Abstract

Abstract: This article discusses the analysis of the prohibition of analogy in the Draft Bill. The majority of the experts of jurisprudence against analogy. The author does not agree with the ban on using the analogy in the Draft Bill, but justifies the analogy with the record, the judge must be competent and with integrity. If the judge is unable to make analogy, then he could use self-interpretation to find a legal decition. The argument of usage of analogy is to seek substantial justice for the people without setting aside the individual’s rights, because by using the analogy, the rule of law will remain unfulfilled. It is because the crime, in its various forms, is still contrary to morality even though it is not written, and even if the crime has an impact to the public. In Islamic law, the method of qiyâs compiled by Imam Shafi’i in may be used as a good analogy, because qiyâs method has been tested by producing many laws.Keywords: Analogy, draft bill, the criminal code. Abstrak: Artikel ini membahas tentang analisis terhadap larangan analogi dalam RUU KUHP. Mayoritas para ahli ilmu hukum menentang analogi. Penulis tidak sepakat dengan larangan menggunakan analogi dalam RUU KUHP, tetapi membenarkan analogi dengan catatan, hakimnya harus kompeten dan berintegritas. Jika hakimnya memang tidak mampu untuk beranalogi, maka ia masih bisa menggunakan interpretasi untuk menemukan hukumnya.   Argumen diperbolehkannya analogi adalah untuk mencari keadilan substansial bagi masyarakat tanpa menyampingkan perlindungan individu, sebab dengan menggunakan analogi kepastian hukum akan tetap terpenuhi. Karena kejahatan, dalam berbagai bentuknya, tetap saja bertentangan dengan kesusilaan meskipun ia tidak tertulis, apalagi jika kejahatan tersebut membawa pengaruh kepada masyarakat luas. Dalam hukum Islam, metode qiyâs yang disusun oleh Imam Syafi’i dalam berijtihad mungkin dapat digunakan sebagai proses analogi yang baik, sebab metode qiyâs ini sudah teruji dengan memproduksi banyak hukum. Kata Kunci: Analogi, Rancangan Perundang-undangan, KUHP.

Abstract

Abstract: This article discusses the General Principles of Good Governance (AAUPB). It has a long journey from the beginning of its coming in the Netherland to its application in Indonesia today. AAUPB, which previously was only in theoretical realm, it changes into Law No. 30 of 2014 today. The principles contained in the law are legal certainty; expediency; impartiality; accuracy; not to abuse authority; openness; public interest; and good service. In addition to these principles, we can also use other principles as far as they become the basis for the judges' judgments that have permanent legal force. In various cases, the basis of the claim of AAUPB does not stand alone but it is also juxtaposed with violations of statutory regulations. The Supreme Court verdict has become a jurisprudence between Suhaili Saun (shareholder in PT Volex Batamindah) and the Chairman of BKPM, although the plaintiff also argued that violating the AAUPB namely the principle of legal certainty, the defendant also violated article 2 letter b of Law No. 1 of 1967 about Foreign Investment. In the case of the dismissal of Bripda Helga Musa Sitepu by the Head of the North Sumatra Regional Police, the decree has violated article 2 paragraph 2 letter d and article 11 paragraph 1 of KAPOLRI regulation No. 8 of 2006 and was contrary to the principle of the district. Keywords: AAUPB, Jurisprudence, State Administration Abstrak: Artikel ini membahas tentang Asas-Asas Umum Pemerintahan yang Baik (AAUPB), AAUPB memiliki perjalanan yang panjang dari awal kelahirannya di Belanda sampai penerapanya di Indonesia dewasa ini. AAUPB pada awal mulanya hanya berada dalam ranah teoritis baru kemudian masuk dalam undang-undang hingga AAUPB mendapatkan posisi yang sangat penting dalam UU No. 30 Tahun 2014, asas yang terdapat dalam undang-undang tersebut meliputi asas kepastian hukum; kemanfaatan; ketidakberpihakan; kecermatan; tidak menyalahgunakan kewenangan; keterbukaan; kepentingan umum; dan pelayanan yang baik. Selain asas-asas tersebut, bisa juga menggunakan asas lain selama dijadikan dasar penilaian hakim dalam putusan yang sudah mempuyai kekuatan hukum tetap. Dalam berbagai kasus, dasar gugatan karena AAUPB tidak berdiri sendiri tapi juga disandingkan dengan pelanggaran peraturan perundang undangan. Dalam putusan kasasi MA yang telah menjadi yurisprudensi antara Suhaili Saun (pemegang saham di PT Volex Batam Indah) dengan Ketua BKPM, meskipun penggugat mendalilkan juga bahwa selain melanggar AAUPB yaitu asas kepastian hukum, tergugat juga melanggar pasal 2 huruf b UU No. 1 Tahun 1967 tentang Penanaman Modal Asing. Dalam kasus pemberhentian Bripda Helga Musa Sitepu oleh Kepala Kepolisian Daerah Sumatera Utara, surat keputusan tersebut melanggar pasal 2 ayat 2 huruf d dan pasal 11 ayat 1 peraturan KAPOLRI No. 8 Tahun 2006 dan bertentangan dengan asas kceramatan. Abstract

