Abstract

The dynamics of Islamic legal thought in malaysia is a contestation of conservatism, moderatism and that of liberalism. When the opposition party of PAS promote conservatism and accuse the government to be not-islamic, UMNO the ruling party responded by launching serial of Islamic campaign. The government try to promote a modern and modern Islam by introducting Islamic Banks, establishing JAKIM to develop modern understanding and application of Islam in Malaysia, hosting an International Islamic Uniersity of Malaysia. Plenty of Muslim intellectuals and clerics were admissed as employees in these institutions. Among the product of this campaign is the enactment of Islamic law act in 1984 for Federal Territory which was reasonably progressive. Thus, criticism from the opposition remains and lead the government to lean toward conservatism. On the other hand, liberal thought of Islam, which in the area of Islamic family law was boosted by gender equality as represented by Sisters in Islam (SIS), also actively engage in discussion and try their best to influence the government policy on Islamic family law with the help of their international exposure.

Abstract

Javanese people believe that there are several months that are not well chosen as the wedding month, because there are calamities or disasters that will occur in the household, namely: Suro (Muharam), Mulud (Rabiul Awal), Poso (Ramadan), and Selo (Zulkaidah). This article further examines the attitude of urban communities who have received much internalization of understanding, cultural influences, and environmental conditions that are generally industrialists against the adat ban. There are three Religious Affairs Offices (KUA) in the Sidoarjo area that are used as research objects, namely (Waru, Sedati, and Buduran). ) The reason for choosing these three locations is the typography of the area that is mostly inhabited by traditionalist Muslim communities. But in the last decade, this region has changed, from an agricultural area that relies on agriculture and fish farming, to become an industrial area with the establishment of various types of factories and other types of businesses. Based on qualitative and quantitative data, there has been a trend of behavior change in the Sidoarjo community which in the period 1984-1985 the percentage of marriages on the month was avoided a little, it was seen that there was an additional percentage according to the data taken in the last 10 years. The people of Sidoarjo are now starting to move to not be fixated on the rules of the month election. In the past, the number of couples married at four months was avoided only slightly. And now, there is a change in tendency even though the percentage is not too significant. [Orang Jawa meyakini adanya beberapa bulan yang tidak baik dipilih sebagai bulan pernikahan, karena ada bala’ atau bencana yang akan terjadi di dalam rumah tangga, yaitu: Suro (Muharam), Mulud (Rabiul Awal), Poso (Ramadan), dan Selo (Zulkaidah). Artikel ini mengkaji lebih jauh sikap masyarakat perkotaan yang sudah banyak menerima internalisasi paham, pengaruh budaya, dan kondisi lingkungan yang umumnya industrialis terhadap larangan adat tersebut. Terdapat tiga Kantor Urusan Agama (KUA) di wilayah Sidoarjo yang digunakan sebagai objek penelitian, yakni (Waru, Sedati, dan Buduran). Alasan dipilihnya tiga lokasi ini adalah tipografi kawasan yang mayoritas dihuni oleh komunitas muslim tradisionalis. Tetapi dalam dekade terakhir, kawasan ini berubah, dari kawasan agraris yang mengandalkan pertanian dan budidaya ikan, menjadi kawasan industri dengan berdirinya berbagai jenis pabrik dan jenis usaha lainnya. Berdasarkan data kualitatif dan kuantitatif, telah terjadi tren perubahan perilaku masyarakat Sidoarjo yang pada periode 1984-1985 persentase perkawinan di bulan yang dihindari sedikit, terlihat ada penambahan persentase menurut data yang di ambil pada kurun waktu 10 tahun terakhir. Masyarakat Sidoarjo saat ini mulai tergerak untuk tidak terpaku kepada aturan pemilihan bulan. Dahulu, jumlah pasangan yang menikah di empat bulan yang dihindari hanya sedikit. Dan saat ini, terdapat perubahan tendensi walau persentasenya tidak terlalu signifikan.]

Abstract

The majority of Thailand's population is Buddhist. However, there are four provinces in the southern part of Thailand that mostly Muslims inhabit. The UINSA International Community Engagement (UICE) delegation team was assigned to plunge into the Muslim community living in Thailand to revive the Qur'anic values in non-Muslim society. Thus, the Muslim population in Thailand would not lose the Qur'anic values even as a minority. This activity also tries to introduce Qur'an recitation art guidance to Muslims in Southern Thailand who are less familiar with this activity. Therefore, this paper aims to describe the activities of Al-Qur'an reading art education by providing intensive guidance on the recitation of Al-Qur'an as a form of community service. The approach used is a qualitative approach that is Asset Based Community Development that is conducted in five stages, namely initial preparation, analysis, designing expectations, program implementation, and results evaluation. The Qur'an recitation art guidance method involves intensive recitation guidance classes, periodic evaluations, performances, competitions, and presenting prizes. Based on the implementation of these activities, some significant achievements have been obtained to increase the potential of Qur'an recitation art of Attarkiah Islamiah Institute students.

