The Indonesian Constitutional Court has played important roles and functions to protect and fulfill human rights in the Indonesian legal system including the economic, social and cultural rights through its legal power of  judicial review.  It affirms that the ecosoc rights are legal justiciable rights and they are parts of constitutional mandates. It means that decision on judicial reviews require State to behave in accordance to legal thresholds decided by the Court. Undoubtedly, compliance to the decisions will reveal undeniable facts for fulfilment of state conduct. However, it seems that there are still many considerations, emphasis and excuse to somehow reduce or ignore threshold of application of the Court decisions. Complexity of actors, institutions, authorities, level of implementation, and orientation of particular policies, programs, actions and funds reduces the thresholds.

Community has played central roles for initiatives of the Local Resilience Action Plan (LRAP) toward Yogyakarta as Resilience Climate City (CRC) since 2012. This paper aims to find out relevance of community participation using the Catholic Church and Islamic Youth organizations participation as the model for dissemination and education on CRC as part of global agenda for achievement of the sustainable development goals. This paper is a empirical legal research conducted through an extensive and in-depth analysis of relevance legal data, i.e. primary and secondary data. At the end, they were completed through in depth analysis of legal logic to sustain their correlation and attribution to the said indicators of availibility, accessibility, adaptability and acceptability based on localities’ contexts and perspectives in Yogyakarta city. This paper reveals two conclusions. First, Catholic Churches and Islamic Youth Organizations in Yogyakarta city have played role to educate and to disseminate CRC through its internal Church guidance of the arch Bishop of Semarang manifestation 2035 and intended speech from Islamic leaders. Secondly, internal driven motivation is one of fundamental Christian values has been effective to continuously manage house hold wastes, increase green Catholic life style, and to map potential climate vulnerabilities.

Recently, the discourse on the relation between local wisdom and human rights shows its relevance. This article describes and critically examines the human rights norms and procedures with regards to common local wisdoms to remedy and redress human rights problems in South East Asian countries. It takes an example of redressing problem in rights to development and also focuses on the application of the ASEAN agreement on Disaster Management Response to contextualize role and influence of local wisdoms to manage and to mitigate disaster response within the ASEAN human rights protection. This writing also highlights that human rights based approach is needed in the implementation of the ASEAN human rights norms and mechanisms in accordance to local wisdoms of respective countries where disaster occurs. In practice, the application of the complementarity principle in the Rome Statute remains unclear, particularly with respect to the prioritization of national penal law jurisdiction. This paper willdiscuss the relevance of the complementarity principle to the development of a national criminal justice system and to the investigation and prosecution of the most serious crimes provided for in the Statute. It was concluded that the complementarity principle should be used to unravel the twisted development of the national criminal justice system in accordance with the provisions of international law. We need to establish our national criminal justice system as the main and foremost forum (hence, willing and able) in the process of investigating and prosecuting the most serious crimes on earth. Dalam praktik, aplikasi Asas Pelengkap (the complementarity principle) dalam Statuta Roma masihbelum jelas, khususnya terkait dengan pengutamaan (prioritization) yurisdiksi hukum pidana nasional. Oleh karena itu, tulisan ini akan membahas relevansi asas tersebut terhadap pembangunan sistem hukum pidana nasional dan terhadap penyelidikan dan penuntutan kejahatan paling serius yang diatur dalam Statuta. Disimpulkan bahwa Asas Pelengkap harus Mahkamah digunakan sebagai pengurai benang kusutpembangunan sistem hukum pidana nasional Indonesia sesuai dengan ketentuan hukum internasional supaya menjadi forum utama (mau dan mampu) dalam proses penyelidikan dan penuntutan kejahatan paling serius di muka bumi.

This article focuses on the implementation of the natural disaster management program (NDMP) after the promulgation of Act No. 24 of 2007 on Disaster Management. This implementation will be viewed both from legal and political frameworks. The aim of this article is twofold: First, to assess whether the community-based natural resources management system principle in Act No. 24 of 2007 has been implemented as the core principle for executing the NDMP. Second, to evaluate the hindrance caused by political decentralization to the effective implementation of the NDMP under Act No. 24 of 2007 as taken by local governments under the community-based natural resources management system principle. Artikel ini fokus pada pelaksanaan program penanggulangan bencana alam setelah diundangkannya Undang-Undang Nomor 24 Tahun 2007 tentang Penanggulangan Bencana dengan menggunakan perspektif kerangka hukum dan politik. Tujuan artikel ini ada dua: Pertama, untuk menilai apakah prinsip pengelolaan sumberdaya alam berbasis masyarakat dalam Undang-Undang Nomor 24 Tahun 2007 telah diimplementasikan sebagai prinsip inti untuk melaksanakan program penanggulangan bencana alam tersebut. Kedua, untuk mengevaluasi kendala yang disebabkan oleh desentralisasi politik terhadap keefektifan pelaksanaan program penanggulangan bencana alam menurut Undang-undang Nomor 24 Tahun2007 sebagaimana ditempuh oleh pemerintah daerah di bawah prinsip sistem pengelolaan sumber dayaalam berbasis masyarakat.

