Abstract

Autonomy system based on act No. 32 /2004 directed the effort to accelerate the realization of thepeople's welfare. Level of welfare can be measured through human development index consist of twomain indicators, that are health and the economy. Autonomy will be encourage government localaccountability and increased sensitivity to provide public goods and services. Accountability andsensitivity of local government based on Perdawhich is form of local legislation.However, the fact shown that there has been a gap between perda and social condition materialized inthe form of poverty. Perda can not guarantee the health rights for the poor in term of freedom,availability, affordability, acceptability and quality. In addition, there is lack on the quantity of perdaand quality of perdas a legal framework to ensure the good services provided by local government.The fulfillment of the health poor rights is requiring progressive perda encompassing the aspects ofauthority, procedure and substance of perda. The moralityof perda progressive can be achieved throughthe empowerment for the poor using a rights-based approach. The empowerment shall be conductedthrough the formulation of perda progressive aiming right enhancement, rights awareness, rightsenablement, and rights enforcement. The effort is requiring the principles of responsiveness, as theprinciple of material formulation and implementation of perda progressive, within the framework ofpurposive law

Abstract

Globalization has placed Indonesia in a dilemma in creating the welfare of the people. Many legislations with liberal character are disallowed through the constitutional review by the constitutional court. The liberal character then becomes constraints for government to realize social welfare, thus harming the economic interest of people and contrary to the constitution (UUD 1945). Efforts to create welfare cannot be separated from state sovereignty in determining the economics welfare policy in the form of law. The State needs to adopt policies of recalibrating sovereignty to realize its objectives. Sovereignty is the essential requirement to be able to build pengayoman law character, ideology by Pancasila ideology and UUDNRI 1945. The legal substance of pengayoman law (protection and succor) will realize a balance between global interests and the interests of the nation. Pengayoman Law integrates the efficiency and freedom with fairness and welfare excellence. Also, the Pengayoman Law always opens the space to give a guarantee/partiality to the poor through social policies that are based on human dignity. Keywords: Welfare, Challenges, Globalization, Dilemma

Abstract

The absence of a clear normative interpretation related to witnesses who are also criminal perpetrators in the Indonesian court has controversy on the theoretical level. In practice, the practitioners adopt a concept known in other countries. However, in adopting ideas from other countries, practitioners are often trapped in practitioners’ paradigms. Translating the perpetrators’ witnesses such as crown witnesses, justice collaborators (JC), and whistleblowers (wb,) are not the concepts comprehensively. In the end, the witness being denied the rights of the perpetrators, namely right non-self-incrimination. The paper offers a concept for finding solutions in the use of witnesses who are also as criminal perpetrators in epistemological basis. These considerations are used to provide a coherent way based on the principle to justify the use of witness evidence from the criminal perpetrators. The purpose is to accord with the principle of due process of law, not to clash the principle of non-self-incrimination in proving the search of material truth.

Abstract

Local government requires a regulatory framework as a base of Genetically Modified Organisms’ (GMO) development and expansion in order to support food sovereignty. In regions of Indonesia, GMO products could be strengthened through local certification. The involvement of the government is vital in supporting the economical activities of entrepreneurs in certain regions. Researchers are interested in further discussion on, “Local Certification: Genetically Modified Organisms’ Commercialization”. The studies focus on the urgency for local certification in GMO products and the commercialization of local certification towards GMO Products of region in Indonesia. This is normative research through a statute approach, which concerns legal basis for local government authority regarding agricultural products’ affairs. The research suggested that urgency for local certification in every region is very much needed to bolster food production with GMO technology base as part of the geographical index product. In the implementation amongst society, the product could be supervised and developed to enhance local and national economic activities by paying attention to the quality of genetically modified products and its food safety. GMO commercialization is still constrained by permit on feed, food and environmental safety. Therefore, the Indonesian Government’s protection on GMO product commercialization is required, both from national and local governments through a local certification. The practice upon food local certification is implemented in several regions of Indonesia, such as West Sumatra by establishing an institution; Kebumen Regency by forming a food certification related regulation and Palembang City also by applying food certification.

Abstract

The regulation of economic, social and cultural rights is always intertwined with language. Language is significant in the written dimension of legal protection and the legal fulfillment of rights. The text of the law is a commitment to fulfilling rights. Understanding the structure of the text is necessary to predict and reach the needs, as well as to fulfill the rights. States must be able to recognize legal texts that are aligned and responsive. These legal texts must favor the fulfillment of the civil rights through language that reflects and transforms elements of the economic, social, and cultural rights (ie. freedom, availability, accessibility, and conformity). Yet, it is often that the language in the legal text formulated is inconsistent and uncertain. Language as a tool of transformation can also become a tool that shackles. This issue requires an understanding of intertextuality, with respect to the text of the law. One strategy is to highlight the elements in legal texts: principles, standards, and concepts to enforce values and legal goals. This effort is intended to understand the various factors and relationships that affect the accuracy of meaning, and subsequently reflect on the purpose of formulating that legal text. The discovered weakness of the text can thus be reconstructed in responsive, progressive and communicative spaces and structures. Abstract

This study aims to analyze the regulation of inter-regional cooperation law in environmental management in Lampung Province. The findings of this research are expected to be a basis in determining the model of legal policy of interregional cooperation in the field of environmental management in Lampung Province. Thus, the implementation of regional autonomy will be protected from regional ego and sector ego, and will eventually realize the ultimate goal of regional autonomy in the field of environment that is the welfare of local communities and environmental sustainability. This research method using socio-legal approach. The practice is primarily concerned with Local Government involvement and communities in upstream-downstream relationships in watershed (DAS) management in Lampung Province. Therefore, this study, in addition to reviewing the environmental policy of the Lampung Provincial Government, also examines district and city government environmental policies, especially in environmental management involving more than one district / city. The results showed that the legal arrangement of interregional cooperation in management of the environment in Lampung Province has not been specifically regulated. The basis of inter-regional cooperation is based only on the principles of regional autonomy and has not been based on the ecological characteristics and conditions in the region. Therefore, the approach still tends to be economic oriented and regional administration.The ideal concept is that the legal arrangement of cooperation inter-regional in the field of environment should be based on the principle of ecoregion.

