Abstract

Penelitian ini bertujuan untuk mengetahui pelaksanaan tradisi pembagian harta warisan pada masyarakat Suku Madura di Kabupaten Sampang; untuk mengetahui kedudukan ahli waris anak perempuan dalam proses pelaksanaan pembagian waris pada masyarakat Suku Madura di Kabupaten Sampang. Metode pendekatan penelitian ini adalah penelitian lapangan (field research). Hasil penelitian ini bahwa pelaksanaan tradisi pembagian harta warisan masyarakat Suku Madura di Kabupaten Sampang menerapkan tradisi pembagian harta warisan menurut hukum adat Madura dengan sistem pewarisan hukum adat di Kabupaten Sampang menggunakan sistem pewarisan individual. Setiap ahli waris mendapatkan haknya secara individu dengan sistem keturunan. Bahwa Kedudukan ahli waris anak perempuan dalam pembagian waris yaitu bagian anak laki-laki dan perempuan menurut hukum adat Madura di Kabupaten Sampang mendapatkan bagian 2:1. Namun, sebuah rumah “patobin” diberikan kepada anak perempuan sebagai tempat pulangnya “pamolean” sanak saudara yang diberikan secara sukarela oleh orang tua atau pewaris. Jika pewaris tidak memiliki anak perempuan maka diberikan kepada anak laki-laki yang menetap dan tidak pergi untuk merantau. Berbeda dengan sistem pewarisan masyarakat Kabupaten Sampang, di mana bagian anak laki-laki dan perempuan terhadap harta warisan adalah 1:1 agar tidak menimbulkan perselisihan warisan. Kata Kunci : Kedudukan; Ahli Waris; Perempuan; Suku Madura.

Abstract

This study aims to analyze the legal protection for wives in murder cases from the perspectives of Islamic law and positive law. In the context of Islamic law, the principle of justice governs the rights of wives, including protection against domestic violence. However, the implementation of this principle in judicial practice still faces various challenges. On the other hand, Indonesia's positive law, despite regulating women's protection through the Law on the Elimination of Domestic Violence (UU PKDRT), also encounters obstacles in effective law enforcement, particularly in cases of violence resulting in murder. This study also discusses the comparison of sanctions imposed on perpetrators of wife murder in both legal systems, highlighting significant differences in the determination and implementation of penalties. Additionally, this research identifies major challenges in law enforcement, such as the lack of gender sensitivity among law enforcers and the limited access victims have to effective protection. The proposed policy recommendations include strengthening regulations on wife protection, enhancing the capacity of law enforcement officers, and expanding access to legal and psychological services for victims. This study contributes to the development of a more responsive legal policy for women's protection.

Abstract

Inheritance disputes involving adopted children are often a complex issue in legal practice in Indonesia, given the lack of comprehensive uniformity of arrangements between Western civil law, Islamic law, and customary law. This study aims to examine how Indonesia's positive law regulates the position of adopted children in terms of inheritance and dispute resolution mechanisms arising from claims of inheritance rights of adopted children. The normative juridical approach is used by examining various laws and regulations such as the Civil Code, the Child Protection Law, and the Compilation of Islamic Law (KHI), accompanied by case studies of court decisions. The results of the study show that in Western civil law, adopted children have an equal legal status with biological children in terms of inheritance, while in the perspective of KHI, adopted children do not automatically obtain inheritance rights, but can be given a mandatory will. Dispute resolution is carried out through litigation and non-litigation channels such as mediation, taking into account the principles of justice and protection of children. Therefore, legal harmonization and regulatory reform are needed to ensure legal certainty for adopted children in the context of inheritance
