Abstract

Pandemi Covid – 19 yang melanda Indonesia tidak menjadi penghalang dalam penyelesaian perkara di pengadilan. Mahkamah Agung yang merupakan lembaga peradilan turut serta dalam rangka melakukan inovasi yang cukup efektif dan efisien di tengah masa pandemi. Sistem peradilan secara elektronik (E-Court) yang telah dikonsep sejak tahun 2019 lalu dengan membentuk Peraturan Mahkamah Agung (PERMA) dapat membantu terwujudnya peradilan cepat, sederhana dan biaya ringan secara nyata dan efektif.

Abstract

Manusia sebagai makhluk sosial senantiasa berinteraksi dan bersosialisasi dengan manusia lainnya dan juga dapat dikatakan manusia selalu membutuhkan satu sama lain untuk bertahan hidup, interaksi atau yang juga disebut komunikasi selalu dilakukan dalam kehidupan sehari-hari baik secara sadar atau tidak. Penelitian ini mengkaji tentang Pengaruh Media Sosial Tiktok terhadap perilaku keagamaan di kalangan mahasiswa. Metode penelitian ini menggunakan pendekatan kuantitatif, juga menggunakan metode studi komparatif dengan responden penelitian yaitu mahasiswa muslim di Universitas Palangka Raya dan Institut Agama Islam Negeri Palangka Raya. Hasil penelitian ini menunjukkan bahwa penggunaan media sosial khususnya aplikasi TikTok digunakan mahasiswa dengan intensitas yang cukup tinggi dan kecenderung yang berbeda. Tidak hanya sekadar media komunikasi namun berkembang menjadi media hiburan atau media dakwah karena tertarik dengan berbagai konten/fitur agama. Penggunaan media sosial Tik tok yang secara terus menerus berdampak pada perilaku keagamaan yang kurang baik seperti melalaikan kewajiban beribadah.

Abstract

Banyak pelaku usaha di Kota Palangka Raya yang sudah memiliki merek terdaftar, namun belum disahkan, karena beberapa kendala salah satunya adalah nama produk yang terlalu umum. Tujuan Penelitian ialah untuk mengkaji Apa saja batasan-batasan merek yang harus disetujui oleh Kementerian Hukum dan HAM, dan bagaimana dunia usaha mendapatkan perlindungan atas merek usahanya. Metode penelitian adalah metode penelitian hukum empiris. Hasil penelitian adalah batasan merek yang dapat didaftarkan yaitu merek tersebut tidak bertentangan dengan ideologi negara dan peraturan perundang-undangan; tidak sama dengan, berkaitan dengan, atau hanya menyebutkan barang dan/atau jasa yang dimintakan pendaftarannya; tidak mengandung unsur yang dapat menyesatkan masyarakat mengenai asal, mutu, jenis, ukuran, jenis, tujuan penggunaan barang dan/atau jasa yang dimohonkan pendaftarannya atau merupakan nama suatu varietas tumbuhan yang dilindungi untuk barang dan/atau jasa sejenis. jasa; tidak memuat informasi yang tidak sesuai dengan kualitas, manfaat, atau khasiat barang dan/atau jasa yang dihasilkan; Memiliki daya pembeda; Merupakan nama umum dan/atau lambang milik umum. Abstract

The existence of Dayak customary law in Central Kalimantan plays an important role in resolving customary land disputes. Recognition of customary institutions and the authority of the Damang (Customary Chief) is affirmed in Central Kalimantan Provincial Regulation Number 16 of 2008. In practice, customary land disputes in Kurun District are often resolved through customary legal mechanisms without proceeding to formal courts. This study aims to analyze the position and authority of the Damang in enforcing Dayak customary law and the process of resolving customary land disputes based on the regulation, with a case study of Damang Decree Number 02/DKA/KK/I/2026. This research employs a legal research method with an empirical juridical approach using statutory and case approaches. Data were collected through literature review and interviews with the Damang Customary Chief, Mantir Adat (customary officials), and the disputing parties, and were analyzed qualitatively. The results indicate that the Damang holds a recognized customary authority with normative legitimacy to enforce customary law and resolve customary land disputes. The dispute resolution process involves complaint submission, examination, customary deliberation, site inspection of the disputed land, and the issuance of a Damang Decree accepted by the disputing parties without further litigation in formal courts.

Abstract

Artikel ini bertujuan mengkaji pertimbangan hukum Majelis Hakim dalam Putusan Mahkamah Agung Nomor 988 K/Pdt.Sus-HKI/2024 serta menganalisis perlindungan hukum terhadap pemilik merek dalam hubungan waralaba. Sengketa bermula dari tindakan penerima waralaba yang mendaftarkan merek dengan persamaan pada pokoknya terhadap merek milik pemberi waralaba sehingga menimbulkan dugaan itikad tidak baik. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan kasus melalui analisis Undang-Undang Nomor 20 Tahun 2016, KUH Perdata, serta putusan terkait. Hasil penelitian menunjukkan bahwa Mahkamah Agung tidak hanya berpegang pada asas first to file, tetapi juga mempertimbangkan itikad baik dan keadilan substantif. Perlindungan hukum diberikan secara represif dan restoratif melalui pembatalan pendaftaran merek dan pencoretan dari Daftar Umum Merek, sehingga menegaskan pentingnya kejujuran dalam sistem pendaftaran merek di Indonesia.

