Abstract

Purpose – This research aims to elucidate in detail how insurance can serve as a vital instrument in ensuring the rights of children and shielding them from the detrimental impacts of economic violence. Methods – The research methodology employed is a thorough literature review encompassing primary data sources from pertinent books, journals, and legal texts related to the research topic. Subsequently, the acquired data is subjected to descriptive-analytical analysis to unveil the underlying objectives of the research. Findings – The results indicate that the security provided by insurance contracts is instrumental in safeguarding the rights of children, particularly in situations where parental figures have passed away or retired from employment. While the fulfillment of children's rights may not have reached an optimal level, their financial needs can be met to a reasonable extent, thanks to the role played by insurance. Additionally, this research underscores the crucial role played by the Financial Services Authority (OJK) in upholding justice and ensuring effective protection for children who are vulnerable in the context of economic violence. The OJK is tasked not only with receiving complaints but also with resolving disputes related to insurance businesses and facilitating the settlement of insurance claim disputes in accordance with the agreements reached by the involved parties. Research implications – The theoretical implication of this research lies in its contribution to broadening our comprehension of the role of insurance in the realm of child protection. Moreover, its originality is underscored by the integration of distributive justice principles and contract theory, enriching our understanding of this dynamic interplay within the context of child protection mechanisms. Originality/value – In conclusion, this research underscores the significance of collaborative efforts among governmental bodies, financial institutions, and communities in enhancing the safeguarding of children from economic violence, utilizing insurance as a potent tool for protection.

Abstract

The purpose of writing this article is to discuss mixed marriages that occur in Indonesia because the practice of mixed marriages is something that cannot be denied, both interfaith marriages and nationalities. Then, using a library study through data collection in its preparation using various journals and books that still have relevance to the object of discussion in the preparation of this article is the type of study that will be used. Furthermore, the data used in this study is a qualitative approach with a descriptive-analytic nature of research. The results of this study state that mixed marriages are a necessity if both partners have the same harmony and commitment in building the ark of domestic life. Then, mixed marriage is also a lifestyle if both partners want a different partner from the surrounding community which is the main attraction, or even a need to fulfil a lifestyle for the perpetrators.

Abstract

Childfree is a phenomenon that refers to a couple's decision not to have children, either voluntarily or temporarily. This phenomenon has become a significant topic of discussion in various countries and has become part of a global issue, including Indonesia. This issue is significant and debatable in society. In the context of the Islamic religion, having children is considered God's will, and children should be looked after properly. In societies that adhere to pronatalist views, the child-free phenomenon often faces pressure and stigmatism. However, these decisions often arise due to social, economic, and cultural changes. This research applies qualitative methods by analysing relevant literature about the childfree phenomenon. This research aims to review the factors behind the choice to be child-free in various countries. The research results show that many factors, including personal, economic, and environmental factors, influence the decision not to have children. In Indonesia, childfree still needs to be fully implemented, and the reason for choosing childfree is motivated by economic considerations. Meanwhile, abroad, the influence of childlessness is more varied, ranging from personal, economic, environmental, and psychological factors. Further research into the childfree phenomenon is needed to better understand its impact on families and society.

Abstract

Artikel ini berusaha menjelaskan bagaimana alasan-alasan dari masyarakat di Desa Leteh Kecamatan Rembang, Kabupaten Rembang menunda perkawinannya dalam kacamata sadd adz-dzari’ah dan fath adz-dzari’ah. Dengan melakukan wawancara secara mendalam terhadap lima belas orang yang telah memilih untuk menunda perkawinan mereka. Hasil penelitian ini menunjukkan bahwa ketidakbolehan atau kebolehan penundaan perkawinan dapat digambarkan melalui pertimbangan sadd adz-dzari’ah (yang mengarah pada kerusakan) dan fath adz-dzari’ah (yang mengarah pada kebaikan dan kemaslahatan). Penundaan perkawinan karena alasan ekonomi atau untuk menemukan pasangan yang sesuai dengan harapan dapat dianggap sebagai fath adz-dzari’ah karena hal ini dianggap sebagai langkah bijak untuk menghindari kerusakan dalam rumah tangga. Namun, penundaan perkawinan karena pengalaman kegagalan atau perasaan bahagia tanpa perkawinan dapat dianggap sebagai sadd adz-dzari’ah karena hal ini dapat mengarah pada ketidaksempurnaan hidup dan kesendirian di masa tua.

