wakaf land in Medan. Abstract

ABSTRACT Bangun Sari Village Community, Tanjung Morawa Sub-district Deli Serdang Regency whose homes and land have been compensated by the Government for the construction of Medan-Kualanamu-Tebing Tinggi Highway, feels aggrieved by the government's policy to raise the recently replaced land price Loss or in 2016. In the period of 2013-2015 the people whose land and houses have been compensated at Rp.236.000/meter (two hundred thirty six thousand rupiah/meter) regardless of the status of land ownership of either the Certificate of Property (SHM) Or other rights basis are all paid at the same price. However, it is very different from some of the people of Bangun Sari Baru Village whose homes and land were compensated in 2016 have increased dramatically to 300% (three hundred percent) and added some additional clause items starting from non-physical losses (premium, Solatium, and transaction costs) and the compensation of the waiting period. Therefore, it is necessary to examine the basis of the compensation arrangement for land taken by the state for the public interest. Non-compliance with compensation for houses and land obtained by the community of Bangun Sari Village, Tanjung Morawa Sub-district of Deli Serdang Regency for the construction of Medan-Kualanamu-Tebing Tinggi Highway. Efforts that can be made by the people of Bangun Sari Village, Tanjung Morawa Sub-district, Deli Serdang Regency, due to inconsistency of compensation for houses and land that have been compensated by the Government for the construction of Medan-Kualanamu-Tebing Tinggi Highway.   Keywords: Toll Road, Public Interest and Indemnification

Abstract

Abstract. The problems of this thesis is whether the provisions of the consignment in the procurement of land for the construction of public interest in accordance with the care that is mentioned in the BW / Civil Code, why legally consignment justified in the procurement of land for development in the public interest, and whether care compensation (consignment) of the land used for construction of the public interest is in conformity with the principles of the agreement. This type of research used in this research is a kind of normative juridical research, descriptive analysis. The data analysis was conducted using qualitative analysis. The survey results revealed that the care for damages (consignment) in different land acquisition or do not fit as well as the shift in meaning with care as in the Civil Code, as consignment in land procurement relationship between the government and community objections regarding the huge amount of compensation given, whereas in the Civil Code to repay debt due receivables arising under a contract in an engagement relationship.   Keywords: Custody Compensation (Consignment), Land Procurement,  Public Interest.

Abstract

Abstract. In Indonesia, the implementation of corporate social responsibility (CSR) was regulated in Law Number 40 of 2007 about Limited Company which contained in Chapter V Article 74, the further provision about Social and Environmental Responsibility were regulated with Governments Regulation No. 47 of 2012 in Article 4.  The fund which channeled through corporate social responsibility was in the amout of 1% of net sales (Net Sales). The CSR implementation constraint which experienced by PT. Toba Pulp Lestari, Tbk in an internal company manner was in the implementation of social investment (development) program. Likewise, the external constraint which experienced by PT Toba Pulp Lestari, Tbk among others, were the existence of management institution of CD / CSR fund company formed by the Regional Government which previously formed and the result of report after audited "Not Stating Opinion" (Disclaimer). The existence of partly districts which were late in submitting the program and even there are some who never submit the program and the formation of a new district, which result in change in the calculation of the company's CD / CSR fund allocation budget. Abstract

