Abstract

This article aims to determine the Urgency of BAZNAS Institution Management, To find out the management of Muztahik criteria determination in getting Zakat Maal, To find out the service system of BAZNAS officers, To find out the management of Maal Zakat management in productivity in Makassar City, To find out the management of Muztahik empowerment in improving their welfare, and To determine the productivity of Zakat Maal in improving the welfare of Muztahik in Makassar City. Data analysis technique used In analyzing the data the method used is a descriptive qualitative. Research Results Show Makassar City Baznas Institution is considered important in managing zakat maal but it has not been given maximum attention by the Makassar city government and the existing Service System in Makassar City Baznas has increased from year to year only to the extent of the institution of Baznas Not until UPZ (Zakat Collecting Unit) which is spread in several districts of Makassar city

Abstract

This article examines the pemmali as a method of da'wah by Bugis and Makassar ancestors in maintaining the noble values formulated in the cultural system. This study with the dawah approach found that the Bugis and Makassar people always maintained the most fundamental values, namely siri'. This value is at the core of a cultural system called pangadereng. Implementation of Pangangadereng is always maintained and controlled through paseng (warning / tazkirah) or (message / wasiyah) and pemmali or prohibition and prevention. Paseng has a role in directing the implementation of the values of Pangangadereng, while pemmali as an effort to prevent violations against pangngadereng. Paseng in the science of da'wah aims to amar ma'ruf, while pemmali is directed at the nahi munkar. Amar ma'ruf and nahi munkar in the science of da'wah are part of the function of dakwah activities that must be realized. There are various ways of carrying out these functions, including the tanzīr methods. The tanzīr which means a warning against this threat was taken by the ancestors of the Bugis and Makassar people with pemmali

Abstract

This study aimed to analyze the legal standing of surrogate mothers from the Islamic law perspective. This study employed library research with a shar'i normative approach. The data were collected through documents related to the surrogate mother, both from books, texts (Qur'an and Sunnah), and scholars’ opinions who discussed the implementation of a surrogate mother. Surrogate mother was one of the efforts made by a married couple to produce descendants. The results of this study indicated that the law of having descendants in a marriage was not something included in the dharuriyyah part or must exist. Additionally, the legal consequences of implementing a surrogate mother would have an impact on the child born, both from the status of the child born from the surrogate mother including legitimate child or illegitimate child, who was the mother or the mother status of children born from the surrogate mother, and the rights inheritance of children born from surrogate mother. Therefore, based on the Qur'an and Sunnah, individual and group scholars' opinions stated that the legal standing of surrogate mothers in Islam was unlawful.

Abstract

Tujuan penelitian ini adalah untuk mengetahui proses penyelesaian dan faktor yang menyebabkan timbulnya sengketa hak atas tanah di Kecamatan Kajang serta peran Badan Pertanahan Nasional Kabupaten (BPN) Kabupaten Bulukumba dalam menyelesaikan sengketa dimaksud. Keseluruhan penelitian ini merupakan jenis penelitian lapangan. Hasil penelitian menunjukkan bahwa proses penyelesaian sengketa atas tanah di Kecematan Kajang akan diupayakan melalui jalur non litigasi yang dilakukan oleh kepala suku. Terdapat beberapa faktor yang menyebabkan timbulnya sengketa dibidang pertanahan seperti penyerobotan, tumpang tindih kepemilikan, batas tanah, dan kesalahan administrasi pada saat pencatatan atau penetapan hak milik. BPN Kabupaten Bulukumba dapat bertindak sebagai mediator dalam upaya penyelesaian secara non litigasi, selain itu, BPN juga dapat melakukan penyelesaian secara administratif jika sengketa yang ditimbul disebabkan oleh kesalahan pendataan atau penetapan.Kata Kunci: BPN Bulukumba; Hak Milik; Sengketa; Tanah

Abstract

The study examines the review of maslahah of uang panaik (bride price) in Bugis Makassar community. This study method used a descriptive qualitative approach that describes the phenomenon in Bugis Makassar's society. The results of the study indicated that uang panaik is a custom or ‘urf in Bugis Makassar community that is implemented at every wedding reception. Previous Islamic jurists have built and developed the Maslahah theory which concludes that all rules in Islam were benefit-oriented. There were three levels of maslahah theory, namely maslahah daruriyyah, maslahah hajiyyah, and maslahah tahsiniyah. Uang panaik was more inclined to maslahah hajjiyyah because it was a necessity in every marriage in Bugis Makassar community.

