Abstract

ABSTRAK Tujuan studi ini untuk mengkaji Peran Satuan Polisi Pamong Praja (Satpol PP) dalam mencegah penyebaran Covid-19 di Bali. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-udangan dan pendekatan konseptual. Hasil Studi menunjukkan bahwa Berdasarkan Pasal 10 Pergub Bali No. 46 Tahun 2020, peran Satpol PP dalam mencegah penyebaran Covid-19 di Bali adalah melakukan pengawasan dan penegakan atas pelanggaran Pergub Bali No. 46 Tahun 2020. Selain dalam hal pengawasan dan penegakan, Satpol PP dalam Pasal 12 Pergub Bali No. 46 Tahun 2020 juga diikutsertakan dalam tata cara pengenaan sanksi. Tata cara pengenaan sanksi administratif berupa denda administratif dalam Pergub Bali No. 46 Tahun 2020 ditetapkan melalui surat bukti pelanggaran yang dikeluarkan oleh Satpol PP. Penetapan surat bukti pelanggaran yang dikeluarkan oleh Satpol PP dapat disebut sebagai tindakan administratif sebagaimana kewenangan Satpol PP yang diatur dalam PP Satpol PP. Walaupun dalam penjelasannya yang dimaksud dengan tindakan administratif adalah tindakan berupa pemberian surat pemberitahuan dan/atau surat teguran/surat peringatan terhadap pelanggaran Perda dan/atau Perkada, tetap saja penetapan surat bukti pelanggaran dapat dikatagorikan sebagai runtutan pemberian surat surat pemberitahuan dan/atau surat teguran/surat peringatan terhadap pelanggaran Perda dan/atau Perkada. Kata Kunci : Satuan Polisi Pamong Praja, Surat Bukti Pelanggaran, Denda Administratif. ABSTRACT The purpose of this study is to examine the role of the Civil Service Police Unit (Satpol PP) in preventing the spread of Covid-19 in Bali. This research uses normative legal research methods with statute approach and conceptual approach. The results of the study show that based on Article 10 of the Bali Governor Regulation No. 46 of 2020, the role of Satpol PP in preventing the spread of Covid-19 in Bali is to supervise and enforce violations of the Bali Governor Regulation No. 46 of 2020. In addition to monitoring and enforcement, Satpol PP in Article 12 of the Bali Governor Regulation No. 46 of 2020 is also included in the procedures for imposing sanctions. The procedure for the imposition of administrative sanctions in the form of administrative fines in the Pergub Bali No. 46 of 2020 is determined through a violation evidence letter issued by Satpol PP. Determination of evidence of violations issued by Satpol PP can be called an administrative action under the authority of Satpol PP which is regulated in PP Satpol PP. Although in the explanation what is meant by administrative action is an act in the form of giving notification letters and/or warning letters/warning letters against violations of regional regulations and/or regional head regulations, still the determination of evidence of violations can be categorized as a series of notification letters and/or warning letters. warning letter against violation of regional regulations and/or regional head regulations. Abstract

The Article 43(3) Act Number 12, 2011 concerning Regulations Makingstipulatedthat theact draft from DPR,  President, or DPD must be accompanied the academic text. However the function was from the obligation enclosed by thesubmitting the academic text still not well understood, so as the academic text was still being considered unimportant and ignored in the submitting act draft. Starting fromthese problems, then the problem that emerged that is what is the normative character of the contents of the academic text according to the law and the doctrine of legal knowledge. The purposeis tounderstand thecharacter ofthe normativecontent of the academic text according to the law and the doctrine of legal knowledge. The research that used was the juridical  normativeresearch. The legal source took form the regulations, literatures, results of the researches, papers in the seminar, the journals, articles, and reading materials that were linked with the problem that was studied in this research, the dictionaries and the legal encyclopedias. The use ofthe word'shall' in the regulations, that wordsis usedforthe fulfillment ofa conditionorspecific requirements. If the obligation that was arranged this was not fulfilled, that was relevant did not receive something or the matter that necessarily will be got if the condition or this condition was fulfilled. So the regulation to the Article 43 (3) was valid. The characteristics from the regulation concerning the obligation enclosed the academic text in putting forward the act draft  was to be imperative. The word'shall' bind the DPR, President and DPD to submitting  the academic text. If the academic text was not submitted, then the consequences that the act draftcould not be processed to the further stage.

