Abstract

In the competition law recognized the existence of several approaches in the application of the law, two of which approach is the approach per se illegal and rule of reason approach. Approach per se illegal and rule of reason applied to assess whether a particular course of business actors violating Competition Act. Restrictions are per se is the prohibition is absolute, clear and obvious to a particular act or agreement to provide certainty to businesses. An act or agreement that prohibited per se means certain that such actions would impair or eliminate competition. Instead the approach is a rule of reason, an act which is done by the business will be seen the extent of the negative impact on competition climate. The second method has a different approach is also used in competition law in Indonesia.

Abstract

One of the efforts to resolve disputes that arise between businesses and the consumers, the government established the Consumer Dispute Settlement Body (BPSK). BPSK formed to handle the settlement of consumer disputes based on the principle of efficient, fast, inexpensive and professional. Any consumer who feels aggrieved by the business can file complaints through Consumer Dispute Settlement Body (BPSK). Settlement of consumer disputes filed with the BPSK must be completed no later than twenty-one working days after the claim is received by BPSK. At the end of the settlement process, the results are set forth in a BPSK decision which is final and binding. Against this decision, the parties do not accept or not satisfied with the content of BPSK decision may appeal to the District Court.

Abstract

In general peace is a dispute resolution produced by agreement of the parties. The parties are at loggerheads with each other agree to resolve the issue with the word agree to terms. This method is the most appropriate because it is a reflection of the personality of the Indonesian nation, known as the principle of deliberation and kinship. Among the benefits of the settlement of disputes by means of this peace is the voluntary nature of the process, the procedure is quick, non-judicial decision, confidential, flexible, saving time and cost, the maintenance of good relations, more easily controlled and decisions tend to last a long time. The peace efforts must be encouraged and pursued, although the dispute has been included in the examination process of the court.

Abstract

Based to The relegoius official files of Wuluhan district about public interest to follows program of “Itsbat Nikah” in district Wuluhan since 2015 until 2016 there was an increase. At first people timidly followed the socialization of “Itsbat Nikah” by The relegoius official of Wuluhan district, but over time the people interest to followed, especially from poor society. Case endorsement (Itsbat) Nikah  is the marriage which was held by a religion but not recorded in Pegawai Pencatat Nikah(PPN) submitted by the couple of marriage or by her husband or by his wife or by their children or  by some person interst which document of marriage them. They must submit to court of religion on the district were them stay. The effectiveness of the law is the process of  the law became effective. The situation can be reviewed on the basis of some measure of effectiveness, namely: Rules or Regulations applicable (Law); Law Enforcement (Personnel of Government); Facilities and amenities; Society and Culture. Results of analysis that’s the rule of law is already complete from the mandate UUD 1945, UU No. 1/1974 About Marriage and all Regulation of Legislation that supports, must do “Itsbat Nikah” to thepeople who don’t recomended by Pegawai Pencatat Nikah (PPN).

Abstract

The problem of bad debts in the practice of banking credit channeling often occurs. This can be caused by many things, both internal and external factors. The Board of Directors of the Company, in this case Rural Bank, as the Company's authorized organ and fully responsible for the management of the Company for the interest of the Company, in accordance with the purposes and objectives of the Company, has responsibility for the incurrence of bad debts and settlement. This study formulates the problems that arise in the practice of banking credit distribution, especially in the BPR in relation to the responsibilities of the Directors of Rural Banks against the settlement of bad debts: what factors cause the bad credit in the BPR in the working area of Bank Indonesia Jember and how the form of responsibility Board of Directors of BPR in case of bad credit. The method in this research is empirical juridical approach with this method is intended to know and understand the factors that cause bad credit and how the form of responsibility of directors to bad credit. Based on the result of the research, it can be concluded that the bad debts occurring in the working area of Bank Indonesia Jember are caused by several factors, such as customers experiencing crop failure or due to unfavorable natural condition, The market economic fluctuation caused the economy to become unstable; Inadequate analysis; There is a divorce between husband and wife of the customer; and the debtor is entangled in legal matters so that it is unable to settle its obligations to the creditor. Board of Directors BPR The Board of Directors is responsible for the management of the RB and shall be carried out in good faith and with full responsibility. In the event of bad credit, the responsibility of RB directors is in the form of striving for the settlement of non-performing loans in order to be repaid by the customer.

Abstract

Legal protection by contracting in the business world is a very popular type. On the other hand, however, the extent of the opportunity to determine the protection of the law itself by contracting often leads to unexpected losses. The application of equitable legal protection principles in cooperation agreements, aims to protect the interests of the parties in relation to the regulation of their respective rights and obligations based on the principles of justice and legal certainty. The principles of law based on justice and certainty become the basis of the birth of cooperation agreement made by farmers with PT. Adi Sampoerna, in addition to other principles contained in the contract law. Object of study of this research is the science of normative law, then the method used is doctrinal which mengaranakan logic deduction.Cooperation agreement between tobacco farmers in Jember Regency and PT. Adi Sampoerna is a contract standard agreement. The principle of freedom of contract if faced with a contractual agreement, or agreement made by parties without the same bargaining position, it can be said that the cooperation agreement is not in accordance with the principle of freedom of contract even resulted in an agreement that unfair. Besides not in accordance with the principle of freedom of contract, there are several other legal principles of contract that are potentially violated, namely: good faith, existence and abuse of circumstances. A form of legal protection that can be done so that both sides are in a balanced position is to refer to the provisions of the inclusion of the standard clause as stipulated in Article 18 of the Law on Consumer Protection and does not include an exoneration clause that could harm either party in the agreement.

