Abstract

Sexual deviations caused by the urge of lust that cannot be adequately controlled and the lack of understanding of religious teachings make humans no different from the actions carried out by animals. This research aims to see the prohibition of sexual perversion in Islamic teachings to maintain the sanctity of human nature. While this research is qualitative, with data collection done through literature studies, the data collected from these sources are analysed descriptively analytically with a historical dimension. The results of this study state that Islamic reform in the family field regulates the distribution of biological needs through marriage because Islam recognises that humans have a huge desire to have sex. In addition, Islam also prohibits various sexual deviations because it is a terrible act and far from human nature, so there are also legal sanctions for the perpetrators. Punishment for perpetrators of sexual perversion is intended to warn humanity and minimise actions that harm oneself or others.

Abstract

This research examines the synchronization process between the sociological approach and the empirical discovery of sui generis Islamic law. This qualitative research uses a literature study method that analyses pre-existing theories, concepts, or phenomena. The results show that the sociological approach can help understand the social and cultural factors that influence the development of Islamic law. Through this approach, it was found that Islamic values can adapt to local values according to the needs and social context of the community. Meanwhile, the discovery of empirical sui generis Islamic law is developing Islamic law by considering the social and cultural realities in which the law is applied. In this case, the research shows that the process of empirical sui generis Islamic law discovery can help produce Islamic law that is more relevant to the needs of society. Therefore, this research shows that the synchronization between the sociological approach and the discovery of sui generis Islamic law can help develop Islamic law in society's social and cultural context. This research provides practical implications for researchers and practitioners in considering the social and cultural context in developing Islamic law.

Abstract

Childfree is a phenomenon that refers to a couple's decision not to have children, either voluntarily or temporarily. This phenomenon has become a significant topic of discussion in various countries and has become part of a global issue, including Indonesia. This issue is significant and debatable in society. In the context of the Islamic religion, having children is considered God's will, and children should be looked after properly. In societies that adhere to pronatalist views, the child-free phenomenon often faces pressure and stigmatism. However, these decisions often arise due to social, economic, and cultural changes. This research applies qualitative methods by analysing relevant literature about the childfree phenomenon. This research aims to review the factors behind the choice to be child-free in various countries. The research results show that many factors, including personal, economic, and environmental factors, influence the decision not to have children. In Indonesia, childfree still needs to be fully implemented, and the reason for choosing childfree is motivated by economic considerations. Meanwhile, abroad, the influence of childlessness is more varied, ranging from personal, economic, environmental, and psychological factors. Further research into the childfree phenomenon is needed to better understand its impact on families and society.
