Abstract

Isu hukum dalam penelitian ini berangkat dari konsep pengaturan yang kuno atau ketinggalan zaman. Konsep pengaturan dimaksud adalah, konsep pengaturan tentang penyertaan di dalam ketentuan Pasal 55 dan Pasal 56 KUHP. Ketentuan tersebut, hanya mengenal subyek hukum yang dapat dimintai pertanggungjawaban sebagai turut serta hanyalah orang perseorangan dan bukan bagi korporasi. Tujuan dilakukannya penelitian ini adalah untuk mengetahui bagaimana tindak pidana turut serta dalam perdagangan orang. Jenis penelitian yang digunakan dalam penelitian ini adalah, jenis penelitian hukum yuridis normatif, yakni melakukan kajian terhadap putusan hakim tentang tindak pidana turut serta dalam perdagangan orang. Hasil penelitian dalam putusan hakim yang diteliti dengan dinavigasi teori Keadilan Bermartabat, ditemukan bahwa hakim nampaknya telah memanfaatkan penemuan hukum (rechtsvinding) yang menyatakan bahwa ada tindak pidana turut serta melakukan perekrutan dalam perdagangan orang dengan cara menyalahgunakan posisi rentan korban mengeksploitasi orang di Provinsi Nusa Tenggara Timur. Hakim dalam putusannya menemukan hukum mengatasi permasalahan pengaturan yang ketinggalan zaman. Namun, dalam kasus-kasus yang diteliti terdapat keterlibatan korporasi sebagai subyek hukum dalam perdagangan orang, tetapi tidak dapat dimintai pertanggungjawaban pidana karena ketentuan pasal 55 dan pasal 56 KUHP hanya mengatur subyek hukum sebagai orang perorangan.Kata kunci: tindak pidana penyertaan, perdagangan orang, putusan hakim

Abstract

The fundamental issue in every general election, for instance the Indonesia’s 2024 election, is the existence of stipulated principle of neutrality of the State Civil Apparatus (SCA) in election laws. The principle has been in conflict with the highest values which should govern it. The purpose of this research is to describe and discuss the idea or effective legal theory for solving the conflict of SCA with the highest values that should govern it. The research applied the Indonesian legal theory known as Dignified Justice to navigate the finding. The methods used is pure legal research or the normative legal research. It has found that the root problem of violations of the principle of SCA in, for instance the 2024 is that election laws is in conflict with the Pancasila, which has long been understood as not as the highest law, but an ideology, while an ideology has been argued as a manipulative tool of a ruling elite to control its subject. In order to solve the problem, this study proposes that Pancasila should be treated as containing the highest values or the inner morality of law to govern the principle of SCA stated in the country’s election laws.

Abstract

Revenge porn merupakan salah satu bentuk kejahatan yang melanggar hak privasi dan martabat korban. Kerangka hukum perlindungan data pribadi di Indonesia saat ini belum memberikan perlindungan memadai bagi korban, terutama dalam hal penghapusan konten dari internet. The right to be forgotten dikaji sebagai solusi potensial untuk mengatasi masalah ini. Penelitian ini menganalisis kerangka hukum perlindungan data pribadi di Indonesia yang relevan dengan kasus revenge porn, yaitu the right to be forgotten, serta mengidentifikasi tantangan dan merumuskan rekomendasi perbaikan hukum. Penelitian berlandaskan pada teori Keadilan Bermartabat. Penerapan right to be forgotten dalam UU PDP masih terbatas dan memerlukan penyempurnaan. Meskipun right to be forgotten berpotensi menjadi solusi efektif untuk melindungi korban revenge porn. Mekanisme pengajuan permohonan dan alasan penghapusan data yang belum jelas. Penelitian ini merekomendasikan revisi UU PDP untuk memperkuat right to be forgotten, dengan peraturan pelaksanaan. Hal itu sejalan dengan tuntutan hukum dalam jiwa bangsa sesuai teori Keadilan Bermartabat.

Abstract

Digital technology and modern telecommunications have been and will continue to be key factors in the emergence of various innovative products. One such innovative product is digital currency, specifically Central Bank Digital Currency (CBDC). In Indonesia, advancements in digital technology and telecommunications have encouraged the government to issue a CBDC, which will be named Digital Rupiah. The initiative to issue Digital Rupiah also responds to global trends and the public's need for secure, efficient, and sustainable payment instruments. However, the plan to issue Digital Rupiah is not without challenges, particularly regarding the clarity of its legal status as a lawful means of payment or legal tender. Using a normative legal research method, this study finds that Article 23B of the 1945 Constitution of the Republic of Indonesia (UUD NRI 1945) does not explicitly regulate the types of digital currency. There exists a *rechtsvacuum* (legal void) concerning the legal tender status of Digital Rupiah at the constitutional level. Additionally, from a technical-juridical perspective, concrete legal regulations regarding the status and legal tender legality of Digital Rupiah, in parity with paper and coin Rupiah, remain insufficiently comprehensive. Such legal conditions have the potential to create ambiguity and uncertainty. Nevertheless, this study identifies the emergence of a new law in the form of an omnibus law, which serves as a supporting framework for the solidity of the legal structure as well as a source of clarity on the meaning, status, and legality of Digital Rupiah. The clarity of such a legal framework is essential to solidify the innovation in the issuance and use of Digital Rupiah in the digital era. The legal framework for Digital Rupiah will support payment system efficiency, promote financial inclusion, and contribute to sustainable national economic growth. The legal theory guiding the research findings, which emphasizes the comprehensive regulation of CBDC, is the Dignified Justice Theory. According to this theory, while the need for legal comparison is unavoidable, Pancasila must remain the ultimate source of all legal principles governing the existence of Digital Rupiah.

Abstract

The legal model governing the financing of a unique form of cooperative management in Indonesia under Article 33 of the 1945 Constitution requires further clarification. According to this management model, the state should remain present in and support cooperatives as pillars of the national economy. The administration of President Prabowo Subianto has developed this cooperative management model through the establishment of more than 83,000 Red-and-White Rural/Urban Village Cooperatives (Koperasi Desa/Kelurahan Merah Putih [KDKMPs]) throughout Indonesia, utilizing digital transformation to strengthen transparency, accountability, and sustainability in modern cooperative management. This study adopts a normative legal methodology supported by an empirical approach. Legislation, interview findings, focus group discussions, and materials from national seminars were collected, analyzed, and interpreted. The study finds that the KDKMP financing legal model is characterized by state intervention through the government’s direct financing of cooperatives using the state budget through state-owned banks as an implementation of constitutional economic principles concerning economic democracy and collective welfare.