This paper describes the implementation of the public participation rule in the disaster management of Merapi volcano. The regulation desires for a shift of paradigm from centralized disaster management to participative disaster management. This study shows the government has not shifted from the old paradigm of centralized disaster management. Tulisan ini menggambarkan pelaksanaan aturan partisipasi masyarakat dalam penanggulangan bencana gunung api Merapi. Peraturan menginginkan pergeseran paradigma penanggulangan bencana dari sentralistik ke penanggulangan bencana yang partisipatoris. Penelitian ini menunjukkan Pemerintah belum sepenuhnya beralih dari paradigma penanggulangan bencana sentralistis.

The AICHR seems to fail to contribute positively in enforcing protection, fulfillment, and implementation of human rights at national level since its terms of references and structural composition differs from the commonly-recognised regional institutions. Legal gaps, legal vacuum, legal overlapping and conflicts of authorities with national authorities are indicators that hinder its future works. Kemampuan AICHR dalam menjamin perlindungan, pemenuhan dan pemajuan hak asasi manusia di level nasional diragukan karena kewenangan AICHR yang limitatif dan tidak mengikuti pakem seperti yang dimiliki oleh komisi HAM di Eropa dan Afrika. Ketimpangan hukum, kekosongan hukum, tumpang-tindih aturan, dan konflik kewenangan dengan otoritas nasional menjadi faktor penghambat pelaksanaan kewenangan AICHR.

This research focuses on the application of the internationally-standardized rights to healthcare and education during the course of decentralization in Yogyakarta. Local government must ensure citizens’ Ecosoc rights before passing education or healthcare-related policies. Results show that the implementation of international standards on healthcare is better than on education. Fokus penelitian ini adalah penerapan standar internasional dalam hak atas kesehatan dan pendidikan selama kebijakan desentralisasi di Yogyakarta. Pemerintah setempat harus menjamin hak-hak Ekosob masyarakat sebelum menerbitkan kebijakan yang berkaitan dengan pendidikan dan kesehatan. Hasil penelitian menunjukkan bahwa penerapan standar internasional di bidang kesehatan lebih berhasil daripada di bidang pendidikan.

The issuance of Indonesia’s Law No. 23 of 2019 on the Management of National Resources for State Defense (PSDN Law) sparked a national debate on conscription and conscientious objection. Consequently, a coalition of civic society organizations submitted the PSDN Law before the Constitutional Court for judicial review. They argued that the PSDN Law violates the Indonesian Constitution’s Article 28 on human rights protection. One of the legal submissions is based on the argument that the PSDN Law deliberately ignores human rights in order to provide reserve and backup components to the military. This argument is supported by Article 18 of the International Covenant on Civil and Political Rights (ICCPR) and the ICCPR’s General Comment No. 22 of 1993 paragraph 11, justifying conscientious objection as an inherent human right. The analysis in this paper is mainly uses the legal positivism paradigm and the human rights-based approach. This paradigm provides a framework for analyzing how the PSDN Law generates a distinctive legal feature for Indonesia’s legal system. In line with Article 28 of the Indonesian Constitution, the Constitutional Court should explicitly assess the preservation of civil rights. It may be claimed that conceivable legal gaps (norm versus reality) and legal loopholes add to the Constitutional Court’s obligation to consider the omission of conscientious objection recognition. This article argues the Constitutional Court should adjudicate on the issue of citizens being conscripted as reserve and backup components in situations of military threats, hybrid threats and/or non-military threats. This research further maintains that the Constitutional Court should recognize the existence of conscientious objection as an inherent human right, as a form of judicial activism. In accordance with the doctrine of judicial activism, the Court could resolve and offer solutions to the existence of conscientious objection as a democratic civil right. The Court should also determine the area, scope, application and orientation of conscientious objection as a distinct feature of human rights based on Indonesia’s context and perspective on defense required by international human rights treaties, conventions, or general comments on such instruments.