Abstract

The COVID-19 pandemic had a significant impact on various countries, including Indonesia, in particular on the securing of the state budget and state financial stability in anticipation of the systemic and comprehensive impact of the pandemic. This deviation is not in line with the Indonesian constitution, welfare state principles, and even regulations based on the principles of good legislation. This article will examine three aspects of the problem: firstly, the formation of Government Regulation Number 1 of 2020 (Perppu) concerning State Financial Policy and Stability under COVID-19 countermeasures by the formation mechanism; secondly, the constitutionality issue in the drafting of Perppu; and thirdly, the legal issue of Article 27 on the immunity of officials who carry out financial policies. This paper employs a combination of normative legal research methods, including a statutory approach, a legal conceptual approach, a legal fact approach, and a relevant case law approach. The result of the research is  that Perppu is a policy in an emergency period that contains a policy of relaxation of the implementation of the APBN is constitutional. The form of deviation that appears from Perppu is that this Perppu implements financial relaxation or sets state financial policies without involving the DPR. This has been constitutionally confirmed by Article 12 of the 1945 Constitution that the government and the DPR must determine state financial policies together. Although the constitutionality of Perppu in terms of fiscal policy is not in question, the provisions of Article 27 of Perppu that are unconstitutional can be cancelled by the Constitutional Court. The legality of Perppu relating to immunity must be implemented by prioritising the principle of good faith in carrying out the duties and functions of each state financial stakeholder during the emergency period.

Abstract

This article interrogates the dimensions of the fifth-generation national philosophy of Indonesia, the 'Pancasila', and its potential to serve as the cornerstone for enhancing the quality of legislation in Indonesia. The prevailing concern is that the quality of Indonesian legislation is frequently compromised in terms of material and formal aspects, irrespective of the multidimensional, multidisciplinary, and even cross-border challenges confronting various developing countries. In order to address these concerns, it is imperative to delve into the fundamental principles of the 'Pancasila', with a view to contributing to the development of a future legal framework characterised by enhanced quality. The present article is limited to two main issues, namely (1) the dynamics of the five principles of the Indonesian state ideology as a legal ideal, and (2) the futuristic dimension based on positive law and the Constitutional Court's decisions related to the aforementioned principles as a basis for improving the quality of future legislation. The results obtained demonstrate that the recognition of the inseparable nature of the five principles of the United Nations as a legal ideal and the primary source of national law is paramount. This underscores the necessity for future legislative formations to deliberate on the incorporation of the principles of the Pancasila as a consideration in enhancing the quality of future legislation.

Abstract

Permasalahan sampah organik di Bali masih menjadi isu lingkungan yang serius, terutama karena pengelolaannya yang belum optimal dan rendahnya kesadaran masyarakat. Penelitian ini bertujuan untuk menganalisis potensi dan landasan yuridis penerapan metode simbiomasi sebagai inovasi pengelolaan sampah organik berbasis sumber sesuai dengan Peraturan Gubernur Bali Nomor 47 Tahun 2019. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan perbandingan. Hasil penelitian menunjukkan bahwa metode simbiomasi memiliki efektivitas tinggi dalam mengurangi timbulan sampah organik, mempercepat proses penguraian alami, dan menghasilkan pupuk organik yang ramah lingkungan. Secara yuridis, penerapan metode ini sejalan dengan prinsip reduce, reuse, recycle sebagaimana diatur dalam UU No. 18 Tahun 2008 dan Pergub Bali No. 47 Tahun 2019. Penerapan simbiomasi di tingkat rumah tangga maupun desa juga mencerminkan implementasi pengelolaan sampah berbasis sumber yang menekankan partisipasi aktif masyarakat. Dengan dukungan kebijakan yang konsisten dan pengawasan pemerintah, inovasi simbiomasi berpotensi menjadi model pengelolaan sampah organik berkelanjutan di Bali.
