Abstract

Menggunakan pendekatan normatif tulisan ini bertujuan untuk menjabarkan asas-asas dan landasan teoretis dalam pembentukan Naskah Akademik Rencana Pembangunan Jangka Menengah Daerah (RPJMD) Kabupaten Tulang Bawang Tahun 2011-2016. Hasil penelusuran kepustakaan ditemukan bahwa asas-asas dalam penyusunan RPJMD meliputi asas hukum yang diatur dalam Undang-undang Pemerintahan Daerah dan Undang-undang Pembentukan Peraturan Perundang-undangan. Adapun landasan teoretisnya mencakup antara lain wewenang pemerintahan daerah dalam menjalankan asas otonomi seluas-luasnya berdasarkan Undang-Undang Dasar Tahun 1945. Kata kunci : RPJMD, asas-asas, landasan teoretis dan Naskah Akademik.

Abstract

Tujuan penelitian ini adalah mengetahui landasan teoretis dan landasan yuridis pengaturan desa dan/atau sebutan lainnya dalam peraturan daerah di Tulang Bawang Barat. Menggunakan pendekatan yuridis dogmatik, disimpulkan bahwa landasan teoretis pengaturan kampung dengan perda antara lain mencakup sejarah penamaan, asal-usul kampung, dan wewenang pemerintahan daerah dalam mengatur kampung dengan peraturan daerah. Adapun landasan yuridis pengaturan kampung dengan peraturan daerah adalah sebagaimana dimaksud angka 39 dan 40 Lampiran II Undang-undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan perundang-undangan. Kata kunci : Kampung, Desa, dan Peraturan daerah.

Abstract

The procedure Oversight Judge (How It Treats People) is regulated by an internal mechanism by the Supreme Court as an institution builder through the remedies and oversight mechanisms of behavior, as well as the external monitoring Judicial Commission behavior of justices and judges in the Supreme Court. While the constitutional judges monitored internally without the involvement of outside agencies. There is injustice setting norms supervision of judges (How It Distribute). Abstract

In order to preserve and uphold the honor, dignity, and the behavior of the judge is required to supervise the attitude constitutional judge to fit the code of ethics, so that each judge's ruling will be implemented in order to enforce the law and justice based on Pancasila and the Constitution 1945 as a permanent legal political for supervision of the constitutional judges. Whereas legal politics incidental that becomes choice among others: a) Behavior of Constitutional Judges are overseen by the Board of Ethics established by the Constitutional Court, and for the reported judges or suspected violations of ethic codes of Constitutional Judges formed by Honorary Council of the Constitutional Judges whose creation was proposed by Ethics Council, with the task of implementing and serves as ethic judicial; and b) there is no judicial supervision against Constitutional Court's decision as well as supervision of a court decision which was in the Supreme Court through the mechanism of legal remedies (ordinary and extraordinary). Keywords: Supervision, Behavior, Constitutional Judges

Abstract

Peran koperasi yang sangat besar bagi perekonomian masyarakat sudah terbukti mampu bertahan dalam menghadapi krisis perekonomian. Koperasi merupakan potensi dalam mengembangkan ekonomi nasional. Selain itu, koperasi juga mewakili sistem ekonomi indonesia yang berciri khas asas kekeluargaan dan gotong royong, bukan kapitalisme. Kegiatan Pengabdian ini bertujuan untuk mengedukasi aparatur desa mengenai Perlindungan dan Pemberdayaan Koperasi Pasca UU Cipta Kerja. Hal ini karena berbagai adanya perubahan kebijakan hukum terhadap koperasi menjadi bagian penting yang juga perlu dipahami oleh desa. Kegiatan ini menjadi sebuah solusi agar desa dalam melakukan upaya dalam pengembangan koperasi di wilayahnya. Sehingga sasaran khalayak dalam kegiatan ini adalah pemerintah desa, badan permusyawaratan desa, dan perwakilan masyarakat. Lokasi kegiatan dilaksanakan di Desa Fajar Baru. Metode yang digunakan dalam kegiatan ini yaitu melalui ceramah, dan diskus. Hasil kegiatan menunjukkan bahwa: kesadaran hukum masyarakat dalam Perlindungan dan Pemberdayaan Koperasi Pasca UU Cipta telah meningkat hingga 88%. Hal ini ditunjukkan dengan beberapa indikator diantaranya: peran koperasi; perlindungan hukum koperasi dalam peraturan perundang-undangan; otonomi desa; dan perlindungan koperasi pasca UU Cipta Kerja.

