Abstract

Public assumes that knowledge of the judge of religious court is moreconcentrated in marital disputes, inheritance, wills, grants, waqaf and sadaqah that be handled, rather than knowledge of sharia economy. Seeing the judge had received his various background of education levels and the representative office building conditions of the religious court, so that it would have been more ready to hear the case of economic disputes than general court. But in Madura, it does not appear yet to have a significant progress as the impact of the regulatory changes, contained in the constitution, number 7 of 1989 jo. number 3 of 2006 on the Religious Court, where there are some additional authorities to resolve some disputes in the field of shariah economic matters.

Abstract

The development of digital financial services has led to the increasingly widespread use of paylater facilities in consumer goods transactions, including mobile phone credit purchases through fintech platforms such as Akulaku and Kredivo, which are widely used at retail counters in Babat. Easy access, rapid processing, and minimal requirements make this practice attractive; however, its transactional structure raises issues related to cost transparency, late payment penalties, and compliance with sharia principles and national regulations. The main issue of this study concerns the form of mobile phone credit practices through these two fintech platforms and the extent to which their cost schemes, contractual arrangements, and penalty mechanisms align with the concept of al-bay’ bi al-taqshīṭ, the provisions of DSN-MUI Fatwas, and POJK No. 10/2022. This study aims to analyze the conformity of actual practices with sharia principles while also assessing their compliance with positive law. The research employs a qualitative method using an empirical juridical approach through the analysis of regulations, fatwas, academic literature, and in-depth interviews with counter employees and consumers using mobile phone credit services. The findings show that the transactions form a triangular scheme in which the counter merely supplies the goods, while all financing calculations, including additional charges and late payment penalties, are fully determined by the fintech system. Most consumers only understand the product price and installment amounts without being informed of the penalty structure, resulting in information asymmetry. The imposition of penalties as company revenue indicates non-compliance with sharia principles, as it closely resembles ribā nasī’ah, and does not fully meet OJK cost transparency standards. This study highlights the need to improve consumer education, contractual transparency, and penalty mechanisms so that paylater practices better reflect principles of justice and comply with sharia law and regulations.

Abstract

Abstract

In the procedural law system applicable in the judicial environment, there is an ex officio right. In this case, a judge can determine a policy on a decision that is considered good and fair because of his position. Law No. 48 of 2009 emphasizes that courts must adjudicate without discrimination and are obliged to assist those seeking justice. This study aims to determine the ex officio authority of judges in resolving sharia economic disputes without the presence of the defendant from a civil law perspective, using case study 1716/Pdt.G/2024/PA.Bjn. This study is a descriptive qualitative research with an empirical legal approach. The primary data source used is interview data from the panel of judges and the deputy court clerk in case 1716/Pdt.G/2024/PA.Bjn, while the secondary data source is obtained from a list of references related to the material to be analyzed, namely legal documents such as laws, regulations, and court decisions. The findings of this study indicate that judges conduct trials using their ex officio authority to ensure legal effectiveness and certainty, particularly in regulating the execution of collateral objects that are not explicitly requested in the petition. Nevertheless, the judge's actions remain consistent with the principles of civil procedure law, including legal certainty, justice, and judicial proactivity within the boundaries of the authority granted. The exercise of ex officio authority demonstrates that in matters of Islamic economics, judges are not only bound by the reasons stated in the complaint but also tasked with formulating effective and enforceable decisions.

Abstract

In Islam, the halalness of the food consumed is a very basic principle, therefore the state is obliged to provide protection and guarantees regarding the halalness of the products consumed and used by the community. The government seeks to stabilize and regulate the flow of products circulating in Indonesia so that Law Number 33 of 2014 concerning Halal Product Guarantee is established. Before PP 31 of 2019 was issued, the halal certification process was still carried out by MUI. However, after PP 31 of 2019 was issued, the authority to issue halal certification rests entirely with BPJPH as the leading Halal Product Assurance sector. The move has drawn a lot of criticism because BPJPH is considered to be still not ready to implement the program, as is the case with infrastructure and information systems. The transfer of authority should have been as mandated by the Law on Halal Product Guarantee, but until the time specified BPJPH is not yet fully ready to become a regulator of halal product assurance in Indonesia. The results of this study can be concluded that BPJPH is ready to be a pioneer in determining halal product guarantees which were previously the authority of MUI. Mandatory halal certification is categorized as maslahah because it relates to the basic needs of mankind in the world and the hereafter and does not contain any harm.
