Abstract

The existence of sharia fintech will always be homework for the government. As one of the pillars of economic security, the development of sharia fintech still leaves various problems, especially regarding existing regulations. On the other hand, strengthening the sharia fintech business ecosystem in Indonesia provides a lot of homework to be done. This research is classified as normative legal research that applies a statutory approach regarding primary legal materials in the form of laws and regulations related to sharia fintech and other financial regulations. This study found that the Islamic economic master plan and the Indonesian Islamic financial architecture master plan do not represent the institutions and regulations for Islamic fintech as a sub-sector of Islamic finance that has the potential to develop further. To strengthen the sharia fintech business ecosystem, regulations from relevant authorities are needed that are in line with industrial needs. Strengthening regulations is expected to create a strong and stable economy and accelerate Islamic finance nationally so that Indonesia can become one of the financial centers in South East Asia Region and the world.

Abstract

The settlement of Minangkabau customary inheritance disputes within Indonesia’s legal practice reveals an encounter and persistent tension between communal, matrilineal customary law and the national positive law system, which is individualistic, formal, and procedural in nature. Minangkabau customary law places pusaka tinggi (ancestral property) as collective property of the clan managed by the mamak kepala waris, whereas national inheritance law, both under the Civil Code and the Compilation of Islamic Law, conceives inheritance as individual rights that may be transferred and proven juridically. These differing paradigms frequently generate conflict when customary inheritance disputes are brought before state courts. This research examines two main issues: (1) how inheritance disputes are resolved under Minangkabau customary law and Indonesian positive law; and (2) how the regulation of Minangkabau customary inheritance dispute resolution is positioned within the framework of Indonesian positive law. The study employs a normative juridical method with statutory and case approaches, focusing on the analysis of Supreme Court Decision No. 2480 K/Pdt/2010, Supreme Court Decision No. 11 K/Pdt/2013, and Pariaman District Court Decision No. 77/Pdt.G/2024/PN Pmn. The findings indicate that courts consistently prioritize formal aspects, particularly legal standing and evidentiary standards, so that the applicability of customary law depends heavily on the parties’ ability to translate customary structures into the framework of civil procedural law. Although customary law is normatively recognized, its operationalization remains subordinative. This study recommends reconstructing civil procedural law to be more accommodative of the collective and dynamic characteristics of Minangkabau customary law, thereby fostering a more equitable harmonization between national legal certainty and customary justice

Abstract

he phenomenon of fraudulent investment (investment scams) is a form of crime that continues to develop along with technological advancements. Initially, investment fraud was carried out conventionally through direct interaction, but today it has increasingly shifted to digital platforms by utilizing the internet and information technology. Illegal activities related to fraudulent investment are a manifestation of the misuse of internet-based technology and constitute criminal acts that violate legal norms and regulations in Indonesia. This study employs a normative legal research method aimed at examining how fraudulent investment crimes are regulated under Indonesian law and identifying the factors that contribute to the persistence of investment scams despite the existence of criminal provisions governing them. Based on the research findings, it can be concluded that fraudulent investment crimes are regulated in several legal instruments, including the Criminal Code (KUHP), the new Criminal Code, and the Law on Electronic Information and Transactions (ITE Law), particularly in relation to provisions concerning fraud and the dissemination of misleading electronic information. Furthermore, the continued prevalence of investment scams, despite the enforcement of existing laws, is influenced by four main factors, namely legal factors, law enforcement and infrastructure factors, community factors, and cultural factors

Abstract

Artikel ini mengkaji rasionalitas hukum dari perspektif Thomistik dengan mendasarkan pembahasannya pada pemikiran Thomas Aquinas. Bagi Aquinas, hukum bukan semata-mata konstruksi sosial atau instrumen kekuasaan, melainkan partisipasi akal budi manusia dalam hukum abadi (lex aeterna) yang bersumber dari kebijaksanaan ilahi. Dengan demikian, hukum memiliki dimensi rasional sekaligus moral: hukum tidak hanya mengatur perilaku lahiriah manusia, tetapi juga mengarahkan manusia menuju kebaikan bersama (bonum commune). Dalam kerangka ini, rasionalitas hukum tidak dapat dipisahkan dari moralitas, karena keduanya berakar pada akal praktis yang berorientasi pada tujuan akhir kehidupan manusia. Artikel ini menyoroti tiga aspek utama. Pertama, dasar metafisik hukum dalam hubungannya dengan hukum abadi dan hukum kodrat (lex naturalis). Kedua, rasionalitas hukum sebagai prinsip yang memberikan legitimasi terhadap hukum positif. Ketiga, relevansi pemikiran Thomistik dalam menjawab tantangan sistem hukum modern yang kerap terjebak dalam positivisme dan terlepas dari nilai-nilai moral.  Dengan menegaskan kembali rasionalitas hukum dalam kerangka Thomistik, kajian ini berargumen bahwa kebijaksanaan abadi Aquinas menawarkan landasan filosofis yang kuat bagi integrasi antara hukum, moralitas, dan keadilan. Implikasi penelitian ini bersifat normatif sekaligus reflektif: hukum modern, khususnya dalam kerangka negara hukum, memerlukan fondasi yang tidak hanya rasional dalam arti instrumental, tetapi juga rasional dalam arti substantif, yaitu hukum yang berakar pada kebijaksanaan moral untuk mewujudkan keadilan sejati.
