Abstract

Penelitian ini bertujuan untuk menganalisis dan membandingkan sistem perlindungan hak moral dalam hak cipta musik di Indonesia dan Korea Selatan, dengan fokus pada efektivitas pengaturan hukum serta implementasi penegakan hak moral pencipta. Secara normatif, hak moral di Indonesia diatur dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta, khususnya Pasal 5 dan Pasal 57, yang menegaskan bahwa hak moral bersifat melekat dan abadi pada diri pencipta. Namun, pelaksanaannya masih bersifat deklaratif karena belum memiliki mekanisme kelembagaan yang efektif. Sebaliknya, Korea Selatan mengatur hak moral secara lebih komprehensif dalam Copyright Act Pasal 11 sampai Pasal 15, yang meliputi hak pengumuman, hak atribusi, hak integritas, dan hak moral pasca-kematian. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan komparatif (comparative approach) yang menelaah bahan hukum primer, sekunder, dan tersier melalui studi kepustakaan. Hasil penelitian menunjukkan bahwa perbedaan utama terletak pada efektivitas kelembagaan dan budaya hukum: Korea Selatan memiliki sistem yang terintegrasi dengan lembaga seperti Korean Copyright Commission (KCC) dan Korea Music Copyright Association (KOMCA) yang menegakkan hak moral secara non-litigasi, sedangkan Indonesia masih bergantung pada penyelesaian di Pengadilan Niaga karena ketidakefektifan jalur non-litigasi. Dimana bahwa lemahnya kelembagaan dan rendahnya kesadaran hukum menjadi tantangan utama dalam penegakan hak cipta di Indonesia. Kesimpulan penelitian ini menegaskan perlunya penguatan regulasi, kelembagaan, dan budaya hukum menjadi faktor penting dalam mewujudkan perlindungan hak moral yang efektif dan berkeadilan di Indonesia. This study aims to analyze and compare the system of moral rights protection in music copyright between Indonesia and South Korea, focusing on the effectiveness of legal regulation and the implementation of moral rights enforcement. Normatively, moral rights in Indonesia are regulated under Law Number 28 of 2014 on Copyright, particularly in Articles 5 and 57, which affirm that moral rights are inherent and perpetual to the creator. However, their implementation remains declarative due to the absence of an effective institutional mechanism. In contrast, South Korea regulates moral rights more comprehensively under Articles 11 to 15 of the Copyright Act, which include the right of disclosure, the right of authorship, the right of integrity, and posthumous moral rights. This research employs a normative juridical method with a comparative approach that examines primary, secondary, and tertiary legal materials through library research. The findings reveal that the main differences lie in institutional effectiveness and legal culture: South Korea has an integrated system supported by institutions such as the Korean Copyright Commission (KCC) and the Korea Music Copyright Association (KOMCA), which enforce moral rights through non-litigation mechanisms, whereas Indonesia still relies on commercial court proceedings due to the ineffectiveness of non-litigation channels. The weakness of institutional capacity and low legal awareness remain the main challenges in copyright enforcement in Indonesia. The study concludes that strengthening regulation, institutional mechanisms, and legal culture is essential to realize effective and equitable protection of moral rights in Indonesia.

Abstract

The development of Intellectual Property Rights (IPR) is significantly shaped by John Locke’s theory of property, along with subsequent philosophical discourse, which provides a foundation for granting exclusive rights to creators and inventors. IPR aims to balance the protection of individual interests with the greater public good, while fostering innovation. In the Indonesian context, a comprehensive legal framework and effective enforcement mechanisms are crucial to maintaining this equilibrium, particularly within the domain of copyright law. This research investigates whether Indonesia’s copyright system reflects the philosophical foundations of intellectual property, examines the integration of these principles into legal norms, and evaluates their role in supporting the growth of the national creative economy. Using a scoping review methodology, the study reveals a strong alignment between philosophical principles of ownership and Indonesia’s legal framework. This alignment highlights the dual role of copyright law: protecting individual creators' rights while stimulating a thriving creative economy. Furthermore, the research underscores the importance of balancing the interests of creators, industries, and the public. The study also explores how the Indonesian government has updated copyright legislation to better protect and promote creative industries, acknowledging the significant role of copyright in economic development. Recent policy reforms, such as the restructuring of the National Collective Management Institute (LMKN) and the digitalization of royalty databases, demonstrate a commitment to harmonizing legal practices with philosophical ideals. These reforms reflect an evolving copyright system that adapts to global dynamics, addressing technological challenges while ensuring effective protection of intellectual property rights.

