Abstract

This paper aims at highlighting some odd court decisions on corruption typed “state financial loss” in public procurement sector. It is odd because of the following reasons: (i) the nature of the case is more about administrative or private law instead of criminal law; (ii) some consider that it will be unjust to sentence guilty the accused; (iii) the cases ensnare persons who are perceived as reformist and clean. The first point will be the focus of elaboration. It will be argued that the encroachment of criminal law towards the area of administrative and private laws are caused by the lower standard of proof for the corruption typed “state financial loss”. Currently, the applied standard is “more likely than not” instead of “beyond reasonable doubt”. The situation which some people are jailed while their faults are more about administrative and private is a justice issue. As the upright of justice is the mandate of the constitution, therefore, articles that create this injustice (Article 2 section (1) and Article 3 of the Eradication Corruption Act) should be re-reviewed by the Constitutional Court. Although the court has previously reviewed the Articles and, therefore, this should be seen as a final and binding; this paper will give some arguments which explain the needs for the court to re-settle this matter.

Abstract

Tulisan ini bertujuan untuk memaparkan sekaligus mengapresiasi aneka upaya yang telah dilakukan oleh Pemerintah Indonesia untuk mendesain pencegahan korupsi di sektor pengadaan barang/jasa, seperti (i) mendesain organisasi pengadaan yang berstruktur lebih horisontal, sehingga sesama petugas bisa saling kontrol satu sama lain; serta (ii) mendesain pengadaan barang dan jasa secara elektronik, khususnya electronic purchasing yang memungkinkan pembelian barang dengan cara efektif dan mengurangi potensi manipulasi dalam proses tender. Namun demikian, tulisan ini juga ingin memberikan catatan kritis yang perlu diperhatikan dari kedua keberhasilan ini. Selanjutnya, berdasarkan analisa perbandingan hukum administrasi negara, tulisan ini juga ingin menekankan bahwa masih terdapat berbagai hal yang dapat dipertimbangkan untuk meningkatkan efektifitas pencegahan korupsi di sektor pengadaan, seperti memperluas cakupan mekanisme sanggah lelang di Indonesia dengan mempertimbangkan mengadopsi regulasi yang diterapkan di Belanda. Di Indonesia, mekanisme sanggah hanya efektif untuk melindungi peserta tender yang merasa dirugikan dengan memberikan kesempatan untuk menyanggah keputusan pemenang lalang. Mekanisme sanggah di Indonesia tidak melindungi (tidak memberikan kesempatan sanggah) kepada calon peserta tender yang merasa dirugikan akibat dokumen pengadaan, misalnya karena desain spesifikasi dan/atau persyaratan pengadaan yang dianggap tidak adil. Mengingat pemerintah masih mempersiapkan Rancangan Undang-undang Pengadaan Barang dan Jasa, maka tulisan ini juga dapat diposisikan sebagai sumbangsih saran.

Abstract

Infrastructure Availability such as government buildings, schools, hospitals are pivotal to underpin public services. The existence of infrastructure like irrigations, ports, roads, bridges, are also important to support social and economic activities of the people. However, the process of procurement in acquiring contractor may be tainted by corruption. This article examines various court decisions which have been final and binding. Three of the selected decisions are appealing to be discussed further, because it is doubted that the legal enforcers have been appropriately enforcing the law and understanding the context. On the first case, the legal enforcers have enforced the anti-corruption law to cases which are detrimental to the state finance. However, the substance of the cases is more suitably categorized as bribery or at least as gratification. On the last two cases, the legal enforcers have applied anti-corruption law for cases that cause the state financial loss. Nevertheless, from the perspective of civil engineering, whether the defendants were guilty are still debatable.

Abstract

This research aims to identify the readiness of the Wonogiri Regency in 2021 regarding regional policies in building planning that support the Job Creation Law (No. 11/2020). Several analytical approaches are used with data taken directly through interviews and focus group discussions and other supporting data. As a result, Wonogiri Regency has two options, namely first, the Wonogiri Regency Building Regulations are revoked in their entirety on the grounds that the "spirit" has been amended by Law Number 11/2020 and PP Number 16/2021 concerning Building Implementation Regulations whose regulatory concept has changed from IMB to PBG . The second option is partial revision. In its implementation, it is necessary to increase the effectiveness of law enforcement, SIMBG tools and increase the capacity and competence of human resources as well as ensuring the Regional Regulations on RTRW and RDTR, and the Regional Regulation on Retributions.

Abstract

The compensation issue is still one of the factors inhibiting development in Indonesia. The government must develop to establish a flourishing society, as required by Pancasila and the Constitution. The government implements National Strategic Projects and initiatives designed to foster growth and equitable development, increase employment opportunities, and enhance community welfare. Limited land control by the government means that the government also needs land owned by the community. When it comes to inland procurement for development, the community whose land rights are impacted by the national strategic project is nearly always unhappy, especially regarding loss compensation. The most complicated and contentious part of taking land for public use is usually the compensation for losses that arise when the government purchases a piece of land. The limited government budget for building infrastructure and restrictions on regulations for using other state finances have caused the government to look for forms and amounts of compensation that can provide a sense of fairness and worth to the community without burdening state finances. Upholding respect for human rights is acknowledged as a form of protection offered by the state to its citizens in Indonesia, a country that upholds the rule of law. This protection extends to situations where the state takes over community land to be used for development in the public interest. The strategies put out to resolve the land acquisition dispute are grounded in the idea of social justice, which is still relevant and evolving in the Indonesian culture of society.

Abstract

This paper seeks to provide conceptual and empirical justifications for civil servants to engage in disobedience to curb bureaucratic pathology. Various civil servants have long complained that they face illegal instructions from their superiors. The cases discussed here are from public procurement, which has a dimension of political corruption, a recurring problem in many places in Indonesia. Thus, the problem shall be seen as a bureaucratic pathology rather than as maladministration. As the reporting of superiors to legal enforcers may be too risky, the disobedience can be accomplished by refusing to cooperate with superiors who give illegal instructions. The term 'superiors' here focuses on positions in government held by politicians, temporary positions obtained through elections, such as president, governor, mayor or regent, and temporary political positions given by appointment to a particular person, such as that of minister. There are four arguments in favour of civil servant disobedience. First, civil servant disobedience is rooted in the concept of civil disobedience, which has certain virtues and has been globally accepted. Second, legal justification dictates that civil servants' loyalty is not to their superiors but primarily to society and the law. Third, a cost–benefit analysis based on several court decisions, interviews and risk factor mapping reveals that the benefits to bureaucrats of following illegal instructions from politicians are less than the risks and sanctions. Fourth, from a religious sociological perspective, religion requires obedience only to God, not servitude to man or worldly interests. The justifications offered here for civil servant disobedience may be applicable to the Indonesian context and serve as food for thought for any country facing similar situations.