Abstract

This study discusses the analysis of the judge's decision regarding isbat nikah for husbands who have passed away, especially in Case Number: 409/Pdt.G/2023/PA.Plk. Isbat nikah is an important legal process to provide certainty of legal status, especially for couples who do not have a marriage certificate. This study aims to understand the judge's considerations in deciding the case and its implications for inheritance rights and civil administration. The method used is normative juridical research, which examines laws and regulations and court practice. The results of the study show that judges consider legal certainty and the interests of the parties in their decisions, which aims to protect the rights of the families left behind. In addition, the analysis shows the importance of marriage registration to avoid legal disputes in the future. These findings are expected to contribute to the development of marriage law and the protection of women's rights in the context of Islamic law in Indonesia.

Abstract

Digital transformation in the Society 5.0 era encourages the use of information technology in various aspects of life, including in notarial practice and the holding of General Meetings of Shareholders (GMS). Law Number 40 of 2007 concerning Limited Liability Companies through Article 77 has provided the legal basis for holding GMS through electronic media. However, detailed technical regulations are currently only available for Public Companies, thus creating a normative vacuum in the implementation of electronic GMS in Private Limited Companies, particularly regarding the preparation of deed releases by notaries. This study aims to analyze the implementation of the preparation of deed releases for Public Limited Companies GMS through electronic media by notaries and identify the normative, technical, and sociological obstacles that influence its implementation. This study uses an empirical juridical approach with participatory observation methods and semi-structured interviews with notaries in Palangka Raya City. The results show that the absence of technical regulations causes notaries to apply the principle of excessive caution, which has an impact on the stagnation of innovation in notarial practices. The main obstacles include the lack of implementing regulations, limited technological infrastructure, and low trust and understanding of business actors regarding the electronic GMS mechanism. This research emphasizes the need for regulatory updates that explicitly regulate the implementation of electronic GMS for closed PTs and standards for the preparation of deed releases by notaries to ensure legal certainty and the adaptation of notarial practices to developments in information technology.

Abstract

This study was prompted by a criminal case in Palangka Raya City involving a cooperating witness (Justice Collaborator) who faced intimidation during the law enforcement process. This situation highlights asymmetrical power relations that potentially hinder investigations and reduce the effectiveness of legal protection. This study aims to analyze the legal considerations of the Witness and Victim Protection Agency (LPSK) in designating MH as a Justice Collaborator and to examine the role of the LPSK in providing protection during the trial process at the Palangka Raya District Court. Employing an empirical legal method with a qualitative approach, data were collected through interviews with an expert staff member of the LPSK’s Protection Bureau and the Chair of the Genta Keadilan Legal Aid Institute, who served as MH’s legal counsel. The findings indicate that MH’s designation as a Justice Collaborator was based on the fact that he was not the principal perpetrator, the importance of his testimony in uncovering the offense, his good faith, and the need for protection due to intimidation and psychological trauma. The protection provided by the LPSK includes physical, psychological, legal, and family protection, enabling the witness to testify freely and safely throughout the judicial process. Theoretically, this study reinforces research on the importance of protecting Justice Collaborators in power imbalances, demonstrating that legal protection effectiveness depends on institutional implementation rather than statutory norms alone. Practically, these findings serve as an evaluative basis for the LPSK and law enforcement to strengthen protection mechanisms in cases involving unequal power dynamics.

Abstract

Over 62% of Muslim college students report encountering LGBTQ+ content on TikTok-how does Islamic education respond to this digital exposure?. This study explores the dual impact of TikTok’s algorithm and its usage intensity on the formation of sexual identity and orientation among Muslim students at State General Universities (PTUN) in Central Kalimantan. This study used a mixed-method approach with a Concurrent Embedded design, in which combined quantitative regression analysis of Likert-scale questionnaire data (N = 312) and qualitative thematic analysis from in-depth interviews and literature reviews. The sample was determined using stratified random sampling based on students' semester levels. The study results TikTok significantly influences students' sexual identity and orientation (r = 0.583, p < 0.01), while Islamic education has a more modest effect (r = 0.299, p < 0.01). Together, both variables explain 46% of the variation (R² = 0.460). Notably, 70% of respondents reported experiencing value conflict after being exposed to sexual content. Regression results indicate that TikTok and Islamic education together explain 46% of the variance (R² = 0.460) in students’ sexual identity orientation. No significant link was found between TikTok usage and internalization of Islamic values (r = -0.079, p = 0.214), suggesting parallel but disconnected development paths. These findings call for urgent integration of digital Islamic literacy to Islamic education curriculum to mitigate the effect of TikTok’s algorithm, and use of social media da’wah within Islamic education frameworks to confront algorithmic influences effectively.

Abstract

This study examines the conflict between state law and Dayak customary law regarding underage marriage practices. Using a legal pluralism framework and a socio-legal approach, this study analyses the customary rationality that legitimises these practices and their impact on human rights, particularly for women. The method used is empirical legal research, which fundamentally examines law in its social context. This choice is based on the research objective to understand how state law, particularly the Marriage Law, interacts and often conflicts with Dayak customary law that is alive and practised by the community. The results of this study show that customary marriage, driven by socio-economic factors and efforts to avoid communal sanctions, creates legal dualism that hinders children's access to fundamental rights to education and health. This study concludes that repressive law enforcement is ineffective and recommends an accommodative protection model.
