Abstract

 The Covid-19 pandemic has become a national disaster that has become a frightening specter for inmates, because the opportunities for transmission are very large due to the overloaded conditions of prisons, besides that the Covid-19 assimilation policy has caused public concern about increasing crime during the Covid-19 pandemic carried out. assimilation prisoners. The purpose of this study was to determine whether the assimilation program for prisoners during the Covid-19 pandemic could be effective in preventing the transmission of Covid-19 and the impact of providing assimilation for prisoners in terms of increasing crime in the city of Medan. The research method used is normative juridical and empirical juridical. The results of this study on the assimilation of COVID-19 are an attempt by the government to break the Covid-19 chain in prisons. created because of the prison's overcapacity. This policy has been reviewed and is considered effective in achieving the target to reduce the spread of Covid-19. The impact of releasing assimilated prisoners is a boon to prisoners and does not have the effect of increasing crime. Abstract

ABSTRACT The labor agreement clause in PKWT in the form of a clause against the period of time the work done based on the type and nature of work, as well as a period in extension and renewal. The termination of the working relationship in the clause set in article 61 of ACT No. 13 of 2003 on Labor. Clause to rights and obligations is the trade off between the workers and employers. The main thing in the rights and obligations i.e. workers are entitled to a wage and employers shall be obliged to pay the wages, worker safety and health are entitled to work and employers are obligated to give it as well employers are entitled a good production results from the work of the workers. In the legal position of workers in article 59 paragraph (7) of the ACT. No.13 of 2003 on Labor  that  PKWT  implementation does not comply with legislation then turn into PKWTT and affirmed in Kepmenaker No. 100/MEN/VI/2004 in article 15. As for the protection of workers, namely the protection of the right to healthcare, protection of right to health care, protection of rights of security/safety and the right end of the working relationship in the form of severance money, money reimbursement rights and money Awards working period. Abstract

Discretionary actions are the authority of investigators who are decided by the Police in dealing with legal issues ini the field directly and without asking for instructions or decisions from their superiors. The discretion exercised by investigators basically must comply with statutory regulations and the code of ethics for the police profession. However, in reality there is still discrimination in the exercise of police discretion. The aim of the research is to find out the mechanism of impelemntation and legal accountability for the police who do negligence ini traffic discretion. The research method uses normative research conducted using a statutory approach and concepts related to the police. The data used are secondary data ini the form af laws and regulations, books, scientific papers, experts, articles and then these data are processed qualitively. The results of the study show that the mechanism for applying police discretion to traffic crimes at the investigative level is that the police go to the scene of a traffic accident and then make a sketch af the crime scene, help the victim, record witness, secure avidence, the police make a case analysis and exercise discretion in case of an accident, light. The discretionary authority of the police causes investigators to have the authority to make decisions or choose various actions in resolving the law violations they handle. The discretionary authority og the police which is individual in nature is the resolution of traffic accident cases by way of deliberation between the parties involved in the accident. Criminal liabity for negligence by members of the Indonesian National Police is based on article 359 of the Criminal Code, it is proven that the actions of the defendant because of thin negligence caused another person to die is punishable by imprisonment for a maximum of five years of imprisonment for a maximum of one year.

Abstract

In 2019 the number of poor people ini Medan Citywas 183,790 people with a percentage of the population receiving PBI health insurance of 29,60% based on data from the Central StatisticsAgency. PBI JK participants are people who are classified as poor and cant’t afford whosecontributions are paid by the Government in the amount of Rp. 420.000. In 2091 the Ministry of Social Affairs issued Decree No. 70 0f 2019 sixthphase concerning policies against deactivating PBI JK participants. This is what becomes a polemic ini a society that can’t afford it. The deactivation of thin Center certainly affects PBI participants who hold the Medan Sehat Card in the city of Medan, which provide health protectionbenefits for Medan city residents.The research method uses a normative-empirical research type. The 1945 constitution explicitly stated that the state is obliged to provide health facilities for the poor and is obliged to develop a Social Security System, hence Law no 40. 0f 2004 concerning the National Social Security System and Law no. 24 of 2011 concerning Sosial Security Administering Bodies. Responbility ofthe Medan City Government in collaboration withBPJS Health, the social service and the Medan City Government Hosipital provide and coordinate in carrying out their socialresponbilities for PBI recipients whose assistancehas been stopped by the Minsitry of Social Affairs. BPJS Health as an institution managing guarantees of free health servicer to the poor must coordinate with the Medan city social service as an extension of the government to provide information related to community povertydata ini terms of data management. This coordination is to create order between institutions and the public in the use of law whichfunctions as legal certainty. Abstract

Anak harus selalu dilindungi karena ia adalah misi dan karunia Tuhan Yang Maha Esa serta memiliki harkat, martabat, dan hak yang melekat sehingga hak asasi manusia sebagai manusia harus dilindungi. Hak anak adalah hak asasi manusia yang diatur dalam UUD 1945. Ordonansi Perlindungan Anak adalah UU No. 35 Tahun 2014. Undang-undang mengatur bahwa orang tua berkewajiban memelihara dan memenuhi kebutuhan hidup anak-anaknya dan tidak melepaskan kehendak anak-anaknya. Pasal 13 (1) Undang-Undang Perlindungan Anak menyatakan bahwa semua anak berhak atas perlindungan dan perlakuan selama mengasuh orang tua, wali, atau orang lain dan mereka yang bertanggung jawab atas pengasuhan mereka. Abstract

Tindak kekerasan dalam masyarakat sebenarnya bukan suatu hal yang baru. Berbagai pendapat, persepsi dan definisi mengenai kekerasan dalam rumah tangga berkembang dalam masyarakat, kekerasan dalam rumah tangga biasanya menimpa istri atau anak, sebab wanita dianggap sebagai kaum yang lemah, Upaya normatif dari negara untuk mencegah terjadinya kekerasan terhadap perempuan, dilanjutkan dengan dikeluarkannya Undang Undang No. 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga, yang secara tegas dan luas merumuskan kekerasan dalam rumah tangga sebagai suatu tindak pidana. Mengingat banyaknya kasus yang terjadi terhadap kekerasan dalam rumah tangga pada saat ini dan juga kejamnya tindakan yang dilakukan terhadap korban maka, kepentingan korban sangat perlu diperhatikan. Perlindungan hukum terhadap korban kekerasan dalam rumah tangga khususnya istri maupun anak, diperlukan juga suatu pemulihan korban, yang mengalami suatu penderitaan baik itu secara kekerasan fisik, psikis, seksual, maupun penelantaran rumah tangga. Maka disusunlah PP No.4 Tahun 2006 tentang Penyelenggaraan Dan Kerjasama Pemulihan Korban Kekerasan Dalam Rumah Tangga