Abstract

The household is a small part of a society. A person's goal in fostering a home is to be happy,safe and secure. In realizing this, it depends on each individual in a household, especially inthe attitude, behavior and self-control of everyone in the household. the factors that cause themost domestic violence is caused by economic factors, this is because the Tegalgede Villageis one of the urban areas in the urban area so that the needs are quite a lot but their incomedoes not match the expenditure. This is because their husband's job is only constructionworkers and shop employees. While obstacles in law enforcement in the event of acts ofviolence in the household namely due to violence in the household is still considered a familydisgrace that should not be told or conveyed to other parties. Abstract

Provisions regarding the minimum age limit in the Marriage Law have been amended with the birth of Amendment to the Marriage Law Number 16 Year 2019. In this law the minimum age of marriage for women is equal to the minimum age of marriage for men, which is 19 (Nineteen) year. The age limit is considered to have matured body and soul to be able to carry out marriage in order to realize the purpose of marriage properly without ending in divorce and get healthy and quality offspring. From the results of the study it was found that the people of the Village of Pontang Ambulu did not know about the change in the minimum limits to carry out the marriage nor did they know about the existence of the Law No. 16 of 2019 which mentions changes in the minimum age limit for marriage.

Abstract

Dalam aspek ekonomi, Pandemi Covid-19 telah berimbas pada kegiatan usaha yang mengalami penurunan bahkan banyak pula yang berdampak pada berhentinya beberapa bidang usaha tertentu. Menurunnya kegiatan ekonomi ini berdampak pula kepada para pelaku usaha dan masyarakat terhadap kemampuannya dalam memenuhi kewajibannya kepada pihak lain, terutama kepada pihak yang memberikan pinjaman dalam bentuk kredit. Penelitian ini bertujuan untuk mengetahui Untuk mengetahui faktor-faktor yang menyebabkan terjadinya sengketa kredit tanpa agunan dan untuk mengetahui penyelesaian sengketa kredit tanpa agunan di Kelurahan Patrang Kabupaten Jember. Metode yang digunakan adalah yuridis normatif dan empiris dengan metode penelitian hukum sosiologis. Berdasarkan hasil penelitian dapat disimpulkan bahwa faktor yang menjadi penyebab terjadinya sengketa kredit tanpa agunan adalah usaha yang dijalankan oleh debitur mengalami kegagalan dan pemahaman nasabah bahwa kredit usaha yang dikucurkan tanpa agunan merupakan hibah atau bantuan dari pemerintah. Kredit tanpa jaminan yang dikucurkan kepada usaha mikro maupun perorangan diberikan dalam jumlah yang kecil. Sistem pembayaran dapat berupa membayar angsuran baik dengan waktu harian mingguan dan bulanan disesuaikan dengan kesepakatan antara pihak debitur dan kreditur. Kata kunci : Sengketa kredit, agunan, Patrang   Abstract In the economic aspect, the Covid-19 pandemic has affected business activities which have experienced a decline and many have even resulted in the cessation of certain business fields. This decline in economic activity also has an impact on business actors and the community on their ability to fulfill their obligations to other parties, especially those who provide loans in the form of credit. This study aims to determine the factors that cause credit disputes without collateral and to determine the settlement of credit disputes without collateral in Patrang Village, Jember Regency. The method used is normative juridical and empirical with sociological legal research methods. Based on the results of the study, it can be concluded that the factors that cause credit disputes without collateral are businesses run by debtors that fail and the customer's understanding that business loans disbursed without collateral are grants or assistance from the government. Unsecured loans disbursed to micro-enterprises and individuals are given in small amounts. The payment system can be in the form of paying installments on a daily, weekly and monthly basis according to the agreement between the debtor and creditor. Abstract

Penelitian ini bertujuan untuk mengetahui bentuk perlindungan hukum bagi tenaga medis dan pasien terhadap tindakan gawat darurat dalam perspektif hukum pidana dan dalam perspektif hukum perdata. Metode yang digunakan dalam penelitian ini adalah yuridis normatif. Hasil penelitian menunjukkan bahwa pasien yang mendapati kesalahan dokter pada saat melakukan tindakan kedokteran dalam situasi gawat darurat dan perbuatan tersebut memenuhi unsur pidana maka pasien dapat menuntut pertanggungjawaban dokter secara pidana, namun sesuai asas ultimum remedium, hukum pidana hendaklah dijadikan upaya terakhir dalam hal penegakan hukum. Dalam perspektif hukum perdata, Pasal 58 ayat (2) Undang-Undang Kesehatan menyatakan bahwa tuntutan ganti rugi tidak berlaku bagi tenaga kesehatan yang melakukan tindakan penyelamatan nyawa atau pencegahan kecacatan seseorang dalam keadaan darurat. Pasien yang kepentingannya dirugikan atas tindakan dokter dalam menjalankan praktik kedokteran dapat mengadukan secara tertulis kepada Ketua Majelis Kehormatan Disiplin Kedokteran Indonesia dan tidak menghilangkan hak setiap orang untuk melaporkan adanya dugaan tindak pidana kepada pihak yang berwenang dan/atau menggugat kerugian perdata ke pengadilan.  Kata kunci: Gawat darurat, Medis, Pasien, Perlindungan hukum This study aims to determine the form of legal protection for medical personnel and patients against emergency measures in the perspective of criminal law and in the perspective of civil law. The method used in this research is normative juridical. The results of the study show that patients who find a doctor's mistake when carrying out medical actions in an emergency situation and the act fulfills a criminal element, the patient can hold the doctor accountable criminally, but according to the principle of ultimum remedium, criminal law should be used as a last resort in terms of law enforcement. From a civil law perspective, Article 58 paragraph (2) of the Health Law states that claims for compensation do not apply to health workers who take actions to save lives or prevent someone from becoming disabled in an emergency.