The issue of multi-party presidential governance in Indonesia remains an unfinished homework to date, many political experts and Constitutional Law have inferred the ineffectiveness of presidential systems in multi-party models. On the other hand, our Constitution has affirmed through its characteristics that Indonesia embraces a presidential government system, but it is applied in multiparty political construction. Since the beginning of the general election, Indonesia still uses the proportional system with various color additions district. Because of the proportional success that has been used since the first election, it may be necessary to try new things by using the district system with a variety of variations so as not to undermine democracy. The parliamentary threshold model and the tightening of conditions for parties to follow the election will slowly simplify the party. Nevertheless, the high standard of parliamentary threshold creates much criticism, the small party feels aggrieved and says it is against democracy.

Abstract

Constitutional Court Decision No. 46 / PUU-VIII / 2010 raise the pro and contra in the society. The pro side considers the Constitutional Court decision gives justice for women who are victims of fraud or sirri wedding, and for the children born from this relationship. On the other hand, the contra side argues that the decision of the Constitutional Court has strayed far from the Islamic law; even they consider it as legalizing adultery. In this research, writer uses a qualitative approach. The writer deciphers Constitutional Court Decision No. 46 / PUU-VIII / 2010 and then analyzes those using concepts laqith and wasiat wajibah in the Islamic law. The concept of laqith can be used to justify the obligation of biological father toward his children, and wasiat wajibah can be used as a way out for inheritance for children born outside wedlock. From these results, it can be concluded that the court decision number 46 / PUU-VIII / 2010 does not contradict with the Islamic law.

Abstract

Artikel ini mengkaji integrasi Badan Riset dan Inovasi Daerah (BRIDA) ke dalam Badan Perencanaan Pembangunan Daerah (BAPPEDA) yang membentuk Badan Perencanaan Pembangunan, Riset dan Inovasi Daerah (BAPPERIDA) dari perspektif hukum tata negara. Fokus kajian terletak pada landasan hukum pengintegrasian BRIDA ke BAPPEDA dan pengaruh integrasi ini terhadap efektivitas riset dan inovasi dalam mendukung pembangunan berbasis ilmu pengetahuan dan teknologi di daerah Kabupaaten Bojonegoro. Artikel ini menggunakan metode penelitian yuridis normatif, dengan pendekatan Perundang-undangan serta pendekatan konseptual, dan mengunakan metode analisis kualitatif. Hasil kajian menunjukkan bahwa integrasi BRIDA ke dalam BAPPEDA memberikan sinkronisasi yang lebih baik antara riset dan perencanaan pembangunan, meningkatkan efisiensi birokrasi, serta mendorong inovasi berbasis iptek dalam kebijakan pembangunan daerah. Di samping itu, integrasi ini juga memperkuat konsep pembangunan berkelanjutan melalui pendekatan kebijakan berbasis bukti (evidence-based policy). Artikel ini merekomendasikan perlunya penguatan regulasi dan kerjasama lintas sektor untuk memaksimalkan potensi riset daerah dalam mendukung pembangunan yang inovatif dan berkelanjutan.

Abstract

The existence of the Head of the Ibu Kota Negara Authority, as regulated by Law of the Republic of Indonesia Number 3 of 2022 (UU No. 3 of 2022), has given rise to significant legal issues. The mechanism for the appointment, dismissal, and termination of the Head of the Authority, carried out directly by the President, is considered contrary to the democratic principles enshrined in Article 18 of the 1945 Constitution of the Republic of Indonesia, which emphasizes the importance of democratically electing regional heads. Additionally, the status of the Head of the Authority, which is equivalent to a minister, raises questions regarding the position and legitimacy of the legal products issued by this authority. This research adopts a normative legal method to analyze the constitutional implications of this regulation. The findings indicate a potential constitutional violation regarding the existence and appointment mechanism of the Head of the Authority under UU No. 3 of 2022, which could affect the democratic rights of the community, particularly in the Ibu Kota Nusantara (IKN) region. In this context, it is crucial to reconsider the existing regulations to ensure that democratic principles and community rights are upheld. Therefore, further studies are necessary to evaluate the impact of these regulations on governance practices and community participation in decision-making processes, as well as to develop policy recommendations that support the sustainability of regional autonomy and decentralization principles. Thus, the existence of the Head of the Authority should align with the goal of establishing a democratic and responsive government that meets the aspirations of local communities.

