Abstract

This study examines the role of judicial orders in healthcare financing in Indonesia through decisions by the Constitutional Court (MK) and the Supreme Court (MA). It employs a normative approach with qualitative analysis to explore the role of judicial orders in regulating healthcare financing, focusing on decisions from both MK and MA. The analysis reveals that the MK, through Decision No. 63 of 2012, emphasizes the shared responsibility of the state and individuals in healthcare services, while Decision No. 72 of 2019 upholds the principle of non-regression. The MA, in Decision 7P of 2020, annulled the BPJS premium increase for violating the principle of social justice. This study underscores the importance of legislative responses to judicial decisions to establish a sustainable, fair, and inclusive healthcare financing system aligned with constitutional mandates.

Abstract

Pegawai sebagai ujung tombak pelayanan dituntut memiliki disiplin kerja yang tinggi agar dapat mencapai tujuan kinerja secara optimal. Penelitian ini bertujuan untuk mengetahui dan menganalisis pengaruh disiplin terhadap kinerja pegawai di Biro Rektor Universitas Negeri Medan. Dengan menggunakan teknik Simple Random Sampling dan rumus Slovin dengan tingkat kelonggaran (e) sebesar 5%, diperoleh sampel sebanyak 104 pegawai yang berstatus Pegawai Negeri Sipil. Data dikumpulkan melalui kuesioner, wawancara, dan studi dokumentasi. Kuesioner diukur menggunakan skala Likert dan diolah menggunakan program SPSS (Statistical Product and Service Solution).Hasil penelitian menunjukkan bahwa baik secara parsial maupun simultan, variabel kepemimpinan dan disiplin kerja berpengaruh positif dan signifikan terhadap kinerja pegawai di Biro Rektor Universitas Negeri Medan.

Abstract

This study examines the importance of ethics as a formal parameter in assessing the validity of Constitutional Court (MK) decisions in Indonesia. The final and binding nature of MK decisions often raises debates regarding absolute power without adequate control mechanisms, especially in the context of ethical violations. This research explores deontological ethics and procedural justice as the basis for analysis, as well as several controversial MK decisions related to ethical issues. This research is a normative legal study that emphasizes a conceptual and statutory approach. The results show that integrating ethics into the assessment of MK decisions can enhance the legitimacy of constitutional justice and ensure more substantive justice. Therefore, this study recommends reformulating the legal framework to incorporate ethics as a key component in the validity assessment process.
