Abstract

Pemerintah Kota Denpasar menerapkan aturan terhadap bangunan gedung di sepanjang jalan Kota Denpasar menggunakan arsitektur bernuansa Bali sebagaimana diatur dalam Peraturan Daerah Provinsi Bali Nomor 5 Tahun 2005 Tentang Persyaratan Arsitetur Bangunan Gedung. Adapun permasalahan dalam penulisan ini berkaitan dengan pengaturan serta penjatuhan sanksi. Dalam penulisan ini, metode yang digunakan adalah metode yuridis normatif. Hasil dari penulisan ini adalah bahwa pengaturan tentang bangunan gedung berarsitektur Bali di Kota Denpasar hanya berdasarkan Peraturan Walikota Nomor 25 Tahun 2010 Tentang Persyaratan Arsitektur Bangunan Gedung di Kota Denpasar. Sehingga terhadap pelanggaran terkait hal tersebut tidak dapat dijatuhi sanksi. Untuk mengatasi hal tersebut, disarankan Pemerintah Kota Denpasar untuk membuat peraturan daerah yang memuat sanksi administratif ataupun sanksi pidana terhadap pelanggar. Kata Kunci: arsitektur Bali, Kota Denpasar, pelanggaran, pengaturan.

Abstract

Along with the times, Balinese traditional architecture is increasingly being eroded by modern architectural art and also by the occurrence of damages. The purpose of this paper is to analyze the protection of traditional architectural buildings in the modern Balinese era  and problems related to the preservation of traditional architecture in the modern Balinese era. This research adopts the doctrinal research and uses primary, secondary and tertiary legal materials. These legal materials were collected using a card system with a statute approach, a fact approach, and an analytical conceptual approach. Findings of the study show that: first, according to national law, Balinese traditional architecture is a cultural heritage and is regulated in Indonesian Law Number 5 of 1992 concerning Cultural Heritage Objects. Meanwhile, in the Province of Bali, Balinese traditional architecture is regulated in the Regional Regulation of the Province of Bali Number 5 of 2005 concerning Architectural Requirements for Buildings; secondly, one of the ways taken by the Government of Bali Province to preserve Balinese traditional architecture is to apply it to buildings. Balinese architecture, besides being used in the physical form of buildings, is also applied to the design of fences and gates along the main roads and streets in the environment. Balinese architecture is also required to be applied to government-owned houses or buildings, and official residences.   Abstrak Arsitektur tradisional Bali seiring perkembangan jaman semakin tergerus oleh seni arsitektur modern dan juga terjadinya kerusakan-kerusakan. Tujuan penulisan ini adalah menganalisis perlindungan bangunan arsitektur tradisional di era Bali modern dan permasalahan terkait pelestarian arsitektur tradisional di era Bali modern. Penelitian ini merupakan Doctrinal Research dengan menggunakan bahan hukum primer, sekunder dan tersier. Teknik pengumpulan bahan hukum dilakukan dengan sistem kartu dengan pendekatan perundang-undangan, pendekatan fakta, dan pendekatan analisis konseptual. Hasil dari penelitian ini yaitu: Pertama, Secara hukum nasional, arsitektur tradisional Bali merupakan salah satu cagar budaya dan diatur di dalam Undang-Undang Nomor 5 Tahun 1992 tentang Benda Cagar Budaya. Sedangkan di Provinsi Bali, arsitektur tradisional Bali telah diatur di dalam Peraturan Daerah Provinsi Bali Nomor 5 Tahun 2005 tentang Persyaratan Arsitektur Bangunan Gedung; kedua, Salah satu cara yang dilakukan oleh Pemerintah Provinsi Bali untuk pelestarian arsitektur tradisional Bali adalah dengan mengaplikasikannya pada bangunan gedung. Arsitektur Bali selain digunakan dalam bentuk fisik dari bangunan gedung, juga diberlakukan untuk desain pagar dan gerbang disepanjang jalan raya dan jalan lingkungan. Arsitektur Bali juga diwajibkan untuk digunakan terhadap bangunan atau gedung milik pemerintah, rumah dinas maupun rumah jabatan.

Abstract

Abstract Medical waste, which includes toxic and hazardous waste, is generated from activities that occur in health facilities and has the potential to transmit various disease-causing agents. Therefore, medical waste must be managed in accordance with the principles of area-based management. This research is a doctrinal legal research project that employs a combination of primary, secondary, and tertiary legal materials. The methodology for collecting legal materials involves a document study that incorporates both a statute and analytical conceptual approaches. The results and discussion demonstrate the unavailability of land for the management of medical waste, including toxic and hazardous materials. This situation compels healthcare facility management to form collaborative relationships with medical waste management companies specialising in the disposal of toxic and hazardous waste. Consequently, the management of medical waste at area-based healthcare facilities remains unfulfilled. Abstrak Limbah medis (limbah B3) pada dasarnya merupakan limbah hasil proses kegiatan yang terjadi di fasilitas kesehatan yang sifatnya sangat potensial dapat menularkan berbagai bibit penyakit. Sehingga limbah medis (limbah B3) perlu untuk dikelola dengan baik dengan prinsip pengelolaan berbasis wilayah. Penelitian ini merupakan penelitian hukum doktrinal dengan menggunakan bahan hukum primer, sekunder dan tersier. Teknik pengumpulan bahan hukum dilakukan dengan studi dokumen dengan pendekatan perundang-undangan dan pendekatan analisis konseptual. Hasil dan pembahasan yaitu adanya ketidaktersediaan lahan untuk membuat pengelolaan limbah medis (limbah B3) sehingga menjadikan fasilitas pelayanan kesehatan harus menjalin kerjasama dengan perusahaan pengelola limbah medis (limbah B3) dalam hal pengelolaannya. Sehingga berdasarkan hal tersebut masih belum dapat mewujudkan pengelolaan limbah medis (limbah B3) fasilitas pelayanan kesehatan berbasis wilayah.

Abstract

Education is the human’s right as the main fondation in the development of the nations. The school zoning system is implemented in the process of accepting new student in order to acess the education evenly. The problem of this research are related to the rules of accepting new students through the zoning system and the authority in determining their zones. This research is aimed to be a critic related to school zoning process which is still becoming an issue nowdays. This research was normative analyzed by using three methods such as statue approach, fact approach and analytical conceptual aproach. The results in this research showed that there is vagueness norm in determining the school zone which has caused some problems for the new students. Therefore, the government’s authority is needed to interpretation this vagueness, and give freedom in determining the zoning area for new student who cannot enter the school because of the long distance. It should be done in order to implement the educational justice and enforcement of human rights in Indonesia.

Abstract

This research aims to explore the relationship between gender diversity on boards of directors and corporate sustainability performance through a literature review analysis. The research methodology employs a literature review approach by examining 11 relevant articles related to the impact of gender diversity on sustainability report disclosure, using inclusion criteria such as article type, methodology, and topic relevance. The analysis results show diverse findings, with most articles stating that gender diversity has a positive impact on sustainability reporting, especially in industrial sectors with high exposure to social and environmental issues. However, some studies also found no significant impact, especially in regions with a strong patriarchal culture, such as Indonesia. The conclusion of this study emphasizes the importance of increasing women's representation in corporate governance to maximize sustainability performance and more transparent disclosures.