Tujuan penelitian ini untuk menganalisis politik hukum terhadap pembangunan untuk kepentingan umum atas tanah abrasi pasca hadirnya undang-undang yang memuat peraturan tentang cipta kerja. Berbagai macam pendekatan seperti pendekatan peraturan perundang-undangan dan pendekatan konseptual menjadi instrument pada jenis penelitian yuridis normatif yang digunakan sebagai metode dalam penelitian ini. Penemuan dari hasil penelitian yang dilakukan bahwa telah ditambahkan kepentingan umum seperti halnya termaktub dalam pasal yang mengatur tentang pengadaan tanah sebanyak 6 (enam) kegiatan meliputi kawasan industri, ekonomi khusus, pariwisata, ketahanan pangan, industri gas, industri minyak, dan pengembangan teknologi. Hapusnya hak atas tanah karena tanah musnah bersamaan dengan pemberian kesempatan kepada pemegang kuasa atas tanah untuk perlu membangun kembali dan merevitalisasi atas pendayagunaan tanah dan diatur di dalamnya tentang pihak lain yang dapat melakukan rekonstruksi dan revitalisasi berdasarkan pemberian dana kerohiman pada kuasa atas tanah atau kuasa pendayagunaan. Adanya perubahan-perubahan tersebut diatas akan menjadi sebuah langkah lebih dekat demi terwujudnya keadilan, kesejahteraan dan kemakmuran dalam pemberian kompensasi terhadap tanah musnah. The purpose of this research is to analyze the legal politics of development in the public interest on abraded land after the presence of a law that contains regulations on work creation. Various approaches, such as the statutory and conceptual approach, become instruments for the type of normative juridical research that is used as a method in this research. The findings from the results of research conducted that public interest has been added as stated in the article that regulates land procurement as many as 6 (six) activities covering industrial areas, special economy, tourism, food security, gas industry, oil industry, and technology development. The abolition of land rights because the land is destroyed simultaneously with the opportunity for the holder of the power over the land to need to rebuild and revitalize the utilization of the land and it is regulated in it by other parties who can carry out reconstruction and revitalization based on the provision of spiritual funds to the power over land or the power of utilization. With the changes mentioned above, it is seen that it will be a step closer to the realization of justice, welfare, and prosperity in providing compensation for the destroyed land.

Abstract

Abstract Acts of decency are all kinds of behavior with sexual connotations that are carried out unilaterally and are not expected by the target person, causing negative reactions, shame, anger, offense at the person who is a victim of sexual harassment. It is concluded that the criminal responsibility of children as perpetrators of the criminal act of rape against children is an effort to protect child victims of the crime of rape because it is one of the crimes against decency as regulated in Article 285 of the Criminal Code, while according to the Criminal Code Bill is regulated in Chapter XVI Concerning the Crime of Morality, Paragraph 1, which reads: "Convicted for committing the crime of rape, with a minimum imprisonment of 3 (three) years and a maximum of 12 years. Legal protection for children who are victims of the crime of rape which results in pregnancy and preventive and repressive measures, both by the community and the government (through law enforcement officials), such as providing protection / supervision from various threats that can endanger the victim's life. Case of the crime of rape committed by children against children in the Supreme Court decision Number 3440 K / Pid.Sus / 2019.Keywords: Criminal Liability, Children, Rape. Abstrak Tindak pidana kesusilaan adalah segala macam bentuk perilaku yang berkonotasi seksual yang dilakukan secara sepihak dan tidak diharapkan oleh orang yang menjadi sasaran sehingga menimbulkan reaksi negatif, rasa malu, marah, tersinggung pada diri orang yang menjadi korban pelecehan seksual tersebut. Disimpulkan bahwa Pertanggungjawaban pidana anak sebagai pelaku tindak pidana pemerkosaan kepada anak sebagai upaya melindungi anak korban tindak pidana pemerkosaan karena merupakan salah satu kejahatan terhadap kesusilaan yang diatur dalam Pasal 285 KUHP, Sementara menurut RUU KUHP diatur dalam Bab XVI Tentang Tindak Pidana Kesusilaan Paragraf 1, yang berbunyi: “Dipidana karena melakukan tindak pidana perkosaan, dengan pidana penjara paling singkat 3 (tiga) tahun dan paling lama 12 tahun. Perlindungan hukum terhadap anak korban tindak pidana pemerkosaan yang mengakibatkan kehamilan adanya upaya preventif maupun represif, baik oleh masyarakat maupun pemerintah (melalui aparat penegak hukumnya), seperti pemberian perlindungan/pengawasan dari berbagai ancaman yang dapat membahayakan nyawa korban. Perkara tindak pidana pemerkosaan yang dilakukan anak terhadap anak  dalam putusan MA Nomor 3440 K/Pid.Sus/2019.Kata Kunci       :           Pertanggungjawaban Pidana, Anak, Pemerkosaan.
