Abstract

Puji Syukur kehadirat Tuhan Yang Maha Esa atas segala rahmat dan hidayah-Nya sehingga Prosiding Webinar Asosiasi Pengajar Hukum Adat dengan Tema "Hukum Waris Menurut Adat di Indonesia" yang diselenggarakan Lembaga Studi Hukum Indonesia bekerjasama dengan Bidang Penelitian dan Pengembangan APHA Indonesia dapat kami selesaikan. Webinar Nasional ini dibagi menjadi empat seri dalam 4 minggu, yaitu: Webinar seri 1 pada Minggu ke 1 Bulan Februari 2021 Webinar seri 2 pada Minggu ke 2 Bulan Februari 2021 Webinar seri 3 pada Minggu ke 3 Bulan Februari 2021 Webinar seri 4 pada Minggu ke 4 Bulan Februari 2021 Penyusunan prosiding ini dimaksudkan agar masyarakat luas dapat mengetahui dan memahami berbagai informasi terkait dengan penyelenggaraan seminar nasional tersebut. Abstract

Legal protection for the creation of Talunombo Wonosobo batik motives is to preserve the traditional written batik owned by Talunombo batik craftsmen in the study of Legal Anthropology approaches, both comparative and empirical approaches. The comparative approach references to the rules made to protect the creation of the Talunombo Sapuran Wonosobo batik motif based on the Copyright Law Numb. 19 Years 2022. empirical approach looks at the reality that occurs in the community of Talunombo batik craftsmen who love the products they made to preserve the nation's cultural heritage. The suggestion used should be that the Wonosobo Regional Government can synergize to be able to provide legal protection to the existence of written batik craftsmen by protecting the talunombo handwritten batik products in the  rapid economic development so that they do not become heredity and can be preserved as batik icons that can prosper the Talunombo handwritten batik craftsmen Sapuran Wonosobo.

Abstract

An electoral system used specifically for a number of districts in the Central Highlands region of Central Papua and Mountain Papua, Indonesia is called the noken system. The noken system is directly related to traditional leaders/traditional elders/tribal chiefs which of course is related to several reasons for holding noken elections both geographically, human resources, socio-culturally. In the tradition of indigenous Papuans, noken is interpreted in the value of elections by making mutual agreements and establishing intact / support for certain candidates with consensus deliberation. In other words, the noken system is a symbol of the highest deliberation for opinion determination in Papua without secrets and is more concerned with deliberation in tribal communities in Papua. The study of Legal Anthropology focuses on the socio-culture of indigenous Papuans, if in making decisions collectively collegially both in life, and in social relations both ideas, ideas in deliberation become absolute decisions, and are officially declared by their tribal chiefs (bigman), because traditional Papuan / inland communities adhere to traditional politics (bigman). So that noken is a cultural object, a community routine that is interpreted in electoral values by making mutual agreements, voting as a whole/supporting certain candidates with consensus deliberation. Thus, the use of noken means that Papuan indigenous elements are respected and obedient people to participate in elections, and to position noken to respect the entire life of indigenous Papuans. This reality underlies the opinion that noken is part of the local wisdom of indigenous Papuans who should be respected, fostered, maintained, preserved, cared for and maintained in their existence to maintain customary law in indigenous Papuans. The study of Constitutional Law focuses on a regulation to determine the noken election to be valid, with the issuance of Constitutional Court Decree Number 47-48 / PHPU-A-VII / 2009 concerning the Noken System Election in Papua. The Constitutional Court understands and appreciates the cultural values that live in indigenous Papuans that are distinctive in elections with the "Citizen Agreement" system that based on the agreement of the community understand noken as a change in object, namely the form of the KPU ballot box replaced with the form of hanging noken and contains philosophical meanings namely opening, filling and binding in the political practice of elections held on indigenous Papuans

Abstract

Development of food security has a strategic meaning in development in an area through its human resources, in accordance with Constitution number 18 of 2012 concerning food, that the provincial, district / city and / or village governments determine the type and amount of certain food reserves according to the consumption needs of the local community. The Human Development Index (HDI) also states that three factors determine the Human Development Index, namely education, health, and economy, so the quality of human resources is very influential and has an important role in developing and managing food so that a synergistic relationship between various aspects of the food security development in a region is needed. In this study, improving the quality of human resources in the city of Semarang in terms of the Anthropological Study of Law on food security, the method used through a normative juridical approach that is the law conceptualized as a normative symptom in legislation with the legal anthropological approach, the population in this study is the Department of Agriculture Semarang City with samples of food products in improving the quality of its human resources The results of this study comes through the Empirical Legal Anthropology approach, the support of strong and effective food institutions can spur growth, development and improvement of food, the nutritional status improvement of the community is very influential in improving the quality of human resources in increasing intelligence and the performance of human resources in determining future growth as one of strengthening local food security in the city of Semarang. With the availability of high quality human resources characterized by a strong physical, strong mental, excellent health and mastering science and technology can support the development of the city of Semarang.