Abstract

Kejahatan siber di Indonesia telah berkembang pesat seiring kemajuan teknologi, hal ini menimbulkan ancaman serius bagi individu, organisasi, dan keamanan negara. Berdasarkan data dari Badan Siber dan Sandi Negara (BSSN), hingga Oktober 2023 tercatat sebanyak 361 juta anomali lalu lintas siber, dengan 42% di antaranya merupakan aktivitas malware. Beberapa insiden besar yang terjadi, termasuk serangan ransomware yang berhasil meretas Pusat Data Nasional (PDN) serta peretasan 150 juta data penduduk Indonesia oleh hacker dengan nama samaran Bjorka, tragedi ini menunjukkan betapa gentingnya perlindungan data di Indonesia. Akar permasalahan yang mendasar terletak pada fragmentasi regulasi perlindungan siber serta tidak diratifikasinya Konvensi Budapest tentang Kejahatan Siber oleh Indonesia. Regulasi yang ada, seperti Undang-Undang tentang Informasi Dan Transaksi Elektronik (ITE) dan Undang-Undang tentang Pelindungan Data Pribadi (PDP), dinilai belum mampu memberikan perlindungan hukum yang efektif dan kepastian hukum bagi korban kejahatan siber. Fragmentasi regulasi menyebabkan tumpang tindih kewenangan dan ketidakefektifan penegakan hukum dalam menangani ancaman siber yang semakin kompleks. Penelitian ini bertujuan untuk mengeksplorasi penerapan metode Omnibus Law sebagai solusi untuk mempercepat perlindungan siber yang berkepastian hukum di Indonesia, dengan mengharmonisasi berbagai peraturan perundang-undangan yang terfragmentasi. Penelitian ini menggunakan pendekatan yuridis normatif dengan pendekatan peraturan perundang-undangan dan pendekatan komparatif. Hasil penelitian menunjukkan bahwa metode Omnibus Law dapat menjadi solusi efektif untuk menyatukan peraturan terkait perlindungan siber dalam satu undang-undang komprehensif, mengurangi tumpang tindih regulasi, dan meningkatkan kepastian hukum. Setelah menyelaraskan regulasi nasional, ratifikasi Konvensi Budapest menjadi langkah strategis bagi Indonesia dalam memperkuat kolaborasi internasional untuk menangani kejahatan siber lintas negara.

Abstract

Pancasila as a guideline for the nation's life is manifested in every aspect of Indonesian society. In the field of education, the existence of Pancasila is concretized in the KKNI curriculum. So, how is the existence of the Pancasila ideology in the Legislation that underlies the KKNI Curriculum, especially in higher education? This study aims to examine the existence of Pancasila in the KKNI curriculum, especially in the implementation of the KKNI curriculum at the Faculty of Law, Airlangga University, and the Faculty of Sharia and Law, UIN Sunan Ampel Surabaya. The research method used in this study is the empirical normative method. Based on the results of the study, it was revealed that the legislation that is the legal basis for the KKNI curriculum already reflects the values of Pancasila and strengthens Pancasila's ideology in organizing the learning process in higher education. This appears in the general description and gradation of the KKNI in Presidential Regulation Number 8 of 2012 and also the Learning Outcomes (CPL) in the attachment to the Regulation of the Minister of Research and Higher Education Number 44 of 2015 on the aspect of general attitudes and skills. These learning outcomes and general skills aspects serve as a guideline for all higher education providers when creating the KKNI curriculum structure. The KKNI curriculum at the Faculty of Sharia and Law and the Faculty of Law UNAIR has strengthened the ideology of Pancasila. The steps are by referring to the CPL in the attachment to the Regulation of the Minister of Research and Higher Education No. 44 of 2015 and adding the university's vision and mission as a Characteristic of Higher Education. Furthermore, several courses are formed that intensively discuss Pancasila and also through the learning process carried out by the lecturers in charge of the courses by instilling the values of Pancasila.