Abstract

Tulisan ini merupakan hasil penelitian terhadap sejumlah karya yang berbicara tentang pentingnya mengatahui sebab dan akibat dari trend nikah muda. Dalam melacak sebab dan akibat pada tulisan ini memanfaatkan studi kepustakaan sebagai pisau bedah kajian yang data-data primernya diolah secara kualitatif dengan. Tulisan ini menemukan, pertama, berat ringannya tanggung jawab yang dipikul bukan hanya ditentukan oleh banyak sedikitnya beban, melainkan tujuan dan pandangan masyarakat terhadap pernikahan dini. Kedua, keputusan menikah di usia muda karena rasa cinta yang begitu besar, kehamilan pra nikah, desakan dari orang tua, mengikuti tradisi daerah sehingga menyebabkan keputusan diambil didasarkan pada suasana batin. Ketiga, akan menerima banyak konsekuensi negatif dari pernikahanya. Dasar agama dalam hal ini ahli fiqih juga berbeda pendapat dalam hal syarat baligh. Menurut Imam Maliki dan Syafii, mensyaratkan harus baligh bagi laki-laki dan perempuan dalam melaksanakan perkawinan, sedangkan menurut Imam Hanafi tidak ada syarat baligh dalam perkawinan, karena adanya hak ijbar. Sedangkan undang-undang perkawinan di Indonesia mensyaratkan batas minimum usia pernikahan adalah 19 tahun untuk laki-laki dan 19 tahun untuk perempuan.

Abstract

Artikel ini membahas mengenai Hukum Perkawinan di Masyarakat Sasak Lombok Nusa Tenggara Barat (Analisis Produk Hukum Perkawinan Masyarakat Sasak Lombok Nusa Tenggara Barat). Fokus perhatian pada kajian ini ialah apa saja Produk Hukum Perkawinan Masyarakat Sasak Lombok Nusa Tenggara Barat. dengan menggunakan studi kepustakaan sebagai pisau bedah kajian yang data-data primernya diolah secara kualitatif dengan metode deskriptif analisis di mana bersumber pada buku dan jurnal yang berkaitan dengan tema yang dikaji. Penelitian ini menyimpulkan bahwa produk hukum perkawinan dalam masyarakat suku Sasak dari sebelum merariq (perkawinan) hingga setelah merariq sampai Beseang (perceraian) dapat klarifikasi menjadi beberapa bagian yakni, Pade Saling Meleq, Midang, Pesopoq Janji, Bebait, Nyelabar, Membait bande, Bekawin, Ngantung Aji Kerame, Begawe, Nyongkolan, Beseang, Umur merariq, Bemadu.

Abstract

This study explores the multidimensional dynamics of the prohibition of polyandry, a marital practice where a woman has more than one husband. Methodologically, the research is grounded in a qualitative approach, drawing on a diverse range of literature, including books, journals, and websites, which are analyzed descriptively and analytically based on the theory of Maslahah. The study aims to provide a deeper understanding and analysis of the dynamics surrounding the prohibition of polyandry and its relevance to the concept of Maslahah. The exploration reveals that the prohibition of polyandry is influenced by social, legal, cultural, economic, and health dimensions. From a social perspective, polyandry disrupts patriarchal structures and complicates issues of lineage and inheritance. Legally, the practice challenges administrative regulations and civil status, reflecting dominant religious and moral norms that support monogamy or controlled polygamy. Economically, while polyandry may address financial constraints in specific settings, it generally reduces economic efficiency and household financial management in the broader societal context. In terms of health, the practice poses risks related to sexual and reproductive health, potentially increasing the spread of sexually transmitted diseases and complicating reproductive management. Additionally, through the lens of Maslahah in Islamic law, the prohibition of polyandry is considered an effort to protect the public welfare, minimize harm (mudharat), and enhance social and familial stability. It indicates that the prohibition policy is not only a manifestation of traditional or religious values but also the result of pragmatic and comprehensive consideration of its long-term impacts on the structure and function of society. Overall, the study provides a critical explanation of how the concept of Maslahah justifies the prohibition, ultimately aiming to preserve societal order and overall well-being.

Abstract

Higher education in Indonesia plays a pivotal role in preparing a generation ready for the professional world. The curriculum of the Master's Program in Sharia Science at UIN Sunan Kalijaga Yogyakarta is integral to this mission. However, this research identifies gaps in the curriculum that do not fully align with alumni needs and job market demands. A field study involving 104 alumni from September 2018 to August 2022 was conducted using a descriptive-analytical method with an empirical approach. Data was collected via a survey sent to alumni and analyzed using Ralph W. Tyler's theory and James A. Banks' multicultural education theory. Findings reveal that courses like Fiqh Studies, Sharia Science, and Islamic Family Law in Indonesia were highly valued and should be further developed. Conversely, courses such as Falak Science and Arabic Text Reading were seen as less relevant and suggested for removal. Additionally, the replacement of the final project with journal publication was criticized. The analysis suggests that the curriculum should evolve to better reflect societal diversity and complexity. The proposed changes emphasize developing relevant courses and revising or eliminating those deemed less beneficial. These recommendations aim to ensure that the Sharia Science Master's Program remains responsive, inclusive, and capable of producing graduates who can compete in the global era.
