Abstract

Pengelolaan keuangan desa merupakan salah satu proses penting dalam mewujudkan pembangunan desa yang bertanggung jawab dan berdaya saing. Oleh karena itu, peningkatan kapasitas aparatur desa dalam pengelolaan keuangan desa menjadi penting untuk dilakukan. Aparatur Desa Sidosari Kecamatan Natar selama ini sudah mengetahui secara umum pengelolaan keuangan desa, namun secara khusus terkait kerangka regulasi dan pertanggungjawaban hukumnya belum paham. Sehingga dibutuhkan peningkatan kapasitas aparatur Desa Sidosari Kecamatan Natar dalam melakukan pengelolaan keuangan desa. Kegiatan ini dilakukan dengan ceramah dan diskusi. Hasil dari kegiatan menunjukkan bahwa terdapat peningkatan kapasitas Aparatur Desa Sidosari Kecamatan Natar dalam melakukan pengelolaan keuangan desa, hal ini diketahui melalui hasil postest yang menunjukkan sebanyak 2 peserta atau 10% masih rendah, sedangkan 12 peserta atau 60% sedang dan 6 peserta atau 30% tinggi. Hal ini menandakan bahwa khalayak sasaran dari pengabdian ini mengalami peningkatan pengetahuan dan kapasitas terkait pengelolaan keuangan desa. Diharapkan dengan hasil ini pengelolaan keuangan desa di Desa Sidosari dapat menjadi lebih baik.

Abstract

Two things become an important part of studies in Indonesian law related to energy management. The first, related to the management of natural resources. Second, the energy sector is also related to other sectors, that is forestry, water resources, marine and fisheries, agriculture and plantations, as well as land. Ideally, all of the energy management law must reflect the state ideology, as natural resources energy must be managed for the greater prosperity of the people. Energy should not be administered arbitrarily because, in addition to the utilization, the existence of natural resources should not be separated from the philosophical orientation of Indonesian legislation, Pancasila, and The 1945 Constitution. However, the reality of energy legislation indicates of the authority competes between sectors and alignments to society which is not optimal. It is due to the legal nature of the energy sector which is liberal and still-exploitation oriented and pro-capitalist. By using a socio-legal approach, this paper describes the reconstruction of law-oriented to the Indonesian legal system in energy management based on Pancasila and the 1945 Constitution as the foundation and soul of the energy sector law. Keywords: Reconstruction of Law, Energy Management, the Indonesian Legal System.

Abstract

An independent judicial power is very important as one of the main characteristics of the rule of law, therefore its position must be maintained in Indonesia. The purpose of this paper confirms that any attempt to intervene in the authority of the Supreme Court and the Constitutional Court in the justice system, including intervention from the President, must be considered an unconstitutional act and violates the ideals of the Indonesian rule of law. A review of the President's position in the statutory regulations found the fact that there was still a gap in the infiltration of the President's power over judicial authority. Specifically in two cases, the first relates to the ambivalence of the prosecutor's position that is not as firm as the Police. Second, the constitutional judge selection model. The need to re-arrange the mechanism for selecting constitutional judges derived from the President's proposal so that it can be more aligned with efforts to distance the President's power from the power of the judiciary. In addition to the recommendations to the formers to reorganize the two potential infiltrations, this paper also recommends the institutionalization of public petitions based on Mark Tushnet's ideas about populist constitutional law. The existence of a public petition institution becomes a forum for gathering input and advice in law enforcement and justice. The opening of the President to accept public petitions makes it easier for the people to submit law enforcement issues which, in a sense of people's justice, must be addressed.

Abstract

The existence of regulation of recall rights of political parties as regulated in Law No. 17 of 2014 and Law No. 2 of 2008 bring a great influence on the position of legislative members. Based on these rules, legislators may be dismissed from their positions if proposed by Political Party. This certainly brings a polemic for the people as the sovereign owner, who have chosen their representatives through the electoral process, but when chosen representatives of the people can be dismissed from his position by a political parties through the mechanism of the right of recall. This research was done by doctrinal method approach as well as the use of the statute, historical, and conceptual approach. This results showed that the legal politics of recall right of political parties is actually only used as an instrument of the political parties in controlling its members in parliament in order to always adhere to the party's policy direction. This makes the recall right political party is legal products that characterized conservative or orthodox. The existence of a political party's recall rights order gives a great authority to the political parties to negate the result of the people's choice as the holder of sovereignty for the sake of the political party. The function of political parties as a means of political recruitment in the process of filling political office in this case as members of the legislature, should have been completed after the people chose their representatives through electoral mechanisms. Therefore, it is necessary for the reconstruction of the ideal and relevant recall rights arrangement to the people's sovereignty.

Abstract

Investment is an important element in the implementation of the economy in regions, that is as efforts to improve economic growth, create jobs, upgrading the development sustainable economic. Not easily attract an investor to invest in the required policies and strategies to attract investors. One policy that you can do is the policy of incentives investment (an investment). This study looked at a policy to invite the investors to invest in the form of investment; incentives that may be given investors to invest in the region. The methodology used normative study done by means of studying regulations be related to investment and legal products associated with local governments. The results showed first, the government has the authority to making policy incentives investment in regional policy; material incentives investment adjustable covering: tax deduction, tax relief, or exemption tax; reduction, lightning, or exemption retribution; fund stimulant; the capital assistance.

