Abstract

Banyak pelaku usaha di Kota Palangka Raya yang sudah memiliki merek terdaftar, namun belum disahkan, karena beberapa kendala salah satunya adalah nama produk yang terlalu umum. Tujuan Penelitian ialah untuk mengkaji Apa saja batasan-batasan merek yang harus disetujui oleh Kementerian Hukum dan HAM, dan bagaimana dunia usaha mendapatkan perlindungan atas merek usahanya. Metode penelitian adalah metode penelitian hukum empiris. Hasil penelitian adalah batasan merek yang dapat didaftarkan yaitu merek tersebut tidak bertentangan dengan ideologi negara dan peraturan perundang-undangan; tidak sama dengan, berkaitan dengan, atau hanya menyebutkan barang dan/atau jasa yang dimintakan pendaftarannya; tidak mengandung unsur yang dapat menyesatkan masyarakat mengenai asal, mutu, jenis, ukuran, jenis, tujuan penggunaan barang dan/atau jasa yang dimohonkan pendaftarannya atau merupakan nama suatu varietas tumbuhan yang dilindungi untuk barang dan/atau jasa sejenis. jasa; tidak memuat informasi yang tidak sesuai dengan kualitas, manfaat, atau khasiat barang dan/atau jasa yang dihasilkan; Memiliki daya pembeda; Merupakan nama umum dan/atau lambang milik umum. Upaya yang dilakukan dalam mengatasi hambatan pendaftaran merek dan pelayanan bagi pelaku usaha adalah memberikan bantuan konsultasi dan pelayanan pendaftaran merek di kantor Kementerian Hukum dan Hak Asasi Manusia serta melakukan sosialisasi kepada kelompok masyarakat melalui seminar dan pelatihan, sehingga masyarakat dapat melakukan pendaftaran pribadi atas mereknya sendiri

Abstract

This study discusses the use of social media as a provocation tool in the context of Pope Francis' visit to Indonesia. The background of this research stems from the increasing potential of social media in spreading provocative information that can trigger social tensions, especially during sensitive moments such as the visit of a religious leader. The aim of this research is to identify the forms of provocation that emerge on social media and evaluate the effectiveness of criminal law, particularly the Information and Electronic Transactions Law (ITE Law) and the Criminal Code (KUHP), in addressing the spread of such provocative content. The research method used is qualitative with a juridical-normative approach, where data is collected through literature studies and content analysis of related social media. The findings indicate that social media is utilized by various groups to spread provocative narratives that can lead to social conflict. Furthermore, the enforcement of the ITE Law and KUHP in addressing criminal acts of spreading provocative content still faces challenges, particularly in law enforcement and public awareness. This study suggests the need for stronger legal regulations and education for social media users to reduce the negative impact of provocative content.

Abstract

This research discusses the criminal law perspective on social media advertisements that lead to gambling and illegal activities in Indonesia. The development of information and communication technology has facilitated the spread of illegal advertisements, including online gambling, through social media platforms. Although gambling is prohibited under Article 303 of the Indonesian Criminal Code (KUHP) and Law No. 11 of 2008 on Electronic Information and Transactions (UU ITE), this practice remains prevalent with increasingly sophisticated marketing strategies, such as the use of influencers and referral codes. This research employs a normative juridical method to analyze the effectiveness of existing regulations, challenges in law enforcement, and effective criminal liability models. The findings indicate that while regulations provide a strong legal foundation, their implementation faces obstacles, such as difficulties in identifying perpetrators, low legal awareness among the public, and limited law enforcement resources. Therefore, this research recommends regulatory revisions, enhanced law enforcement capacity, and public education to more effectively address this phenomenon

Abstract

he occurrence of electoral fraud in Palangka Raya City was a direct finding by the General Election Supervisory Agency (Bawaslu) of Palangka Raya. The case involved the misuse of voting rights, specifically impersonating another person to vote, which constitutes a violation Article 533 of Law No. 7 of 2017 on General Elections. Upon discovering the incident, Bawaslu promptly referred the case to the police investigation team for further legal action. To prevent and address such issues, Bawaslu Palangka Raya has introduced an innovative public outreach program aimed at increasing community participation in election monitoring and preventing electoral violations. This study attempts to investigate the utilization of prevention and enforcement measures related to electoral violations and to identify the challenges in their execution. Using an empirical juridical method through observation, interviews, and online media data analysis, the research found that the implementation of prevention and enforcement efforts is not yet fully effective. Key obstacles include suboptimal inter-agency coordination, limited public awareness, and the constrained time frame for legal proceedings in handling election crimes. Currently, Bawaslu Palangka Raya’s innovation community outreach serves as a short-term solution. This study recommends strengthening supervision and improving inter-agency coordination, with more active communication and cooperation to enhance institutional capacity.

Abstract

Disparities in judges' decisions in human trafficking cases indicate inconsistency in delivering verdicts for similar or related cases. The primary objective of this study is to identify various factors influencing the differences in judges' decisions in human trafficking cases, including how judges assess the elements of the case, consider aggravating and mitigating circumstances, and apply the law appropriately to realize justice in court rulings. The research method used is normative juridical, with data collection techniques including the study of court decisions from the Palangka Raya District Court, books, and scientific journals. The research findings show that there are several disparities in judges' rulings on similar cases. In the judicial process, a judge's conviction is based on legally valid and admissible evidence. Sentences, such as imprisonment and fines, are influenced by various factors, including mitigating conditionslike young age, confession, remorse, and the defendant's attitude during the trial. Disparities in rulings occur due to differences in judges' convictions and the lack of clear guidelines insentencing.