Abstract

Globalization is a necessity which can’t be avoided by the nations of the world. There are Many benefits that appear from globalization process, but also there is negative effect which posed by economic order difference. To cope the negative effect, it need an effort to strengthen the state role which can be done by creation of law instrument.  The creation of law instrument based on the Pancasila Ideology and UUDNRI1945- Constituion.Those thing as a fundamental value in constructing the real state sovereignty. The orientation of law creation focused to create the stability of nation interest and global interest. The stability focused on 4 important aspect which are justice, exellence, efficiency, and liberty as fundamental value of moral economic law. Those 4 aspect having a fundamental value which embodied in character of law that protect and succor.

Abstract

A known agrarian issue took place in Indonesia, particularly in the area of Register 45 Mesuji Lampung. The granting of natural forest management permit by the government to PT. Silva Inhutani, thus eliminating public access around Register 45 to manage the forest, subsequently lead to conflict in the region. The objectives of this research are, namely: 1) to explain the grounds for partnership in the Register 45 area; and 2) to analyze the partnership program undertaken in Register 45 as an effort of resolving conflict. This research used a descriptive qualitative approach that describes the results of research, assessment and other references reinforced with empirical data through interviews and observations. This study found a number of issues in the partnership agreement formation process, wherein the community was not being involved in the formation process of the partnership provisions, such as the planting process and the profit sharing scheme. The issues found in the implementation stage of the partnership agreement can be observed from an internal factor perspective, which was the unfulfilled expectation to increase acacia planting. Regarding the external factor, there were still many acts of thuggery in the area of Register 45 that interfered with the partnership process. There was also a fundamental problem in the partnership implementation, which was the prevalent lack of aptness in the mapping of community entitled to the partnership, as well as the lack of trust among collaborating parties.

Abstract

Artikel ini menganalisis pelaksanaan kebijakan resettlement bagi masyarakat korban bencana alam tsunami di Lampung Selatan yang terjadi pada Desember 2018 lalu. Dengan menggunakan pendekatan peraturan perundang-undangan dan konseptual, hasil penelitian menunjukkan bahwa menurut UU Penanggulangan Bencana dinyatakan bahwa penyelenggaraan penanggulangan bencana meliputi empat tahapan yaitu: penetapan kebijakan pembangunan yang berisiko timbulnya bencana, kegiatan pencegahan bencana, tanggap darurat, dan rehabilitasi. Dua tahapan di awal dibuat sebelum adanya bencana (prabencana), tanggap darurat dilakukan saat terjadinya bencana, dan rehabilitasi dilakukan pascabencana. Dalam konteks bencana tsunami di Lampung Selatan pada 2018 silam, salah satu kebijakan pascabencana yang dilakukan adalah resettlement. Kebijakan ini dilakukan berdasarkan Keputusan Bupati No. B/613.1/VI.02/HK/2019. Dalam keputusan tersebut ditentukan bahwa kebijakan resettlement ini dilakukan pada 4 kecamatan yang telah ditentukan yakni Kecamatan Rajabasa, Kecamatan Kalianda, Kecamatan Sidomulyo dan Kecamatan Katibung. Pada pelaksanaannya, kebijakan ini berdampak pada beberapa aspek kehidupan masyarakat yang dipindahkan, seperti dalam aspek sosial dan ekonomi.

Abstract

Pesatnya perkembangan pasar modern saat ini berbanding terbalik dan bahkan menjadi ancaman bagi eksistensi pasar tradisional (pasar rakyat) yang merupakan motor penggerak perekonomian rakyat. Kontrasnya, pengaturan dalam produk hukum daerah justru berpihak pada pertumbuhan pasar modern dan mengesampingkan keberlanjutan pasar rakyat. Kajian ini bertujuan untuk menguji pengaturan mengenai pasar modern dan pasar rakyat dengan indikator nilai-nilai Pancasila. Penelitian ini sangat urgen dilakukan guna mengidentifikasi dan menyelesaikan problem hukum dalam pengaturan pasar modern dan pasar rakyat saat ini. Kajian ini menggunakan metode penelitian hukum normatif dengan pendekatan filosofis, pendekatan konseptual, dan pendekatan perundang-undangan. Hasil penelitian menunjukkan bahwa ada ketimpangan pengaturan yang terjadi dalam perumusan pasal per pasal pengaturan dalam produk hukum daerah. Ketimpangan tersebut berupa keberpihakan pemerintah daerah terhadap pasar modern dan lemahnya perlindungan terhadap pasar rakyat. Keberpihakan ini dapat dimaknai sebagai sebuah perubahan paradigma pembangunan yang lebih berorientasi pada liberalisasi perdagangan dibanding perlindungan terhadap pasar rakyat sebagai warisan budaya bangsa yang mencerminkan nilai-nilai Pancasila yaitu nilai kegotongroyongan, solidaritas dan kebhinekaan. Untuk itu, ke depan, regulasi yang mengatur mengenai penataan pasar modern dan pasar rakyat hendaknya dapat menyeimbangkan keduanya dan konsisten, koheren dan koresponden dengan nilai-nilai Pancasila.
