Abstract

The substance of legislation is a written legal norm which has a binding and constant legal power. Substantially, the Article 20 section 1 letter a of the Laws Number 21/2001 has violated the constitutional rights of the adat community of Yawaonat. In this connection the adat community has made a proposal for material examination against Laws Number 21/2001 to the Constitutional Court. This study describes the rights of the adat community in accommodating outsiders (non-Papuan people) to become the Native of Papuans based on the adat law which has been accommodated in the Laws Number 21/2001. The material examination conducted by the Constitutional Court decided that the significance for recognizing outsiders to become the Native of Papuans if it is not well signified will create constitutional losses for outsiders who have been recognized as the native Papuans and can harm the constitutional rights of the adat community. This is a normative legal study. The legal sources employed for this study was the legal primary and secondary sources. The analysis was done systematically and interpretatively with juridical evaluations. The legal standing of the adat community of Yawaonat as a proposer in the session of the Constitutional Court is based on the specifications of Article 51 section 1 of the Laws Number 24/2003 with reference to the Laws Number 8/2011 concerning Constitutional Court. The rights of the adat community which is violated covers the constitutional rights given by the 1945 Constitution and the rights by Laws Number 21/2001

Abstract

Penelitian ini dengan judul Pelaksanaan Penetapan Keberadaan Hak Ulayat Masyarakat Hukum Adat Di Kabupaten Keerom Berdasarkan Perdasus Provinsi Papua Nomor 23 Tahun 2008 Tentang Hak Ulayat Masyarakat Hukum Adat dan Hak Perorangan Warga Masyarakat Hukum Adat Atas Tanah. Metode yang digunakan dalam penelitian ini adalah penelitian yuridis normative yang meneliti dan mengkaji undang-undang, bahan kepustakaan peraturan-peraturan tertulis lainya serta bahan-bahan hukum sekunder yang sebagai alat untuk mengidentifikasikan kenyataan sosial dalam masyarakat. Hasil penelitian ini mengungkapkan bahwa keberadaan masyarakat hukum adat merupakan suatu unsur penting dalam suatu pemerintahan daerah maupun negara. Berdasarkan Bab I Ketentuan umum Pasal 1 ayat 6 Hak ulayat masyarakat hukum adat atas tanah adalah hak persekutuan yang dipunyai oleh masyarakat hukum adat tertentu atas suatu wilayah tertentu yang merupakan lingkungan hidup para warganya yang meliputi untuk memanfaatkan tanah beserta segala isinya sesuai dengan peraturan perundang-undangan, didalam Pasal 7 Hak perorangan warga masyarakat hukum adat atas tanah adalah hak perorangan yang dipunyai oleh warga masyarakat hukum adat tertentu atas suatu wilayah tertentu yang merupakan lingkungan hidupnya yang meliputi hak untuk memanfaatkan tanah beserta segala isinya sesuai dengan peraturan perundang-undangan dan Pasal 8 Masyarakat hukum adat adalah warga asli Papua yang sejak kelahirannya hidup dalam wilayah tertentu dan terikat serta tunduk kepada hukum adat tertentu dengan rasa solidaritas yang tinggi diantara para anggotanya. Dalam hal ini UUD 1945 Pasal 18B ayat (2) menyatakan Negara mengakui dan menghormati kesatuan-kesatuan masyarakat hukum adat beserta hak-hak tradisional sepanjang masih hidup dan sesuai dengan perkembangan masyarakat dan prinsip Negara Kesatuan Republik Indonesia yang diatur dalam undang-undang.

Abstract

The title of this community service activity is "The Application of Science and Technology in Law No. 28 of 2014 on Copyright for Lecturers at Universitas Muhammadiyah Papua." This activity was conducted on August 1, 2024, and attended by 19 (nineteen) lecturers. The goal was to enhance the understanding and skills of lecturers in applying the Copyright Law, particularly related to academic works and research. The implementation methods included socialization, workshops, and mentoring. The socialization provided basic understanding of copyright and intellectual property protection. The workshop focused on practical training, such as how to register copyrights and understand the legal procedures. Mentoring, both in groups and individually, offered direct guidance to lecturers in applying the knowledge they had gained.The outcomes achieved included increased lecturer knowledge of copyright, an increase in the number of works registered, and the formation of a copyright oversight team within the university to ensure compliance with applicable regulations.

Abstract

Pada tanggal 7 Agustus 2024 telah dilaksanakan kegiatan pengabdian kepada masyarakat dengan tema “Pencegahan dan Rehabilitasi Penyalahgunaan Narkotika Bagi Siswa” di SMA Negeri 7 Kota Jayapura. Kegiatan ini diikuti oleh 31 siswa kelas XII dan bertujuan untuk meningkatkan kesadaran siswa tentang bahaya narkotika sekaligus memberikan informasi tentang pencegahan dan rehabilitasi. Metode yang digunakan adalah penyuluhan interaktif, diskusi kelompok, dan simulasi kasus. Penyuluhan interaktif disampaikan oleh tim ahli yang memaparkan dampak negatif narkotika dari berbagai sudut pandang. Dalam diskusi kelompok, siswa diajak untuk berdiskusi tentang tantangan yang dihadapi dan bekerja sama untuk mencari solusi. Simulasi kasus memberikan pelatihan kepada siswa tentang cara menangani situasi berisiko. Hasil kegiatan ini menunjukkan adanya peningkatan pemahaman siswa tentang bahaya narkotika dan pentingnya tindakan pencegahan. Selain itu, beberapa siswa yang membutuhkan rehabilitasi diarahkan ke layanan yang tepat. Capaian utama yang dicapai adalah terbentuknya kesadaran kolektif dan keterlibatan aktif siswa dalam pencegahan narkotika.

Abstract

Based on the results of training on Techniques for Preparing Good Village Regulations, it was found that there are still many village officials (Village Heads and Village Consultative Body) who do not have the knowledge and expertise in drafting good village regulations in accordance with the provisions of statutory regulations. The low level of knowledge of village government officials in drafting village regulations has created a legal vacuum in society, thereby affecting the effectiveness of village government administration. If this is not addressed from the start, it can affect all village development policies in accordance with the mandate of Law Number 6 of 2014 concerning Villages. The objectives of training in preparing good village regulations are (1) to provide knowledge and understanding of the procedures for preparing good and correct village regulations (2) to provide knowledge about the correct preparation of village regulations in accordance with the theory, principles and concepts of legislative science. The expected benefit from training in techniques for preparing good village regulations is that it can provide scientific contributions to village government officials and the community regarding the benefits of correct procedures for drafting village regulations and how to implement the village regulations themselves. Community service was carried out in Skouw Mabo Village, Muara Tami District, Jayapura City using the method: lectures and discussions with the theme "Training on Techniques for Preparing Good Village Regulations for Village Government Apparatus", then continued with a question and answer session to explore the problems and obstacles faced and find solutions as a form of resolving the obstacles faced by village government officials. Based on the results achieved in this training activity, it can be concluded as follows: (1) training participants are able to understand and know the procedures for preparing village regulations that are good and correct; and (2) and Training Participants can apply the results of the training by compiling and implementing village regulations independently