Abstract

Physical culture can be understood as objects created by human beings which are an embodiment of the growth and development of cultural values ​​in a particular society, in the form of buildings that have been designated as cultural heritage buildings in the city of Semarang. The building is the Semarang Sobokartti building on Jalan Dr. Cipto Semarang, which is a reflection of the development of humans to always preserve culture both Javanese culture and western or European culture The approach used in this research is an empirical approach and a comparative approach to law anthropology. In an empirical approach, the sobokartti building is a physical culture which is a historic building that accommodates traditional arts which are closely related to Javanese culture, namely karawitan training, puppetry routine, puppetry courses, host courses, dancing courses and batik training. It should be appreciated because the community can maintain its preservation until now by showing the existence of Javanese culture with a love for culture that deserves to be preserved and for the nation's successor generation. Likewise with a comparative approach, it is said that the existence of physical culture in the sobokartti building is expected by the government to have regulations on cultural heritage objects, namely historic buildings or ancient buildings of the Sobokartti Semarang building as outlined in the Cultural Heritage Law No. 11 of 2010 to protect cultural heritage buildings with the aim of preserving, utilizing, and maintaining the beauty of a cultural heritage building Sobokartti Semarang. Suggestions that will be used in this research that is the role of the Government and Society to maintain physical cultural wealth should be developed by the nation's next generation, with the utilization of the Sobokartti building can provide sustainable use. So that, the Government and the community have the desire to protect and preserve the function of the Sobokartti Semarang building.

Abstract

Budaya carok sebagai upaya penyelesaian sengketa di Madura yang menggunakan kekerasan memiliki arti yang berbeda bagi masyarakat umum dan masyarakat Madura. Bagi masyarakat Madura, carok merupakan pemulihan harga diri yang berhubungan dengan harta, tahta, dan wanita. Ada istilah “Lakona daging bisa ejai’, lokana ate tada’ tmbana kajaba ngero’ dara.” Arti ungkapan tersebut adalah “Daging yang terluka masih bisa dijahit, tapi jika hati yang terluka tidak ada obatnya, kecuali minum darah.” Sedangkan, bagi masyarakat umum, tindakan ini tidak bisa dibenarkan karena merupakan tindakan main hakim sendiri dan bertentangan dengan hukum pidana yang berlaku.Penelitian ini dilakukan dengan tujuan mengetahui nilai-nilai budaya carok dan sejauh mana hukum pidana Indonesia dapat mengakomodir nilai-nilai budaya carok tersebut.

Abstract

Pendekatan holistik antropologi hukum memandang bahwa kebudayaan tari angguk merupakan budaya yang sakral dalam peradaban Jawa sebagai media dakwah dan syiar Agama Islam dan tari angguk sebagai sumber-sumber tradisi lisan yang diwujudkan dalam tarian sakral sebagai manifestasi dari penghormatan para leluhurnya sesuai dengan ajaran Agama Islam, sehingga dalam pendekatan holistik antropologi hukum dapat disimpulkan bahwa tari Angguk tercipta sebagai tarian pergaulan di kalangan remaja yang digelar sebagai ungkapan rasa syukur kepada Tuhan yang berdasarkan Agama Islam.  Unsur Agama Islam terlihat di saat sholawat nabi sebagai pembuka pertunjukkan, budaya barat (Belanda) terlihat pada gerakan dan kostum para penari memakai celana pendek, budaya timur yang terlihat pada keluwesan alur cerita tari angguk dan selalu diadakan ritual sesaji di sekitar lokasi pementasan tari angguk. Hendaknya masyarakat Pati turut mempertahankan, melestarikan tari angguk sebagai sumber-sumber tradisi lisan dan membangun peradaban Jawa, barat dan timur sebagai  perwujudan mempertahankan tradisi yang sakral.

Abstract

Customs and values within Indigenous communities form the basis of customary behavior in understanding human conduct, particularly in the context of Balinese indigenous women's behavior as guardians of tradition in an empirical approach to legal anthropology. This means that the legal norms used to observe the behaviors of Balinese indigenous women as custodians of indigenous traditions within the frame of cultural relativism represent legal realities apparent in legal situations or any legal events that genuinely occur within the indigenous community, as manifestations of the indigenous women's behaviors in preserving sacred traditions. This is based on an empirical approach to Legal Anthropology. Whether acknowledged or not by the indigenous community, the empirical approach to cultural relativism fundamentally holds a social and cultural value system that can serve as the social capital of the nation. The community's attitudes and behaviors rooted in tradition are guided by values believed to be true, exemplifying the traditional values and cultures passed down through generations and perceived as instruments for social control and religious values that guide human life, manifesting the preservation of local cultural relativism among the local indigenous community. Indigenous communities in these regions become the focal research site with the hope of safeguarding traditional values as a reinforcement of customary practices, the culture, and the traditions of the local indigenous community, which embody the manifestation of protected local wisdom governed by regional customary laws. The methodological approach utilized involves the Empirical Approach of Legal Anthropology linked with the theory of cultural relativism, leading to the conclusion that the approach involves field observations, interviews with research informants, and analyzing primary, secondary, and tertiary data sources through the lens of cultural relativism concerning the behaviors of indigenous women based on an empirical approach within the context of indigenous customary law.
