Abstract

ASEAN  Framework  Agreement  for  The  Integration  of  Priority Sectors (AFAIPS) yang disepakati pada KTT ASEAN ke-10 tanggal 29November 2004 di Vientine, Laos mengintegrasikan beberapa sektor yang diprioritaskan atau dianggap penting di ASEAN yang salah satunya adalah Air Travel Integration. Indonesia sendiri telah mengesahkan AFAIPS melalui Peraturan Presiden Nomor 25 Tahun 2009. Penelitian ini akan fokus pada langkah-langkah legislasi domestik apa saja yang sudah dilakukan oleh Indo- nesia dalam rangka melaksanakan Pasal 5 (2) ASEAN Charter khususnya bidang jasa angkutan udara di Indonesia. Pelaksanaan Pasal 5 (2) Charter of The Association of Southeast Asian Nation Bidang Jasa Angkutan Udara di Indonesia, diantaranya dengan dilakukannya perubahan terhadap UURI Nomor 15 Tahun 1992 tentang Penerbangan dengan UURI Nomor 1 Tahun2009  tentang  Penerbangan.  Lebih  lanjut,  pemerintah  telah  menerbitkanKeputusan Direktur Jenderal Perhubungan  Udara  Nomor:  KP  480  Tahun2012 tentang Roadmap Hubungan Udara Indonesia yang menetapkan road- map yang digunakan sebagai pedoman bagi setiap pejabat dalam melakukan perundingan hubungan udara dengan negara mitra, khususnya terkait hard right (market access). Indonesia, sampai dengan saat ini, mempunyai   per- janjian  hubungan  udara  dengan  73  negara,  sedangkan  untuk perjanji- an ASEAN Indonesia telah meratifikasi ASEAN Multilateral Agreement on Air Services beserta Protocol 1 dan Protocol 2-nya. Kata Kunci: pelaksanaan, ASEAN Charter, angkutan udara

Abstract

The enactment of Law Number 32 of 2009 concerning Management and the Environment has been based on a legal basis and a philosophical basis that has elements of protection for Human Rights. In the provisions of Perma Number 1 of 2023 concerning Guidelines for Adjudicating Environmental Cases, it not only expands the objects of Environmental disputes but also adds a PTUN touchstone in testing the validity of Decisions or Actions taken by Officials/State Administrative Agencies, namely human rights provisions. As the third touchstone, it does not mean that Human Rights Provisions can be set aside in testing environmental disputes. Because environmental disputes are closely related to Human Rights. So that PTUN Judges can classify which Decisions or Actions are classified as violating the Law, AUPB or Human Rights Provisions. This research method is carried out by reviewing literature sources, namely by examining legal principles and norms. This article aims to provide an understanding of Judicial Activism in Environmental cases by the Panel of Judges, which is not impossible based on the Theory of Legal Protection in order to realize the objectives of the law, namely justice, benefit and legal certainty.

Abstract

Modern digital-based justice is the answer to the challenges of the development of the times. Although modern justice reflects an adaptive judicial body, it must still be equipped with established regulations. This study aims to examine the harmonization of personal data protection principles between the Supreme Court Regulation No. 7/2022 concerning electronic case administration and trials and Law No. 27/2022 concerning Personal Data Protection (PDP Law). In this case, the researcher uses a normative juridical method, with a statutory regulatory and comparative combined approach. This study highlights the norms gap in the Supreme Court Regulation No. 7/2022, particularly in the aspect of protecting the personal data of the parties input into the electronic justice administration system. The main findings exhibited are that the Supreme Court Regulation No. 7/2022 does not regulate the basic principles of data protection as mandated by the PDP Law, which has the potential to cause legal uncertainty and privacy right violations. The fact that the principle of personal data protection in the Supreme Court regulation has not been absorbed is due to the PDP Law, which only came into effect in 2024, even though both were enacted in the same year in 2022. This is seen as weakening the legitimacy of electronic justice in Indonesia. This study is expected to provide a positive contribution in the form of regulatory reform through the revision of the Supreme Court regulations, the establishment of data protection units in the judicial environment, and strengthening institutional coordination. The results of the comparative analysis of common law systems such as England show the importance of integrating data protection principles into the legal infrastructure and institutions of electronic justice to be aware of the protection of privacy rights that intersect with the guarantee of the human rights of justice seekers.
