Abstract

MAQASHID SYARI’AH AND HUMAN RIGHTS (IMPLEMENTATION OF HUMAN RIGHTS IN ISLAMIC THOUGHT).  This  research  intends  analysed  relationship between ‘maqashid shari’ah’ and human rights in the context of  Islamic thought. In some text and context of  Islamic civilization, Islam respects equality. Islam gives freedom, both thinking and doing. Humans have a sense that is used to assess and see the surroundings. God gives the freedom of expression, criticizing and rectifying the country steps. Related to human rights, human being is a central point that gets attention. All the concepts and theory directed towards how to maintain mankind virtue. In the classification stage, these rights can be grouped into the most important, important and less important. To provide a solution to the phenomenon, the most ideal is to use a ‘maqashid’ concept that is implemented with ‘fiqh aulawiyat’ (priority). To promote and realize the ‘maqashid’ concept, it requires skillful people. Incorporating the concept of  Islamic human rights in the International level becomes an indicator of the implementation of these two relations.keywords:   ‘Maqashid   Syari’ah’,   Human   Right,  ‘Dlaruriyah’, ‘Hajjiyah’, ‘Tahsiniyah’Penelitan ini bermaksud mengkasji relasi antara maqashid syari’ah dan hak asasi manusia dalam konteks pemikiran  Islam. Dalam beberapa teks dan konteks peradaban Islam, Islam sangat menghormati persamaan hak. Dalam masalah kebebasan; baik berfikir maupun berbuat, Islam memberikan  keluasaan  selebar–selebarnya.  Manusia  memiliki  akal yang dipergunakan untuk menilai dan melihat alam sekitarnya. Allah memberikan kebebasan mengutarakan pendapat, mengkritik dan meluruskan langkah–langkah negara. Dalam perbincangan tentang HAM, manusia adalah titik sentral yang mendapatkan perhatian. Semua konsep dan teori diarahkan  bagaimana untuk menjaga kemashlahatan umat manusia. Dalam tahap klasifikasi, hak–hak tersebut bisa dikelompokkan menjadi paling penting, penting dan kurang penting. Untuk memberikan solusi atas fenomena tersebut yang paling ideal adalah dengan memakai konsep maqashid yang diimplementasikan dengan fiqh aulawiyat (prioritas). Untuk mengedepankan konsep maqashid ini diperlukan tangan–tangan terampil sehingga bisa terealisir. Memasukkan konsep HAM Islam dalam tingkat International, menjadi indikator implementasi dua relasi ini.kata kunci: Maqashid Syari’ah, HAM, Dlaruriyah, Hajjiyah, Tahsiniyah

Abstract

Existence nadzir very important in maintaining and managing the waqf.According to Law No. 41 of 2004 amid Endowments, Nadzir divided intothree, namely: nadzir individuals, organizations and nadzir nadzir legalentity. Nadzir efforts in developing endowment assets ie the memproduktifkanwaqf. In addition, no less important is the security of property assets donatedto charitable status is not contested by the parties are not responsible. There areseveral things that must be done by the Inspectors, such as: first, immediatelymake available the certificate of land ownership (if the endowment assets, suchas land). Second, advocates of endowment assets, which are still disputed.Third, strengthening the productive waqf property. Nadzir have a central rolein the management of waqf in general. Therefore, the existence and quality ofhuman resources should nadzir exactly observed. Nadzir (whether individuals,organizations and legal entities) must be made up of people who are honorable,honest, well-behaved, experienced, mastered the science of administrationand finance necessary to carry out its duties in accordance with the type ofownership and purpose. In general, the management of waqf can be directedand built optimally, when nadzirnya trust (trustworthy) and professional.

Abstract

Endowments to save a great potential to be developed into a productive asset, which in the end was not only able to support socio-religious services, but also directed to support the various initiatives and social justice objectives. However, during this endowment has not played a significant role in realizing the benefit, the welfare of the people and social justice. Often heard slogan that endowments can be empowered to address issues of poverty, underdevelopment, poor nutrition, and so on. But there is no clear conceptual framework of how endowments can be developed to be an effective instrument for social change toward a more guarantee the welfare and justice. Abdullah Ahmad an-Na’im proposes transformation and reviewing their philanthropic tradition, in order to develop socio-economic communities, promote the fulfillment of human rights, political administration of justice, and guarantee the autonomy of the community. In addition to an-Na’im proposed above, there are several strategies in the development of productive endowments, among which are: the development of productive endowments through a reinterpretation of the concept of waqf, endowments regulatory legislation, issuance of certificates of endowment money, and productive waqf fund raising strategy.