Abstract

This article analyses the diverse paradigms of death penalty from its debatable perspectives, starting from the views of the church, concept of human dignity, history of Christianity, as well as from the general world history. The death penalty is still and will always be a matter of debate, because of the nature of human dignity which placed the highest among all creatures and status in this world. Therefore, the purpose of this article is to see that the death penalty is not actually a necessity to fight crime, considering that the purpose of punishment in contemporary legal discourse is to improve and develop the quality of life of a person who is considered to have committed a crime. Furthermore, it is such a struggle to make the death penalty more humane, dignified, and civilized, so abolishing this kind of penalty shall be done to reflect how the law is upheld for the society in a dignified manner. This article uses normative research by referring to some laws and regulations in Indonesia as well as the official documents from the Catholic church. The findings showed that no one should presume to have the right under any circumstances to directly end an innocent human life, so the death penalty shall be abolished in the law enforcement in Indonesia.

Abstract

This study analyzes the strategy of the Deli Serdang Regency Government in implementing personal data protection regulations, especially in Sibolangit District. In technological developments, the advancement of information technology has increased individual privacy risks, such as identity theft and data leaks. Law Number 27 of 2022 concerning Personal Data Protection (UU PDP) serves as a significant step to protect individual rights in the collection, use, and exchange of personal data. However, implementation at the local level faces challenges. This research uses a qualitative approach with a case study design, involving interviews, observations, and the distribution of questionnaires to 80 respondents from various backgrounds in Sibolangit District. The results show several challenges, such as some community members not fully understanding the UU PDP, a high incidence of data misuse, and a gap between normative awareness and practical caution in managing personal data. Although the public is aware of the importance of data protection, 64 out of 80 respondents are still willing to provide personal data for promotions or certain application registrations. In response, the Deli Serdang Regency Government has implemented strategies that include socializing the dangers of social media use and commercial service registration. The government has also integrated the Satu Data Indonesia program for human resource development and information dissemination through various media. This study recommends the need to strengthen infrastructure, improve human resource capacity, and conduct more targeted education for the public, especially young people and government employees, to be more prudent in managing personal data. Bahasa Indonesia Abstract: Penelitian ini menganalisis strategi Pemerintah Kabupaten Deli Serdang dalam mengimplementasikan peraturan perlindungan data pribadi, khususnya di Kecamatan Sibolangit. Perkembangan digital, kemajuan teknologi informasi telah meningkatkan risiko privasi individu, seperti pencurian identitas dan kebocoran data. Undang-Undang Nomor 27 Tahun 2022 tentang Perlindungan Data Pribadi (UU PDP) hadir sebagai langkah signifikan untuk melindungi hak-hak individu dalam pengumpulan, penggunaan, dan pertukaran data pribadi. Namun, implementasi di daerah menghadapi tantangan. Penelitian ini menggunakan pendekatan kualitatif dengan desain studi kasus, melibatkan wawancara, observasi, dan penyebaran kuesioner kepada 80 responden dari berbagai latar belakang di Kecamatan Sibolangit. Hasil penelitian menunjukkan bahwa terdapat tantangan, seperti sebagian masyarakat yang belum sepenuhnya memahami UU PDP, tingginya insiden penyalahgunaan data, dan adanya celah antara kesadaran normatif dan kehati-hatian praktis dalam mengelola data pribadi. Meskipun masyarakat menyadari pentingnya perlindungan data, 64 dari 80 responden masih bersedia memberikan data pribadi untuk promosi atau pendaftaran aplikasi tertentu. Sebagai respons, Pemerintah Kabupaten Deli Serdang menerapkan strategi yang meliputi sosialisasi bahaya penggunaan media sosial dan pendaftaran layanan komersial. Pemerintah juga telah mengintegrasikan program Satu Data Indonesia untuk pengembangan sumber daya manusia dan diseminasi informasi melalui berbagai media. Penelitian ini merekomendasikan perlunya penguatan infrastruktur, peningkatan kapasitas sumber daya manusia, dan edukasi yang lebih terarah kepada masyarakat, khususnya kaum muda dan pegawai pemerintah, agar lebih bijaksana dalam mengelola data pribadi.
