Abstract

AbstractTechnology makes conventional financial systems seem impractical and time consuming. Bank offices or ATMs are also becoming less desirable, from buying and selling transactions to lending and borrowing and funds can be accessed with the internet and smart phones, and financial transactions are far from rigid and complicated. However, this phenomenon has an impact both directly and indirectly on the banking service industry as an official financial service provider, banks have already introduced bank products, bank loan services and so on to the public. The Financial Services Authority (OJK) has made rules to be obeyed by lending business operators from user to user, or commonly known as Fintech peer to peer lending (P2P lending), namely POJK Number 77 / POJK.01 / 2016, this regulation aims to protect consumers related to security of funds and data, prevention of money laundering and terrorism financing, financial system stability, to managers of Fintech companies.

Abstract

The aim of this research is to find out and analyze the legal arrangements regarding labels and certification of Halal Food Products. This study uses a normative juridical approach. Normative legal research is a procedure and method of scientific research to find the truth based on legal scientific logic from a normative point of view. Research results are In the food industry, food is processed through various new processing techniques and methods by utilizing scientific and technological developments, so that it becomes a product that is ready for consumption Public. However, keep in mind that most of the world's food industry and food technology products do not apply the halal certification system. This raises concerns that in facing free trade at the regional, international and global levels, Indonesia is being flooded with food products and other products that contain or are contaminated with haram elements. In processing, storage, handling, and packing techniques, preservatives are used which are harmful to health or additives containing haram elements which are prohibited by Islam. Halal certification is a business ethic that producers should carry out as a halal guarantee for consumers. Apart from being a halal guarantee for consumers, halal labels provide economic benefits for producers including: (1) Can increase consumer confidence because halal is guaranteed, (2) Has a USP (Unique Selling Point), (3) Able to penetrate the global halal market, (4) Improving product marketability in the market, (5) Cheap investment when compared to revenue growth that can be achieved.

Abstract

The existence of sharia fintech will always be homework for the government. As one of the pillars of economic security, the development of sharia fintech still leaves various problems, especially regarding existing regulations. On the other hand, strengthening the sharia fintech business ecosystem in Indonesia provides a lot of homework to be done. This research is classified as normative legal research that applies a statutory approach regarding primary legal materials in the form of laws and regulations related to sharia fintech and other financial regulations. This study found that the Islamic economic master plan and the Indonesian Islamic financial architecture master plan do not represent the institutions and regulations for Islamic fintech as a sub-sector of Islamic finance that has the potential to develop further. To strengthen the sharia fintech business ecosystem, regulations from relevant authorities are needed that are in line with industrial needs. Strengthening regulations is expected to create a strong and stable economy and accelerate Islamic finance nationally so that Indonesia can become one of the financial centers in South East Asia Region and the world.

Abstract

Land disputes are common in society, and the village head, as witnessed by the family, resolved the matter in congruent with the parties' will and good intention. Purpose to investigate the arrangement of land dispute resolution in Indonesia; and to investigate its application through consensus deliberation in villages to realize public order. Methodology an socio-legal approach, involving primary data gathered from the interview. Furthermore, the study was also conducted in Kuningan Regency. Findings in Indonesia, land disputes resolution have been completely regulated, ranging from laws to derivative regulations and is carried out through community discourse and consensus. However, deliberation method is more common than going to the court. The deliberations include bringing the parties together; if peace arrangements can be made, they will be made. It can, however, only function optimally if both sides (the family and the community) agree to deliberate. The method is thought to be more efficient in terms of time, cost, and mechanism.  Conclusion in the village, there are two procedures for resolving land conflicts through consensus deliberation: mediation and family negotiation. Recommendation at the village level, it is critical to provide a legal framework for deliberation so that the outcomes are more equitable and mutually beneficial to all parties