Abstract

Through empowerment productive endowments, charitableinstitutions have run most tasks of government institutions, or specialministries such as the ministry of education, ministry of health, social ministryand other ministries related to the needs of the community. This is because theempowerment endowment has been used to build the dormitory, library, hireteachers, pay teachers, provide scholarships to students, provide health care,clean water supply, help the hungry, and help the disaster in the community.In addition, it is also motivating the research and translation programs aresupported by the results of waqf. Many books written or translated by scholarsand Muslim scientists were funded from the endowment. Research that isdeveloped either by using empirical and scientific methods to be developedand supported by the endowment funding. This means making productiveendowments as a medium for creating economic justice, reducing indigenceand poverty, developing social security systems, and provide health carefacilities and public service facilities are good.

Abstract

This study aimed to examine the effect of education managers, company lifespan, scale effort, sharia accounting training on the use of accounting information systems at BMT in ex-Pati residency. This was field research with survey through questionnaires. Samples of this study were the manager of BMT both headquarters and branch offices which actively operate in ex-Pati residency totaling 114 respondents using purposive sampling method. The results showed that managers education influences the use of accounting information systems based on the coeffecience of total effect 0.12. The company lifespan influences the use of accounting information systems based on the coefficience of  total effect 0.19. The business scale influences the use of accounting information systems based on the coefficience of  total effect 0.20. And sharia accounting training affects the use of accounting information systems based on the coefficience of total effect 0.35.

Abstract

UU. No. 41 Tahun 2004 tentang wakaf dan PP. No. 42 Tahun 2006 tentang pelaksanaan UU. tersebut menjadi pijakan pelaksanaan wakaf uang dalam praktek perwakafan di Indonesia. Wakaf uang diatur dalam pembahasan khusus yang menandakan bahwa pengembangan wakaf uang perlu mendapatkan perhatian serius dalam meningkatkan perekonomian Indonesia. Jadi secara ekonomi, wakaf Islam adalah membangun harta produktif melalui kegiatan investasi dan produksi saat ini, untuk dimanfaatkan hasil bagi generasi yang akan datang. Wakaf juga mengorbankan kepentingan sekarang untuk konsumsi demi tercapainya pengembangan harta produktif yang berorientasi pada sosial, dan hasilnya juga akan dirasakan secara bersama oleh masyarakat. Investasi harta melalui wakaf dalam tatanan Islam sebenarnya merupakan sesuatu yang sangat unik yang berbeda dengan investasi di sektor pemerintah (public sector) maupun sektor swasta (private sector). Praktik wakaf uang sebenarnya telah berjalan di beberapa negara Muslim seperti Mesir dan Tunis. Di Indonesia, wakaf uang berkembang pesat setelah diakui secara legal formal melalui Undang-Undang tentang wakaf tersebut. Kata Kunci: Ekonomi, Wakaf Uang, Manajemen, Investasi Abstract: The Government Regulation on endowments under Act. No. 41 of 2004 on and Regulation No. 42 of 2006 on the implementation of the Act became the foundation a practice of cash waqf in Indonesia. cash waqf need to get serious attention in improving the economy of Indonesia. The goal of waqf in Islam is to build productive assets through investment and production activities which have benefit for the next generations. Waqf are also sacrificing someone not to consumption now in order to achieve productive property for social development and also society. The endowment property through wakf in Islamic is different from the investment in the public sector (public sector) and the private sector (private sector). Practice Cash waqf has actually been working in several Muslim countries like Egypt and Tunis. Abstract