Abstract

This study aims to create an ideal pattern of local regulation to create competitive coastal tourism in West Coastal Village. By using doctrinal/normative research methods which mainly analyze secondary data consisting of: primary legal materials, secondary legal materials and tertiary legal materials, the regional regulation patterns will be constructed which are ideal for realizing competitive coastal tourism in West Coastal Village. The stages of the research to be carried out are divided into three parts as follows: first, identifying and inventorying the laws and regulations relating to the implementation of tourism; secondly, evaluating and drafting an academic manuscript regarding the implementation of tourism; thirdly compose the ideal regional regulation pattern to realize competitive coastal tourism in the West Coast Regency. The results showed that the ideal local regulation pattern for realizing competitive coastal tourism in West Coastal Village contained the following minimum content material: namely: general provisions; principles and objectives; policies and strategies; establishment of a competitive beach tourism area; development of competitive coastal tourism areas; implementation and control; closing.

Abstract

The discussion about omnibus law in the formation of laws and regulations has become a continuing discourse to this day, this is because omnibus law has been implemented in Indonesia through the work copyright law contained in Law Number 11 of 2020 concerning Job Creation. In its development, through the Constitutional Court Decision Number 91/PUU-XVIII/2020 on the Formal Review of Law Number 11 of 2020 concerning Job Creation, it is stated that the Job Creation Act is conditional. However, on one hand, the Instruction of the Minister of Home Affairs Number 68 of 2021 regarding the Follow-up to the Decision of the Constitutional Court Number 91/PUU-XVIII/2020 becomes a dilemma because in Indonesia regions must continue to follow the Job Creation Act and make adjustments to regional regulations on the follow-up to the existing law. The content material in the work copyright law is so diverse that it consists of eleven clusters and has changed, deleted and/or stipulated new arrangements for several provisions regulated in various laws, which have implications for the laws and regulations below them, including the regulations. On the other hand, some local government authorities have also experienced a shift through the law. The implications of the omnibus law regarding job creation on regional regulations include the deregulation of various regional regulations as a delegation of norms from higher regulations, and the responsibility of regional governments in harmonizing and synchronizing regional regulations in an effort to optimally implement autonomy and co-administration tasks.

Abstract

Pancasila as universal values with a high abstraction nature need to be concretized so that they can live and become the basis for behavior for the people of Indonesia. As the basis of the State for unification and defense from the flow of globalization, Pancasila is actually reflected in the behavior of the government in exercising state power. It is the commitment and attitude of the actions of the symbols of the State that are able to reflect on whether Pancasila can survive as a unifier and defense or not. The discussion shows thatt as the basis of the state, Pancasila is the foundation that unites the diversity of the Indonesian nation in the state, as well as a defense in facing the challenges of world development/globalization. The factual condition of Pancasila as the unifier and defense of the Indonesian nation has been degraded due to the inability of government institutions to realize Pancasila in the life of the state. This degradation can be seen by the emergence of separatist movements that demand to break away from Indonesia, the frequent SARA-related conflicts and the low morality of youth due to the disadvantages of globalization. Therefore, government institutions are obliged and required to be able to realize the values of Pancasila in the life of the nation and state.

Abstract

Perkembangan ilmu pengetahuan, globalisasi dan teknologi, telah memberikan dampak yang nyata, bagi tata hubungan manusia di dunia. Karenanya sangat berpengaruh pada perubahan hukum, baik yang bersifat hukum privat maupun hukum publik seperti hukum pidana. Kejahatan juga berkembang sejalan dengan cepatnya, teknologi informasi dan elektronika, sehingga dalam mengantisipasinya, maka setiap negara melakukan penyesuaian dalam pembaharuan hukum pidananya. Tulisan ini bertujuan untuk menganalisis dan menguraikan Turning point hukum pidana Indonesia yang berbasis cita hukum pengayoman Pancasila. Hasil analisis dan pembahasan menunjukkan bahwa: Turning point hukum pidana Indonesia yang berbasis cita hukum pengayoman Pancasila sebagai sebuah ikhtiar ditengah arus globalisasi dan pluralisme hukum yang ada, berlandaskan pada dua dimensi yang membentuk karakter cita hukum pengayoman Pancasila, yaitu dimensi perlindungan dan dimensi pertolongan. Muatan dimensi perlindungan dan pertolongan sangat penting dalam pembaruan hukum Pidana Indonesia, yang terutama akan berfungsi sebagai volkgeist (jiwa bangsa) dalam substansi hukum pidana ke depan.

Abstract

The emergence of the Critical legal studies movement (CLS) in the map of legal thought which mainly developed in America is interesting to study further from its historical aspect, content of thought and criticism of the thoughts of critical legal school figures. This paper with all its limitations will try to elaborate further and provide an analysis of CLS. The results of the analysis show that: First, the critical school of law emerged as a thought movement that provided a new alternative to legal realism which was considered unsatisfactory and still traditional. In general, CLS thinking is a response to positivistic liberal legal thought which is considered a failure. Second, the legacy of CLS thinking basically tries to package a theory that aims to counter established thinking, especially regarding the norms and standards that have been built-in in existing legal theory and practice, which tend to be taken for granted. ), namely legal norms and standards based on the premise of liberal legal justice teachings. Third, the criticisms that arise regarding CLS's theses and claims relate to the following matters: regarding its relation to realism, regarding the rejection of liberalism, regarding fundamental contradictions, regarding deconstruction, regarding indetermination and regarding the unity of law and politics.