Abstract

Political parties are the political suprastructure in a democratic country as a means for citizens to occupy political positions through general elections. The requirements for verifying political parties participating in an election are always contained in every election law making it difficult for political parties to pass verification as well as excluding several political parties that have met certain verification requirements so that they are immediately declared as participants in the next elections. This exception is not in accordance with several Constitutional Court Decisions which have the same substance which consistently declares unconstitutional, except for the Constitutional Court Decision Number 55/PUU-XVIII/2020. The research method used is normative juridical regarding laws and regulations, namely Law Number 7 of 2017 concerning Elections, accompanied by comparative study of jurisprudence  Constitutional Court's decision regarding an application for judicial review of political party verification accompanied by literature studies. The research analysis uses a qualitative approach to understand more deeply the legal phenomena that occur and examines the substance to obtain specific conclusions on what is studied. That decision based on a discussion of this research is inconsistent because the arguments and materials of the 1945 Constitution used are different and the Constitutional Court is not required to use jurisprudence as a basis for consideration even though there are similarities in substance.

Abstract

Placing the National Guidelines of State Policy (GBHN or PPHN) made by the People's Consultative Assembly (MPR) as a guideline for the President can potentially reposition MPR above the President. Such an idea of a state has been implemented in Indonesia for no less than 54 years (1945-1999). This paper aims to analyze the basic characteristics of the presidential system and assess the compatibility of PPHN with the presidential system, with the novelty which then offers a model for pouring PPHN into laws and regulations that align with Indonesia's presidential system. Based on the conceptual and theoretical approaches, it can be concluded: First, the basic character of a presidential system is to separate the legislature from the executive, so no accountability mechanism puts the President down as subordinate to the legislature. PPHN implementation can shift this separation towards an accountability model, a feature of a parliamentary system. Second, PPHN can be re-enforced in a presidential system, with the prerequisite that no accountability mechanism puts the President under MPR. Third, pouring PPHN into the form of a Law replacing the RPJPN Law will be more relevant to avoid a government system shifting. However, providing a checks and balances mechanism for the President through the House of Representatives' budgetary rights is still necessary.

Abstract

ABSTRAK: Berlakunya Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah membawa konsekuensi baru terkait pelaksanaan urusan pemerintahan konkuren antar tingkat pemerintahan di daerah. Kajian ini bertujuan untuk mendekonstruksi urusan pemerintahan konkuren pemerintah daerah sehingga akan terlihat titik berat otonominya. Penelitian yang dilakukan dengan koridor doctrinal research dan menggunakan statute dan conceptual approach ini menghasilkan temuan sebagai berikut: Perubahan kewenangan konkuren pemerintah daerah yang diatur dalam UU No. 23 Tahun 2014 membawa konsekuensi terjadinya polemik antar pemerintah provinsi dan pemerintah kabupaten/kota serta infleksibilitas, inefektifitas dan inefisiensi dalam pelaksanaan urusan pemerintahan tertentu, seperti pelaksanaan kewenangan di bidang perizinan pertambangan yang akan lebih baik jika dilaksanakan oleh pemerintah kabupaten/kota karena sesuai dengan aspek perpajakan daerahnya. Hal ini menjadikan pembagian urusan pemerintahan konkuren daerah dalam UU No. 23 Tahun 2014 bernuansa the thinnest version rule of law.   Deconstruction of Concurrent Government Affairs Based on Law Number 23 of 2014 on Local Governance ABSTRACT: The enactment of Law No. 23 of 2014 on Local Governance brings new consequences related to the implementation of concurrent government affairs between levels of local government. This study aims to deconstructing the administration of local government concurrent affairs so that it looks the emphasis autonomy. Research conducted by doctrinal research corridors and using the statute and conceptual approach, resulted in the following findings: The changes of local government concurrent authority as stipulated in Law No. 23 of 2014 brought consequences of a polemic between the provincial government and district/city governments as well as inflexibility, ineffectiveness and inefficiency in the implementation of government affairs, such as the exercise of authority in the field of licensing mining would be better if implemented by the district/city governments because in accordance with aspects of taxation area. This makes the distribution of concurrent local government affairs in Law No. 23 of 2014 shades of the thinnest version rule of law.
