Abstract

Compared to the trial process which only consider legal facts and criminal actions which have been carried out, mediation has the advantage of considering the interests of the future of the family and keep the family together especially for the benefit of the children, religion also teaches the peaceful settlement of disputes. The mediation process is conducted in a closed manner and only attended by related parties and mediator, who is bound with ethics and code of ethics to maintain confidentiality. This process can make criminal avoid jail time, stigmatization, and prison life, which tends to make people become recidivist. Penal mediation has not been widely used for KDRT cases because there is no formal legal protection that provides a strong foundation for the use of penal mediation in the resolution of KDRT cases. Therefore there will be a need to re-evaluate and re-orient the laws, which will lead to the need for a criminal law reform especially concerning KDRT.

Abstract

Advances in science and technology and the ability, skills, and soul of the art of Plastic Reconstructiveand Aesthetic Surgeons can change human organs according to the patient’s wishes to improve one’sappearance to become more beautiful or handsome. Aesthetic plastic surgery is not performed totreat physical disabilities, in contrast to reconstructive plastic surgery, which aims to treat physicaldisabilities. However, misunderstandings or failures can occur because Plastic Reconstructive andAesthetic Surgeons are also human, so it does not give satisfaction to the results expected by the patient.Not infrequently, the misunderstanding peaked, resulting in a dispute between the doctor of PlasticReconstructive and Aesthetic Surgeons with the patient. This research method is normative juridicalresearch empirical. The research specification in this study is descriptive-analytical. Research conductedusing secondary data sources that include primary legal materials in norms, basic rules, laws, andregulations. The results of this study explain that Plastic Reconstructive and Aesthetic Surgeons shouldnot give an appointment or guarantee success on the surgical efforts that have been done because thereare other factors beyond their power as a doctor. The doctor should explain the risks and complicationsthat may occur. In addition, before surgery, it is recommended that a complete agreement be madewith the patient, and the patient understands and understands the risks or possibilities that can occurpostoperatively in the future. The doctor and patient agreement are made in full and detailed in writtenform before medical action is carried out by involving a notary public to ensure legal certainty, fairness,and benefit.

Abstract

Obyek Jaminan Fidusia mencerminkan adanya jaminan kebendaan dalambentuk baru yang mempresentasikan “Penyerahan Hak Milik atas dasarkepercayaan sebagai jaminan”, sehingga pemilik benda jaminan Fidusia masihdapat memakai benda yang dijaminkan secara kepercayaan. Bentuk Fidusia inimerupakan solusi akan syarat “in bezit stelling” dalam jaminan gadai, dimanabenda yang digadaikan harus diletakkan di luar kekuasaan si pemberi gadai. Padasertipikat Fidusia ada grosse acte yaitu dengan irah-irah “Demi Keadilanberdasarkan Ketuhanan Yang Maha Esa”, sehingga mempunyai kekuatan sepertiKeputusan Pengadilan. Perumusan masalahnya adalah Bagaimana DampakPutusan Mahkamah Konstitusi No 18/PUU-XVII/2019 terhadap Obyek JaminanFidusia ? Metode penelitian yuridis normatif menggunakan data sekunder sebagaidata utama dan data primer sebagai data pendukung. Adanya Putusan MahkamahKonstitusi No 18/PUU-XVII/2019 terjadi 3 (tiga) syarat yang ditentukan bahwaPasal 15 ayat (2) dan (3) serta penjelasan Pasal 15 ayat (2) Undang-Undang No 42Tahun 1999 tentang Jaminan Fidusia berlaku secara inkonstitusional bersyarat(conditionally unconstitusional) yaitu : 1. Syarat wanprestasi/cidera janji harusdisepakati antara Kreditur dan Debitur. 2. Jika Debitur wanprestasi/cidera janji,Debitur harus sukarela menyerahkan jaminannya. 3. Jika Debitur keberatanmenyerahkan secara sukarela obyek jaminan Fidusia maka eksekusi Sertipikatjaminan Fidusia tidak bisa dipaksa, tapi harus melalui gugatan ke PengadilanNegeri, 4. Selama gugatan berlangsung, Debitur wajib memelihara barangjaminan secara baik dan layak jika terjadi kehilangan atau kerusakan menjaditanggung jawab Debitur sepenuhnya. 5. Selalu diasuransikan baik kebakarandan/atau kehilangan benda jaminan Fidusia.

