Abstract

AbstractThis study aims to analyze and review law and politic interactions in drafting legislation in the area of     the Regional Representatives Council of the City of Surakarta. Will be tested conceptualization commonly accepted that there is an interaction between law and politics in the process of legislation, so that the perspective used is a law which is not simply a normative sense, but influenced by the layout of the resultant interaction with other factors. This study is an empirical legal research. How to obtain the data held with the literature study and interviews. As an object of observation, then conducted the study and analysis of regional regulation Surakarta generated for the period 2005-2010 and this research, performed sorting into 3 clumps of Local regulations relating to the collection and Licensing, Government Activities, and Social Community. Based on research results that local regulation in the clump of government activity have a similar pattern of interaction of political and legal issues than local regulation and licensing in the family collection. The similarity is apparent in At a working meeting with the regional political system this interaction is actually happening. In such interactions will occur bargaining process and argument in order to obtain a common perception among the Special committee with the regional to the substance of the draft regulation. Meanwhile, local regulation in clumps social activity that particularly made an object of this study showed variation facts. Whenever it is deemed to include the substance of the rules of public interest and can be used as a reason for the interests of certain social groups such as the Local regulation of Education, will take some time for discussion indicates attraction between politics and law in the process of discussion. Then, in the case of the Regional Equality Regulations disabilities, in addition to the widely recognized and important problem, but because it targets only certain elite discussion, in this case the regional, then it does not show interactions that complicate the process of discussion.Keywords: law and politic, legislation, local interest.AbstrakPenelitian ini bertujuan untuk menganalisis dan mengkaji interaksi politik dan hukum dalam penyusunan legislasi daerah di Dewan Perwakilan Rakyat Daerah Kota Surakarta. Akan diuji konseptualisasi yang lazim diterima bahwa ada interaksi antara hukum dan politik dalam proses legislasi, sehingga perspektif yang digunakan adalah hukum tidaklah sekedar pengertian normatif, akan tetapi merupakan resultan yang dipengaruhi oleh tata interaksi dengan faktor-faktor lain. Penelitian ini merupakan penelitian hukum empiris yang bersifat deskriptif. Cara memperoleh data dilaksanakan dengan studi pustaka dan wawancara. Sebagai obyek pengamatan, maka dilakukan kajian dan analisis terhadap Peraturan Daerah Kota Surakarta yang dihasilkan kurun 2005-2010 dan untuk riset ini, dilakukan pemilahan ke dalam 3 rumpun yaitu Peraturan Daerah yang terkait dengan Pemungutan dan Perizinan, Aktivitas Pemerintahan, dan Sosial Kemasyarakatan. Berdasarkan hasil penelitian bahwa Peraturan Daerah dalam rumpun aktivitas pemerintahan mempunyai pola yang sama terhadap masalah interaksi politik dan hukumnya dibandingkan Peraturan Daerah dalam rumpun pemungutan dan perizinan. Kesamaan itu nampak dalam Pada saat rapat kerja dengan Perangkat Daerah inilah interaksi sistem politik yang sebenarnya terjadi. Dalam interaksi tersebut akan terjadi proses tawar-menawar dan adu argumentasi dalam rangka memperoleh kesamaan persepsi antara Panitia Khusus dengan Perangkat Daerah terhadap substansi Rancangan Peraturan Daerah. Sementara itu, Peraturan Daerah dalam rumpun aktivitas sosial kemasyarakatan yang khususnya dijadikan obyek studi ini menunjukkan variasi fakta. Bilamana substansi aturan itu dianggap mencakup kepentingan masyarakat luas dan dapat dijadikan alasan untuk memperjuangkan kepentingan kelompok-kelompok masyarakat tertentu maka seperti Peraturan Daerah Pendidikan, akan memakan waktu untuk pembahasan yang menunjukkan adanya tarik menarik antara politik dan hukum dalam proses pembahasannya. Kemudian, dalam kasus Peraturan Daerah Kesetaraan Difabel, di samping masalahnya diakui luas dan penting, namun karena sasaran pembahasannya hanya elit tertentu, dalam hal ini Perangkat Daerah, maka tidak menunjukkan interaksi yang mempersulit proses pembahasannya.Kata Kunci: hukum dan politik, legislasi, kepentingan lokal.

Abstract

Abstract. This research aims to determine the implementation of a Child Friendly District (KLA) in Magetan Regency. The implementation of the role of the Magetan Regency Government is to implement and carry out policies in implementing and developing a Child-Friendly Magetan Regency and knowing what factors are obstacles and drivers of the regional government's role in implementing a Child-Friendly Regency in Magetan Regency. This research was conducted using empirical or non-doctrinal law using primary data in the form of interviews with regional officials of Magetan Regency as well as the results of field observations conducted in Magetan Regency. Secondary data used in this research are legal materials in the form of articles, journals and other legal literature related to the research being discussed. The role of regional government in implementing KLA is an implementation of obligations that have been regulated in Government Regulation Number 12 of 2022 concerning the Implementation of Child Friendly Districts/Cities, and in its implementation the role of regional government is regulated directly in the policies governing Magetan Regency, this is specifically regulated in Magetan Regency Regional Regulation Number 1 of 20222 concerning the Implementation of a Child Friendly Regency.