Abstract

This research is qualitative, the type of research is library research and uses a normative juridical approach. The data collection method used was a literature study. The results showed that; 1) The meaning of the rule (Ijtihad Does Not Cancel Other Ijtihad), namely the rule (Ijtihad Does Not Cancel Other Ijtihad) means that ijtihad cannot produce a product that has been implemented at a certain time and place, it cancels the legal product of an ijtihad result. at one time and another. 2) The validity of the principle (Ijtihad does not cancel other Ijtihad), namely the honesty of this principle can be seen from the existence of the arguments that legalize it. Starting from the hadith until then the consent of a friend, as we have stated, this can be noticed from a caliph 'Umar who did not annul or cancel his predecessor's opinion or ijtihad, namely Abu Bakr. 3) Implementation of the rule (Ijtihad does not cancel other Ijtihad), which can be seen from the examples in the literature that discuss al-Qawa'id al-Fiqhiyyah. This rule is valid as long as it does not violate or contradict the nas, consent, qiyas jaliy, the words of the 4 schools, and it is clear that the judge's error is the result of the law, cause, or method. Also, ijtihad must be equally strong, it cannot be just one of them, and finally, that the implementation of ijtihad has been legitimized by Fatwa or Qa ataupunā. So the implementation of this rule can be noticed in existing examples and this rule is not always able to be implemented or implemented, because several things have been mentioned regarding the exceptions regarding this rule.

Abstract

Shari'ah and Hakikah are two sciences in Islam that are seen as conflicting sciences. The science of Shari'ah which is oriented to the deeds of human birth and the science of hakikah oriented to the inner deeds of man. Both tend to be viewed differently in their practice. However, if understood and explored, the two sciences have a very close relationship and cannot be separated from practice. Man consisting of both lahiriyah and batiniyah elements desperately need both knowledge to achieve the goal of human creation, namely worship and worship God. The science of Shari'ah as a form of embodiment of human slavery through concrete behavior, while the science of nature as the embodiment of human slavery through abstract and only known emotional and inner activities of the individual who does it. Through the fusion of shari'ah and hakikah, the application of Islamic law can be enforced in a mannered manner with law enforcement through a method of gentle approach or upholding ihsan. The enforcement of Islamic law with ihsan has been enforced since the time of the Prophet Muhammad (peace be upon him), enforcement in a polite manner is expected to uphold the sharia law of Islam to all human beings around the world without any violence and compulsion.

Abstract

Islamic law only became an authoritative source (a legal source that has legal force) in constitutional law when the Jakarta Charter was placed in the Republic of Indonesia's Presidential Decree dated 5 July 159 as can be seen in the preamble to the Decree as follows: "That we believe that the Jakarta Charter is dated 22 June 1945 animates the 1945 Constitution and constitutes a series of units in the Constitution.” The word "animating" negatively means that it is not permissible to make laws in the Indonesian state that are contrary to Islamic law for its adherents. Even though Islamic law has failed to be obtained by Islamic parties, the opportunity to make laws based on or inspired by Islamic law through the mechanism of representative democracy in Indonesia is still wide open. Challenges faced by Islamic law The toughest challenge at this time does not lie in the constitutional logic of accommodating Islamic law in national law, but in the dialectics between secular currents of Western thought and expressions of the diversity of Muslims which sometimes creates phobias.