Abstract

Pre-nuptial agreement which was originally provided in Article 119 of the Civil Code and Article 29 of Act Number 1 of 1974 may only be made upon or before the marriage is conducted. As for foreigners who conduct mixed marriage with Indonesian Citizen, without having pre-nuptial agreement before marriage is conducted or upon the marriage is conducted, the joint property in marriage shall be deemed as foreign property and in accordance with the Basic Agrarian Law, land and building which is registered under the name of Indonesian citizen who conduct mixed marriage with foreigners, which is not transferred after one year will become state property. Afterwards the Constitutional Court issued Decree Number : 69/PUUXIII/2015 which grants permission that pre-nuptial agreement may be made after the marriage is conducted. Can after marriage pre-nuptial agreement be applied retroactively without harming the third party? Pre-nuptial agreement may be made after the marriage is conducted if it's implementation does not harm the third party. Because after the pre-nuptial agreement is made the conjugal property is no longer joint property. The husband and wife property's title shall become their own property title respectively. Thus, Indonesian citizen property shall remain Indonesian citizen property, foreign citizen property shall remain foreign citizen property in mixed marriage. Land which is owned by Indonesian citizen may still be owned by Indonesian citizens because there is no joint ownership of property by foreigncitizen.

Abstract

The implementation of the criminal law enforcement policy on mineral and coal mining businesses (minerba) still occurs several violations of Article 158 of the Law of the Republic of Indonesia No 4 of 2009 (minerba Law). This journal aims to find out and analyze: 1) criminal law policy in law enforcement on illegal mining businesses according to the Minerba Law, and 2) current law enforcement constraints and future improvements. The normative juridical research approach places secondary data, in the form of primary legal material (Minerba Law) as the main material. Meanwhile, primary data acts as supporting analysis, which is obtained using interview techniques. Secondary data was obtained through the study of legal literature, especially Case No. 237 / Pid. Sus / 2018 / PN Jpa. The entire dawas ta was analyzed using descriptive qualitative methods. Results: (1) Minerba Act, qualified as administrative criminal law. The criminal provisions are regulated in 8 articles with the threat of imprisonment, confinement and fines. (2) Law enforcement constraints from the Legal Substance dimension is the equalization of all mining activity permits in the form of Mining Business Permits. The legal structure perspective, demands large funding requirements. Internal Legal Culture experiences obstacles in coordination between Police investigators and PPNS. Externally, it explains that people prioritize economic value. In the future, a Rock Mining Permit is required, consistency in the application of article 158 and solid coordination between police and ESDM investigators, as well as education on environmental values.

Abstract

Inheritance law is part of civil law as well as part of family law. it regulates the transfer of assets left by someone who dies and the consequences for the heirs in family relations or with third parties. In one case, a marriage that was not recorded was invalid. The results of the study concluded that the consequences of marriage were not recorded as marriages that were never considered to exist. What was the legal consideration of the judge in deciding this case? Marriage is legal if it is done in accordance with their respective religions and beliefs, so each marriage must be registered. Because the marriage was not registered, it was not legal so the lawsuit was granted in full. According to the authors of marriages that are not recorded remain valid, legal marriages are marriages conducted in accordance with their respective religions and beliefs. This lawsuit should have been completely rejected because the Plaintiff as a father does not have a legal position, heirs must be sons and husbands and not fathers.

It is considered very important in relations to the business target, and this is consecuted by applying it appropriately on the basis of the situation and existing legal norms.