Abstract

Village development is an important aspect in the development of the Indonesian Nation. One sector that can be utilized for village development is tourism. Village has the authority to develop its tourism as a form of managing the potential of the village. Village tourism in the process of its development is inseparable from obstacles such as low human resources, conflicts between villagers in the development of village tourism, etc. This research discusses how the authority of Kemuning Village in tourism management to support the enhancement of Kemuning Village's original income and what obstacles the Kemuning village government experiences in managing the village's tourism potential to support village income. This research is a type of empirical legal research with a descriptive research style and a qualitative approach. The data collection techniques used are field research and literature study. Based on this research, Kemuning Village has already executed some of its authorities in tourism management to support the increase of village income, but there are also some authorities that have not been executed by the Kemuning Village government. The obstacles experienced by the Kemuning Village government in managing tourism potential to support village income are the lack of people who understand and can utilize the potential of the tourism sector, the lack of coordination between the Kemuning Village Government and the Karanganyar Regency Government, the implementation of BUM Desa that is not yet optimal, and the absence of village regulations related to tourism management and levies on tourist business services.

Abstract

Penelitian ini bertujuan untuk menganalisis pelaksanaan peraturan tentang prioritas penggunaan dana desa Tahun 2022 di Desa Makamhaji, Kecamatan Kartasura, Kabupaten Sukoharjo serta kendala dalam pelaksanaan peraturan tersebut. Penelitian ini merupakan penelitian hukum empiris dan bersifat deskriptif dengan menggunakan pendekatan kualitatif. Sumber data penelitian berupa data primer dan data sekunder. Teknik pengumpulan bahan hukum adalah wawancara dan studi kepustakaan dengan teknik analisis kualitatif, melalui tiga tahap, yaitu reduksi data, penyajian data dan penarikan kesimpulan serta verifikasi. Hasil penelitian menunjukan Pemerintah Desa Makamhaji dalam merencanakan prioritas penggunaan dana desa Tahun 2022 mengacu langsung pada Peraturan Menteri Desa Pembangunan Daerah Tertinggal dan Transmigrasi Nomor 7 Tahun 2021 di Desa Makamhaji. Pelaksanaan peraturan menteri desa tersebut di Desa Makamhaji sudah terlaksana sesuai dengan ketentuan yang terdiri dari 4 poin, yaitu perencanaan penetapan prioritas penggunaan dana desa; pelaksanaan prioritas penggunaan dana desa; publikasi dan pelaporan; serta pembinaan. Kendala yang dihadapi Pemerintah Desa Makamhaji antara lain peraturan dari pemerintah pusat yang berubah-ubah tiap tahunnya; sumber daya manusia aparatur pemerintah desa yang kurang kompeten; serta kondisi cuaca.

Abstract

Abstrak Penelitian ini bertujuan untuk mengetahui mengenai bagaimana peran strategis yang telah dilakukan oleh perpustakaan Universitas Sebelas Maret dalam mendukung pembangunan berkelanjutan. Metode yang digunakan adalah metode penelitian kualitatif dengan pendekatan studi kasus. Hasil penelitian menunjukaan bahwa peran perpustakaan UNS dapat terlibat tujuan pembangunan berkelanjutan pada tanpa kemiskinan (tujuan no 1), pendidikan berkualitas (tujuan no 4 ), Pekerjaan Layak dan Pertumbuhan Ekonomi ( tujuan no 8) dan Kota dan Komunitas Berkelanjutan ( tujuan no 11). Selain itu, peprustakaan UNS masih dapat melakukan berbagai peran lainnya untuk mendukung tujuan pembangunan berkelanjutan yang lain. Abstract

Sampai pada tahun 2023, Jumlah penyandang disabilitas yang telah menerima vaksin Covid-19 masih dapat dikatakan rendah. Kurangnya akses terkait dengan informasi atas vaksin Covid 19 mungkin merupakan salah satu penyebab rendahnya jumlah vaksinasi terhadap kelompok ini. Penelitian ini akan mengevaluasi bagaimana pemerintah Indonesia menjamin dan memenuhi hak akses vaksin Covid-19 bagi penyandang disabilitas, dengan menganalisis penyelenggaraan program vaksinasi pada empat wilayah di Indonesia. Penelitian ini merupakan penelitian sosio-legal dengan pendekatan interdisipliner. Hasil analisis menunjukkan bahwa pemerintah telah menjamin hak akses atas informasi penyandang disabilitas melalui peraturan perundang-undangan baik di tingkat pusat maupun daerah. Beberapa kendala yang ditemukan antara lain kepastian ketersediaan data penyandang disabilitas dan persebaran hoaks dalam komunitas penyandang disabilitas.

Abstract

The World Health Organisation has recommended that its member states conduct national vaccination programs based on fair and equal access principles. COVID-19 has had more severe impacts on persons with disabilities (PwDs). This article focuses on how the provisions of international human rights instruments obligate countries to provide vaccination for PwDs. Further, these provisions will be used to analyse the law and policy adopted by the Indonesian government related to the vaccination program designed for this group. This article used both normative/doctrinal and empirical legal research methods. Based on international human rights law, access to vaccines and medical technology are elements of the right to health under the AAAQ principles. Member states should consider groups’ vulnerabilities, risks, and needs when designing the vaccination program. Some groups risk experiencing a more significant burden from the pandemic due to underlying social, geographic, or biomedical factors. PwDs are people coming from diverse backgrounds. Thus, the challenges they face will vary according to age diversity, gender, types of disability, ethnicity, sexual orientation, and migration status. The results show that Indonesia, during the first vaccine rollout, did not explicitly mention disability as a priority. PwDs have experienced barriers in accessing vaccination due to a few persistent problems. In the future, national vaccination programs should include measures to overcome such barriers and ensure that PwDs have equal access to the vaccine and other healthcare services. Such access will enable the fulfilment of the right to health of the PwDs as guaranteed both under international human rights law and domestic law. In addition, future healthcare policy should put PwDs at the centre and address the unique needs and preferences of disabled people, including their cultural and language requirements.   Keywords: COVID-19 Vaccine, Persons with Disability, Equal Access, Indonesia