This  study is  a  field  study using   qualitative  descriptive approach.  Data  obtained  by  the  method  of  interview,  observation and documentation. Source of data in this study is UMKM in Kudus who become customers of Micro Shop BSM Kudus and Sacred BSM Micro Shop manager. Test the validity of the data with triangulation techniques and data analysis methods and Milles huberman. The results show  that  implementations financing in the  Micro  Shop  BSM Kudus addressed to UMKM using the murabaha contract and has been implemented in accordance with the procedure. Micro stalls BSM Kudus role in overcoming obstacles UMKM in Kudus, especially in the capital,  so that  UMKM  can  increase  sales  revenue, profit  and  assets. Enabling and inhibiting factors implementations Micro Shop BSM Kudus comes from within (internal) and outside (external).Kajian ini adalah kajian lapangan dengan menggunakan pendekatan kualitatif-deskriptif. Data diperoleh dengan metode wawancara, pengamatan dan dokumentasi. Sumber data dalam kajian ini adalah pelaku UMKM di Kabupaten Kudus yang menjadi nasabah Warung Mikro BSM Kudus dan pengelola Warung Mikro BSM Kudus. Uji keabsahan data dengan teknik triangulasi dan analisis data dengan metode huberman dan Milles. hasil kajian menunjukkan bahwa implementasi pembiayaan Warung Mikro BSM Kudus yang ditujukan kepada pelaku UMKM menggunakan akad murabahah dan telah dilaksanakan sesuai dengan prosedur. Warung Mikro BSM Kudus berperan dalam   mengatasi kendala pelaku UMKM di Kabupaten Kudus, khususnya dalam permodalan, sehingga para pelaku UMKM dapat meningkatkan omset penjualannya, laba dan asset. Faktor pendukung dan penghambat implementasi Warung Mikro BSM Kudus berasal dari dalam (internal) dan dari luar (eksternal).

Abstract

 Sejalan dengan semangat kedermawanan umat Islam, filantropi Islam di Indonesia tengah mengalami perkembangan signifikan. Filantropi Islam dalam bentuk zakat, infak, sedekah dan wakaf telah ikut berjasa dalam pembangunan bangsa dan pengembangan ekonomi umat. Filantropi ini tidak hanya mewujud dalam sumbangan-sumbangan dadakan, melainkan dikelola secara kelembagaan. Penelitian ini menggunakan metode penelitian kualitatif dengan pendekatan fenomenologis. Sedangkan metode kajian yang dipakai adalah metode kajian eksplanatif-analitis. Dengan pendekatan ini peneliti berusaha memahami optimalisasi peran Dompet Dhu’afa (DD) REPUBLIKA dalam pengembangan ekonomi umat. Potensi filantropi Islam ini ditandai dengan meningkatnya antusiasme umat dalam berfilantropi dan dipengaruhi oleh revitalisasi visi dunia filantropi Islam, yang mencoba mentransformasikan paradigma lama filantropi dengan paradigma baru yang lebih kreatif dan inovatif. Selain itu, terdapat suatu tujuan yang positif mengenai konsep keadilan sosial yang berdasarkan kesetaraan hak dan pemerataan kesejahteraan yang terintegrasi dalam konsep maupun praktik filantropi Islam dalam peran yang dimainkan oleh Dompet Dhu’afa (DD) REPUBLIKA.Kata Kunci: Kesejahteraan, Ekonomi, Karitatif, Civil SocietyThe spirit of generosity and Islamic philanthropy in Indonesia have significant growth. Islamic philanthropy in the form of charity, donation, charity and endowments have participated instrumental in the nation building and the economic development. Philanthropy is not only for consumptions but also productive activities. This study used a qualitative research method with a phenomenological approach. While the assessment method used is an explanatory analytical method. This study try to understand the role Dompet Dhu'afa (DD) REPUBLIKA in the development of poor people. Potential Islamic philanthropy is characterized by an increased enthusiasm people in giving and also influenced by Islamic philanthropy revitalization vision of the world, which tries to transform the old paradigm of philanthropy with a new paradigm that is more creative and innovative. In addition, there is a positive goal of the concept of social justice based on equal rights and equal distribution of welfare are integrated in the concept and practice of Islamic philanthropy in the role played by Dompet Dhu'afa (DD) REPUBLIKA.Keywords: Welfare, Economics, charity, Civil Society