Abstract

Abstract: Iran declared as an Islamic state since its 1979 Islamic revolution. Since leadership of Ayatullah Khomeini, Islamic ideology has been carried out in all levels of the state. In politics, it was conducted by creating wilayah al-faqih, in which the ulama plays important and decisive role. Iran even tried to expand this ideology outside its border, especially in areas with considerable number of Shi’i population. However, in its practice, the implementation of this Islamic ideology should also accommodate pragmatism and other aspects that contradict that ideology, namely nationalism and cultural pluralism. In politics, this is reflected by the emergence of ideologists and reformists-pragmatists. This dichotomy can be witnessed in presidential elections. While Ali Khamenei and Mahmoud Ahmadinejad are considered ideologists, Ali Akbar Rafsanjani, Muhammad Khatami and Hassan Rouhani are reformists-pragmatists. Ideological expansion which was proven backfired was also put on halt. In social-cultural expression of the society, there is growing trend to identify Iran using pre-Islamic symbols. This is happen mostly among younger generation who do not take part in the 1979 revolution. Abstrak: Iran adalah sebuah negara yang mengumumkan sebagai Negara Islam modern sejak revolusi Islam di tahun 1979. Di bawah kepemimpinan Ayatullah Khomeini, ideologi Islam dilaksanakan dalam berbagai cara dan mekanisme, antara lain kepemimpinan ulama (wilâyah al-faqîh) yang tercermin dalam peran sentral ulama dalam politik kenegaraan dan implementasi besar-besaran nilai-nilai keislaman dalam politik dan kehidupan sosial. Iran bahkan berusaha melakukan ekspansi ideologi Islam mereka ke wilayah-wilayah Islam lainnya, khususnya yang memiliki paham Syi’ah yang sama. Akan tetapi, dalam praktiknya upaya ini tidak dapat dilaksanakan secara murni tanpa akomodasi terhadap pragmatisme politik. Dalam politik kenegaraan, hal ini tercermin dengan kemunculan kelompok ideologis dan pragmatis-reformis dalam politik, diantaranya dalam pemilihan presiden. Beberapa presiden Iran tergolong ideologis seperti Ali Khamenei dan Mahmoud Ahmadinejad, sedangkan Ali Akbar Rafsanjani, Muhammad Khatami dan presiden saat ini Hassan Rouhani termasuk reformis-pragmatis. Ekspansi ideologis yang tidak menghasilkan apa-apa kecuali resistensi juga nampak dibatasi. Dalam kehidupan sosial, semakin banyak kecenderungan masyarakat Iran untuk menonjolkan identitas Persia pra-Islam, khususnya di kalangan generasi muda yang tidak berpartisipasi dalam revolusi Iran di tahun 1979.

Abstract

Abstract: One issue that remains a stumble block for modernization of Islamic family law is polygamy. In Indonesia, polygamy is restricted, but not completely forbidden. Husbands who have desires for polygamy should fulfill requirements before the court of justice. However, there is a tendency among judges of Islamic courts nowadays to grant permission for them to practice polygamy although not all of those husbands meet the requirements as outlined by the Marriage Law. The judges argue that according to Article 5 the Law No. 48 of 2009 concerning Judicial Authority they have the right and are obliged to deliver justice at all costs. Therefore, they grant permission for polygamy not only on the basis of the corresponding the Law No. 1 of 1974 on Marriage, but also on the authority of rechtsvinding, Islamic jurisprudence or fiqh as living law concept, and contra legem theory, a progressive implementation of legal value. Abstract

This paper discusses the thoughts of Najm al-Din al-Tufi (1277–1316 AD), a Hanbali scholar who was known to be radical in carrying out the concept of maṣlaḥah. This research is a normative and textual approach. Data collection is carried out through literature review, and it was analyzed descriptively.  This article finds that al-Tufi places maṣlaḥah as the main postulate in the determination of the law, even in certain cases it can surpass nas and ijma'. This thought departs from his commentary on the hadis lā ḍarar wa lā ḍirār, which, according to him, affirms the principle of the elimination of harm and the maintenance of benefits. He defines maṣlaḥah broadly, dividing it into two domains: worship and muqaddarāt, which are subject to nas, and mu'āmalāt, which is entirely subject to human welfare. Within this framework, al-Tufi developed the methods of tarjīḥ and bayān to resolve the contradiction in the postulate by prioritizing maṣlaḥah. His thoughts sparked controversy; some scholars accuse him of ignoring the authority of the text, while modern thinkers see it as a progressive bid to renew Islamic law. Although limited only to the realm of mu'āmalāt, the idea of al-Tufi is still relevant in responding to contemporary legal problems that are not explicitly accommodated in nas or ijma'.