Abstract

Children are an integral part of the younger generation and the potential of the nation's human resources in the future. Efforts to foster and protect children are a shared responsibility in ensuring physical, and mental growth and development. This research is a qualitative research field. The results showed that regulatively, the Makassar City Government already has regulations related to child protection, namely Makassar City Regional Regulation Number 5 of 2018 concerning Child Protection, but technically, the regulation has not regulated the protection of children from online game addiction. Efforts to protect children from the negative influence of online games are not only the responsibility of the government, but the role and commitment of the family and the environment are also determining factors, especially the presence of online games related to information technology which has become a primary need.

Abstract

Abstract The aim of this investigation is to comprehend all forms of internet-based dealings within the framework of Islamic Jurisprudence. This exploration is a qualitative and descriptive inquiry conducted through a literature review, utilizing written sources such as scholarly journals, reference books, literature, encyclopedias, scientific articles, scientific papers, and other pertinent sources related to the research subject. The research object is text or writing that elucidates various types of online transactions that are presently prevalent in the current technological age, particularly in Indonesia. The outcome of this analysis suggests that Islam authorizes online transactions provided they adhere to predetermined requirements and do not breach Islamic law. Currently, technologi advancements enable transactions to be conducted effortlessly and expeditiously online, as long as there is a network or internet connection available, which is the principal prerequisite for auxiliary devices in online transactions.In the contemporary digital age, modern technology such as computers or mobile phones can be employed as a medium for processing online transactions. Numerous transactions are carried out through cyberspace (online or via the internet), allowing the involved parties to transact without any restrictions of space and time, whether conducted by individuals or corporations or companies that involve more than one person. In general, a transaction can be interpreted as an agreement made by two or more individuals to accomplish something within a specific duration of time, with several other conditions agreed upon by both parties. Therefore, online transactions in the perspective of Islamic law can be regarded as transactions that have specific provisions that must be agreed upon by the parties involved in the transactionAbstrakTujuan dari penelitian ini adalah untuk memahami segala jenis transaksi online dalam konteks hukum Islam. Penelitian ini merupakan studi deskriptif kualitatif yang dilakukan melalui kajian literatur, dengan menggunakan sumber-sumber tertulis seperti jurnal ilmiah, buku referensi, literatur, ensiklopedi, artikel ilmiah, karya ilmiah, dan sumber lain yang relevan terkait dengan objek penelitian. Objek penelitian ini adalah teks atau tulisan yang menjelaskan berbagai macam transaksi online yang sedang populer di era teknologi saat ini, terutama di Indonesia. Hasil dari penelitian ini menunjukkan bahwa Islam mengizinkan transaksi online selama memenuhi persyaratan yang telah ditetapkan dan tidak melanggar hukum Islam. Saat ini, kemajuan teknologi memungkinkan transaksi dilakukan secara online dengan mudah dan cepat, selama tersedia jaringan atau koneksi internet yang menjadi syarat utama alat bantu dalam transaksi online.Era digital saat ini, teknologi modern seperti komputer atau telepon genggam dapat dimanfaatkan sebagai alat bantu dalam proses transaksi online. Ada banyak transaksi yang dilakukan melalui dunia maya (online atau via internet), sehingga pihak yang melakukan transaksi tidak terbatas oleh ruang dan waktu, baik itu dilakukan oleh individu maupun oleh korporasi atau perusahaan yang melibatkan lebih dari satu orang. Secara umum, transaksi dapat diartikan sebagai sebuah kesepakatan yang dilakukan oleh dua orang atau lebih untuk menyelesaikan suatu hal dalam jangka waktu tertentu dengan beberapa syarat lain yang disepakati oleh kedua belah pihak. Oleh karena itu, transaksi online dalam perspektif hukum Islam dapat dianggap sebagai transaksi yang memiliki ketentuan khusus yang harus disepakati oleh pihak-pihak yang terlibat dalam transaksi tersebut.
